Commission staff have received information submitted as evidence of compliance with Coastal
Development Permit 5-99-282 and/or as evidence of conformance with Consistency Certification
CC -078-99 for the following sites in the City of Newport Beach:

Commission staff have reviewed the information submitted and determined that the above
referenced dredging event conforms with Consistency Certification CC -078-99 and that no further
federal consistency review is necessary from the Commission for the dredging component of the
project. In addition, the proposed beach disposal has been reviewed and found by the Executive
Director to be consistent with Special Conditions 1, 2, and 3 of Coastal Development Permit 5-99-
282. No further review is necessary from the Commission for the beach disposal component of
the project.
Please be advised that only the project described in the materials submitted for the site listed
above have been found to conform with Consistency Certification CC -078-99 and/or conform with
the terms and conditions of Coastal Development Permit 5-99-282. Any change in the project may
cause it to lose its status as consistent with CC -078-99 and/or CDP 5-99-282. This certification is
based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring
at that time must cease until a new determination regarding conformance with CC -078-99 and/or
CDP 5-99-282 is obtained.

Dear Lisa:
On May 2, the City of Newport Beach inspected the dredging project at the above
address and at that inspection we found Eelgrass within the proposed dredging
location. As a result, we are not able to process the appl ' ication. Our permit does
not allow dredging under the maintenance -dredging permit within 15 feet of
Eelgrass.

Reference is made to your letter dated November 26, 1998 in which you submitted on
behalf of Mr. Norman Williamson who resides at 1008 W. Bay Ave., Newport Beach, a
notification for the maintenance dredging of 120 cubic yards of sand and silt material by
hydraulic suction and disposal of the dredged material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Williamson's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Reference is made to your letter received August 24, 1993,
in which you submitted on behalf of Mr. Hutchinson at 2702
Bayshore Drive, a grain size analysis performed for the
maintenance dredging of 250 cubic yards of material and disposal
of the dredged material at the LA -3 ocean disposal site. By
providing this analysis, which you indicated was inadvertently
left out of the permit notification to the Corps, the City of
Newport Beach has demonstrated compliance with Special Condition
14.b.1 of General Permit #89 -211 -GS.
Based on the furnished information, we have determined that
the proposed maintenance dredging activity complies with the
terms and conditions of Permit No. 89 -211 -GS provided Mr.
Hutchinson does not exceed the maximum dredging design depth of
-5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Dear Mr. Melum:
Reference is made to your letter dated June 18, 1993, in
which you notified the Corps of Engineers that J.H. Hutchinson
intends to maintenance dredge approximately 250 cubic yards of
material by hydraulic suction from 2702 Bayshore Drive, City of
Newport Beach, Orange County, California with disposal of the
material at the LA -3 ocean disposal site.
According to Special Condition No. 14.b.l. of the City of
Newport Beach's general permit, COE #89 -211 -GS, a grain size
analysis was to be performed to characterize the sediment to be
dredged. For the project to be excluded from further testing (40
CFR Part 260), you must demonstrate that the sediment is
composed predominately of sand, gravel, rock, or any other
naturally occurring bottom material. Due to the lack of an
analysis, the Corps has insufficient information to determine if
the project complies with the terms and conditions of general
permit 89 -211 -GS and the rules and regulations of the Marine,
Protection, Research and Sanctuaries Act of 1972 (40 CFR Parts
220-220). There fore, J.H. Hutchinson may not commence dredging
and disposal operations.

The City of Newport Beach Marine Department has recived a request
to transfer pier permit # 130-2702 for the property located at
2702 Bayshore Drive, �,-Newport Beachr CA.
We cannot transfer the pier permit until the following -
deficiencies have been corrected:
1- A City approved anti -syphon device must be installed at the
2. water connection to the pier and float.
3. The telephone line must be completely out of the water, in conduit.

The structure was inspected on - 10/19/87- and in accorda . nce
with Section 10-D of the Harbor Permit Policies it cannot be
transferred until it meets City requirements.
10.D."At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of
the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.ff

Building Department of the City.

On April 30, 1979 the City of Newport Beach issued Harbor Per-
mit #130-2702 for the construction of a pier and float at 2702
Bayshore Drive. Ordinarily, the City would not have issued its
permit until the applicant had acquired a County Permit, as the
structure will be on County tidelands. In this case, however.,
the City permit was issued and it is my understanding that an
application for a County Permit has never been made.
I am bringing this to your attention in order for you to contact
the property owner and have him apply for the required County
Permit.

Recommendation
.If desired, approve the maintenance dredging applications.
Discussion
The application requires City Councilapproval under the conditions of
approval placed on the City of Newport Beach general permit for maintenance
dredging issued by the,U.S. Army Corps of Engineers, on February 12, 1974,
and subsequently amended on May 10, 1977 to allow beach restoration. The
locations and applicants for the proposed dredging and beach restorations
are:
130-2702 James Dean ' e, 2702 Bayshore Drive
144-22 Gary Myers, #22 Harbor island
The staff has reviewed the projects and has determined that the work will be
done within the parameters of the Corps of Engineers permit. The dredging
contractor will place a filter screen around the discharge site to control
turbidity. There is no known eel grass in the vicinity of the projects.
At 2702 Bayshore Drive, the dredged material will be placed on adjacent beaches.
This will aide in the restoration of beaches bayward of private residences.
At #22 Harbor Island, the dredged material will be hauled to sea and dumped.

the California Coastal Act of 1976. -
2. If located between the nearest public road and the sea or shore-
line of any body of water located within the coastal zone, the
development is in conformity with the public access and public
recreation policies'of Chapter 3 of the California Coastal Act of
1976.
3. There are no feasible alternatives, or feasible mitigation
measures, as provided in the California Environmental Quality
Act, available for imposition by this Commission under the
power granted to it which would substantially lessen any signi-
ficant adverse impact that the development, as finally proposed
may have on the environment.
EII. Whereas, at a public hearing, held on March 19, 1979 at

DISCUSSION
These applications require City Council approval u nder the conditions
of approval of the City of Newport Beach "blanket" permit for main-
tenance dredging issued on February 12, 1974, by the U. S. Army Corps
of Engineers.

108-2124 - Mr. Byron Farwell, 2124 E. Balboa Blvd.
130-2702 - Mr.. Charles Mottl, 2702 Bayshore Drive
The staff has reviewed the proposed dredging and has determined that
the work to be done is within the parameters of the Corps of Engineers
permit. There is no anticipated adverse affect on proximity beaches
or contiguous bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidity
as much as is possible and will barge the dredged material to the
Environmental Prote ction Agency's designated disposal site, four
miles at sea.
