As outlined in your action plan, the non-use of slips #56-57 will allow for the removal of the vessel in slips #58-59. If you choose to utilize these slips again, any vessel in slips #58-59 shall have the ability to be removed without the necessity of moving other vessels. All vessels in the marina shall be berthed in this manner. The vessel CARRIE JOE II presently occupies slips 458-59. At the time of inspection, it was indicated that the boat in slip #62 would impede the removal of CARRIE JOE II from its slip. We have concluded that, by making slips #56-57 non-use, adequate space will be provided to allow CARRIE JOE II to exit its slip without the need to move the boat in slip #62. When a boat smaller than CARRIE JOE II is using slips #58-59, we intend to have a boat in slips #56-57 as long as it does not impede exit of the boat in slips 458-59. Although not noted during the visit on March 10, 2004, we intend to make sure that the beams of the boats moored at slips #8-9 and #17-18 are narrow enough that boats moored inside of these slips (slips #10 thru 416) will be able to exit without movement of any other boats. It is our understanding this Action Plan must be submitted for approval prior to July 31, 2004 and that, once approved, the Plan must be implemented by January 1, 2005. In my conversation with Lorenzo Miller on this date, he indicated that the dredging was going to be in two stages; the first would start at the baywardmost location of the area to be dredged, moving in towards the bulkhead,stopping at a minimum distance of 30 feet from the bulkhead. Stage 2, if necessary would involve dredging from that location towards the bulkhead. Prior to Stage 2 we would require that the applicant get signed approval from the adjacent property owner to the east, to make sure he was aware of the proposed dredging near his bulkhead, so all parties involved could make sure all concerns were addressed. Coast Highway Newport Beach, CA 92663 Dear Mr. Haskell, 1 7 = /0/ On June 11, 1979 I responded to a report of an oil spill in the west end of your marina. After a brief investigation, I. concluded that the oil was apparently crank case oil from an engine and that someone had poured this oil into an area drain adjacent to Canos restaurant trash enclosure. Because of the potential problems associated with this type of situation and because deliberate disposal of materials of this type into navigable waters is a Federal offense, I requested the United States Coast Guard to assume control of the situation, which they did. During the time I spent in and around your marina on the 1lth, I noticed two other problems which I have discussed with you and Cano's management in the past. First: with regards to the marina, there appeared to be an excessive amount of litter and debris not associated with the oil spill throughout the marina. As I have indicated previously, the condi- tions of approval on the Harbor Permit for your marina require the permittee to maintain the permit area free of litter and debris. I suggest that the marina management assign an employee to skim the marina watersregularly in order to remove debris. Future complaints or observations of debris will require the City staff to aggressively enforce Newport Beach Municipal Code, Section 17.32.040. Refuse - Marinas and Piers which states: "Any owner or, operator of a marina or any owner or permit holder who maintains a pier, shall keep the area in and around such marina or pier located on the shorelines of Newport Harbor within the City reasonably fee and clear from beached or floating refuse, debris or litter at all times." Additionally, any type of pollutants discharged into Newport Bay by tenants of your marina, would be cons) dered to be the responsibility of Ardell Marinas, as the holder of the Harbor Permit. City Mall • 3300 Newport Boulevard, Newport Beach, California 92663 Page two Don Haskell June 15, 1979 Second: I have on two or three occasions received complaints that Canos restaurant washes their trash cans and trash enclosure into the area drain adjacent to the trash enclosure. Each time I have discussed this with the managers of Canos, I have been assured this situation would be corrected. On the llth, photographs were taken of this activity. These photographs show an employee of Canos washing debris into the area drain and also placing what appears to be a detergent on the area being washed into the area drain. This type of activity is prohibited by City, County, State and Federal regulations. I have requested the Orange County Health Depart- ment to periodically visit Canos and if this type of activity is observed, to issue citations. You are being informed of the action taken regarding Canos since it is my understanding that Canos is under a lease from the Sherman Company.
