This information will hopefully provide sufficient background for you in case someone asks "what are those Hornblower guys doing". Los Angeles Here's our planning list for the December crush: e We will operate four yachts during most of the month. These yachts are: * - M/V Pacific Hornblower - M/V Newport Hornblower - M/V Hornblower Marina del Rey - M/V Lady Hornblower During the period 18-23 December we will add two yachts to our fleet. These yachts are: M/V Marina Hornblower * - M/V Renown We have already made arrangements for Special Activity Permits for these two Yachts. All of these yachts will Newport Beach operate out of our base at 2431 W Coast Highway. s Our guests, if driving to an event, will park at one of the following lots: - Mariners Mile Marine Center Phase I - Mariners mile Marine Center Phase II Sonship Christian Bookstore San Diego - Imperial Savings Lot I - Imperial Savings Lot II (32nd Street) Valets or parking attendants will be present whenever * private automobiles are the primary transportation to one of our events. Some nights will require mandantory bussing for our guests. Busses, if provided by us, San Francisco will be motorcoaches- from Pacific Coachways and Orange Blossom Lines. * Seattle HORNBLOWER D IN ING Y A C H T S Mariners Mile Marine Center 2431 West Coast Highway Newport Beach, CA 92663-1779 714/646-0155 FAX 714/646-5924 2 - Berkeley • We have increased our trash pickup shcedule to a daily service program to keep in line with the higher activity level. Our trash service pickups are located at: Mariners Mile Marine Center Phase II Long Beach - Imperial Savings Lot I • New crew have been added and trained. We currently * have seven captains and sixty-five service crew (first officers, bartenders, stewards and chefs). Training included our service program as well as live man overboard drills and the use of fire and safety Los Angeles equipment. • Crowd control has been carefully planned and includes * the placement of personnel on the docks and at parking locations to direct and assist our guests. Marina del Rey We believe that we are as prepared as possible for the holiday rush. All of our planning efforts and contingency planning will keep our programs under control. I have begun to hear things about all of the other charter activities which will be going on that causes me some concern. The problems I fear stem directly from the admirable job your department has done to limit the number of charter pickup points. The expected demand for these Newport Beach limited chartering sites will quickly result in predictable problems. In my view, these problems include: • The number and size of yachts attempting to stay on * schedule and get into a slip on -time. We could conceivably have more than a few yachts standing off in the turning basin near Lido Village and the Charthouse. San Diego The potential navagational problems seem clear. • We have heard that Business Licensing is holding requests for permits which account for 15,000 people. Although some of those requests are likely for on -land activities, it is probably safe to say that the majority are for events on the water. Crowd control San Francisco could become an unbelievable_ problem if not carefully planned. These will no doubt be exacerbated by the number of people all attempting to get to a limited Long Beach number of pickup sites. Apparently, in addition to typical whole boat chartering, there will even be some resturant style cocktail cruises with parking at Lancer's Landing. All the extra cars that this sort of * program will generate can be expected to edge us closer to PCH gridlock. Los Angeles s Unless someone has been assigned with the responsibility, there will likely be no provision for trash pickup at the chartering sites. With the * anticipated level of activity there will be an unbelievable amount of debris on the docks. e Crowd control will be nearly impossible. Groups will Marina del Rey be trying to get to their designated pickup points. Most of the pick up point docks are not suited to safely hold a large number of people so there will * be overflow expected. This overflow will likely roll out toward the front of resturants as well as to the end of slip floats (for the daredevils in the crowd). Unless the yacht pickups go absolutely without a hitch, Newport Beach we can expect delays, upset people and the potential for accidents everwhere. As was noted above, there are a lot of yachts coming to town. We have even heard the * rumor that "three large yachts are scheduled to pick up at the charthouse between six and six -thirty on one evening of the parade. If each of these yachts will San Diego hold 100 - 150 passengers then worst case is that we will be faced with 300 - 450 people standing around waiting for their boat to arrive. You are aware of the Charthouse property, there is absolutely no place for * these people to mill about. Add to this the number of people going to the resturants nearby or even to yachts at John Dominis and we have a potential for a serious San Francisco crowd control problem. * Seattle 0%001 NOj_ _gyp 0 4* HORNBLOWER DINING YACHTS Mariners Mile Marine Center 2431 West Coast Highway Newport Beach, CA 92663-1779 714/646-0155 FAX 714/646-5924- Berkeley - 3 r * Perhaps these concerns are the worst case scenarios of an overly cautious planner. However, given the expected size of the Parade of Lights this year, it seems only reasonable that some of this will actually happen. The ramifications of a serious Long Beach accident at one of these charter pickup sites could very well have a direct impact on my business (in the form of new rules, restrictions, higher operational costs, etc.). I will do my very best to control my operation at my facilities during this busy time. However , I feel compelled to ask who is Los Angeles responsible for controlling the potential problems of the shared facilities such as the Charthouse and John Dominis and Lancer's Landing. Without some real positive control on the part of the City of Newport Beach, the problems noted above can be guaranteed * to see the, light of day. Someone in your Department needs to get into the act real quick. Now that the COI is in hand we would like to have this yacht included as part of our Commercial Harbor Permit. Information pertinent to this request is as followe: • Photo of the vessel is attached. • Copy of the Certificate of Inspection is attached, • Vessel will be berthed at: Mariners Mile Marine Center Marina 2431 West Coats Highway Newport Beach, Ca 92663. e Parking continues to be at 2431 W. Coast Highway. We intend to operate our business with our existing number of spaces. When spaces are filled, our customers will be required to use some form of mass transportation. • The yacht has been configured to connect with our existing pumping facility. • Although some charters may be operated out of our existing slip at Lido Village, we expect that the bulk of our business will originate and end at 2431 W. Pahl General Manager Hornblower Dining Yachts 2431 West Coast Highway Newport Beach, CA 92663-1779 Re: Your letter of October 25, 1989 Dear Mr. Pahl: The -Commercial Harbor Permit issued to Hornblower Yachts included the power of the City to impose additional conditions to the permit, as outlined in the City of Newport Beach Municipal Code Section 17.41.070. in that section Paragraph 2 indicates that the Marine -Director or the City Council, on approval or review, will have the power to impose new- conditions or modify existing conditions with regard to any permit issued pursuant to the chapter, upon a determination that the operations by the permittee, in the absence of new or modifiying conditions, do adversely impact the health, safety or welfare of those using or enjoying property near the waters of Newport Beach. Upon adoption of Section 17.30 of the Newport Beach Municipal Code, the Council made findings that operations by Charter permittees, in the absence of new or modifying conditions, would adversely impact the health, safty or welfare of those using or enjoing property near the waters of Newport Beach. As a result, in your situation there are two possible ways to go; either your existing Commercial Harbor Permit must be modified and additional conditions added to it, or the possibly simpler approach would be for the permittee at Lido Village to comply with Section 17.30 of the Municipal Code and provide a pumpout that would be available to the vessels of your company that board at that location. Los Angeles In our view, the following items are pertinent to this situation: • In May of 1988, the City Council granted a Commercial Harbor Permit to Hornblower Dining Yachts to operate Yachts out of two locations. These locations are: Marina del Rey _ 2431 Weat Coast Highway; 3366 Via Lido. * • The Commercial Harbor Permit specifically detailed the need for a pumping facility in paragraph 10. This Newport Beach paragraph is worded as follows: "That the applicant provide, at his expense, installation and maintenance of a vessel pumpout * station at the Mariner's Mile Marine Center location and that.all vessels pump out there." San Diego • City ordinance 88-18 was adopted in June 1989 - a year after the granting of the above mentioned Commercial Harbor Permit. • Discussions and agreements between the City of Newport Beach and the Management of Lido Marina Village were made without the knowledge or participation of Son `ranmco Hornblower Dining Yachts. City Ordinance 8B -18, adopted June 27, 1989 requires that all charter boats be boarded at sites that have a vessel waste pump. This requirement would have been met by the - managers of Lido Village if they had installed a dedicated pumplic pumpout station as they promised. This agreement has not been met. The City notified Lido Village management on April 21, 1989 that they had ninety days to.comply with the ordinance. They notified.the City only last week that they will not install the required pump. This letter is notice that the extension ending on November 21, 1989 will cease, and no further boardings will be permitted to occur at Lido Village after that date. If Hornblower Yachts intends to install a pumpout station. at their location at Lido Village they should inform the Marine Department of their intent and can request time to comply with Ordinance 88-18. The department will help in any way it can. He advised that Deputy Honicker had.caught workers polluting the Bay while doing paint preparation work on a boat docked at -a slip neat the Mariner's Mile Shipyard. Deputy Honicker requested that -I meet her at the scene to assist in the investigation. 1435 Hours Upon my arrival I met Deputy Honicker. She led me to the boat slips 'directly behind Hornblower Dining Yachts at 2431 West Coast Highway. A large, approximately 100 foot yacht was in the slip. It had a wood hull with the name "High Spirits" on the cabin and looked -to be at least 50 years old. The boat was being refurbished with workmen working -in and on the boat. The Above deck cabins were natural wood and appeared to be recently stained and varnished.. The entire outside of the hull appeared to have been freshly sanded. What appeared to be sawdust and paint.sandings could be seen covering the dock on the starboard side.. This same material was thickly covering the surface of the water surrounding the boat including the adjoining slips and spreading out into the open channel. Deputy Honicker told me that she had noticed the boat was being refurbished about two weeks ago and that debris was getting into the water; however, there was never anyone around. Today she observed suspect Cruz standing in a dinghy alongside the forward starboard hull in the water. He was using a power sander and sanding the side of the hull. Paint and wood sandings were falling all around him and into the water. Other workmen could be seen working on the interior of the boat. She made contact with Mr. Cruz and asked him to stop work. She then turned her attention to the debris in the water and obtained a 24 ounce water sample from the surface of the slip to the starboard side of the suspect's boat. This sample was marked for evidence and released to my custody. 'T2 Water Pollution 89- NO.. 03308 UAM Suspect Pahl contacted Deputy Honicker and told her he was the General Manager for Hornblower Dining Yachts. He told her he was supervising the work being done on the "High Spirits." She explained the violations she had observed and asked him to stop work on the boat until measures could be take to prevent further water pollution. Mr. Pahl was standing at the rail on th edge of the seawall overlooking the "High Spirits" when I arrived. I introduced myself to Mr. Pahl but prior to interviewing him, I took five 35mr color photos of the scene recording the appearance of the boat, boat slip an the water. I recontacted Mr. Pahl and told him that -I would be investigating this incident. In response to his questions, I explained the laws regarding wate pollution and the disposal of hazardous waste. I advised him that it appeared that some of the laws were violated by the work being done on the boat today. He told me -that he, is the General Manager for Hornblower Dining Yachts and that the "High Spirits" is owned by Hornblower. It was purchased at an auction in Florida and brought to its present location in the Newport Harbor in January. It is being completely refurbished according to Coast Guard specifications so that it can be used by Hornblower for charter. He i contracting and supervising all the work being done. He said that -he wanted the hull repainted so -he instructed Mr. Cruz to sand down the hull to prepar it for painting. Mr. Cruz is employed by Hornblower as -a dock worker and general workman. He provided Mr. Cruz with a'dinghy and equipment to do thi work in the water. Mr. Pahl said that due to its size, it would be impractical to remove the boat from the water to do this work.. He further stated that he knew that sanding debris and sawdust was going into the water but he thought it was. all bio-degradeable and harmless. He didn't believe that the amount of old paint and varnish that went into the water was significant. He pointed out that it is common for all boat owners to do this kind of work on the water. He told me 'he had heard that spray painting was not permitted on the water so he intended to have the hull painted with a roller. At the conclusion _of'the interview, I advised him that he could continue work on the boat if he.could insure that debris, sawdust, sandings and paint did not reach the water. Since we have a restriction on parking here, we expect to follow two paths simultaneously as follows: • Secure additional parking - we have located an additional 10 parking spaces nearby and I expect that we will have signed an exclusive agreement before the end of summer. This is possible because our program is unlike that of a resturant: Our * guests all arrive at the same time and leave at the same time. Knowing this the valets are able to arrange the cars in a fashion that best suits this sort of schedule. As you are aware, we at Hornblower Dining Yachts are very sensitive about abiding by all of the Federal, State and Municipal regulations which pertain to vessel chartering. Indeed, here at Newport Beach we have made every attempt to be in accord with both the letter and spirit of the Municipal Code of the City of Newport Beach. With this in mind, it is of great concern to me that Hornblower Dining Yachts would be accused of violating the conditions of our Commercial Harbor Permit. We have invested far too much here to risk losing our permit to operate because of a violation of our basic conditions. With regard to the letter from the Yacht Masters and Marine Associates, I would respond as follows: o We did, in fact, board passengers from a private residence and private dock at Collins Island. Although I was not personally aware of the program in advance, I did have the occasion to speak with Bob Burnham after this event occured. Bob and I agreed that there was nothing in our Commercial Harbor Permit which precluded this sort of program. We did agree, however, that much confusion would be avoided if we assume that* --The Commercial Harbor Permit will apply only to our our permanent locations (2431 West Coast Highway and 3366 Via Lido); --Any-other locations for events would require a Special Event Permit through the Business Liscensing Division of the City. You will no doubt recall that I communicated this agreement to you after my discussion with Mr. Burnham. o The discussion about parking is at best unfounded and at worst, malicious, All of our sales representatives are very aware of the parking available for our use. In fact, our client booking contract clearly states the parking restrictions which apply (a copy of that page of our contract is attached). As you know, our permit requires that we report how each party arrived. It would make no sense that we tell someone to park at a location other than what is available to Hornblower Dining Yachts. The Police officer covering the Dunes event was dispatched to another location, only to find his police vehicle was "blocked -in" by illegally parked automobiles. Council Member Plummer stated that the Police Department is very concerned with the traffic problems and congestion caused by this event and therefore the Police Department strongly recommends denial of the application. In view of the foregoing, motion was made to deny the application of Newport Dunes for fireworks display on July 4, 1988. Council Member Sansone commented that he was driving on Pacific Coast Highway between Jamboree Road and the Bay Bridge last July 4th during the Dunes event, and noticed that vehicles were parked "all over the place." He did not feel the police report referenced by Council Member Plummer accurately reflected the actual traffic problems that occurred in that area. Discussion ensued wherein it was noted that the City Council had just approved a request on the consent calendar for fireworks display at the Big Canyon Country Club. In view of the foregoing, motion was made to reconsider agenda item No. F-21(b), request of Big Canyon Country Club. It was noted that the Police Department had recommended denial of the request of Big Canyon Country Club due to illegal and hazardous parking that occurs on San Joaquin Hills Road, Jamboree Road, Ford. Road, and MacArthur Boulevard. In addition, hazardous pedestrian violations occur frequently. Council Member Plummer stated that she was not against celebrating the 4th of July, but that in her opinion, the City is now compromising the safety of too many people if these requests are approved, and therefore, she revised her motion to deny the applications of Newport Dunes and Big Canyon Country Club for fireworks displays. The City Attorney also recommended that the words "on approval or review" be deleted from Condition No. 16 in order to give the Marine Director and/or City Council the power to impose new or revised conditions when deemed necessary. Newport Beach. Background. In the past, Commercial Activities Harbor Permits have been issued by the Marine' Director as provided in the Municipal Code. However, recently Commercial activities upon the waters of Newport Beach have generated such a large amount of public concern relative to the use of the waters area within the City, that the Marine Department has felt it necessary to refer these matters to the City Council so that a public hearing can be held on each application to allow public input. Currently the City Attorney''s office is drafting a proposed revision to the pertinent Section of the Municipal Code to require rev P P in the future that all Commercial Activities Harbor. Permits be approved by the City Council. This is in response to public concern over intensified commercial use of the water areas within the harbor. Page 4 In October 1985 the Marine Department issued a permit to Cormorant Cruises to operate a charter vessel out of 3366 via Lido. This permit was subsequently amended to allow the operation of two vessels out of this location with passenger occupancy limited to available on -site parking and off -site parking within a reasonable distance of the berthing of the `vessels. Additional vessel occupancy was available if passengers were bussed to the site. In July 1987 a request was made by Cormorant Cruises to transfer their Commercial Harbor Activities Permit for theiroperation at 3366 via Lido fromm Cormorant Cruises to Hornblower Yachts. This application was approved by the City Council on July 13, 1987. At that time, Hornblower Yachts took over the two vessels formerly Operated by Cormorant Cuises and operated them, after name changes, under the existing permit. Subsequent to the July date, Hornblower Yachts brought a third vessel into the harbor and operated it out of the "3366 via Lido' location on a "Special Events Permit basis, pulling a permit on a charter by charter basis. The vessel capacity of the two vessels berthed at the via _Lido location was 450 passengers and crew. The current total vessel capacity of Hornblower Yachts including all three vessels is 512 passengers and crew. Based on the conditions of the Staff Report, vessel occupancy will always be limited by the number of parking spaces available on site, unless passengers are bussed to the site. Hornblower Cruises proposed to continue to operate two of their vessels, the Newport Hornblower and the Pacific Hornblower, out of the 3366 via Lido Location and depending on booking,, all three of their vessels out of the Mariner's Mile Marine Center: All three of the Hornblower Yachts vessels are Coast Guard certified and are skippered' by Coast Guard licenced-skippers. Hornblower Yachts operation typically consists of harbor cruise programs which range from 2 to 6 hours. Itineraries range from simple cruises around Newport Bay on routes specified by the City Marine Department to trips to such distant locations as Catalina, Long Beach, Marina del Rey and San Diego. During the cruises the Hornblower Yachts provide dining, dancing aboard with food preparation by on board staff. Also on board would be sales of specialty gifts. The above described certification by the Coast Guard allows Hornblower Yachts to acquire business protection and liability insurance in the amouunt of 10 million dollars. Entertainment on board all of the Hornblower vessels is provided only inside the vessels. Located at 2439 West Pacific Coast Highway, this property is ideally suited for an operation such as ours for many reasons. Four important considerations however, were the following: • The Mariners Mile Marine Center, at 2349 W. Coast Highway, is in the heart of the Mariners Mile Commercial Zone. • There are no residences in close proximity to the Marine Center. • There are no resturants or other conflicting off -hour businesses located at the Marine Center. • On -site parking, dedicated to HYNB is available in a. quantity to accomodate at least 180 guests at one time., As of this writing, we expect to be able to move into Mariners Mile Marine Center in stages as follows: • April - Yachts (M/V Pacific Hornblower and M/V Hornblower) were moved. • May - Pumpout station installed and tested prior to parking lot blacktop surfacing approximately one week later. • May - Sales and Administrative personnel are planned to move. • June - Operations and Engineering personnel scheduled to move into shop. • July - Food and Beverage personnel scheduled to move at the completion of the commissary areas. Clearly, one of the most critical issues to be resolved by any business here at Newport Beach is parking. HYNB is acutely aware of the concern of the City of Newport Beach relative to providing adequate parking for our customers. We have opted to secure, as a part of our long term lease with Mariners Mile Marine Center, on -site parking which is dedicated to our operation. In addition, we have developed a parking program which is very likely the strictest of its kind for our industry here in Newport Beach. This parking program consists of the following elements: • Busing and limousine services. We strongly encourage our charter customers to transport their guests by some form of mass transit vehicle. Indeed, if the planned event is scheduled to occur mid -week and mid -day, our guests are required to come by bus or limo. Further, if a particular party is planned for the evening or weekend and will carry more than 180 passengers a bussed program will also be required. Our sales service staff is well trained to provide our guests with appropriate alternatives to individual automobiles. • Valet Parking. In order to insure full use of our leased parking spaces HYNB and Mariners Mile Marine Center have agreed to provide professional valet services to those guests who have opted to drive their own automobiles to an event.. • Security. Every HYNB event will have uniformed attendants to assist our guests in both parking their cars and transiting to the boarding area. These security efforts are clearly aimed at ensuring that our guests arrive and depart in a safe and swift fashion. In exceptionally busy times of the year the attendant also provides HYNB the assurance that our parking facilities are used by our guests only. 0 Clear instructions. Each guest of HYNB, whether an individual or a charter host, receives a very clear description of our parking program as well as the limitations of this program. Each person is clearly told that HYNB can provide parking at only designated lots. 'Each is also told that parking at unauthorized locations could result in their car being at least ticketed and at worst being towed. Clear instructions are also given to our chartered bus and limo drivers. These instructions include: - Where to drop off passengers - Where to await passengers - Being sensitive about motor noise near residences - Where to pick up passengers. It is the explicit intention of the management of HYNB to meet or exceed the requirements of the City of Newport Beach. This intention definetly includes parking. We intend to ensure that parking does not become an issue in our operation in at least the following three ways: 0 Vigorous monitoring of existing parking. We will monitor the space which we have acquired through long term lease. The purpose of this monitoring will be aimed at ensuring that our guestshave the opportunity to park in HYNB lots: Of course, the secondary purpose of this monitoring is to turn away non -authorized users of parking (these non -authorized users may be either guests of another yacht company or simply visitors to Newport Beach). • Addition to our parking space inventory. We will pursue all possibilities for adding further spaces on a long term basis. This includes a carefull review of the parking program at the Mariners Mile Marine Center. Given the space configuration and the type of traffic flow, HYNB may propose an expansion of the number of cars allowed at the Mariners Mile Marine Center through a valet parking configuration program. With the assistance of the City of Newport Beach, HYNB will build a multi -story parking structure in the Mariners Mile Commercial Zone, an area which desparately needs additional parking. One particular area which could offer a potential opportunity is just off Pacific Coast Highway. This land is currently used as Municipal public parking. There can be no doubt that a parking structure in this area would benefit both HYNB as well as the City of Newport Beach. We would welcome the opportunity to discuss this concept with City officials at any time. As was noted earlier,the average capacity for motor vessels Pacific Hornblower and Hornblower is on the order of 192. If we use this number as the expected level for future charters, we would need to supply 64 parking spaces. Mariners Mile Marine Center will lease only 60 spaces to HYNB. With this in mind, our maximum individually driven combined event for the two vessels would be 180 passengers. Until we are able to secure the additional parking noted above, we expect to limit our individually driven operations to that combined number of 180 passengers. This is particularly true of our hours of operations which are summarized as follows: • Office hours: - 8am to 6pm Monday through Friday - 9am to 5pm Saturday - 10am to 2pm Sunday (beginning Summer 1988) • Typical yacht charter hours: - 7pm to 11:30pm Monday through Friday - 10am to 11:30pm Saturday and Sunday - Special events for standard holiday cruises would require later hours (New Years eve for example) Application Items #7 through #10 (Routes of travel, activities, merchandise, vessel certification and licensing). These gifts are both memorabilia items such as photographs and brass plated name tags as well as a variety of specialty logo items including mugs, champagne flutes, shirts and baseball caps. • Quality yachts which are certified by the Coast Guard to carry passengers for hire. By Federal law, if a yacht operator is somehow compensated for service when carrying more than six people, those people are considered to be passengers. In this event, the vessel which carries those passengers must have been certified by the Coast Guard. • Vessels which are licensed by the California State Department of Alcoholic Beverage Control. It should be noted that a primary issue in qualifying for a liquor license onboard a yacht, that vessel must first have been certified by the Coast Guard to carry passengers for hire. Application Item #11 (Insurance). As has been noted above, the vessels operated by HYNB are certified by the Coast Guard to carry passengers for hire. This certification allows the opportunity for significantly greater insurance coverage than other categories of vessels. With this in mind HYNB insurance provides more than adequate business protection including $10,000,000 Protection and Indemnity (which covers passenger liability). In other words, it is quite likely that the vessels will be shuffled to a particular slip in order to meet the needs of a particular customer. In addition, two of the vessels, M/V Pacific Hornblower and M/V Hornblower are licensed to operate on ocean waters and therefore may well be berthed for short periods of time at other Southern California ports. Special Facilities. Due to the size of the existing vessels and the planned volume of charter activity, some special marina and shoreside facilities have been designed. Included in the design plans are: * Redesigned marina area with additional piling to accomodate our vessels - 2 - * Extra wide floats to facilitate safe, effecient passenger loading * Sufficient shore power to minimize generator operation at dockside * Build appropriate holding tank pump -out facilities to both accomodate our vessels and eliminate any possible burden on public facilities. All of the above listed special facilities are a part of the HYNB plan. Most of the design work has been completed and final plans will be sub- mitted for City approval as required. PARKING PLAN General. Hornblower Yachts of Newport Beach, Inc. is aware of City of Newport Beach requirements for charter customer parking. Specifically, we are responsible to control, as much as possible, our impact on public streets and parking through the use of: * Bussing * Limosine services * Car pooling Additionally, we are required to provide one parking space for every three passengers carried. - Parking Plan. With, all of the above in mind, and with the HYNB goal of customer service considered, we, intend to respond to our parking requirements in the following ways: * Sales personnel will emphasize the opportunity which busses and limosine services offer. * Encourage all of our customers to take advantage of our bus and limo programs. * Provide parking for our customers who do not choose to utilize more effecient methods of transportation. HYNB will maintain the following inventory of spaces for our customers: - A minimum of 13 and up to 26 spaces at 3366 via Lido (Imperial Savings). This lot is available from 5pm until Sam Monday through Friday and on a 24 hour basis on Saturday and Sunday. - Imperial Savings and City National Bank remote lot on 32nd Street to provide a minimum of 13 spaces up to a maximum of 72 spaces. This lot is available from 5pm until Sam Monday through Friday and on a 24 hour basis on Saturday and Sunday. 3 - •- Riverside and Avon Streets lot. A maximum of 60 spaces 24 hours per day 7 days per week. - 1303 Avocado, Newport Beach. No less than 60 parking spaces. This lot is available from 5pm until 6am Monday through Friday and,24 hours on Saturday and Sunday. - 1011 and 1012 Brioso, Costa Mesa. No less than 100 spaces. These spaces are available from 5pm until 6am Monday through Friday and 24 hours on Saturday and Sunday. - City National Bank lot at 3388 Via Lido. Those 23 spaces which were originally allocated to Tiffany's. This lot is available from 5pm until 6am Monday through Friday and 24 hours on Saturday and Sunday. All totaled, Hornblower Yachts of Newport Beach, Inc. has acquired, through long term lease agreements, a minimum of 269 parking spaces and a maximum of 340 spaces. As each charter program of the future is prepared, we will allocate our inventory of parking carefully. In every event where distant lots are utilized we will insure that some form of shuttle service is provided from the lot to the boats. More often than not, all of the above listed parking will be more than required. On a one space for each three passenger basis, HYNB will need an average parking space inventory of 102 spaces. Given that HYNB has acquired a minimum of 269 spaces -for -our guests, we believe that in every instance we have exceeded the City of Newport Beach requirements. Notwithstanding this, Hornblower Yachts of Newport Beach, Inc. will continue to seek and sequre long term parking for our operation. Further, HYNB would be willing to construct a parking structure on City property. HYNB management would welcome the opportunity to discuss this with the appropriate city officials. - 4 - GUEST COORDINATION General. It is the intention of Hornblower Yachts of Newport Beach, Inc. to provide appropriate service to our guests. This service starts as customers arrive and continue until our guests are safely away. Specific Plans. Given our plan for two separate facilities (Lido Marina and John Dominis Marina) we have two specific guest boarding plans: *Lido Marina. Passengers arriving by bus will disembark from their buses at Lido Village and escorted through to the boat. Bus drivers will be instructed to await their passengers at 32nd Street lot. Passengers arriving by car will be given specifics instructions directing them to appropriate HYNB lots. These passengers will also be clearly told that parking at unauthorized lots will subject their vehicles to being towed. *John Dominis Marina. Passengers arriving by bus will disembark from their buses in the view corridor between John Dominis and the Chart House. These passengers will be escorted down to the boat. Bus drivers will be instructed to await their passengers at the Riverside and Avon Street lots. Passengers arriving by car will be given directions to park at the Riverside and Avon Street lot. In line with what was stated above. Passengers will be clearly told that parking at unauthorized lots will subject their vehicle to being towed. WASTE MANAGEMENT General. Any business which handles a large volume of people will also need to deal with waste. HYNB considers this portion of our business to be absolutely critical. With this in mind our program is as follows: *Boat Holdong Tanks. A private pump out station will be designed into our John Dominis Marina slip plan. This facility will fully meet HYNB vessel requirements for adequate pumping. Further (and more importantly) this pump out facility will allow HYNB to be completely independent of public facilities. *Trash Disposal. Trash will be packaged in unique trash bags and disposed of in large bins either at John Dominis or Imperial Savings. An appropriate number of "pick-ups" per week will be established. *Litter and general clean-up. The major complaints are that busses for these vessels are parking on Via Lido, waiting for passengers to return for over 30 minutes at a time, with engines running and making noise and causing air pollution. They are also double parking and creating traffic disruption. Secondly, complaints are of loud, resonant exhaust systems on one or more of the vessels which creates noise problems for long periods of time while the boat is in the slip before departure or while rotating vessels. A condition of your permit is that passengers bussed to the loading and unloading site must park in designated off-street parking zones at City National Bank. When busses park legally on the City streets their engines should be shut off. We would appreciate your cooperation in this matter. In regard to the engine noises of the vessel, it is important that running of the engines be kept to an absolute minimum because of the close proximity to a residential zone. The City staff is aware that your are aggressively working to relocate your operations to a facility along Pacific Coast Highway. Terry mentioned that you had some specific concerns which we might address directly. These concerns can be divided into three general areas: Noise; hours of operation; bad experiences with other operators. We will address each of these individually by defining potential problems and our plans- 0to minimize problems in each area. Noise - This is one of your greatest concerns. Nothing can be as irritating or frustrating than to be continually .annoyed by the sounds of a group event. We recognize this as the primary area of difficulty and. while it is impossible to completely eliminate all noise. we propose to undertake the following noise abatement ;programs;; Marina Configuration - we intend to reconfigure the slips adjacent to your home such that our vessels will be as . far away from you as is possible (over 100 feet). It is our intention to have our yachts tied close to the John Dominis Building. This should eliminate most noise echoed directly up from the water and dock. Attached is a drawing of our slip plan which is currently in the approval process Customer Transit The noise of shoes on the decks and boardwalks may be heard. We intend to provide a noise absorbent padding on the walkways which lead directly to our vessel loading areas. Further, we will ensure that our customers have access to our vessels through a covered' entrance. Finally, our customers will park either in , the underground garage or at remote lots. As a matter of fact, much of our traffic actually comes by bus. These three programs should significantly reduce the noise of our customers as they transit to and from our yachts. Onboard Parties - Once our customers arrive onboard, we intend to keep dockside noise at a minimum in at least three ways. First, by design our vessels are enclosed and exterior deck areas are completely carpeted. This design is intended to add to the vessel quality and ambience. it also. tends to supress noise. Second. we will limit our dockside public address announcements. Any :announcements made at dockside. 'if required would be safety items. Finally, we will ensure that all music -3- at dockside is played to the interior salons on the main decks only. There will be no topside live music in general aboard our yachts (and certainly never any while at dockside) . Unruly Passengers - our services are provided for the enjoyment of our customers. However. we are absolutely firm about controlling unruly guests. In the past we have not _. hesitated to stop serving drinks. While we cannot completely control the actions of our passengers after they have disembarked. we do our utmost to get them away safely and on their way as quickly as possible Because of the liquor license restrictions, we do. not allow passengers to exit the vessels with drinks in hand. vessel operations - Although there are some possibilities for concern regarding vessels at dockside, it is appropriate that focus on the , following five areas: -,Engines.- It seems a common practice for boat Captains to idle their engines for hours on end while ,at dockside Generally speaking this is both noisy and air polluting. This sort of warm-up will not be necessary for our vessels.-: We have a fleet of 'very new boats so. we can` -limit our main engine warm-up time to less than 5 minutes before a charter. Also these boats are well designed, with exhausts directed into the turning basin so we do not expect to pollute the marina area with diesel fumes, - Maintenance Boats require frequent maintenance. Given our particular mission we will likely be a bit more meticulous than most about our maintenance activities.' We will limit our normal maintenance activities to. daytime hours. Since our vessels are new;, we expect that our maintenance routines will be relatively low noise evolutions such as touch up painting. vacuuming and'general clean-up. Charters In addition to the items discussed in the sectidn'on- noise above, there will be occasional late night clean-up after charters ("llpm.). Promises are not worth much here as. in this case, our actions will speak louder (perhaps we should -say quie''er) than our words. However. under no circumstance will our crews be without supervision. The last person to leave the vessel after a charter will be the Captain or First Officer. It will be the"responsibility of the Captain - 4- to ensure that our crews are both thorough in cleaning and quiet in the removal of refuse. Hours of Operation - Although we are available, we seldom operate every day of the week. Occasionally, during a busy weekend our yachts may carry several charters per day. Our earliest charter is generally about 10 am., and there are a few occasions where we will get underway earlier. For the most part, we do not run very late charters. With a few exceptions our standard program.. r; ends by 11 pm. These exceptions are predictable holiday events such as New Year's. Halloween. Parade of Lights. etc. Docking Our largest yacht is 100' in length. Docking can be A loud shouting match between deckhand and captain. We b consider this to be unprofessional for our type of` business and so we have incorporated hand held communicators to be used for all docking activity. Our method allows safe controlled communications between the captain and deckhand without shouting,. Previous Operations - We are well aware that many of your z` concerns stem from other boat charter activities.. While H . we cannot 'fix the things that may have happened in the ;. past. we can certainly take action to ensure that problems do not continue long into the future. As noted at the. outset of this letter, we intend to fully comply with all appropriate Federal, State, County and City regulations Further,. we will support regulatory agencies in their efforts to insure the safety and well being of all charter customers. Our support includes the f ollowingi - Coast Guard - In the interest of safety and in accordance with Federal ; Regulations (by The Department of Transportation) we know the Coast Guard will inspect all boat operators -and verify ,that vessels are certif ied to carry passengers and that all Captains are licensed. We encourage such inspections and you may check with USCG in other. °areas we operate if you wish to verify this. Most operator in Newport bay are not licensed. and cannot be with thfer current vessels. This will result in a substantial decrease in the amount of charter activity in 'Newport Harbor. as well as a safer, properly regulated environment. likely that it is these operators who have disturbed you in the past. We intend to work with the Local inspectors of the State ABC in identifying unlicensed operators. - Local Administration -' We will work closely with the local city and marina 4" officials to enforce the existing rules and regulations regarding charter operations on the waters of Newport Beach Marina. Dr' Krogh. this basic information will hopefully convince you and your fellow homeowners that we at Hornblower Yachts are serious about our business. I cannot stress too strongly that we will do our absolute best to set the local standard of excellence for charter boat operat-ors. We will be model corporate citizens. `. To insure our accountability we will install a cellular telephone aboard each of.our vessels so that local citizens may call us to let us immediatly know of any problems if they should occur. We have attached a form which we would appreciate your sending to the State Department of Alcoholic Beverage Control on the P behalf of ,:your Association. It is our under- standing that you have received such an application from one Hornblower Yachts, which company has also applied for a liquor license from the Alcoholic Beverages Commission. After discussions with the owner of Lancer Landing, it is our understanding that the Newport Beach Planning Commission indeed requires 40% of the Lancer development to be devoted to marine use, and that he is required to accept marine tenants of the above nature in order to fulfill your demands, whether such tenants be judged suitable for the Lancer project and the surrounding neighborhood, or whether such tenants might be an admittedly destructive influence on the environment. The homeowners of the Newport Towers building have enjoyed a rather peaceful life in the building for some twenty-seven years since its construction. The building was constructed with your blessing and approval in 1961, and it is our conten- tion that inherent in that approval is the implied right of receiving your protection to enjoy a peaceful existence in our homes. These charters are predominantly 6 or 7 pm. to 10 or 11 pm. in the evenings during the week, and 12 noon - 11 pm. on the weekends. The current excursion or public cruise schedule is tentatively set at 11 am.- 1 pm. For Saturday and Sunday brunches with occasional 7:30 to 10:30 pm dinner cruises. In all cases, applicable parking regulations will be followed to the letter. Parkinq -- The attached letter from Lancer Landing as well as the letter from Stuart Seidner requesting a transfer of operating permit show that the required parking spaces are in our control. Aproximately %70 represents on site spaces. While we cannot give you operating statistics in Newport Beach, we can tell you our other locations have a similar mix of business, with one non -dedicated on -site space per 8 passengers of capacity. Our load averages 60% of capacity, and only on 5-10% of the events does the load reach 95% or greater of capacity. There are very few cases where we have any parking capacity problems. They are limited to occasions when we have many couples on the boats ( such as Valentine's Day). Because most of our groups know each other, or are coming on a business function the auto/bus quantities tend to be lower than our restaurants. Nevertheless, we have included parking considerations in all long term leases. Utilities - We have requested and our landlords' have agreed to provide appropriate sewer, trash and other utility services. We are aware of the federal, state and local regulations pertaining to these services. Permit Transfer Reguest - As you know, we have recently acquired Island Passenger Services DBA Charter Pacific Yachts (formerly Cormorant Cruises). At this time, we respectfully request a transfer of their harbor activities permit to one or more of our vessels. Pending completion of our new office facilities at 3101 Pacific Coast Highway, we will keep our offices at 3366 Via Lido. We understand the parking and the marina at 3101 PCH will be available around August. In the interim, if we have an occasion which requires more useable parking then we have available, we will work with your office, or the business permit office whichever you request. General Note In view of our successful operating history in other locations, we seem to have many of the Charter Businesses in the harbor concerned about our arrival.
