Dear Mr. Herbst:
This is in reply to your application (File No. SPL -2008-00958) for a Department of
the Army.Permit to discharge fill onto waters of the U.S., in association With your boat
dock re -configuration pr oject. The proposed work would take place bayward of 2692
Bayshore Drive within Newport Bay in the City of Newport Beach, Orange County,
California.
. Based on the information you have provided, the Corps of Engineers has
determined that your proposed activity complies with the terms and conditions of
Regional General Permit (RGP) No. 54: Maintenance Dredging, Beach Nourishment, and
Dock Maintenance.
As long as you comply wifn the general peri -nit conditions of RGP No. 54, an
individual permit is not required.
Specifically, you are authorized to (as shown on enclosed figures):
1. Remove an 8' x 20' section off the existing floating dock structure;
2. Install new 8' x 10' and 8' x 76"sections to either end of the existing dock; and
3. Retain existing gangway.
A general permit does not grant any property rights or exclusive privileges. This
letter of verification is valid until October 23, 2009. Also, it does not authorize any injury
to the property or rights of others or authorize interference with any existing or

proposed Federal project. Furthermore, it does not obviate the need to obtain other
Federal, State, or local authorizations required by law.

construction projects conform with the submittal requirements established under Consistency Certification CC -
031 -06 the Special Conditions of Coastal Development Permit 5-06-117. Please note that the eelgrass and
Caulerpa taxifolia surveys completed are only valid for a limited time period and that additional surveys must be
completed and submitted to Commission staff for review if the proposed dock projects listed above do not
commence prior to expiration of the initial survey. In addition, please note that this authorization shall expire on
October 23, 2009 and that all authorized work must be completed prior to that date. Finally, please note there are
ongoing obligations relative to water quality protection established in the authorization which must be implemented
for the entire life of the approved development.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -031-06 and/or conform with the terms and conditions of

Coastal Commission Permit 5-06-117 & Federal Consistency Certification CC -031-06, the Army Corps
of Engineers Regional General Permit 54 (File No. 200501233-13PS) and the California Regional Water
Quality Control Board General Certification for Regional General Permit No. 54 for construction in
Newport Harbor and that I will comply with all of the conditions in those permits. I also certify that by
acceptance of this Permit, the applicant acknowledges and agrees that the site may be subject to hazards
from waves and erosion.
I will further hold the City of Newport Beach harmless from and indemnify the City against any claim for
damages arising out of the exercise of these permits. In addition, I shall reimburse the City of Newport
Beach for all attorney's fees and other costs expended by them in defending any claim, lawsuit, or
judgment arising out of the activities of the applicant carried on under the authority of such Permit.
I understand that any work authorized must be completed by October 23, 2009, after which a new
authorization is required.
Per the RGP Permit, all dock construction applications will be processed by the various agencies through
monthly batch submittals sent to them by Harbor Resources. Therefore, all dock construction applications
must be submitted to and received by Harbor Resources by the I " Monday of evM month. Applications
submitted prior to this deadline are encouraged and appreciated.

Municipal Code or other regulations in any manner that would affect the use of the
property or the design of a project located thereon, this Approval In Concept shall
become null and void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted thereunder, this development:

All discretionary approvals legally required of Newport Beach prior to issuance of a

not subject to rejection in principal by Newport Beach unless a substantial change is
proposed.
This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached

With reference to the plans currently under consideration at the above referenced address to
reconfigure or modify the dock system or bulkhead, the following conditions will now be in
effect:
1 . The project proponent is aware of the Harbor Permit Policies (Council Policy H-1) and Title
17 of the City of Newport Beach Municipal Code. The project proponent understands that the
above referenced structure(s) is under the purview of these Policies and Codes.
2. Any future work on the above mentioned structure(s) requires permits with the City of
Newport Beach and any other applicable agencies. Painting and work considered to be
cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the proposed dock system and/or
bulkhead under consideration. Any future modifications or alterations to the dock system
and/or bulkhead may require new conditions which may override or change these conditions.
These conditions supersede all past conditions associated with this property.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. In accordance with Municipal Code 10.08.030 A. the project proponent shall obtain the
proper permits for equipment and materials storage. "Except -as otherwise provided in this
section, no person shall use any public street, sidewalk, alley or. parkway or other public
property for the purpose of storing or displaying any equipment, materials or merchandise, or
any other commercial purpose. B. Public streets, sidewalks, alleys, or parkways may be used
for the purpose of selling, storing, or displaying any equipment, material, merchandise or for
other commercial purposes in the following cases: ... For the temporary storage of construction
equipment or material provided a permit is issued pursuant to Chapter 12.62 of this Code and
the storage is consistent with provisions of the Uniform Building Code."
6. The project shall be implemented in conformance with the Local Coastal Program - Coastal
Land Use Plan.

7. In accordance with Municipal Code 10.28.040 the following noise regulations apply: "A.
Weekdays and Saturdays. No person shall, while engaged in construction, remodeling, digging,
grading, demolition, painting, plastering or any other related building activity, operate any tool,
equipment or machine in a manner which produces loud noise that disturbs, or could disturb, a
person of normal sensitivity who works or resides in the vicinity, on any weekday except
between the hours of seven a.m. and six -thirty p.m., nor on any Saturday except between the
hours of eight a.m. and six p.m. B. Sundays and Holidays. No person shall, while engaged in
construction, remodeling, digging, grading, demolition, painting, plastering or any other related
building activity, operate any tool, equipment or machine in a manner which produces loud
noise that disturbs, or could disturb, a person of normal sensitivity who works or resides in the
vicinity, on any Sunday or any federal holiday."

encroach upon the neighbor's property on either side.

STANDARD CONDITIONS:
Notice of Receipt and Acknowledgment. The permit is not valid and development shall not
commence until a copy of the permit, signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. Interpretation. Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. The permit may be assigned to any qualified person, provided assignee files with
the Commission an affidavit accepting all terms and conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the pernniftee to bind all future owners and possessors
of the subject property to the terms and conditions.
SPECIAL CONDITIONS: See pages four to six.
EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of
development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act. If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Proiect DescriDtion
The subject site is located at 2692 Bayshore Drive in the City of Newport Beach (Exhibits #1-2).
Single-family residences characterize the subject site and the surrounding area. The proposed project
(Exhibit #3) involves the removal of an existing "U" shaped dock system (including four 14" pilings)
and replacement with a new L" shape dock system consisting of: 8' x 32' backwalk; one (1) 8' x
95'finger; installation of two 18" concrete pilings and four 16" concrete pilings; and use of TREX
composite decking and -Douglas fir for framing. The existing 10' x 14' pier and gangway are
proposed to remain.
The dock project will be used for boating related purposes to serve a single-family residential
development. - The site has been surveyed by the City of Newport Beach Harbor Resources Division for

eelgrass and no eelgrass was discovered within 15 feet of the project area. Public access to the bay is
available along the walkway/bikeway/accessway on the west side of the Pacific Coast Highway
approximately 1/4mile to the north of the project site. The proposed project has received an approval in
concept from the City of Newport Beach Harbor Resources Division. The Regional Water Quality
Control Board (RWQCB) has determined that the proposed project will not adversely impact water
quality if standard construction methods and materials are used. The applicants have applied for a
permit from the U.S. Army Corps of Engineers.
B. Marine Resources
The proposed recreational boat dock development and its associated structures are an allowable and
encouraged marine related use. The project design includes the minimum sized pilings and the
minimum number of pilings necessary for structural stability. There are no feasible less
environmentally damaging alternatives available. As conditioned, the project will not significantly
adversely impact eelgrass beds and will not contribute to the dispersal of the invasive aquatic algae,
Caulerpa taxifolia. Further, as proposed and conditioned, the project, which is to be used solely for
recreational boating purposes, conforms to Sections 30224 and 30233 of the Coastal Act.
C. Water Qualit
The proposed work will be occurring on, within, and adjacent to coastal waters. The storage or
placement of construction material, debris, or waste in a location where it could be discharged into
coastal waters would result in an adverse effect on the marine environment. To reduce the potential for
construction related impacts on water quality, the Executive Director imposes special conditions
requiring, but not limited to, the appropriate storage and handling of construction equipment and
materials to minimize the potential of pollutants to enter coastal waters. To reduce the potential for
post -construction impacts to water quality the Executive Director requires the continued use and
maintenance of post construction BMPs. As conditioned, the Executive Director finds that the
development conforms to Sections 30230 and 30231 of the Coastal Act.
D. Local Coastal Program
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. The certified LUP
was updated on January 9, 1990. As conditioned, the proposed development is consistent with
Chapter 3 of the Coastal Act and with the certified Land Use Plan for the area. Approval of the project, -
as conditioned, will not prejudice the ability of the City of Newport Beach to prepare a Local Coastal
Program that is in conformity with the provisions of Chapter 3.
E. California Environmental Quality Act (CEQ
As conditioned, there are no feasible alternatives or additional feasible mitigation measures available
that would substantially lessen any significant adverse effect that the activity may have on the
environment. Therefore, the Executive Director finds that the proposed project, as conditioned to
mitigate the identified impacts, is the least environmentally damaging feasible alternative and is
consistent with the requirements of the Coastal Act to conform to CEQA.

SPECIAL CONDITIONS:
Water Qualit
A. Construction Responsibilities and Debris Removal
(1) No construction materials, equipment, debris, or waste will be placed or stored
where it may be subject to wave, wind, or rain erosion and dispersion.
(2) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(3) Machinery or construction materials not essential for project improvements will not
be allowed at any time in the intertidal zone.
(4) If turbid conditions are generated during construction a silt curtain will be utilized to
control turbidity.
(5) Floating booms will be used to contain debris discharged into coastal waters and
any debris discharged will be removed as soon as possible but no later than the
end of each day.
(6) Non -buoyant debris discharged into coastal waters will be recovered by divers as
soon as possible after loss.,
B. Best Management Practices Program
By acceptance of this permit the applicant agrees that the long-term water -borne berthing of
boat(s) in the approved dock ' and/or boat slip will be managed in a manner that protects water
quality pursuant to the implementation of the following BMPs.
(1) Boat Cleaning and Maintenance Measures:
a. In -water top -side and bottom -side boat cleaning shall minimize the discharge of
soaps, paints, and debris.
b. In -the -water hull scraping or any process that occurs underwater that results in
the removal of paint from boat hulls shall be prohibited. Only detergents and
cleaning components that are designated by the manufacturer as phosphate -
free and biodegradable shall be used, and the amounts used minimized.
c. The applicant shall minimize the use of detergents and boat cleaning and
maintenance products containing ammonia, sodium hypochlorite, chlorinated
solvents, petroleum distillates or lye.
(2) Solid and Liquid Waste Management Measures:
a. All trash, recyclables, and hazardous wastes or potential water contaminants,
including old gasoline or gasoline with water, absorbent materials, oily rags,
lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits will

be disposed of in a proper manner and will not at any time be disposed of in the
water or gutter.
(3) Petroleum Control Management Measures:
a. Oil absorbent materials shall be examined at least once a year and replaced as
necessary. The applicant will recycle the materials, if possible, or dispose of
them in accordance with hazardous waste disposal regulations. The boaters
will regularly inspect and maintain engines, seals, gaskets, lines and hoses in
order to prevent oil and fuel spills. Boaters will use preventive engine
maintenance, oil absorbents, bilge pump -out services, or steam cleaning
services as much as possible to clean oily bilge areas. Bilges shall be cleaned
and.maintained. Detergents will not be used for cleaning. The use of soaps
that can be discharged by bilge pumps is prohibited.
2. Eelgrass Surve
A. Pre Construction Eelgrass Survey. A valid pre -construction eelgrass (Zostera
marina) survey shall be completed during the period of active growth of eelgrass
(typically March through October). The pre -construction survey shall be completed
prior to the beginning of construction and shall be valid until the next period of active
growth. The survey shall be prepared in full compliance with the "Southern California
Eelgrass; Mitigation Policy" Revision 8 (except as modified by this special condition)
adopted by the National Marine Fisheries Service and shall be prepared in consultation
with the California Department of Fish and Game. The applicant shall submit the
eelgrass survey for the review and approval of the Executive Director within five (5)
business days of completion of each eelgrass survey and in any event no later than
fifteen (15) business days prior to commencement of any development. If the eelgrass
survey identifies any eelgrass within the project area which would be impacted by the
proposed project, the development shall require an amendment to this permit from the
Coastal Commission or a new coastal development permit.
B. Post Construction Eelgrass Survey. If any eelgrass is identified in the project area
by the survey required in subsection A of this condition above, within one month after
the conclusion of construction, the applicant shall survey the project site to determine if
any eelgrass was adversely impacted. The survey shall be prepared in full compliance
with the "Southern California Eelgrass; Mitigation Policy" Revision 8 (except as modified
by this special condition) adopted by the National Marine Fisheries Service and shall be
prepared in consultation with the California Department of Fish and Game. The
applicant shall submit the post -construction eelgrass survey for the review and approval
of the Executive Director within thirty (30) days after completion of the survey. If any
eelgrass has been impacted, the applicant shall replace the impacted eelgrass at a
minimum 121 ratio on-site, or at another location, in accordance with the Southern
California Eelgrass Mitigation Policy. All impacts to eelgrass habitat shall be mitigated
at a minimum ratio of 1.21 (mitigation: impact). The exceptions to the required 1.21
mitigation ratio found within SCEMP shall not apply. Implementation of mitigation shall
require an amendment to this permit or a new coastal development permit unless the
Executive Director- determines that no amendment or new permit is required.

A. Not earlier than 90 days nor later than 30 days prior to commencement or
re -commencement of any development authorized under this coastal development
permit (the "project"), the applicant shall undertake a survey of the project area and a
buffer area at least 10 meters beyond the project area to determine the presence of the
invasive alga Caulerpa taxifolia. The survey shall include a visual examination of the
substrate.
B. The survey protocol shall be prepared in consultation with the Regional Water Quality
Control Board, the California Department of Fish and Game, and the National Marine
Fisheries Service.
C. Within five (5) business days of completion of the survey, the applicant shall submit the
survey:
(1) for the review and approval of the Executive Director; and
(2) to the Surveillance Subcommittee of the Southern California Caulerpa Action Team
(SCCAT). The SCCAT Surveillance Subcommittee may be contacted through
William Paznokas, California Department of Fish & Game (858/467-4218) or Robert
Hoffman, National Marine Fisheries Service (562/980-4043).
D. If Caulerpa taxifolia is found within the project or buffer areas, the applicant shall not
proceed with the project until 1) the applicant provides evidence to the Executive
Director that all C. taxifolia discovered within the project and buffer area has been
eliminated in a manner that complies with all applicable governmental approval
requirements, including but not limited to those of the California Coastal Act, or 2) the
applicant has revised the project to avoid any contact with C. taxifolia. No revisions to
the project shall occur without a Coastal Commission approved amendment to this
coastal development permit unless the Executive Director determines that no
amendment is legally required.

Reference is made to your request of April 4, 2005 (File No. 200301146-CLM). Under the
provisions of Section 10 of the Rivers and Harbors Act of March 3, 1899 (33 U.S.C. 403), you are
hereby authorized to remove the existing "U" shaped dock with 8 foot by 61 -foot fingers, a 8 -
foot by 18 -foot backwalk, and four 14 -inch pilings, and replace with the new configuration. The
new configuration will be an "L" shaped dock with an 8 -foot by 95 -foot finger, an 8 -foot by 32 -
foot backwalki two. 18 -inch pilings, and four 16 -inch pilings mi New.port Beach, Orange County,
California, as shown on the enclosed drawings. There is no work proposed for the existing pier
and gangway.
The owner or authorized responsible official must sign and date all copies of this Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).

INTRODUCTION
An eelgrass; (Zostera marina) bed offshore of 2692 Bayshore Drive in Newport Beach,
California was required to be surveyed prior to dredging to remove excess sediment that has restricted
the use of the docking facilities. As eelgrass; beds are environmentally sensitive habitats with many
species of marine life utilizing -this; important. resource for nursery grounds, protection, and living space,
they are protected by California and federal law. Therefore, resource agencies require that proponents
of projects that may result in an impact to eelgrass beds survey the bed and determine methods to
avoid or reduce the impact on the resources. If impacts are unavoidable, then particular emphasis is
placed on restoration or re-establishment of the eelgrass; bed in a nearby location as mitigation for
habitat loss due to development.
. To meet these requirements, MBC Applied Environmental Sciences (MBC) conducted
mapping and surveying of eelgrass offshore of the site on 17 May 2001 to determine the potential
impact of the project. The results of the 17 May survey are presented in this report.
METHODS
- Location
The location of the proposed project is offshore of 2692 Bayshore Drive, Newport Beach,
California. The lot front is approximately 150 ft wide with a seawall surrounding the entire beach front
(Figure 1).
Survey
Utilizing tape measures and transect lines, MBC biologist/divers determined the amount of
eelgrass; in the shallow subtidal and out to 30 rn offshore of the site.
Measurements and observations taken included areal coverage, depth distribution, density,
and relative health. Une transects were utilized to determine the distribution of eelgrass; in the project
area. Areal coverage in the project area was quantified by recording (in meters) the presence or
absence of eelgrass along six line transects extending from 0 ft MLLW to the offshore edge of the
eelgrass; at -7 to -8 It MLLW (approximately 22 m offshore) and out to 30 rn depth (at -11.5 ft MLLW).
Each perpendicular transect was 9 m (30 ft) apart along the seawall, while along the dock, mapping
was conducted at 3 meter intervals along the 18 m dock length on perpendicular transects; to 9 rn
offshore of both sides of the dock (Figure 1).
Density was determined by counting the number of turions per 0.125 M2. In addition, the
presence or absence of flowering shoots -and other environmental data were noted. Physical and
biological attributes of each of the sites were assessed.
RESULTS
Area Coverage. The area offshore of 2692 Sayshore Drive was surveyed for eelgrass;
coverage from the bulkhead to 30 rn offshore, terminating in approximately 10 ft MLLW. The six
transects; ranged from 0 to 18.6 m coverage along each transect indicating that about 552 m2 of

eelgrass was present offshore of the property (Table 1). Focused transects,- at 3 m intervals,
perpendicular to the west and east side of the dock and out 9 m indicated that there was appro;dmately
14.1 m2 of eelgrass; within 4.5 m (15 ft) of the

possible. Although a finger projection of eelgrass comes within about 6 ft of the dock near the northeast
comer, it would be possible to dredge underneath the, dock without disturbing the existing eelgrass. It is
possible, however, that the slope from the dredged area over to the eelgrass bed may cause some of
the bank above the slope to slough down the slope towards the dock. If this was to occur, then some of
the eelgrass close to the bank could be buried. The post -dredge survey will be conducted shortly after
the dredging and will allow the biologist -diver to determine whether sloughing of the eelgrass has
occurred or whether there is still potential for this -to occur. If impacts do occur, then the eelgrass; could
be replanted on site (there is sufficient area on the west side of the dock to transplant eelgrass)
according to. the guidelines of the Southern California Eelgrass; Mitigation Policy (NMFS 1991).
Sediments were relatively silty on the east side of the dock and eelgrass appeared healthy.
Most of the available area was covered with an eelgrass; meadow of low density but meter -long
eelgrass turions. Eelgrass; on the west side of the dock is also healthy although sediments are
somewhat coarser. The eelgrass; on the west side of the dock is not in the proposed dredge path so the
beds probably are not at risk.
A diverse assemblage of fish and invertebrates was noted in the area. Barred sandbass,
California halibut, diamond turbot, shiner seaperch, black surlperch, topsmelt, bay gobies, and yellowfin
goby were noted in the eelgrass bed along with the sea slug Navanax, musseK and small mollusks
such as fat nassas.
CONCLUSION
During a consultation with the dredger, the operator indicated that dredging could be
accomplished without disturbing the existing eelgrass beds as depicted on the map. Our

recommendation is to proceed with the dredging. If the post -dredge survey indicates an impact to the
bed, then a mitigation plan would be written and a transplant accomplished on-site.

Dear Mr. Melum:
On June 22, 2001, Commission staff received the detailed eelgrass survey for the subject property
requested in our letter to you dated March 29, 2001. According to the survey, there is 14.1 square
meters of eelgrass within 15 feet of the dredging area on the east side of the dock and 4.6 square
meters of eelgrass on the west side of the dock which is within 15 feet of the proposed dredging.
Since the proposed dredging is within 15 feet of an eelgrass bed it does not conform with Special
Condition 2 of Coastal Development Permit 5-99-282 and the agreement established under
Consistency Certification CC -078-99, which require that all dredging and any beach disposal have
a minimum 15 foot setback from eelgrass beds. Accordingly, the proposed dredging is not
authorized under CDP 5-99-282 and Consistency Certification CC -078-99. Since the dredging is
within 50 feet of an environmentally sensitive habitat area (the eel grass bed), a separate coastal
development permit review is required for the proposed dredging. That permit will function as a
consistency certification as required by the federal Coastal Zone Management Act (16 USC
§1456(c)(3)(A)) and its implementing regulations (15 CFR Part 930 Subpart D). The disposal at
LA -3 is not covered by the permit, but is consistent with the requirements of CC -078-99 and may
be covered by the Commission's concurrence with that certification. Therefore, Commission staff
do not anticipate any need for further federal consistency review for the offshore disposal
component. However, Commission staff reserve the right to make a final determination on this
element at the time a complete application for coastal development permit has been submitted for
the other components of the project.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Hinimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative,Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #5-95-205 APPLICANT: Williams Family Trust
LOCATION: 2692 Bayshore Drive. City of Newport Beach. County of Orange
PROPOSED DEVELOPMENT: Replacement of an existing residential dock structure
with a new dock structure consisting of a 10'xl4' platform supported by four
approximately one -foot diameter pre -stressed concrete piles, an aluminum
gangway, and a 102'x46' U-shaped timber dock supported by foam -filled
polyethylene pontoons and anchored by twelve approximately one -foot diameter
guide piles.
RATIONALE: The proposed development is the exact same development approved by
Waiver 5-95-092. However, Waiver 5-95-092 incorrectly described the number of
piles supporting the proposed platform as two instead of four. The proposed
development would not extend past the U.S. Pierhead or Project Lines, would
not have significant adverse impacts on coastal access, coastal resources, or
public recreation opportunities, and is consistent with the City's Certified
Land Use Plan, past Commission actions in the area, and the Chapter Three
policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their
September 12-15, 1995 , meeting and the site of the proposed development
has been appropriately noticed, pursuant to 13054(b) of the Administrative
Code. The enclosed Notice Card shall remain posted at the site until the
waiver has been validated and no less than seven days prior to the Commission
hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

LOCATION: 2692 Bayshore Drive, City of Newport Beach. County of Orange
PROPOSED DEVELOPMENT:- Replacement of -an existing residential dock structure
with a new dock structure consisting ofa 10110.41 platform supported by two
approximately one -foot diameter -pre -stressed concrete piles, an aluminum
gangway, and a 102'x46' U-shaped timber dock supported by foam -filled
polyethylene pontoons and anchored by twelve..approximately one -foot diameter
guidepiles.
RATIONALE: The proposed development would not extend past the U.S. Pierhead
Line nor the U.S. Project Line, would not have significant adverse impacts on
coastal access, coastal resources, nor public recreation opportunities, and is. -
consistent with the City of Newport Beach Certified Land Use Plan, past
Commission actions in the area and the Chapter Three policies of the Coastal
Act.
This waiver will not become effective until reported to the Commission at their
May 9-12. 1995 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

On November 16, 1994, the City of Newport Beach City Council
approved the application by the J.A.W. Family Trust to revise the
pier and float bayward of 2692 Bayshore Drive. The relocation of
the dock and its eventual reconstruction conform to the City of
Newport Beach Municipal Code and the City Council's Harbor Permit
Policies and Standard Drawings. As a result, the above approval
and concept was given to the applicant.
Once the applicant has received the other required approvals from
concerned agencies, the City of Newport Beach will issue its final
permit for construction of the revised dock.

Re: Dock Relocation Permit
Dear Tony,
We have reviewed the drawing of the slip relocation at 2692
Bayshore Drive and we have also done an on-site inspection for
the proposed relocation.
According to the Deputy who made the inspection, we do not feel
that there is any negative impact with the proposed location as
it is represented in the drawings that were provided. However,
there is some concern about the size vessel that would be put in
the slip with reference to how far it would extend out into the
channel from the end of the dock. We understand that the
acceptable rule of thumb is that a boat may extend the length of
its beam. In this particular case, it is felt that anything over
ten feet may pose a hazard to the navigational channel at that
location. Please feel free to contact us should you have any
questions on this matter.

Discussion: -
This application is before the City Council as required by Section
5.B. of the Harbor Permit Policies which states:
S.B. "Prior approval of the City Council will be
required before the Marine Department may issue any
permit that does not conform to standard drawings and
the adopted Harbor Permit Policies.,,
In this particular location, the piers and boat slips may be
permitted to extend 20 feet channelward of the U. S. pierhead line.
However, in the past, based on navigational considerations,
previous permits at this location have been required to extend no
further bayward then the U. S. pierhead line.

the revised structure also extend no
further bayward then the U. S. pierhead line, and after review by
the Orange County Sheriff's Harbor Patrol, it was recommended that
an additional condition be placed on the permit to limit bayward
extension from the slip to ten feet. Again, this restriction will
reduce the potential for hazards to navigation.

Dear Captain Mann,
Attached for your information is a conceptual drawing by an
architect for the applicant and property owner at 2692 Bayshore
Drive. As the drawing for the applicant indicates, the new owner
of the property wishes to relocate and enlarge the dock bayward of
his residence. My concern, even though the dock does fit within
the Harbor Permit Policies, is does this dock present any kind of
a navigation issue relative to the channel between the docks on
that side of Bayshore and the offshore.moorings?
In addition to the above, are there other concerns that the Harbor
Department might have relative to this revision of an existing
structure.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0130-2692-1 for the property located at
2692 Bayshore Drive, Newport Beach, CA. The facility was inspected
on August 13, 1994.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. The electrical receptacles must be GFI.-for use in a water
environment.
2. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed.
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
The Newport Beach City Council Harbor Permit Policies state:
10.D . "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer��of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred. Please forward to us the orignal signed
transfer cards.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments—Section 30624.7 of the Coastal Act
Based on your project plans and information -provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will -become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #-1-91-586 APPLICANT: Frank Celeberti
LOCATION: 2692 Bayshore Dr., Newport Beach, Orange County.
PROPOSED DEVELOPMENT: Relocate existing boat dock. New location will be no
further channelward than the existing.dock configuration.
RATIONALE: The proposed development will have no adverse impacts on coastal
access or resources, is consistent with the City's certified LUP, with the
Chapter 3 policies of the Coastal Act and past Commission actions in the area.
This waiver will not become effective until reported to the Commission at their
October 8-11, 1991 . , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

The New dock as proposed would be acceptable as long as the vessel
does not extend beyond end of the slip. If the vessel should
extend out it could present a hazard to navigation. An alternative
may be to rotate the dock further to eliminate any potential
blockage�of the channel.

Attached for your information is a copy of the proposed revision to
the dock at 2692 Bayshores Drive. As the drawing indicates, the
applicant wishes to swing. the dock 90 degrees and place it
perpindicular to the bulkhead. our concerns are that if you put a
boat at the slip and allow it to ' extend beyond the end of the pier
the width of the beam, as allowed by Council permit policy, a
vessel could extend 20 feet beyond the dock structure. Would this
have a potential f or navigation problems between the boat and
traffic which haf�� restricted due to the county moorings in t-hert
area? zi��
