BROWN, JR., GOVERNOR ONE Page 1 Date: November 26, 2014 Permit Application No.: 5-14-0522 NOTICE OF INTENT TO ISSUE PERMIT (U on satisfaction of special conditions) THE SOLE PURPOSE OF THIS NOTICE IS TO INFORM THE APPLICANT OF THE STEPS NECESSARY TO OBTAIN A VALID AND EFFECTIVE COASTAL DEVELOPMENT PERMIT ("CDP"). A Coastal Development Permit for the development described below has been approved but is not yet effective. Development on the site cannot commence until the CDP is effective. In order for the CDP to be effective, Commission staff must issue the CDP to the applicant, and the applicant must sign and return the CDP. Commission staff cannot issue the CDP until the applicant has fulfilled each of the "prior to issuance" Special Conditions. A list of all the Special Conditions for this permit is attached. The Commission's approval of the CDP is valid for two years from the date of approval. To prevent expiration of the CDP, you must fulfill the "prior to issuance" Special Conditions, obtain and sign the CDP, and commence development within two years of the approval date specified below. You may apply for an extension of the permit pursuant to the Commission's regulations at Cal. Code Regs. title 14, section 13169. On November 14, 2014, the California Coastal Commission approved Coastal Development Permit No. 5-14-0522 requested by Kevin Moriarty subject to the attached conditions, for development consisting of: Demolition of an existing 764 sq. ft. 'U" shaped boat dock system, three 12 -in. square concrete dock piles, and two 12 -in. "T" piles, and installation of a new 994 sq. ft. 'U" shaped boat dock system, three -16 -in. square concrete piles and two 16 -in. 'T" piles. Total water coverage would be increased by 230 sq. ft. more specifically described in the application filed in the Commission offices. Commission staff will not issue the CDP until the "prior to issuance" special conditions have been satisfied. Date Permittee Please sign and return one copy of this form to the Commission office at the above address. STANDARD CONDITIONS i. Notice of Receipt and Acknowledgment. The permit is not valid and development shall not commence until a copy of the permit, signed by the permittee or authorized agent, acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to the Commission office. 2. Expiration. If development has not commenced, then permit will expire two years from the date on which the Commission voted on the application. Development shall be pursued in a diligent manner and completed in a reasonable period of time. Application for extension of the permit must be made prior to the expiration date. 3. Interpretation. Any questions of intent or interpretation of any condition will be resolved by the Executive Director or the Commission. 4. Assignment. The permit may be assigned to any qualified person, provided assignee files with the Commission and affidavit accepting all terms and conditions of the permit. 5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and it is the intention of the Commission and the permittee to bind all future owners and possessors of the subject property to the terms and conditions. (Upon satisfaction of special conditions) Date: November 26, 2014 Permit Application No.: 5-14-0522 Page 3 SPECIAL CONDITIONS: This permit is granted subject to the following special conditions: 1. Revised Project Plans. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit, for the review and approval of the Executive Director, two (2) sets of final revised project plans. The intent behind the required revised project plans is to minimize water coverage of the proposed new dock. The existing 3' x 16' headwalk section will be eliminated and replaced with two 4'. x 4' knee structures. The revised project plans shall be in substantial conformance with the plans submitted on -September 12, 2014. The revised plans submitted to the Executive Director shall bear evidence of Approval -in -Concept of the revised design from the City of Newport Beach Harbor Resources Division. The permittee shall undertake development in accordance with the approved final plans. Any proposed changes to the approved final plans shall be reported to the Executive Director. No changes to the approved final plans shall occur without a Commission amendment to this Coastal Development Permit unless the Executive Director determines that no amendment is legally required. 2. Newport Tidelands Encroachment Permit from the County of Orange. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit, for the review and approval of the Executive Director, a copy of the Newport Tidelands Encroachment Permit from the County of Orange regarding the proposed project, or a letter of permission; or evidence that no permit or permission is required. The applicant shall inform the Executive Director of any changes to the project required by the County of Orange. Such changes shall not be incorporated into the project until the applicant obtains a Commission amendment to this coastal development permit amendment, unless the Executive Director determines that no amendment is legally required. 3. Pre -Construction Eelgrass Survey. A valid pre -construction eelgrass (Zostera marina) survey shall be completed during the period of active growth of eelgrass (typically March through October). The pre -construction survey shall be completed prior to the beginning of construction and shall be valid until the next period of active growth. If any portion of the project commences in a previously undisturbed area after the last valid eelgrass survey expires, a new survey is required prior to commencement of work in that area. The survey shall be prepared in full compliance with the "Southern California Eelgrass Mitigation Policy" Revision 8 (except as modified by this special condition) adopted by the National Marine Fisheries Service and shall be prepared in consultation with the California Department of Fish and Game. The applicant shall submit the eelgrass survey for the review and approval by the Executive Director within five (5) business days of completion of each eelgrass survey and in any event no later than fifteen (15) business days prior to commencement of any development. If the eelgrass survey identifies any eelgrass within the project area, which would be impacted by the proposed project, the development shall require an amendment to this permit from the Coastal Commission or a new Coastal Development Permit. If any eelgrass is identified in the project area by the survey required by this special condition, within one month after the conclusion of construction, the applicant shall survey the project site to determine if any eelgrass was adversely impacted. The survey shall be prepared in full compliance with the "Southern California Eelgrass Mitigation Policy" Revision 8 (SCEMP) (except as modified by this special condition) adopted by the National Marine Fisheries Service and shall be prepared in consultation with the California Department of Fish and Game. The applicant shall submit the post -construction eelgrass survey for the review and approval by the Executive Director within thirty (30) days after completion of the survey. If any eelgrass has been impacted, the applicant shall replace the impacted eelgrass at a minimum 1.2:1 ratio on-site, or at another location, in accordance with the SCEMP. All impacts to eelgrass habitat shall be mitigated at a minimum ratio of 1.2:1 (mitigationdmpact). The exceptions to the required 1.2:1 mitigation ratio found within SCEMP shall not apply. Implementation of mitigation shall require an amendment to this permit or a new Coastal Development Permit unless the Executive Director determines that.no amendment or new permit is legally required. 4. Pre -Construction Caulerpa Taxifolia Survey. Not earlier than 90 days nor later than 30 days prior to commencement or re -commencement of any development authorized under this Coastal Development Permit (the "project"), the applicant shall undertake a survey of the project area and a buffer area at least 10 meters beyond the project area to determine the presence of the invasive alga Caulerpa Taxifolia. The survey shall include a visual examination of the substrate. If any portion of the project commences in a previously undisturbed area after the last valid Caulerpa Taxifolia survey expires, a new survey is required prior to commencement of work in that area. The survey protocol shall be prepared in consultation with the Regional Water Quality Control Board, the California Department of Fish and Game, and the National Marine Fisheries Service. Within five (5) business days of completion of the survey, the applicant shall submit the survey: (1) for the review and approval by the Executive Director; and (2) to the Surveillance Subcommittee of the Southern California Caulerpa Action Team (SCCAT). The SCCAT Surveillance Subcommittee may be contacted through William Paznokas, California Department of Fish & Game (858/467-4218) or Robert Hoffinan, National Marine Fisheries Service (562/980-4043), or their successors. If Caulerpa Taxifolia is found within the project or buffer areas, the applicant shall not proceed with the project until 1) the applicant provides evidence to the Executive Director that all Caulerpa Taxifolia discovered within the project and buffer area has been eliminated in a manner that complies with all applicable governmental approval requirements, including but not limited to those of the California Coastal Act, or 2) the applicant has revised the project to avoid any contact with Caulerpa Taxifolia. No revisions to the project shall occur without a Coastal Commission approved amendment to this Coastal Development Permit unless the Executive Director determines that.no amendment is legally required. The permittee shall comply with the following construction related requirements: A. No demolition or construction materials, equipment, debris, or waste shall be placed or stored where it may enter sensitive habitat, receiving waters or a storm drain, or be subject to wave, wind, rain or tidal erosion and dispersion. B. Any and all debris resulting from demolition or construction activities, and any remaining construction material, shall be removed from the project site within 24 hours of completion of the project. C. Demolition or construction debris and sediment shall be removed from work areas each day that demolition or construction occurs to prevent the accumulation of sediment and other debris that may be discharged into coastal waters. D. Machinery or construction materials not essential for project improvements will not be allowed at any time in the intertidal zone. E. If turbid conditions are generated during construction a silt curtain will be utilized to control turbidity. F. Floating booms will be used to contain debris discharged into coastal waters and any debris discharged will be removed as soon as possible but no later than the end of each day. G. Non buoyant debris discharged into coastal water_ s will be recovered by divers as soon as possible after loss. H. All trash and debris shall be disposed in the proper trash and recycling receptacles at the end of every construction day. I. The applicant shall provide adequate disposal facilities for solid waste, including excess concrete, produced during demolition or construction. J. Debris shall be disposed of at a legal disposal site or recycled at a recycling facility. If the disposal site is located in the coastal zone, a Coastal Development Permit or an amendment to this permit shall be required before disposal can take place unless the Executive Director determines that no amendment or new permit is legally required. K. All stock piles and construction materials shall be covered, enclosed on all sides, shall be located as far away as possible from drain inlets and any waterway, and shall not be stored in contact with the soil. L. Machinery and equipment shall be maintained and washed in confined areas specifically designed to control runoff. Thinners or solvents shall not be discharged into sanitary or storm sewer systems. M. The discharge of any hazardous materials into any receiving waters shall be prohibited. N. Spill prevention and control measures shall be implemented to ensure the proper handling and storage of petroleum products and other construction materials. Measures shall include a designated fueling and vehicle maintenance area with appropriate berms and protection to prevent any spillage of gasoline or related petroleum products or contact with runoff. The area shall be located as far away from the receiving waters and storm drain inlets as possible. Best Management Practices (BMPs) and Good Housekeeping Practices (GHPs) designed to prevent spillage and/or runoff of demolition or construction -related materials, and to contain sediment or contaminants associated with demolition or construction activity, shall be implemented prior to the on -set of such activity. P. All BMPs shall be maintained in a functional condition throughout the duration of construction activity. 6. Best Management Practices (BMPs) Program. By acceptance of this permit the applicant agrees that the long-term water -borne berthing of boat(s) in the approved boat dock and/or boat slip will be managed in a manner that protects water quality pursuant to the implementation of the following BMPs. A. Boat Cleaning and Maintenance Measures: In -water top -side and bottom -side boat cleaning shall minimize the discharge of soaps, paints, and debris; 2. In -the -water hull scraping or any process that occurs under water that results in the removal of paint from boat hulls shall be prohibited. Only detergents and cleaning components that are designated by the manufacturer as phosphate -free and biodegradable shall be used, and the amounts usedminimized; and 3. The applicant shall minimize the use of detergents and boat cleaning and maintenance products containing ammonia, sodium hypochlorite, chlorinated solvents, petroleum distillates or lye. B. Solid and Liquid Waste Management Measures: 1. All trash, recyclables, and hazardous wastes or potential water contaminants, including old gasoline or gasoline with water, absorbent materials, oily rags, lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits shall not at any time be disposed of in the water or gutter but, rather be disposed of in a manner consistent with state and/or federal regulations. C. Petroleum ControlManagementMeasures: 1. Boaters will practice preventive engine maintenance and will use oil absorbents in the bilge and under the engine to prevent oil and fuel discharges. Oil absorbent materials shall be examined at least once a year and replaced as necessary. Used oil absorbents are hazardous waste in California. Used oil absorbents must therefore be disposed in accordance with hazardous waste disposal regulations. The boaters shall regularly inspect and maintain engines, seals, gaskets, lines and hoses in order to prevent oil and fuel spills. If the bilge needs more extensive cleaning (e.g., due to spills of engine fuels, lubricants or other liquid materials), the boaters will use a bilge pump -out facility or steam cleaning services that recover and properly dispose or recycle all contaminated liquids; and 3. Bilge cleaners which contain detergents or emulsifiers will not be used for bilge cleaning since they may be discharged to surface waters by the bilge pumps. NOTE:. The existing dock system was likely constructed over 30 years ago and consists of an access pier and gangway connecting to a "U" shaped floating dock. The dock extends approximately 73.9', within two feet of the Federal Project line, and is supported by five 12" x 12" concrete piles. The existing dock is set back approximately 10.3' to the southern property line, and approximately 25.4' to the northern property line. The Existing Dock exhibit depicts the layout and dimensions of the existing dock. The access pier, gangway and dock are covered by plywood and a deck coating material. The combined total water and bottom coverage, including the piles is approximately 764 square feet. The existing gangway and dock structure have been weakened by age and have reached the end of their safe and useful life. The proposed project consists of essentially the same components as currently exists, including an access pier, gangway and "U" shaped floating dock to be supported by five 14" x 14" concrete piles. The proposed dock will be longer than the existing dock, by reorienting the gangway and moving the floating dock approximately 20' closer to the existing seawall. The proposed dock will be set back approximatley 8' to the southern property line, and approximately 23.4' to the northern property line. The proposed dock will be approximately 1' longer than the existing dock to 74.9', but will not extend beyond the project line of 75.9'. The Proposed Dock exhibit depicts the proposed dock plan. While the new dock structure will be larger than the existing dock with an overall area of approximately 1,086 square feet, the proposed dock system will be covered with Global Grid Decking. which allows light to penetrate to the water surface and significanity reduces the effect of shading when compared to the existing dock system. Using a factor of 60 percent for light penetration, the total water and bottom coverage of the proposed dock system, including the required piles, is approximately 834 square feet. No dredging is proposed at this time; dredging will be pursued under the City's anticipated Regional General Permit. The Overall Layout and Access exhibit depicts the the Swales Marina, located northerly of Mr. Moriarty's property. As indicated above, the propsoed dock will be 23.4' from the property line which is two feet less than the existing setback. The Overall Layout and Access exhibit depicts an outline of the largest boat possible (70') that could be accommodated at the proposed dock, showing the navigable space for the small boats entering the Swales Marina. The setback of 23.4' from the property line could easily accommodate a large vessel and still allow for access to the small slips located between the seawall and the marina. This application includes the City's Worksheet for Builiding Permit Application, draft Notice of Exemption, Vicinity Map, and the Dock Replacement exhibits referenced above, prepared by Bellingham Marine. An Eelgrass and Caulerpa survey was conducted by Professional Ecological Sampling Consultnats International in October 2012. That survey is attached and confirms that no Eelgrass or invasive algae were found on the property at that time. It is understood that the Southern California Eelgrass Mitigation Policy requires timely pre and post construction surveys for Eelgrass and invasive algae and we request that the City's AIC be conditioned to insure compliance with that policy and allow for future pre and post construction surveys. Based on the information you have provided, I have determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54 -Maintenance Dredging and Beach Nourishment. As long as you comply with the terms and conditions of RGP No. 54, an individual permit is not required. A copy of RGP No. 54, including terms and conditions related to ocean disposal of dredged sediment, is available at htty://www.spl.usace.army.mi]/Portals/17/docs/re ug latory/RGP/RGP54.pdf. Specifically, you are authorized to dredge up to approximately 455 cubic yards of sediment from approximately 0.1 acre of non -wetland waters of the United States using an excavator, barge, dump scow, and tug boat and dispose of the dredged material at the LA -3 Ocean Dredged Material Disposal Site (Figure 2). Furthermore, you must comply with the following non -discretionary Special Conditions: 1. This letter of verification is valid through December 20, 2015. 2. A new pre -construction Caulerpa (Caiderpa !ax folia) survey shall be conducted in accordance with the Caulerpa Control Protocol (http://www.westcoast.fisheries.noaa goy/publications/liabitat/cauleipa taxifolia/caulerpa contr of protocol 4 .pdi and submitted to the Corps Regulatory Division before project -related activities continence. Within 45 calendar days of completion of authorized work in waters of the United States, the Permittee shall submit to the Corps Regulatory Division a post -project implementation memorandum including the following information: A. Date(s) work within waters of the United States was initiated and completed; B. Summary of compliance status with each special condition of this permit (including any noncompliance that previously occurred or is currently occurring and corrective actions taken or proposed to achieve compliance); and C. One copy of "as built" drawings for the entire project. Electronic submittal (Adobe PDF format) is preferred. All sheets must be signed, dated, and to -scale. If submitting paper copies, sheets must be no larger than 11 x 17 inches. 4. Pursuant to 36 C.F.R. section 800.13, in the event of any discoveries during construction of either human remains, archeological deposits, or any other type of historic property, the Pennittee shall notify the Corps' Archeology Staff within 24 hours (Steve Dibble at 213-452- 3849 or John Killeen at 213-452-3861). The Permittee shall immediately suspend all work in any area(s)where potential cultural resources are discovered'. Payment is enclosed with this letter. www.anchorgea.com Ms. Lisa Walters March 27, 2013 Page 2 PROPOSED PROJECT INFORMATION The proposed project is located in Lower Newport Bay adjacent to a residential unit at 2782 Bayshore Drive, Newport Beach, California (Figure 1). The proposed project would replace the existing dock currently used for berthing of recreational vessels by the property owner. The existing dock is highly unstable due to its narrow design and having reached the end of its design life. In its current condition, the dock cannot safely accommodate elderly people, children, or multiple concurrent users. To improve access and user safety, the proposed project would remove and replace the existing dock with a slightly larger and more stable dock. The proposed dock is being designed consistent with current standards and building codes and to fit within the property boundaries while providing safe access and berthing of the owner's recreational vessels. The proposed dock layout is shown on Figure 2 and a cross section is depicted in Figure 3. The proposed project does not involve dredging or discharges of dredged or fill material. Description of Activities The existing structure is supported by five concrete piles (three guide piles for the dock and two support piles for the fixed pier) and has an area of 744 square feet. Based on current conceptual -level drawings, the larger replacement structure is anticipated to be supported by approximately 12 concrete piles (six guide piles for the dock and six support piles for the pier) and have an area of approximately 1,500 square feet. Pile heights would be consistent with other piles in the area. Project activities would consist of: • Disassembling the existing decking in water and transporting it to an approved upland disposal site. • Removing the existing concrete guide and support piles and installing new concrete piles. New piles would likely be installed using a combination of jetting and driving methods using a pile -driving barge, which would act as a staging area for pile driving and equipment storage. Based on an average rate of six to eight piles driven per day, installation and removal of the piles is anticipated to take approximately 2 days to complete. 0 Installing the replacement dock and pier. Ms. Lisa Walters March 27, 2013 Page 3 Construction is anticipated to begin in spring 2013 and would be completed by summer 2013. The proposed project requires approval from various local, state, and federal agencies. We intend to submit applications to the U.S. Army Corps of Engineers for a Section 10 Letter of Permission, Regional Water Quality Control Board for a Section 401 Water Quality Certification, California Coastal Commission for a Coastal Development Permit, and County of Orange for an Encroachment Permit. Eelgrass A Caulerpa taxifolia (Caulerpa) and eelgrass (Zostera marina) survey was conducted during the prior growing season on October 13, 2012 (Attachment A). While no Caulerpa was observed, one small patch of eelgrass was found south of the existing dock outside of this parcel. The location of the eelgrass is shown on Figure 2. The proposed project is being designed to avoid all impacts to eelgrass. As such, the proposed replacement dock would not encroach on or result in shading of existing eelgrass. Additional pre -construction (within 60 days prior to construction) and post -construction (within 30 days following construction) surveys would be conducted for Caulerpa and eelgrass as required by the Southern California Eelgrass Mitigation Policy (SCEMP) and the Caulerpa Control Protocol (CCP). Should these surveys detect eelgrass within the proposed dock footprint, SCEMP policies would be followed, as appropriate. This combination of decent light and visibility allowed us to have a clear view of the sea bottom on all swimming transects and we covered 90% of the survey area. The water temperature on all dives varied between 18-20 ° C (66-68° F). Water depth varied from -2ft to -12.5 ft MLLW. No Cauderpa was observed in the survey area. A small amount of Zostera was encountered and mapped on the west side of the study area. A Google Maps -compatible Amz files of the track lines and of the Zostera patches are attached for your convenience. Also attached is a PDF of the Caulerpa Survey Reporting Form for the project. Biota along all swimming transects was typical of a soft -bottom shallow water habitat in southern'California.The epibenthos was patchily covered with"thin algal mats inhabited by sedentary invertebrates, Iconsisting of various clam dwellings and tube anemones (Pachycerlanthus sp.). Some motile invertebrates were observed including the seaslug navanax (Navanax inermi.$) and the California sea bare (Aplysia californica). Also observed were round stingray (Urobatis halleri) and top smelt (Atherinops anis). No marine mammals, brown pelicans (Pelecanus occidentalis), or California least terns (Sterna antillarum) were observed on the day of the survey. This fee was established in order that the City could maintain comprehensive records on all permits in Newport Harbor, conduct periodic inspections, and enforce all laws and regulations regarding the harbor. This fee, in 1971, was $10.00 annually. It was raised in 1976 to $15.00 and in 1983 to $30.00. Because it is a fee for administration, maintenance, and improvement of the harbor exclusively, it is not subject to the restrictions of Proposition 13.
