She is scheduled to leave Newport around the first of April, 1987. It is very important that we start construction on the Cormorant's replacement as soon as possible. I would therefore appreciate your notifying me, at your earliest convenience, of any potential problems you may foresee with the following proposal. 1. We would like to build a vessel that will be 100-105' long, instead of 80' like the M. V. Cormorant. 2. We would not change the hours of operation, passenger limits, or any part of the conditions of our existing Commercial Harbor Permit. 3. We would need to reconfigure a portion of the dock space in front of the Imperial Bank building to accomo- date the larger vessel. 4. We would like to install a sewage :pumping station that would ,,be used by the Cormorant;'° r:epl_ace.men ,,_. and. a1so. ournewvessel, the Osprey. If; possible, we wouldlike to make this station available to others as well. The reason we are considering building a vessel larger than the Cormorant is that it would add to the comfort and safety of our passengers. We wil.l also be able to layout the larger vessel better, so as to reduce the noise from entertainment and guests. As an update, our second vessel, the Osprey, is complete. She will be arriving in Newport around the end of January, 1987. I am aware that you are very busy, but I'm hoping that we can get together during the first week of January to work out any neces- sary details to expedite the issuance of our new, or ammended Commercial Harbor permit. As I review my letter to you, I see I made no reference to the Cormorant Cruises, but am happy to hear they are licensed as a Charter Boat Operator and will be required to meet the trash disposal and toilet facility regu- lations. However, there are other boats such as the Constintine, Lovely Lady, Nolimit, Sea Peace, MoJo, J.P. Johns II and many others who dock and use that area to load and unload as many as one hundred (100) people or more; dumping trash and looking for a toilet. I appreciate the difficult job you have, Mr. Harshbarger, to oversee such a large harbor. A letter from you confirming this understanding would be greatly appreciated. The new boat will be 70 feet long and certified to carry a total of 150 people including crew. It is being specifically designed for use as a charter boat, and will have a full galley. Please let me know exactly what needs to be done to add this new vessel to our existing Commercial Harbor Use permit, or if a separate permit is required. We are expecting the new boat to be delivered to Newport Harbor around the middle of November. If at all possible,I would like to have all the permits taken care of by then. I was personally out-i'n the harbor that weekend and observed the.vessel.goi'ng by with a live band playing extremely loud. The .Harbor Department further indicated that they received innumerable phone.calls from residents.around the harbor regarding the noise coming from the "Cormorant". As you are aware, Section 6 of your Harbor .Permit requires that amplified.music.to.include bands.and disc jockeys must be enclosed within the vessel and not heard for more than 100 feet. Obviously what occurred.thi's weekend is a violation of that section. of your permit. , If we receive any .further complaints regarding noise coming from the "Cormorant" we will have no alternative but to condition this permit that no sound amplification at all be allowed on the vessel. That the boat shall not be available for charter or public cruises prior to 5:OO p.m. Monday through Friday, unless the boat is chartered by an organization or group which wi'll provide some form of mass transportation to and from the vessel. 2. That a minimum of one parking space shall .be provided for each 3 occupants, including crew members, when the boat is chartered on Saturday or Sunday or after 5:00 p.m. Monday through Friday. 3. That the owner of the property shall provide veri'fi'cation of the applicant's ability to utilize the on -site parking spaces and the spaces in the off -site parking lot located at the south- easterly corner of 32nd Street and Villa Way after 5:OO p.m. weekdays and all day and night on.weekends. 4. That the permittee shall hold the City, the County of Orange, and the Orange County Harbor District harmless from, and indemnify said agencies against, any claim for damages arising out of the exercise of the permit; in addition, the permittee shall reimburse said agencies for all attorney's fees and other costs which are expended by them in defending against any claim, lawsuit or judgment arisinq out of the activities of the permittee carried on under the authority of such permit. 13. That the Marine Director or City Council,,on approval or review, shall have the power to impose new conditions or modify existing conditions with regard to this permit upon a determination that the operations by permittee, in the absence of the new or modified conditions, does adversely impact the health, safety or welfare of those who use, enjoy and own property near the waters of Newport Beach. At the last Tideland Affairs Committee Meeting you asked that I prepare some background for you, relative to the attached letter from Pete Barrett. His letter seems to raise two questions: 1. That permits have been issued since the Council policy change on 1/15/85, and are not being inspected as required, and 2. That a non -licensed person is doing work under a Newport Beach permit. City files reflect the following as regards 1. Only one construction permit has been issued between 1/15/85 and 2/14/85.. This permit was issued to the applicant and the upland property owner, Mariner's Mile Marine Center. The applicant has submitted plans and engineering calculations to both the Public Works Department and the Building Department. These plans and engineering calculations have been approved by both the above City departments. The job itself is being inspected by the City Building Department. 2. Both the Building Department and the Marine Department have no knowledge that unlicensed persons are doing work under this permit. Because the permittee/applicant was the owner/builder, he need not be a licensed contractor under State Law. The study was commissioned by the Turnstone Corporation, the owner, in response to Condition 2.4 of the Marine Department's memorandum' of August 13, 1984 regarding the Owner's permit application 129-2505 to upgrade the property by repair, remodeling, and new construction. DESCRIPTION OF FACILITY The existing facility is currently a boat repair yard located between the northerly shore of Newport Bay and Pacific Coast Highway. Bay frontage is 150 feet between property lines. At the present time there are marine railways of indeterminate size at both the westerly and easterly segments and separated by approximately 85 feet of precast concrete sheet pile bulkhead. It is the intent of the Owner to abandon the two existing railways, close off the railway sections with new bulkhead, and construct a new pier to accommodate a 35-ton marine travel lift. The immediate waterfront area is planned for boatyard activities and parking for customers and employees. The shop building immediately adjacent to the bulkhead will be demolished as part of the remodeling plans, and new building structures will be located along the northerly or street side of the property. SOIL CONDITIONS The project Soils Report describes the subsurface condition as follows (numbers are depth in feet below grade): 0-9 Fine sand and silty sand varying to medium depth. 10 - 16 Medium stiff silty clay interbedded with layers of silty sand approximately two feet thick. 16 - 36 Dense to very dense sand becoming gravelly below about 25 feet. The reader is referred to the soils report for specific geotechnical details (Ref. 1). BULKHEAD DESCRIPTION Field examination of the existing bulkhead revealed that it is made up of 10"- thick concrete sheet piles, most of which are 4 feet wide. Jet probing disclosed that the bottom of the pile is about Elevation-12 feet ( VILLW)< which implies a pile length of 20 feet, a value which is consistent with many of the older bulkheads in the Newport Bay area. IIt is not known whether the piles are prestressed, but it is considered that if they ;are not,. then they most likely contain conventional reinforcement. Technically, there is little to chose between either scheme, assuming the amount of steel and the preload are adequate for the loading conditions. il_ Excavation on the back (shore) side of the bulkhead showed that the bulkhead was anchored with tie rods located on approximately 12-foot centers. Rods are 1-inch diameter mild steel, assumed to conform to ASTM A-36 (yield strength 36,000 psi min.). Rods are encased in 1-1/211-diameter PVC Schedule 40 plastic pipe. Rods are anchored landward in what appear to be a continuous cast -in - place concrete deadman, 2 feet deep and about 3 feet thick, located approximately 4 feet below existing grade. Exploratory excavation also revealed several old, rusted anchor rods, indicating that the PVC -encased rods are of more recent origin. Inquiries of local waterfront contractors and senior employees of the Owners failed to provide any historical information. The City, likewise, does not appear to have any information in its files indicating when this repair work might have been done or by whom. We therefore assume that the current anchor rods have been in service for at least 10 years, based on the recollection of the yard superintendent who has been employed on the site for this length of time. In any case, the anchor rods appear to be in good condition and we believe may be expected to continue to serve satisfactorily for the foreseeable future if properly augmented (see the discussion below and Recommendations). The coping, or pile cap, is cast -in -place reinforced concrete with nominal dimensions of 18 inches thick (horizontal) by 24 inches deep (vertical) except for the most westerly portion -which is 1`811 x 18". The top of the coping is at Elevation + 9.8 feet (MLLW). The coping generally appears to be in good condition with some old shrinkage cracking which is considered normal. The most westerly 25 foot portion which has the smaller dimension, appears to be older and is in poor condition, exhibiting many cracks and spalls. Bulkhead panels appeared to have had weep holes at approximately Elevation + 6, which had been mortared closed. It is suspected that there was some settlement due to loss of fill through weep holes which would account for the closure. Bulkhead panels are reasonably well aligned and vertical, indicating no excessive loading conditions to date. BULKHEAD ANALYSIS In reviewing the structural capability of the existing bulkhead, several cases were studied: Case I - Static soil loading with no hydrostatic pressure due to tidal lag. Case II - Static soil loading with hydrostatic pressure. Case III - Seismic case with M 7.0 earthquake. The method of analysis used initially is the Equivalent Beam Method, which requires development of fixity at the lower end. In the event that there is insufficient embedment, the. Free Earth Support Method is used. If the pile embedment is adequate for the Equivalent Beam approach, forces and moments are found to be less than those derived by the Free Earth method, thus the latter approach, when used in borderline cases, may be assumed to provide values which tend to be on the conservative side (Refs. 2 and 3). It was found that the pile embedment required to validate the Equivalent Beam method for Case I is about 6.2 feet. Since an embedment of 5 feet was assumed, the bulkhead was re -analyzed using the Free Earth method. A comparison of results is shown in Table 1. TABLE 1 Comparison of Results from E.B. & F.E. However, since the section modulus-, S, of the sheet pile is 200 in. 3/ft. bending stresses may be seen to be: fb = M = 13477 X 12/200 = 809 psi S 200 which is well within the capability of most 10-inch sheet : pile, whether prestressed or conventionally reinforced. For example, if minimum reinforcement per ACI is assumed: Amin = 200 y and Fy 40,000 psi then p,min) = 0.005 As(min) = 0.005 X 10 X 12 = 0.60 in2/ft. then Mu = 3.75 Asd - 2.3(AS)2 per ACI 31$ (3.75) (0.6) (8) - (2.3) (0.6)2 = 17.2 k-f t/f t. This is slightly more than half that given by the PCI (1971) (Ref. 4) for a similar panel, assuming symmetrical reinforcement Maximum service load movement for 10-inch precast sheet pile is given by PCI (1978) (Ref. 5) as 17.7 k-ft/ft. Lateral and rotational stability checks reveal -adequate factors of safety. We -therefore conclude that the bulkhead is safe and stable for the static loading condition without differential hydrostatic pressure (Case I). -3 Tabulated anchor rod tension results in rod stress: Ft = 2351 X 12 35.7 ksi 1000 X 0.79 which approaches the yield stress of A36 material. It can be seen that even the lower unit value of the Equivalent Beam method provides a rod stress of the same magnitude. It seems evident that additional anchor rods will be required. CASE 11 - Static Soil Pressure with Hydrostatic Pressure It should be evident that the existing configuration of anchor rods does not have sufficient margin to safely accommodate any significant hydrostatic pressure. In addition, although there is some unused bending moment capacity, we would urge that this be reserved to accommodate the design seismic event. Adequate drainage should be provided to preclude the development of meaningful hydrostatic or hydrodynamic forces on the bulkhead. CASE III Seismic Event Few bulkheads if any — more than 10 to 15 years old were designed to accommodate dynamic soil pressure resulting from significant earthquake. Even today, the Uniform Building Code does not address the condition specifically for bulkheads and retaining walls. Japanese researchers Mononabe and Okabe addressed this condition in 1928 and their findings were supported by the spectacular failures of waterfront structures in the Niigata earthquake of 1964. Further data was derived from failures during the Alaska quake of 1964 and the Sylmar event of 1971. Seed (University of California, Berkeley) and Whitman (M.I.T.) provided practical guidance for designers in their classic paper, published in 1970 (Ref. 6). Further refinement is furnished by Okamoto (Ref. 7). With this background, the assumptions which provide the basis for this review are as follows: o Ground acceleration a = 0.24 g (Newmark. Standard Spectra) o Water level @ +3.0' (MLLW); no hydrostatic p o No surcharge loading on bulkhead o Dynamic soil pressure component = 0.75 a/g (design) x static pressure (active) o Dynamic pressure acts at 0.6h . o Internal friction,, is reduced 50 due to pore pressure (partial liquefaction) o Cohesion in mud layers is reduced to 0 o Hydrodynamic pressures are computed per Westergaard theory (Ref: 3) -4- Analysis shows that the sheet pile is satisfactory for the seismic case, but that the anchor rod will be stressed beyond yield, although not beyond ultimate strength. Catastrophic failure is not likely to occur. SUMMARY OF FINDINGS o The bulkhead is generally in good shape as are the replacement anchor rods. o The current system is satisfactory for the maximum credible static loading; condition if adequately drained to preclude differential hydrostatic pressure. o Sheet pile is adequate for the design seismic event. Anchor rods will yield, but are not expected to fail catastrophically. RECOMMENDATIONS o Replace undersized coping and coping not in sound structural condition (approximately the 25 feet just east of the west marine railway). o Add a drainage system to assure no . significant differential hydrostatic pressure. o. A similar presentation was made on August 13, by Target Media. Subsequently, the City Council requested a report on the various options for providing either bus benches or shelters. The following alternatives were presented: (a) Direct staff to make application to the Orange County Transit District to participate in their grant program to purchase bus shelters; (b) Direct staff to institute an expanded program of providing bus benches; (c) Direct staff to prepare an agreement with Inter -City Shelters, Inc., for a pilot program of shelters with advertising; or (d) Direct staff to solicit specific proposals from all interested companies that market shelters with advertising. Jean Le Royer, President of Inter -City Shelters, Inc., addressed the Council and stated that they would be providing the City with 35 bus benches in areas where there are no bus shelters. The benches would not have any advertisement and there would be five in each Councilmanic District. They would also maintain these benches. During discussion, it was noted that this would be a one-year pilot program. Motion x Motion was made to direct staff to prepare an agreement with Inter -City Shelters, Inc., for a pilot program of shelters with advertising. Council Member Strauss indicated he felt the City should advertise for additional bidders. In order that both "Mariners" and SSYC can both have easy access to their docks near this property line extension the following agreement has been made between James Evans, representing Mariners Mile Marine Center and Giltner J. Knudson, representing South Shore Yacht Club. 1. SSYC will increase the width of their slips facing towards "Mariners" by reducing the spaces for boat storage from eight to seven. The wider slips allowing the boats to start or finish their turns within the slip when leaving or entering, thus reducing their encroachment on the property line. That the slips be reserved for the boat yard and or tenants of the uplands only Discussion This application is before the City Council as required by Sections 5C3 which states: "Prior approval of the City Council will also be required before issuing a permit for shore -connected structures when the abutting upland property is zoned commercial." Mayor and City Council (2) August 13, 1984 The applicant proposes a revision to the existing. commercial slips. This revision will reconfigure the docks so they are better suited to the instal- lation of a "Travel Lift" for boat yard use rather than the marine ways used at this site in the past. The finger proposed in the westerly side of the property poses a potential problem for the South Shore Yacht Club and access to their existing docks. Staff has requested that the parties resolve this prior to the Council meeting, and in this regard both the applicant and the commodore of the yacht club have been contacted. There has been no resolution as of this date and the applicant has requested, for timing reasons, that the application go forward. The Harbor Permit Policies give no precise direction on how the above could be handled; however, the original revision permit, issued in 1964 to the South Shore Yacht Club was conditioned but as of this writing those conditions have not been located. We understand that the request for approval has been placed on the Council's agenda as Item No. J-3 to be heard on Monday, August 13, 1984. The purpose of this letter is first to request a continuance of the August 13 hearing and second to set forth our position as to why the current proposal by the Turnstone Corporation should be rejected by the Council. Concerning the need for a continuance, it was not until August 3, 1984, just ten days before the scheduled hearing, that the Club was first informed by the Turnstone Corporation that its proposed dock plans had been submitted to the City for approval. The Turnstone Corporation made no effort to discuss the plans with the Club prior to submission to the City. As explained below, because of the severe and detrimental impact of the proposed dock plan on the Club, we believe that it would be extremely unfair for the City to act - upon the proposal just ten days after our first learning of MayorandCity Council August 9, 1984 Page Two it. Having been working on the waterfront in this area#. we know how allneighbors must be able to work together. Keeping this in mind, we have developed a dock plan that could solve some future problems. We have designed the dock that would run along the west property line to set back twelve feet.. We are offering to your club the opportunity to rent fifty feet of that side tie from the bulkhead out. If your club would elect to do this, you would be able to launch boats with comfort and with the right to shuffle boats '`that may be out at.the end of the dock. You would always have room for your marina boats to exit. When we come to an agreement on this, we would put a: gate in the fence near your hoist for easy access. The dock rates will be the same price as it will be for the other temnauts, which should be around $12.00 per linear foot. You already have a set or plans of the Marine Center and dock layout. Due to the fact that the majority of the slips that are going to be at our facility will be used by customers of the Marine Service Center, which has twenty-four parking stalls in the conceptual plan, and that the remaining slips rented would primarily be used by tennants of the center, or by boaters that use their boats mostly on the weekends, the marine service center parking would be available to them due to the absence of automobiles because the shipyard is closed on week -ends. I would also like to point out that there is municipal parking across the street from our facility, that may be used if there would be an unusual overload of cars. In light of the situation I have just mentioned, I am requesting that your department consider waiving the parking requirements to help us develope this marine service center that would greatly help the community.
