Please be advised that Waiver Number 5-07-061-W, which was reported to the Commission
on June 14, 2007, became effective as of that date. Any deviation from the application and
plans on file in the Commission office may require a coastal development permit for the entire
project.

LOCATION: 2672 Bayshore Drive, Newport Beach (Orange County) (APN(s) 049-191-15)
DESCRIPTION. Demolition of an existing single-family residence and construction of a new
two-story 4,490 square foot single-family residence with two attached
garages (a one -car garage and a two -car garage) totaling 1,126 square
feet. The maximum height of the residential structure will be 26'-2" above
finished grade. Grading will consist of 1,400 cubic yards of recornpaction,
which will balance on site, 40 cubic yards of cut, 50 cubic yards of import
and 90 cubic yards of fill. Bulkhead work will consist of a new cap on the
top edge of the wall (coping), new tie back rods, and new deadmen. All
bulkhead work will take place on the landward side of the existing
bulkhead. Drainage from the roof and surface water will be directed to
permeable areas before entering the main storm drain system.

RATIONALIFE: The iot size is 10,999 square feet and is designated as, residential medium density in of
Newport Beach Land Use Plan CLUP). The subject site is a bay front lot located between the first public road and
the sea and is located in the locked gate community of Bay Shores in the City of Newport Beach. No public access
currently exists through the site. However, the, project will have no impacts on existing coastal access. Public
access to the harbor exists in the area across the channel from the Bayshores community along the public
walkways on Lido Island and Balboa Island. The proposed project conforms to the ComrnissioWs parking
requirement (2 spaces per residential unit) and is designed to be compatible with the character of the -surrounding
development. Directing storm drain runoff to permeable surfaces is consistent with the marine protection policies
of the Coastal Act. 'Tbe proposed project design is compatible with the character of surrounding development and
does not have any negative affects on visual orwastal resources, public recrealion orcoastal access- Als% the
proposed development will not prejudice the City's ability to prepare a Certified Local Coastal Program and is
consistent with the land use designation In the City's certified Land Use Plan, past Commission actions in the area
and Chapter Three policies of the Coastal Act
This waiver will not become effective until reported to the Commission at their June 13-15. Z007 meeting and the site
of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of
Regulations. The endosed Notice Card sinall remain posted at the site until the waiver has been validate4 and no
less than seven days prior to the Commission hearing- If four (4)
requirements, a coastal development peffnit will be required.

Effective July 1, 1987 there is a change in the fee structure
for permits in Newport Beach.
The new fees are:
Maintenance permits, no configuration change,
less than 20% replacement $30.00
New Permits, Administrative Action $300.00
Council Action $400.00
Revisions, Administrative Action $150.00
Council Action $240.00
Plus: $27.50 for each additional slip and
$2.75 for each lineal foot of bulkhead.
For work started but not finished within the time limit
specified, a $70-00 fee will be charged for any Council
request for a time extension.
If the value of the work proposed under a revision is over 50'/0 of
the replacement value of the existing structure a new permit
will be required.

III. Said terms and conditions shall be perpetual and bind all future
owners and possessors of the property or any part thereof unless
otherwise specified herein.
IV. The grant of this permit is further made subject to the fol_-Iowing:
A. That this permit shall not become effective until the attached
verification of permit has been returned to the South Coast
Regional Conservation Commission upon which copy all permittees
have acknowledged that they have received a copy of the permit
and understood its contents. Said acknowledgment should be
returned within ten working days following issuance of this
'permit.
B. That said development is to be commenced on or before 360
days from effective date of approval.
V. Therefore, said Permit (Sta.-Lidard, BffGQ%WffU7,) No. P-5-2-74-3184
is hereby granted for the*above described development only, sub-
ject to the above conditions and subject to all terms and pro-
visions of the Resolution of Approval by the South Coast.Regional

The regulations of the California Coastal Zone Con-
servation Commission, Section 33510, specifies that no
permit shall become effective until a copy thereof has
been returned to the'Regional Commission, upon which all
permittees have acknowledged that they have received a
copy of the permit and understand its contents. You are
therefore requested to verify the following statement
after completely reviewing your permit and return the
signed verification to the Coastal Commission within ten
(10) working days following the permit issuance.

Recommendation
If desired approve the permit subject to 1) approval by the Orange
County Harbors, Beaches, and Parks Department, the U. S. Army Corps
of Engineers, and the South Coast'Regional Zone Conservation Com-
mission, and 2).recommenda.tion of the Joint Harbor Committee that
thenew slip not extend any further bayward than the present slip.
Discussion
1. City Council approval is required since the proposed facility
does not conform to the City's Standard Drawings or with Section
1 paragraph E of the Harbor Permit Policies.that state:
"In R-1 zones, only a single pier and float or slip shall be
permitted bayward of each parcel or lot."
2.. The proposed.revision as applied for would add a 101 x 101 plat-
form to the existing pier and will replace the existing single
slip float with a two slip float that will be approximately 10'
wider and 101 shorter.
3. The Joint Harbor Committee, at their February 15 meeting, recom-
mended approval of the permit with the condition that the two
slip configuration not extend any further bayward than the
existing single slip. The recommended variance to Councills
Harbor Permit..Policies, reference Section l -E, was based on a
review of the site location and surrounding facilities. It
was determined that the proposed configuration would not have
an adverse affect on surrounding installations.

4. The approval of the Orange County.Harbors, Beaches, and Parks
Department is required because the proposed revision is over
tidelands held in trust by Orange County. The County Harbor
Commission will review the application at their next regular
scheduled meeting for March 12. The County staff is recommend-
ing approval to the Commission.

'BA -44, $57, 000 transfer of BudgetAppropriations

reviewed an application for modification to a
private residential pier at the above address.
A staff report submitted on the application
identified two major points for consideration:

and (2) the pier is on County Tidelands necessi-

The Committee deferred action on the request and
asked that the applicant be present at the Feb-
ruary meeting to explain the need for a variance
from the City and County Harbor Permit policies.
The applicant has been so notified.
RECOMMENDED ACTION: A. -Recommend to the
Council whether the variance request from City
Harbor Permit Policies should be permitted.
B. If the r ecommendation is positive, recommend
that the approval be conditioned as follows:
a Authorization from the County Harbors
Beaches and Parks Commission for the
Director to sign a County Tidelands
Permit.

-Digest: At the January 8 Joint Harbor Committee
