Dear Mr. Winkler,
This letter is in response to a June 2, 2005 letter from William Hensley (Jackson, DeMarco, Tidus
Peckenpaugh Law Corporation) and a meeting with you and Mr. Hensley near that date. During our
conversation, you presented me with certified, documented evidence from a registered engineer that
accurately depicts the "Circle of Friends" vessel berthed at your marina. According to this survey,
the "Circle of Friends," at its widest part, is 2 feet 3 inches from the true property line.
The City accepts this evidence as being true. Therefore, you have successfully proven to the City
that the "Circle of Friends" does not encroach into the neighbor's property.
Thank you for your cooperation in clearing this matter. The file on this matter is now closed.

Dear Mr. Miller:
I am in receipt of your letter under date of May 9, 2005 addressed to Mr. Dave Winkler. This
office represents Dick's bock, LLC, the owner of the docks located at 2735 West Coast Highway. Mr.
Winckler is the Managing Member of Dick's Dock.
Dick's Dock disputes that there has been any encroachment as outlined in your letter. To prove
otherwise, it has commissioned Duca-McCoy; through Registered Professional Engineer Pete J. Duca, to
do a survey to substantiate — one way or the other — whether "Circle of Friends" (the berthed vessel)
encroaches over the property line from the adjacent property located at 2703 West Coast Highway.
Enclosed please find a survey, prepared on May 31, 2005 by Mr. Duca, showing no encroachment: his
survey shows that there is a 2.23' leeway at the point of the boat which is nearest the adjacent property
line and as much as a 4.66' leeway at the point of the boat which is .farthest from the adjacent property
line.
Given the fact that there is no encroachment, we would ask that you rescind the Notice of
Violation and desist from issuing any Administrative Citation in light of this survey.
Please respond directly to Dick's Dock by indicating that the Notice is rescinded and that no
Administrative Citation will be forthcoming. If you have any questions or need further information,
please feel free to contact me directly. Also, if Dick's Dock needs to make any other challenges to the
preliminary finding in your letter, let us know how to proceed.

Dear Mr. Winkler,
A recent field inspection of your dock has revealed a berthed vessel (Circle of Friends) that is
extending beyond the projection of the property line and into 2703 W. Coast Hwy. This is in
violation of the Newport Beach Harbor Permit Policies which state:
Moorings — A: "Boats moored at private or public docks shall not extend beyond the
projection of the property lines of the property to which the dock facility is connected in
accordance with section 20-C."
This letter will advise you that the encroaching vessel must be relocated within thirty (30) days from
the date of this notice, otherwise an Administrative Citation may be issued and penalties will begin
to accrue ($100, $200, $500 daily increments). Your cooperation will be greatly appreciated in this
matter.
Please see the attached picture of the infraction. If you have any questions regarding the
enforcement of the Harbor Permit Policies, please feel free to give me a call.

Subject: Restricted Access to Bay at Larson's Shipyard
Dear Mr Miller:
Our tenant at the above location, Nancy Dixon of Larson's Shipyard, has expressed an urgent need to
us for a wider water space along her work dock to carry, on her boat repair operations and for. a better,
exit way for her boats. Consequently, we -need to cancel our License Agreement ,With -Dick's . Dock,
LLC (David Winkler);"whose slips -are located' next to Larson's Shpyardbehind:the Rusty:Pelican
restaurant at 273 5 West Coast Highway. A copy of the License Agreement is enclosed herewith. I
think you probably required the License in order to allow the boat "Circle of Friends" ("Cof F") to
dock there.
We gave the License Agreement to Dick's Dock, without charge, as a neighborly gesture (according
to our owner, Ted Robinson, they are quite nice people), so that the wider -beamed Cof F could dock
along their outside slip. The Cof F takes up almost all the water space between the edge of its slip and
their property line between us, so they needed the License to use our waterway in order to keep the
Cof F along that dock:
A survey dated 12/31/05 was provided to Harbor Resources Division showing 2 feet between the
edge of Cof F and the property line, but Ms. Dixon reports that this was accomplished only by
removing all the fenders and then leaning the boat over the slip. If one looks at the survey, it can be
seen that the beam overlaps the slip, but as it is normally docked, the boat is fendered away from the
edge of the slip, not that this is really pertinent here. They still could not get the rear :boats through a
2' exit and therefore cannot dock the Cof F in the dock without a License Agreement from us.
Inany event, our tenant says that the Cof F's -beam has squeezed the amount of width available to:
boats docked along Larson's slip, clown to a size too `small to give -Larson- s a feasible -work and
docking area and still have an -way.; In fadtwe recently paid-a=fine=for having too small of a fire
exit -way there. But without ifi&E cense access through the Larsons's-waterway;ahe Cof F would
heed to be moved from that dock'because; while it's there, the docks -in the Rusty -pelican slips behind
the Cof F do not really have any access out through their own waters.

In any event, we reluctantly still need to cancel this License. Once the Cof F is moved elsewhere,
however, we might then be able to create a new mutual license agreement where each property
contributes at least 8 feet along the edge of their property line such that we have at least a 16 foot fire
exit space available to both properties.
We're not sure if this is right department to send the License cancellation to, however. If it is not, if
you could refer us to the proper department for this, it would be greatly appreciated.

This Agreement between the Larson Group, LLC, as owner of the Larson Shipyard property and
its marina, and Dick's Dock, LLC, as owner of the Rusty Pelican property and its marina area, which two
properties are adjacent to each other along Pacific Coast Highway in Newport Beach, shall act as a license
for the Rusty Pelican property and its marina to use the waterway alongside the way and track of the
Larson Shipyard in the following manner:
1. In order to meet the ingress and egress requirements of the City of Newport Beach Harbor
Resources Division and the Newport Beach Fire Department, the boats within the Rusty Pelican marina
shall have the right to utilize said waterway for ingress and egress for the berthing of their boats and in
case of fire or other emergency.
2. This Agreement shall not act as a guarantee of any kind that said waterway shall always be
open for such ingress and egress, given the nature of the shipyard operation and its occasional need to
realign and move side by side during the change or shifting of boats during the normal course of shipyard
operations.
3. This License Agreement may be cancelled at any time by either party for any reason or for no
reason.

APPLICATION TO: Revise the existing harbor permit bayward of 2735 West
Coast Highway.
APPLICANT: Ancient Mariner, Inc.
RECOMMENDATION: If desired, approve Harbor Permit Application No. 129-2735
subject to the condition that the permit holder will bei responsible for
abating any litter and debris which may accumulate beneath the proposed
deck area.
DISCUSSION: 1) The approval of the City Council on this application
is required because the abutting upland property is zoned commercial.
2) The existing concrete bulkhead is located behind the
U. S. Bulkhead Line. This bulkhead will remain unchanged and the proposed
building and deck area will be supported on piling.
3) The entire structure would be located behind the U. S.
Bulkhead Line.
4) Application has been made to the U. S. Corps of Engineers;
however, the Corps of Engineers permit will be granted only after the
proposed construction receives approval from the City Council.
5) A City of Newport Beach Building Permit has been issued
for this construction subject to the condition that the proposed Harbor
Permit revision be approved.
6) It is not anticipated that the litter and debris accumu-
lation will be a problem at this location, ho , hould a problem in
this regard occur in the future, the recommended cond'tion of approval will
provide the City with greater control of/ he,problem.

As I indicated to you on the telephone on this date, the recent
repairs made at the above location were done.without permits.
This is in violation of Section 5.H. of the Newport Beach Harbor
Remit Policies, which state:
5.H. "A written permit for maintenance is required from the
Marine Department for any structural or work where the cost
for such work, including labor and materials, would normally
exceed $500.00. Painting, replacement of rub -rails and works
considered cosmetic in nature do not require a permit. Prior
to issuance of a permit, the applicant will show proof of
Longshoremen's Workers' Compensation Insurance as required
by the Longshoremen's Act."
To rectify the situation, please show on the attached drawing
when and what type of repairs.were..made:and_who 1did',the..wGrk.
In addition, please fill in the 3x5 card where indicated and
return to us with your check for $25.00.
Once I have the above in hand and have confirmation from
Jim Upton of the Newport Beach Fire Department that you have
met their requirements, I will issue your permit.
In the meantime, the facility is in violation of the Newport
Beach Municipal Code and the Newport Beach Harbor Permit Policies
and this situation must be corrected in a timely manner to
