Recommendation_
If desired, approve the application subject to the following
conditions:
1. Approval of the Army Corps of Engineers
2. Approval of the California Coastal Commission
3. That all plumbing and electrical work be done under a
permit from the City Building Department
_4. That the plans and specifications for the dock must be
approved by the Public Works Department
5. The fire prevention equipment on the docks must be
approved by the City Fire Department
6. The sunken dry dock in the water at the eastern side
of the property must be removed prior to construction
7. The revised slips can be made available only to boat
brokers and the only vessels berthed at the marina will
be vessels for sale. The marina will not be used as a
private berthing marina for private vessels.
Discussion•
This application is before the City Council as required by Section
5.C.3 of the Harbor Permit Policies, which state:
5.C.3. "Prior approval of the City Council will also be
required before issuing a permit for shore -connected
structures when (3) the upland abutting property is zoned
commercial".
The applicant wishes to rebuild an existing marina that is in need
of extensive repair. As part of that rebuilding, applicant wishes
to reconfigure the docks as indicated on the attached diagram.

In its new configuration the marina wouild provide berthing for at
least 18 vessels. Based on Sections 17 and 19 of the Harbor
Permit Policies the applicant, should be required to provide
thirteen and one half,parking spaces and one men s and one women's
restrooms.
The applicant has indicated that the slips will be used only for
vessels for sale by yacht brokers and will not be available for
berthing of private vessels. In this case, the applicant has
agreed to allow that the marina be so conditioned, and has asked
that they be exempted from the parking and sanitary requirements.
In the past, where applicants of commercial marinas have so
conditioned their permit, the Council has allowed these sections
(Sections 17 and 19) to be waived.
If, in the future, the marina becomes available for the berthing
of private vessels, the applicant would be required to show
compliance with the above sections of the Harbor permit policies
dealing with parking and sanitary facilities.

I have attached a copy of a claim filed on behalf of Marco A.
Otero. I have talked to Otero's attorney who says the accident
took place on the docks bayward of Billy's. The accident occurred
on August 5, 1994 so we should be able to track down the marine
charter permit issued to Orca Yacht Charters. Otero's attorney
filed the claim to cover his rear and is quite reasonable. I-
intend to send him a copy of the Commercial Pier Permit and the
Marine Charter Permit. I will also notify the two permittee's of
their obligation to defend, indemnify_ a d hold us harmless with
respect to this claim.

At said time and place, and prior thereto, the described area
above was in a dangerous condition that created a substantial
risk of the type of injury hereinafter alleged when the property
was used in a manner that was reasonably foreseeable in that
there was a gap between the dock and the ramp, creating a
substantial risk that persons walking on the dock would trip or
fall and injure themselves.
5. Claimant's injuries include but are not limited to
right knee pain, neck, mid and low back pain, right shoulder
pain, and pain in his right hand.
6. The name of the public employees causing the
Claimant's injuries are unknown at this time.
7. Our claim as of this date is $250,000.00 and

This is to verify that the building owner, James A. Carter,
is asking that we be given the building permit to remove
the badly deteriorated docks at 2801 W. Coast Highway and
2751 W. Coast Highway.
Upon removal of these docks, the.drydock that is laying on
the marina floor will be raised, cut up, and hauled away.
Then, the new docks will be installed.
It was found to be easier to first get the docks out of
the way so that the drydock can be removed.

Motion was made to schedule a public

2. Report from the Marine Department
recommending approval, subject to

The City Clerk advised that after the
agenda was printed, a letter was
received from the applicant requesting
this item be removed from the agenda
until further notice.
Motion was made to grant the foregoing
request.
3. Proposed resolution establishing fees
for dog licenses with report from
Business License Supervisor, was
presented.
Council Member Plummer indicated her
continual concern regarding the need for
stronger enforcement pertaining to dog
litter; and stated she would favor the
City issuing, along with new dog
licenses, a notice of the City's
animal control regulations,, as well as
possibly dog scoopers and bags.
The City Manager advised that very clear
instructions will be issued along with
the dog licenses pertaining to animal
nuisances (cleaning up after dogs or
animals).
There being no further comments, motion
was made to adopt Resolution No. 87-105
establishing FEES FOR DOG LICENSES.
4. Letter from S. R. Willford regarding
parking rights of Lido Shop owners, was
presented.
Sandy Willford, owner of property in the
3400 block of Via Lido, known as the
Lido Shops, addressed the Council
referencing his letter of July 3, 1987,
wherein he requests the City Council to
review its action taken pertaining to
the parking rights in the multi -story
parking structure located immediately
north of the shops. He stated he felt
the Council has been ill-advised, and
that the City Attorney's office has a

legal conflict of interest in
representing both the City staff and
City Council, and therefore, the Council
should receive independent legal advice
regarding this matter.
Mr. Willford stated this issue has been
dealt with for over a year, and he would
request that it be referred to the staff
for report. He summarized areas of
concern to him, as enumerated in his
letter and stated that the only real
issue is, "Do the Lido Shop owners have
a parking agreement granting parking
rights?" If so, he felt the staff
should honor it.
Mr. Willford stated that if the City
Attorney and staff have evidence which
shows that they do not have the parking
rights set forth in the parking
agreement, it should be presented now.
Otherwise, he felt the Council should
instruct the staff to honor the
agreement. In conclusion, he requested
that:
1) Staff specifically list what.
they feel the disputes are
between the owners of the
parking structure and the Lido
Shop owners;
2) City Council obtain its own
independent legal counsel on
this issue; and
3) Rather than litigate the issue
in Executive Session, this
matter be discussed openly in
a regular City Council
meeting.
The City Attorney stated that he would
like longer than two weeks before
bringing this item back to the Council,
in order that he and the staff can
review the issue and make
recommendations to the Council. He
stated he felt there still was a dispute
involved, based upon the fact that there
are certain developments that have
occurred in Lido Village that have been
approved by the Planning Commission, or
City Council which made certain
assumptions about the availability of
parking spaces in the parking structure,
and who is entitled to those spaces. He
stated he felt the City Council does not
have the right to decide what the

Subject: Proposed New Dock Layout - James Carter
The staff of the\State Lands Commission has received your
letter dated October 22, 1987, and attached drawing relative to
the proposed new dock layout, for James Carter, to be located at
2751 and 2827 West Coast Highway, in the City of Newport Beach.
The tide and submerged lands over which the proposed
project will extend are sovereign lands of the State of
California that the Legislature granted in trust to the City of
Newport Beach pursuant to Chapter 74, Statutes of 1978.
Therefore, you need not apply to the State Lands Commission for
project authorization. You should, however, apply to all other
agencies having approval authority.
This action does not constitute, nor shall it be construed
as, a waiver of any right, title, or interest by the State of
California in any lands under its jurisdiction.

Discussion:
This application is.before the City Council as required by Section
5.C.3 of the Harbor Permit Policies, which state:
5.C<3. "Prior approval of the City Council will also be
required before issuing a permit for shore -connected
structures when (3) the upland abutting property is zoned
commercial".
The applicant wishes to rebuild an existing marina that is in need
of extensive repair. As part of that rebuilding, applicant wishes
to reconfigure the docks as indicated on the attached diagram.
In its new configuration the marina wouild provide berthing for at
least -18 vessels. Based 'on :Sections 17 -and 19- of, the Harbor
Permit Policies' the applicant Should- be _required to provide
thirteen and one half parking spaces Arid one men s and one women's
restroom.
The applicant has indicated that the slips will be used- only for
vessels for sale by yacht brokers and will not be available for
berthing of private vessels. This being the case, the applicants
have agreed to Condition #7 stated above, if they would be exempt
from the parking and restroom requirements.In the past, where
applicants of commercial marinas have so conditioned their permit,
the Council has allowed these sections (Secretins 17 and 19) to be
waived.
If, in the future, the marina becomes available for the berthing
of private vessels, the applicant would be required to show
compliance with the above sections of the Harbor permit policies
dealing with parking and restroom facilities.

Dear Council Members:
I represent Avalon Pacific, Inc., who is a lessee of
applicant at 2751 West Coast Highway, Newport Beach,
California. Under its written lease with applicant, Avalon
has the exclusive use of the existing drydock in the marina
at this location until June 1988.
Avalon opposes the above referenced application because the
proposed plans contemplate the removal of Avalon's
drydock. Avalon is in the -charter business, and it is
essential to Avalon to have a slip that will accommodate a
larger boat than the proposed plans contemplate.
Avalon will agree to modify its lease to permit the
immediate removal of the existing drydock, provided Avalon
has immediate use of a slip or slips that will accommodate
the same size boats, or larger, that it can accommodate at
the existing drydock.

Your March 6, 1987_ letter requests, in essence, that the City approve a
berthing faci:lity_gui'de pile design that is predicated upon a maximum
boat length. of 70 feet., even though_ the berth.will.accommodate a much
longer boat._ In return, you offer to absolve the City and your engineer
of liability and -damage that may occur should a boat longer than 70
feet be moored at the berth.
The City has determined to not approve such a guide pile design. The
berthing facility must either: l) Contain the guide piles calculated
for a maximuw.length boat moored thereto,_or 2). Contain.some permanent
physical -barrier __to prohibit mooring of longer -boats than... guide pile
calculations were predicated upon.

Gentlemen:
It has been brought to our attention by our engineer that if
sufficient piling were placed in Headwalk "A" to satisfy the City
design criteria, there would be a piling approximately every 12'.
We feel the resulting inconvenience to persons using the dock by
the strict application of the criteria in this instance would be
considerable and undesirable. Accordingly, we would appreciate an
indication from your department that you will be receptive to con-
sidering a proposed design of an anchor piling layout to accommodate
a 70' boat, although at some variance from the strict application of
the criteria.
Should you consider and approve such design as we submit, as a
condition to approval, we are Willing to absolve the City of Newport
Beach and the engineer of liability and damage as .might be caused
should a boat in excess of 70' be moored at the subject headwa I k .

2.. Expiration. If development has not commenced, the permit will expire two
years from the date on which the Commission voted on the application.
Development shall be pursued in a diligent manner and completed in a
reasonable period of time. Application for extension of the permit must
be made prior to the expiration date.
3. Compliance. All development must occur in strict compliance with the
proposal as set forth below. Any deviation from the approved plans must
be reviewed and approved by the staff and may require Commission approval.
4. Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Commission.
5. Inspections. The Commission staff shall be allowed to inspect the site
and the development during construction, subject to 24—hour advance notice.
6. -Assignment. The permit may be assigned to any qualified person, provided
assignee files with the Commission an affidavit accepting all terms and
conditions of the permit.
7. Terms and Conditions Run with the Land. These terms and conditions shall
be perpetual, and it is the intention of the Commission and the permittee
to bind all future owners and possessors of the subject property to the
terms and conditions.
