Dear Mr. Parker:
I am in receipt of your letters dated August 27, 2004 and September 3,
2004, proposing an action plan to resolve the issue of multiple berthing
occurring at the above subject property -
As outlined in the action plan and diagrams provided the removal of dock
sections and the extension of dock fingers will allow for the docking of
boats in a manner that will no longer impede the removal of vessels at the
dock. Your action plan is approved and required to be implemented by
January 30, 2005.
A permit from the City's Building Department is required for section
removals and extension of fingers- Prior to obtaining this permit, please
contact Chris Miller at (949) 644-3043 or Tom Rossmiller at (949) 644-3041
in Harbor Resources to obtain an application. Please begin the pern-dt
process promptly to allow for review by various City departments.
I appreciate your response to the multiple berthing violation and look
forward to further cooperation to correct this problem.

As mentioned in the "Berthing" portion of my August 27th letter to you, I have been in contact with
the Harbor -Resources Division regarding a proposed change at referenced -marina that would facilitate
our abili ty to conform with NFPA 3 03, Chapter 5, Section 5. 1. 1.
At a meeting with Chris Miller on 9/2/04, he agreed that the configuration depicted on the enclosed
marina diagramwould be the best solution for all concerned. Yve-added a depiction of the proposed
vessel berthing plan along with the exit paths for vessels occupying the inside berthing area.
Following your review of the information submitted, please advise me if you also approve of the
proposed berthing plan.

. - The following response to the "Inspection Checklist" for subject marina (dated 412012004), was sent to
Harbor Resources Division on July 27, 2004. Following their receipt of m y respo nse,'they asked me to
send a copy to your office.
The general deficiencies noted on the Inspection Checklist have been corrected as described.
Fire Extinguishers - Extinguishers are being inspected on a monthly basis and service tags are being
dated and initialed.
Class H Standpipe Testing- Standpipe system will be inspected at least semi-annually.
GFCI Issue - I don't recall that there were any non -marine grade plugs in service on this dock at
the time of the inspection (there were two in service on the adjacent Port Calypso dock). In any event,
Only marine grade continuous twist lock cords/plugs will be allowed at the marina.
Conduit/fittings Referenced conduit under gangway has been repaired and the J -Box has been
covered.
Plug/damaged area at dock box has been repaired.
Other Knock -outs have been installed where needed in the boxes mounted in dock box'

Anti -siphon - An anti -siphon device is in place.

small portion of dock that I propose to remove and a proposed extension of an existing dock section. I
estimate that the total cost of the maintenance project would be equal to no more than 5% of the whole.
Please, advise me as to availability of a maintenance permit for this work and, if available, how I apply
for the permit.
I am currently in contact with the Harbor Resources Division regarding the permit procedures
that may be requiredfor the above referenced dock work. In any event, my tenant at the marina has been notified
that they must be infull conformance with NFPA 303, Chapter 5, Section 5. 1. 1 no later than January 30, 2005.

Here is the notification of work that is required on the pier and
docks bayward from the property at 2607 W. Coast Highway, Newport
Beach, in order to complete the transfer of the pier permit. Jim
Parker accompanied the Building Inspector during the electrical
inspection and, as indicated in your recent letter, has begun the
work.
To complete the transfer the following work must be completed:
Electrical
1. The electrical breaker box should be inclosed in a cabinet
o
and sealed for use in a water environment.
2. All connection that are loose or broken must be made
whole.
3. All receptacles must be either twist lock or GfI.
Fire Fighting Equipment
1. All extinguishers should be tagged (indicating most recent
service)
2. All hose boxes must have glass and working locking
mechanisms.
3. The water system to docks must have evidence of the most
recent service for the class 2 stand, pipe.
If you need to discuss the electrical requirements, please call Ray
Baltera in the Building Department, 644-3261; and for information
regarding the fire fighting requirements, call Russ Cheek, 644-
3107.
As soon as the work has been completed, and the Marine Department
has re -inspected the docks, the permit will be transferred.

Dear Melinda:
Regarding the request to transfer the pier permit for the pier and
float bayward from the property at 2607 West Pacific Coast Highway,
Newport Beach, I have attached the * application card and
instructions. Please secure the required signatures., and send this
card, plus the $300 transfer fee to the Marine Department. Included
in the transfer process is a pier inspection to determine if the
structure, electrical, and plumbing meets city minimum standards.
The result of this inspection will be sent to you and if there are
anv corrections needed to be done, these will have to be completed
beiore the transfer can occur.
Thank you for the $2259.75 check for the annual pier permit fee.
Tony Melum has waived the penalty.

Dear Tony:
This letter is written on behalf of Mariners Mile Marina
Partnership which recently closed an escrow with Mr. Yu -Ter
Mau for the property and dock rights related to the above
referenced pier number. We did not know until just today
that the annual permit had not been paid and are enclosing a
check in the amount of $2,259.75; we are requesting that the
penalties be waived.
You indicated on the phone today that the permit needs to be
transferred to the new owners and I would appreciate you
letting me know what the mechanics are for the transfer so we
can get it taken care of. For your information, there has
been no change in the operation at the marina which is master
leased to Jim Parker, Marina Properties.

3. Transferring Permit: This permit is not transferable with-
out the written consent of the City Council of the City of Newport Beach.
4. Notice Prior to Starting Workt. The Permittee shall notify
the City �ngineer at least three (3) days in advance of the date work is
to begin and its completion.
5. Inspeetiont The work shall be subject to the supervision
and approval of the City Engineer. On work which * requires the presence
of an employee of the City of Newport Beach as inspector, the salaxy and
other incidental expense of such inspection during the work shall be paid
by the Permittee upon presentation of a bill therefore,
6. Protection of Traffic- Adequate provisions shall be made
for the protection of the travelling public. Barricades shall be placed
on streets, with red lights at night, also flagmen employed) all as may
be required by the particular work in progress.
The Permitt'ee shall not attempt to forbid the full and free
use by the public of all navigable waters at or adjacent to the work or
structure. If the displaybf lights and signals on any work hereby auth-
orized is not otherwise provided by law, such lights and signals, as may
be prescribed by Bureau of!Light Houses, Department of Commerce) shall be'
installed and maintained at the expense of the Permittee.
I . 7. Liability for - Damages: The Permittee is responsible for all.

1. The City of Newport Beach shall never be hold liable
or obligated for any injury or damage resulting to either persons
or property through the erection, use or possession of commercial
boat slips. I
2. Boat �slips shall be so constructed as not to obstruct)
interfere with or p I revent the free use or passage of any sidewalks,
street, alley, public way or navigable channel.
3. The right given for the erection and maintenance of
boat slips is permissive only and the Permittee shall, upon revo-
cation hereof', remove said boat slips and appurtenances thereto,
within thirty (30)ldays after date of * mailing written notice of
this permit, whichInotice may be mailed to the last known address
of the Permittee.
4. The City of Newport Beach reserves full right, power

and authority to revoke this permit and in the event the ' Permittee
fails to remove said boat slips within the time specified, then the
City Engineer shall have the right to immediately remove same at

west Coast Highway, Newport Beach, Ck. The facility was ins,_)ected
on 11/12/91.
We cannot transfer the pier permit until the following defiCiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THIS
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketca
showing the approved type of device and its installat,:�.On is
enclosed.

8. The issuance of these waste discharge requirements is exempt from -the
provisions of the California Environmental Quality Act (Public Resources
Order No. 85-176 cit""Ainued

Code, Section 21000 et seq.) in accord ance with the California
Administrative Code, Section 13389.
9. The Board has notified the discharger and interested agencies and persons
of its intent to prescribe waste discharge requirements for the proposed
discharge and has provided them with an opportunity for a public hearing
and an opportunity to submit their written views and recommendations.
10. The Board, in a public meeting, heard and considered all comments per-
taining to the discharge.
IT IS HEREBY ORDERED that the discharger, in order to meet the provisions con-
tained in Division 7 of the California Water Code and regulations adopted
thereunder and the provisions of the Federal Water Pollution Control Act and
regulations and guidelines adopted thereunder, shall comply with the following:
A. Waste Discharge Requirements
1. Neither the treatment nor the disposal of wastes shall cause a nuisance
or pollution, as defined in the California Water Code.
B. Receiving Water Limitations
This discharge shall not cause a violation of any applicable water quality
standard for receiving waters adopted by the Regional Board or the State
Water Resources Control Board as required by the Federal Water Pollution
Control Act and regulations adopted thereunder. If more stringent appli-
cable water quality standards are promulgated or approved pursuant to
Section 303 of the Federal Water Pollution Control Act, or amendments
thereto, the Board will revise and modify this order in accordance with
such more stringent standards.
C. Provisions
1. This order includes the enclosed "Standard Provisions and Reporting
Requirements" with the exception of the following items: A.4., 11, and 18;
B.1. through 9; C.3, 4, and 6 through 9; D.2., 3, 6, and 7.b.; E.1 through 9.
2. This order includes Monitoring and Reporting Program No. 85-176.
3. The discharger shall develop and submit a Water Pollution Control Plan by
March 1, 1986, detailing means of controlling the discharge of pollutants
from boatyard operations areas. The plan shall address each existing
waste source including, but not limited to, trash, scale, rust, spent
sandblasting abrasive, old paint, new paint, marine growths, oil and
qrease, and washwater, and shall detail specific methods by which pollu-
tion from these sources shall be controlled. The plan shall include
methods of segregating these wastes to prevent contact withrainwater and
other liquids as well as methods of maintaining work areas in "broom
clean" or equivalent conditions. This plan shall be implemented once the
Executive Officer has determined it to be acceptable.

4. This order expires De cember 1, 1990 and the discharger must file a report of
waste discharge in accordance with Title 23, California Administrative
Code, not later than 180 days in advance of such date as application for
issuance of new waste discharge requirements.
5. In the event of any change in control or ownership of land or waste
discharge facilities presently owned or controlled by the discharger, the
discharger shall notify the succeeding owner or operator of the existence
of this order by letter, a copy of which shall be forwarded to this Board.
6. This order shall serve as a National Pollutant Discharge Elimination
System permit pursuant to Section 402 of the Federal Water Pollution
Control Act, or amendments thereto, and shall take effect at the end of 10
days from the date of hearing provided the Regional Administrator of the
Environmental Protection Agency has no objections.
7. This order rescinds Order No. 82-251, the previous waste discharge
requirements for James L. Evans, dba Boat Specialist.

STANDARD PROVISIONS AND REPORTING REQUIREMENTS
A. General Provisions
1 . The requirements prescribed herein do not authorize the commission of
any act causing injury to the property of another, nor protect the
discharger from his liabilities under federal, state, or local laws,
nor guarantee the discharger a capacity right in the receiving waters.
2. The discharger shall permit the Regional Board and the Environmental
Protection Agency:
a.. Entry upon premises in which an effluent source is located or in
. which any required records are kept;
b. Access to copy any records required to be kep-t under terms and.
conditions of this order;
c. Inspection of monitoring equipment or records; and
d. Sampling of any discharge.
3. All discharges authorized by this order shall be consistent with the
of this order. The discharge of any pollutant
terms and conditions
more frequently than -or at alevel in excess of that identified and
authorized by this order shall constitute a violation of .the terms and
conditions of this order.
4. The discharger's wastewater treatment plant shall be supervised and
operated by persons. possessing certificates of appropriate grade pur
suant to Chapter 3, Subchapter 14, Title 23, California Administrative
Code.
5. The discharger shall, at all times, properly operate and maintain all
facilities and systems of treatment and control (and relat,�d appur-
tenancds) which are installed or used by the discharger to achieve
compliance with the permit -limits. Proper operation and maintenance
includes effective performancet adequate funding, adequate staffing
and training, and adequate laboratory and process controls, including
appropriate quality assurance procedures.

7. After notice and opportunity for a hearing, this order may be ter
minated or modified for cause3 including, but not limited to:

a. Violation of any term,or cond ition contained in this order;
b. Obtaining this order by misrepresentation, or failure to
disclose fully all relevant facts;
c. A change in any condition that requires either a temporary or
permanent reduction or elimination of the authorized
discharge.
8. If a toxic effluent standard or prohibition (including any sche-
dule of compliance specified in such effluent standard or prohibi-
tion) is established under Section 307(a) of the Federal Water
Pollution Control Act, or amendments thereto, for a toxic pollu-
tant which is present in, the, discharge authorized herein and such
standard or prohibition is more stringent than any limitation upon
such pollutant in this order, the Board will revise or modify this
order in accordance with such toxic effluent standard or prohibi-
tion and so notify the discharger.
9. If more stringent applicable water quality standards are approved
pursuant to Section 303 of the Federal Water Pollution Control
Act, or amendments thereto, the board will revise and modify this
order in accordance with such more stringent standards.
10. The provisions of this order are severable, and if any provision
of this order, or the application of any provision of this order,
or the application of any provisions of this order to any cir-
cumstance, is held invalid, the application of such provision to
other circumstances,. and the remainder of this order shall not be
affected thereby.
11. Safeguard to electric power failure:
a. The discharger shall maintain in good working:order a suf-
ficient alternate power source for operating the wastewater
treatment and disposal facilities. All equipment shall be
located to minimize failure due to moisture, liquid spray,
flooding, and other physical phenomena. The alternate power
:c�!irce shall be designed to permit inspection.'and maintenance
and shall have provision for peri -odic testing.
b. If such alternate power source is not in existence, the
discharger shall halt, reduce, other otherwise control all
discharges upon the reduction, loss, or failure of the primary
source of power.

12. Any diversion from or bypass of facilities necessary to maintain
compliance with the terms and condit,ions of this order is prohi-
bited, except (a) where unavoidable to prevent loss of life or
severe property damage, or M where excessive storm drainage or
runoff would damage any facilities necessary for compliance with
the effluent limitations and prohibitions of this order. The
discharger shall promptly notify the Board and the Regional
Administrator of EPA within 24 hours of each such diversion or
bypass.
13. Except for data determined to be confidential under Section 308 of
the Federal Water Pollution Control Act, all reports prepared in
accordance with terms of this order shall be available for public
inspection at the offices of the Regional Water Quality Control
Board and the Regional Administrator of EPA. As required by the
Federal Water Pollution Control Act, effluent data shall not be
considered confidential. Knowingly making any false statements on
any such report may result in the imposition of criminal penalties
as provided for in Section 309 of the.Act and Section 13387 of the
California Water Code.
14. The discharger shall take all reasonable steps to minimize any
adverse impact to receiving waters resulting from noncompliance
with any effluent limitations specified in this order, including
such accelerated or additional monitoring as necessary to deter-
mine the nature and impact of the noncomplying discharge.
15. In the event of any change in control or ownership of land or
waste discharge facility presently owned or'controlled by the
discharger, the discharger shall notify the succeeding owner or
operator of the existence of this order by letter, a copy of which
shall be forwarded to this Board.
16. The discharger shall ensure compliance with any existing or future
pretreatment standard promulgated by EPA under Section 307 of the
Federal Water Pollution Control Act or amendments thereto for any
discharge to the municipal system.
17. The discharge of any radiological, chemical, or biological warfare
agent or high level radiological waste is prohibited.
18. The discharger shall require each industrial user to submit
periodic notice (over intervals not to exceed nine months) of
7rogress toward compliance with applicable toxic and pretreatment
developed pursuant to the Federal Water Pollution
Control Act or amendments thereto. The discharger shall forward a
copy of such notice.to the Board and the Regional Administrator.
B. Provisions for Monitoring
1. Water quality analyses shall be performed in accordance with the
most recent edition of "Environmental Protection Agency Regulations on
Test Procedures for the Analysis of Pollutants" promulgated by EPA (40
CFR 136). In addition, the Board and/or EPA, at their discretion, may
specify test methods which are more sensitive than those specified in
40 CFR 136.

2. Chemical, bacteriological, and bioassay analyses shall be conducted at
a laboratory certified for such analyses by the State Department of
Health Services or EPA.
3. The laboratory which performs.the sample analyses must be iden-
tified in all monitoring reports submitted to the Regional Board
Executive Officer and the Regional Administrator (EPA).
4. The discharger shall have, and implement, an acceptable written
quality assurance WA) plan for laboratory analyses. An annual
report shall be s6bmitted by January 30 of each year which sum-
marizes the QA activities for the previous year. Duplicate chemi-
cal analyses must be conducted on a minimum of ten percent (10%)
of the -samples, or at least one'sample per month, whichever is
gr ' eater. . A similar frequency shall be maintained for analyzing
s iked samples.

when requested by the Board or EPA, the ditcharg'er': will par-
ticipate in the NPDES discharge monitoring report QA performance
study.. The permittee must have a success rate equal to or' greater
than 80%.
5. Sample containers, preservationj and hold times shall conform with
40 CFR -Part 136.
.6. Influent samples shall be taken at each point,of inflow to the
wastewater treatment plant, upstream of any in -plant return flows,
and shall be representative of the influent to the treatment
plant.
7. Effluent samples shall be taken downstream of the last addition of
waste to the treatment or discharge works where a representative
sample may be obtained prior to mixing with the receiving waters.
8. All monitoring instruments and devices used by the discharger to
fulfil:l the prescribed monitoring program shall be properly main-
taihed and calibrated as necessary to ensure their continued
accuracy.
9. The flow measurement system shall be calibrated at least once per
year or more frequently, to ensure continued accuracy.
C. General Reporting Requirements
The'discharger shall submit to the Board on or before each compliance
report date, a report detailing his compliance or noncompliance with
the specific schedule date and task.

If noncompliance is being reported, the reasons for. such noncompliance
shall be stated plus an estimate of the date when the discharger will
be in compliance. The discharger shall notify the Board by letter
when he has returned to compliance with the time schedule.
2. In the event the discharger does not comply or will be unable to
comply with any prohibition, daily maximum effluent limitation, or
receiving water limitation of this order for any reason, the
discharger shall notify the Executive Officer by telephone (714)
684-9330 as soon as he or his agents have knowledge of such non-
compliance, and shall confirm this notification in writing within five
(5) days. The written notification shall state the nature, time, and
cause of noncompliance and shall describe the measures being taken to
prevent recurrences.
3. The discharger shall file with the Board within ninety (90) days after
the effective date of this order a technical report on his preventive
(failsafe) and contingency (cleanup)- plans for controlling accidental
discharges and for minimizing the effect of such events. The tech-
nical report should:
a. Identi fy the possible sources of accidental loss, untreated waste
bypass, and contaminated drainage. Loading and storage areas,
power outage, waste treatment outage, and failure of process
equipment, tanks, and pipes should be considered.
b. Evaluate the effectiveness of present facilities and procedures
and state when they became operational.
Describe facilities and procedures needed for effective preventive
and contingency plans.
c. Predict the effectiveness of the proposed facilities and proce-
dures and provide an implementation schedule containing interim
and final dates when they will be constructed, implemented, or
operational . (Reference: Sections 13267(b) and 13268, California
Water Code.)
The Board, after review of the technical report, may establish
conditions which it deems necessary to control accidental
discharges and to minimize the effects of such events. Such con-
ditions may be incorporated as part of this order, upon notice to
the discfi�rger.

4. Discharge monitoring data shall be submitted to the extent possible on
preprinted Discharge Monitoring Report forms to be supplied by the
Board and EPA. Other specific reporting formats which may include
magnetic tape, punched cards or direct computer entry may be
prescribed at a later date. Unless otherwise specified, discharge
flows shall be reported in terms of the 30 -day average and the daily
maximum discharge flows.'
The results of all monitoring required by this order shall be reported
to the Board, and shallbe submitted.in such a format as to allow
direct comparison with the limitations and requirements of this order.
5. The discharger shall file with the B oard a report of waste discharge
at least 120 days before making any material change, or proposed change
in the character, location, or volume of thedischarge.
6. The results of any analysis of samples taken more frequently, than -
required at the locations' specified in�the'Monftoring and Reporting
Program shall be reported to the Board.
7. The discharger shall file a written report with the Board within
ninety (00) days after the average dry -weather waste flow for any
month equals or exceeds,75 percent of the design capacity of his waste
treatment and/or disposal facilities. The discharger's senior admin-
istrative officer shall sign a letter which transmits that report and
certifies that the policy-making body- is adequately i.nformed about it.

8. The discharger shall notify the Board not later than 180 days in
advance of implementation of any plans to alter production capacity of
the product line of the manufacturing, producing, or processing faci-
lity by more than 10 percent. Such notification shall include estima-
tes of proposed production rate, the type of process, and projected
effects on effluent quality. Notification shall include.submittal of
a new report of waste discharge and appropriate filing fee.

The discharger shall notify the Board of (a) new introduction into
such works of pollutants from a source which would be a new source,, as
defined in Section. 306 of the Federal Water Pollution Control Act, or
amendments thereto, if such source were discharging pollutants to the
waters of the United States; (b) new introductions of pollutants into
such works from a source which would be subject to Section 301 of the
Federal Water Pollution Control Act, or amendments thereto, if it were
discharging such pollutants to the waters of the United States; (c) a
substantial change in the volume or character of pollutants being
introduced into such works by a source introducing pollutants into
such works at the time the waste discharge requirements were adopted.
Notice shall include a description of the quantity and quality of.
pollutants and the impact of such change on the quantity and quality
of effluent from such publicly owned treatment works. A substantial
change in volume is considered.an increase of 10 percent in the mean
dry -weather flow rate. The disc'harger shall forward a copy of such
notice directly to the Regional Administrator.
D. Reporting R-equirements for Monitoring
1. For every item -of monitoring data where the requirements are not met,
the discharger shall submit a statement of the actions undertaken or
proposed which will bring the discharge into "full compliance with
requirements at the earliest time, and shall submit such information,
in writing, within two weeks of becoming aware of noncompliance.
2. By January 30 of each year, the discharger shall submit an annual
report to the Board. The report shall contain both tabular and
graphical summaries of the monitoring data obtained during the pre-
vious year. In addition, the discharger shall discuss the compliance
record and the corrective actions taken or planned which may be needed
to bring the discharge into full compliance with the waste discharge
requirements.
3. The discharger shall maintain records of all sampling and analytical
results, including strip charts; the date, exact place, and time of
sampling; the analyst's name; analytical techniques used; and results
of all analyses. Such records shall be retained for a minimum of
three years. This period of retention shall be extended during the
course of any unresolved litigation regarding this discharge or when
requested by the Board.
4. The discharg6r shall file with the Board technical reports on self-
monitoring work performed according to the detailed specifications
contained in any Monitoring and Reporting Program or as directed by
the Executive Officer.

5. All reports shall be signed by:
In the case of corporations, by a principal executive officer
at least of the level of vice president or his duly authorized
representative, if such representative is responsible for the
overall operation of the facility from which the discharge
originates;
b. in the . case of a partnership, by a general partner;
c. In the case of a sole proprietorship, by the proprietor;
d. In the case of a municipal, state, or other public facility,
by either a principal executive officer, ranking elected offi-
cial, or other duly authorized employee.
The discharger �shall submit to the Board, by January 30 of each
year, an annuall summary of the quantities of all chemicals listed
by both trade and chemical names which,are used for cooling and/or.
boiler water treatment and which are discharged.
The discharger shall mail a copy of each monitoring report on the
appropriate form to be supplied by the Board and any other reports
required by this order to:

2. The R30 -day, or 7 -day, average" mass emission rate is the total mass
emission rates by weight during a 30, or 7, consecutive calendar day
period, respectively, divided by the number of days in the period that
the facility was discharging. Where less than daily sampling is
required by this permit, the 30 -day, or 7 -day, average discharge shall
be determined by the summation of all the measured mass emission rates
by weight divided by the number of days during the 30, or 7, con-
secutive calendar day period when the measurements were made.
For -other than 7 -day or 30 -day periods, compliance shall be based upon
the average of all measurements made during the specified period.
3. The mdaily maximumm discharge means tM total discharge by weight
during any calendar day.
4. The "30 -day, or 7 -day, average" concentration, is the flow weighted
mean of measurements made during a 30, or 7, consecutive calendar
day period, respectively.
5. The *maxim= daily" concentration is defined as the measurement made
on any single grab sample or composite sample.
6. A mgrabm sample is defined as any individual sample collected in
less than 15 minutes.
7. A composite sample is defined as a combination of no fewer than eight
individual samples obtained over the specified sampling period. The
volume of each individual sample shall be proportional to the
discharge flow rate at the time of sampling. The compositing period
shall equal the specific sampling period, or 24 hours, if no period is
spec if i ed.

8. �An "industry" Is defined as any facility identified in the
Standard Industrial Classific4tion,manualw:1972. Office of
Management and Budget, as amended and supplemented, under the
following divisions:
a. Di vision A - Agriculture, Forestry, and Fishing;
b. Division 8 - Mining;
c. Division D - Manufacturing;
d. Division I - Services.
A facility in the divisions listed may be excluded if it is deter-
mined by the Board that it introduces primarily domestic wastes or
wastes firom sanitary conveniences.
9. "Prohibited wastes" are any of the following wastes which shall
not be introduced into the treatment works:
a. Wastes which create a fire or explosion -hazard in the treat-
ment works;
b. Wastes which will cause corrosive structural damage to treat-
ment works, but, in no.case:, wastes with.a pH lower than 5.0
unless the works'are designed to accomodit6such wastes;
c. Solid or viscous wastes in amounts which would cause obstruc-
tion to the flow in sewers or other interference with the
proper operation of the treatment works; or
d. Wastes at a flow rate and/or pollutant discharge rate which is
excessive over relatively short time periods so that there is
a treatment process upset and subsequent loss of treatment efficiency.

I wish to thank you for your call concerning the mariner's
Mile Marina pier permit for the property located at 2607 West
Coast Highway, Newport Beach, California.
This will confirm our telephone conversation concerning
the history of the Partnership and of the docks. The present
docks were constructed approximately 15 years ago by the Partner-
ship who were the ground lessees under a 55 -year ground lease.
Subsequent mailing address changes were given to the City which,
apparently, were interpreted by the City Staff as being a change
of ownership, rather than a change of mailing address. The
Mariner's Mile Marina Partnership continues as owner and has
recently purchased the fee.
The docks are managed under a short-term agreement by Robert
Sloan, whose mailing address is 542 Catalina Drive, Newport Beach,
California 92663.
All matters, other than those matters which are directly
between the City and Mr. Sloan, should be handled through this
office as follows: Mariner's Mile Marina General Partnership,
c/o Harwood & Adkinson, Attention: Don R. Adkinson, 550 Newport
Center Drive, Suite 800, Newport Beach, California 92660.
Although the structural deficiencies referred to in your
letter of October 28, 1983, may not need to be corrected since
there is not actually a pier transfer at this time, we have asked
Mr. Sloan to investigate those items and to proceed with the
electrical and plumbing work.

We,transferred the pier permit in October.
Don says there was no need -for a transfer;
that "they" have had the ground lease for
.more than 50 years; what they did was buy
the fee from Plummer, and he thinks escrow
transferred the permit unnecessarily.
Please refund his $220 if that is the case.

The structure was inspected on 10/27/83 at which time it was determined
that the following deficiencies exist:
1. A new drawing must be submitted.to 'replace the one on file,
which.is inaccurate (see attached).
2. The water line to the dock needs a City approved anti -syphon
device.
3, Lighting on floats need repair.
