Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in yourpermit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #_L-_89-257 APPLICANT: Robert Cohen
LOCATION: 2686 Bayshore Dr., NEWPORT BEACH
PROPOSED DEVELOPMENT: Demolish existing private residential boat dock and
pier; construct new dock and pier within U.S. pierhead line.
RATIONALE: The proposed project will have no adverse impacts on coastal
resources, is consistent with the Coastal Act, the City's Land Use Plan and
past Commission actions.
This waiver will not become effective until reported to the Commission at their
May 9-12, 1989 meeting and the site of the proposed
development has been appropri;tely noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver�has been validated and no less than seven days prior to the
Commission hearing. If four (4),Commissiohers object to this waiver of permit
requirements, a coastal development permit will be required.

much as he can in order to accommodate
the neighbor to the north.
Frank Celiberti, 2692 Bayshore Drive
(Mr. Cohen's neighbor to the north),
addressed the Council in opposition to
the request. He stated that Mr. Cohen's
boat is 125' long and approximately 25'
to 30' high, weighing 110 tons, and as a
result, there will be a blind spot of
350 feet on the waterways9 which could
cause an accident with vessels
approaching from different angles. He
also felt that heavy winds could cause
the boat to come loose from the dock and
cause considerable damage, and
recommended the vessel be permitted to
dock at the subject location for loading
and unloading purposes only.
Tony Melum, Tidelands Administrator,
addressed the Council and stated there
are a number of locations in the harbor
where there are blind spot§9 and he felt
the "prudent" yachtsman would have to
take that into consideration and handle
his vessel accordingly. There are also
vessels in the harbor the size of Mr *
Cohen's. As to the size of the proposed
dock, the city will require it be
constructed according to City Standards
and reviewed by Public Works Engineering
staff.

and stated he will have a professional
crew aboard his yacht; the boat is a
long-time dream of his, and he would not
leave it in a precarious location; he
intends todo extensive cruising with
the yacht, and therefore, it will not be
docked in the harbor on a permanent
basis; his crew will monitor the
weather, and if necessary, relocate the
vessel.
In response to question raised by
Council Member Sansone rearding
liability, the City Attorney advised
that harbor petmitees are required to
defend and indemnify the City in the
event of any liability that may arise
due to the granting of any permit or
activities authorized by the permit.

Recommendation:
If desired, approve the application subject to the following
conditions:

5. Approval of the California Coastal Commission
Discussion:
This application was originally before the City Council as
required by Section 5.B.. of the Harbor Permit Policies which
states:
5.B. "Prior approval of the City Council will be required before
the Marine Department may issue any permit which does not conform
to the Standard Drawings and the adopted Harbor Permit Policies".
The only deviation from the Standard Drawings was a pier platform
in excess of the size allowed by the Harbor Permit Policies, which
states a 10' by 141 maximum. However, when this matter was
originally before the City Council on February 13, 1989, adjacent
property owners spoke at the council meeting and expressed
concerns regarding the angle of the proposed slip and the size of
the vessel that was to be berthed there. Based on their concernsr
the City Council referred this matter to the Tideland Affairs
Committee for their.review and report back.
On February 15 the Tideland Affairs Committeer composed of Jean
Watt and Evelyn Hart met to consider the revisions of the above
dock. At that time the committee took testimony from the property
owner to the west, Mr. Burnand, who indicated his major concerns
were the angle of the proposed revision -relative to his slip and
the inability of the revised dock to safely berth a vessel of the
size proposed.
Since the Tideland Affairs Committee meeting on February 15, the
applicant has met with the adjacent property owners, in an attempt
to address their concerns. As a result of those meetings, the
applicant has angled his dock to the east to address the perceived
berthing problems. The applicant also indicates that the vessel
to be berthed at the revised float will not extend bayward of the
float. As regards the safety issue, the plans and specifications
will be prepared by an engineer and reviewed by the City's Public
Works Department to ensure that they are properly designed to
berth a vessel of the size contemplated.
The applicant has revised the proposed pier so that -It now
conforms to the City's standards.
For the above reasons, the Tideland Affairs Committee is
recommending approval of the revision as shown.

application, with a minor repositioning of the proposed float; if
not, it is the committee's belief that there is nothing the
committee can do in regard to downsizing the float or boat,
because of the fact that it fits in that zono under current Harbor
Permit Policies..
2. The committee discussed a letter from Mr. Bevan regarding the
distance between his dock at 106 South Bay front and the dock at 1
Collins laland. The owners of the Collins Island property have
requested that they be allowed to shift their dock to the south
west approximately 10 to 15 feet. The TAC recommended that Mr.
Hunt at 12 Collins Island be allowed to move his dock and that his
permit be conditioned so that there be at least 18 1/2 feet
clearance between his dock, when a vessel is side tied to the
dock, and the dock at 106 South Bay Front.
3. Tony Melum briefed the committee regarding the hauling of
dredge material to sea for disposal at LA #3 dredge site.
Currently the staff is recommending that dredging permits, applied
for by bay front ownersr for haul to sea, be acquired by the
homeowner. The City will approve permits on a City basis,
conditioned on the premise that the homeowner will get a p(�rmit
from the Army Corps of Engineers.

which permit a maximum dimension of 101 x 141.
Discussion:
This application is before the City Council as required by Section
5.B. of the Harbor Permit Policies, which states:
5.B. "Prior approval of the City Council will be required
before the Marine Department may issue any permit which does not
conform to the Standard Drawings and the adopted Harbor Permit
Policies".
Due to existing upland landscaping and the large size of the float
itself, the applicant proposes a pier configuration larger than
that permitted by the Standard Drawings.
Over the years there has been increased pressure from harbor
permittees to increase the size of their pier areas over and above
that allowed by the Standard Drawings. The City Council has
remained firm in allowing only 101 x 141 maximum dimensions for
the pier areas, and staff is recommending that no exception be
granted in this case.

Dear Mr. Cohen:
The City of Newport Beach has received a complaint regarding the
use of your residential float bayward of 2686 Bayshore Drive.
Specifically, the complaint is that a vessel is being berthed at
your dock in violation of Section 21.A. of the Harbor Permit
Policies which states:

On May 20, 1993 staff from the Marine department made a field
inspection of your dock. At that time it was noted that a vessel,
the "LotsOPride III" was docked on the westerly side of your dock
in violation of the above quoted policy.
To preclude further action by the Marine Department it is necessary
that this vessel be relocated and brought within conformance of the
above quoted section.

DREDGING OF 740 CUBIC YARDS AT 2686 BAYSHORE, NEWPORT BEACH
Dear Mr. Miller:
Tb._Js is in response to your September 19, 1989 letter regarding the
above -referenced project.
you are proposing to dredge approximately 740 cubic yards of
material at the Cohen residence, 2686 Bayshore, Newport Beach,
orange county. The dredged material will be pumped to a dump barge
and hauled to sea for disposal at the EPA disposal site, LA -3. A
filter screen will be installed around the discharge area to
minimize turbidity.
Based on the informat I ion you have provided, it appears that this
discharge will not significantly affect the quality of waters of
the region. Pursuant to the California Water Code Section 13269,
the Regional Board adopted Resolution No. 84-48 on May 11, 1984,
waiving waste discharge requirements for various types of
discharges. The above referenced project complies with the waiver
criteria. Therefore, the need to file a Report of Waste Discharge
is hereby waived.
This letter constitutes our clearance for this project.. This
waiver is conditioned upon the -following.
1.. The discharge shall not exceed 740 cubic yards of dredge
spoils.
2. The discharge shall be non-toxic and shall not cause a
nuisance �or pollution as defined in the California Water
Code.

Should the above conditions not be met,
and you must notify this office immediately to determine a further
course of action. In addition, this waiver does not relieve you
of the responsibility to comply with the laws and guidelines of
other regulatory agencies involved with this project.
