We cannot transfer the pier permit until the following deficiencies have been corrected and the property has been re -inspected: 1. It needs a new testable Backflow Prevention Device installed (please see diagram). The Newport Beach City Municipal Code 17.60.030 states: CA. Prior to the transfer of an annual pier permit, all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All structural deficiencies must be corrected prior to the transfer of the permit. A fee will be charged for this inspection, established by Resolution of the City Council. Please call 949-644-3044 to request a reinspection. Once the property has passed reinspection and we have the signed application, the pier will be transferred. The floating dock will only be used for boating related purposes. . RATIONALE: The subject site is a lot located between the first public road and the sea and is a bayfront lot. The subject site is also located in the locked gate community of Bay Shores in the City of Newport Beach. No public access currently exists through the site. However, the project will have no impacts on existing coastal access. Public access to the harbor exists in the area across the channel from the Bayshores community along the public walkways on Lido Island and Balboa Island. An inspection by the City of Newport Beach Fire and Marine Department states that no eel grass is present in the project area, thus no eel grass will be impacted by the proposed project. In addition, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The Regional Water Quality Control Board has also received a statement stating that there will be no waste discharged from the proposed project. The proposed project design is compatible with the character of surrounding development and does not have any negative affects on visual or coastal resources, public recreation or coastal access. Also, the proposed development will not prejudice the City's ability to prepare a Certified Local Coastal Program and is consistent with the land use designation in the City's certified Land Use Plan, past Commission actions in the area and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their November 14-17, 2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to 1 3054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing. We cannot transfer the pier permit until the following deficiencies have been corrected and we have been notified of the corrections: The dock has been modified from the structure approved by the City of Newport Beach. The original U -shape slip has been decked over and a new slip has been constructed adjoining the original dock. To retain this revision, an application to revise the dock must be obtained from the City of Newport Beach Building Department and submitted to that department. This application will require the approval of the various Federal & State agencies. The only other option is to return the structure to the original design approved by the City. The pier must have a backflow prevention device in accordance with Title 17 of the California Administrative Code. A drawing showing the approved installation technique and approved devices is attached to this letter. The Newport Beach City Council Harbor Permit Policies require that at the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum standards, and the conditions of the existing permit.
