Ladies and Gentlemen:
This letter is being written in connection with the above
referenced harbor permit issued by the City of Newport Beach (the
("City") to the Irvine Company in relation to the Balboa Marina,
located in Newport Beach, California.
The City of Newport Beach Municipal Code requires that the Harbor
Permit for structures bayward of private property be in the name
of the upland property owner or long term lessee. If the upland
property owners or long term lessees should divest themselves of
such private property ownership, they would no longer be able to
retain the Harbor Permit in their name. If this divesting is a
result of a foreclosure sale, in the past the City has transferred
the Harbor Permit from our existing permittee to the new property
owner and to subsequent transferees who have acquired the
property.
Barring unforeseen circumstances I see no reason at this time why
Security Pacific National Bank could not become the Harbor
Permittee if at some future date they should foreclose on Irvine
Company property adjacent to the marinas listed above. This i's
all specifically spelled out in Section 17.24.030 of the Newport
Beach Municipal Code.
This letter will also serve to confirm that the permit listed
above is issued pursuant to Chapter 17.24 of Title 17 of the
municipal Code and as of this.date the permit constitute the only
permit which the Irvine Company is required to obtain from the
City Marine Department in order to carry on its business as
presently conducted in connection with the marina. To my knowledge
the Irvine Company is in compliance with all relevant provisions
of the Municipal Code and any other City Council Policy Sections
administered by this department relating to its ownership and
operation of the marina.

If desired, approve the maintnance dredging application, and the hauling of
the dredged material to sea4
Discussion:
The application requires City Council approval under the conditions of ap-
proval.placed on the City of Newport Beach,general permit for maintenance
dredging issued by the U. S. Army Corps of Engineers, on February 12, 1974,
and subsequently amended on May 10, 1977, to allow beach restoration. The
location and applicant for the proposed dredging is.
132-201 California RecreationCo. 201 East Coast Highway
The staff has reviewed the project and has determined that the work will
be done within the parameters of the Corps of Engineers' permit. The dredging
contractor will place a filter screen around the dredge area to control turbid-
ity. There is no known eel grass in the vicinity of the project.
All dredged material will be hauled to sea and dumped.

Dear Mr. Harshbarger:
We hereby request an amendment to Construction Permit No. 132-201 to allow
for installation of approximately 1,200 linear feet of 5 -foot high tubular
steel security fencing and three (3) gates. The fence is to be secured on
the bay side of the bulkhead with "redheads".
All construction will be completed off-site. Installation should take no
more than two (2) days.
With your approval, installation will be scheduled on or about August 4, 1980.
The contractor has been instructed to keep all materials and debris out of the
water.
Please contact the undersigned if further clarification is required.

contacted Mr. Charles Holt of the Corps of Engineers . regarding
their apparent failure to include our request that pump -out
facilities were necessary at Balboa Marina. Mr. Holt indicated
that the omission was an oversight, but Condition I of the
permit should have been enough direction for you to comply with
our letter dated November 26, 1979 (a copy of which is enclosed).
You are, therefore, requested to provide the pump -out station
for your new Balboa Marina prior to its use. By copy of this
letter we are requesting the City of Newport Beach to cooperate
in this matter.

This Board will recommend that the State Water Resources Control Board require
a pump out station to protect water quality, in accordance with Section 2833,
Title 23, California Administrati've Code.

or modified during the term of this permit, be modified, if necessary, to conform with such revised or modified water quality S�tandarcls
within 6 months of the effective date of any revision or modification of water quality standards, or as directed by an implementat on
plan contained in such revised or modified standards, or within such longer period of time as the District Engineer, in consultation with
the Regional Administrator of the Environmental Protection Agency, may determine to be reasonable under the circumstances.
. d. That the discharge will not destroy a threatened or endangered species as identified under the Endangered Species Act, or
endanger the critical habitat of such species.
e. That the permittee agrees to make every reasonable effort to prosecute the construction or operation of the work authorized
herein in a manner so as to minimize any adverse impaqt on fish, wildlife, and natural environmental values.
f. That the permittee agrees that he will prosecute the construction or work authorized herein in a manner so as to minimize any
degradation of water quality.
9. That the permittee shall permit the District Engineer or his authorized representative(s) or designee(s) to make periodic
inspections at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in
accordance with the terms and conditions prescribed herein.
h. That the permittee shall maintain the structure or work authorized herein in good condition and in accordance with the plans and.
drawings attached hereto.
i. That this permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and that it does
not authorize any injury to property or invasion of rights or any infringement of Federal, State, or local laws or regulations nor does it
obviate the requirement to obtain State or local assent required by law for the activity authorized herein.
j. That this permit may be summarily suspended, in whole or in part, upon a finding by the District Engineer that immediate
suspension of the activity authorized herein would be in the general public interest. Such suspension shall be effective upon receipt by
the permittee of a written notice thereof which shall indicate (1 ) the extent of the suspension, (2) the reasons for this action, and
(3) any corrective or preventative measures to be taken by the permittee which are deemed necessary by the District Engineer to abate
imminent hazards to the general public interest. The permittee shall take immediate action to comply with the provisions of this notice.
Within ten days following receipt of this notice of suspension, the permittee may request a hearing in order to present information
relevant to a decision as to whether his permit should be reinstated, modified or revoked. If a hearing is requested, it shall be conducted
pursuant to procedures prescribed by the Chief of Engineers. After completion of the hearing, or within a reasonable time after issuance
of the suspension notice to the permittee if no hearing is requested, the permit will either be reinstated, modified or revoked.
k. That this permit may be either modified, suspended or revoked in whole or in part if the Secretary of the Army or his authorized
representative determines that there has been a violation of any of the terms or conditions of this permit or that such action would
otherwise be in the public interest. Any such modification, suspension, or revocation shall become effective 30 days after receipt by the
permittee of written notice of such action which shall specify the facts or conduct warranting same unless (11 ) within the 30 -day period
the permittee is able to satisfactorily demonstrate that (a) the alleged violation of the terms and the conditions of this permit did not, in
fact, occur or (b) the alleged violation was accidental, and the permittee has been operating in compliance with the terms and conditions
of the permit and is able to provide satisfactory assurances that future operations shall be in full compliance with the terms and
conditions of this permit; or (2) within the aforesaid 30 -day period, the permittee requests that a public hearing be held to present oral
and written evidence concerning the proposed modification, suspension or revocation. The conduct of this hearing and the procedures
for making a final decision either to modify, suspend or revoke this permit in whole or in part shall be pursuant to procedures prescribed
by the Chief of Engineers.
1. That in issuing this permit, the Government has relied on the information and data which the permittee has provided in connection
with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be false, incomplete or
inaccurate, this permit may be modified, suspended or revoked, in whole or in part, and/or the Government may, in addition, institute
appropriate legal proceedings.
m. That any modification, suspension, or revocation of this permit shall not be the basis for any claim for damages against the
United States.
n. That the permittee shall notify the District Engineer at what time the activity authorized herein will be commenced, as far in
advance of the time of commencement as the District Engineer may specify, and of any suspension of work, if for a period of more than
one week, resumption of work and its completion.

d. That the permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the
authorized structure or work, shall, without expense to the United States and in such time and manner as the Secretary of the Army or
his authorized representative may direct, restore the waterway to its former conditions. If the permittee fails to comply with the
direction of the Secretary of the Army or his authorized representative, the Secretary or his designee may restore the waterway to its
former condition, by contract or otherwise, and recover the cost thereof from the permittee.

Dear Mr. Nyquist:
The investigation conducted by the Chief Inspector, Ted Kirkhart,
and myself on the morning of December 14 at the above -noted address
revealed some very hazardous conditions. The support pilings have
decayed to the point.that a high wind or minor earthquake would
cause collapse of the structure. The building presently shows con-
siderable evidence of distress due to settlement and failure of
structural members. The building is in sufficiently poor condition
that any occupancy should be abandoned as soon as possible.
The building may be relocated to a new p osition back of the bulkhead.
This, however, could prove to be costly due to the fact that reloca-
tion of the structure will establish a requirement that it be made to
comply with present codes. In my opinion, this would be economically
unfeasible. You may find it considerably less costly to remove the
existing structure and build a new complying building in its place.
If you need additional information regarding this matter, we will be
happy to discuss it at greater length.

ACTIVITY: Tinder Section 10 of the River and Harbor Act of 1899 to
perform the following:. remove an existing, commercial, floating wooden -
dock, facility (123 slips, ramps, and guide piles), one -(I) overhanging
building, and six (6) guide piles; construct a new commercial, floating
concrete -dock, facility (102 slips, 3 gangways, and 72 concrete guide
piles.) There will be no fueling facilities. Pump -out facilities will
be handled by use of a licensed, comp.Iny-owned and operated pump -out
vessel. All work will be done in the Balboa Marina Channel, Newport
Bay, -Pacific Ocean, at 201 East Coast Highway, City of Newport Beach,
Orange County, California, as shown on the attached drawing.
PURPOSE AND USE: To provide an adequate commerciaf boat docking facility
for the boating public.
FEDERAL,,STA,TE AND LOCAL AUTHORIZATION: Approvals have been received
from,the City of Newport Beach and the Santa Ana Regional Water Quality
Control Board. Approval will also. be required from the California
Coastal C ission, prior to issuing the permit.
ENVIRONMENTAL IMPACT: A Preliminary Environmental Assessment of the pro-
posed actionhas determined that some impacts would occur. Removal of
existing wooden docks and six pilings would eliminate the mature float
community attached to the structures. Installation of 72 concrete piles
would permanently eliminate about 77 square feet of benthic habitat. The
new pilings and floats would provide -substrate for.attached organisms
which should begin to colonize the structures immediately after project
completion. Hydraulic pile driving would generate turbid conditions in
the immediate project area with some mortality of benthic and nearby
attached organisms expected to occur. Motile organisms would be forcei
to temporarily leave the area of disturbance. A temporary increase in
the ambient noise level andimpairment of local air quality and aesthetics
would occur for the duration of project construction activities. Removal

of the existing docks would temporarily displace boats presently moored.
Replacement of the deteriorated dock system would benefit public safety
and local aesthetics.
Preliminary review of the proposed project indicates that this work
will not significantly affect the quality,of the human environment.
Therefore, an Environmental Impact Statement will not be, prepared -at
this time. Should significant additional information be developed
concerning the proposed.action or should the application be significantly
modified, the effect of the action will be reevaluated and a supple-
mental assessment will be prepared. The supplemental assessment may
conclude that an EIS is required.
IMPACT ON HISTORIC PLACES AND NATURAL LANDMARKS: The proposed -activity
is not near any of the sites listedin the.National Register of.Historic
Places or the National Registry of Natural Landmarks. Anyone,having
knowledge of archaeological, scientific, prehistoric or historic
materials in the immediate area should contact this office during the
comment period. The.permit (if issued) will include a condition that
if potentially significant findings are made during construction, work.
shall be suspended immediately. The findings shall be reviewed and
appropriate action will be taken.
CRITERIA: Your written comments or objections, should include -the number
and date of this notice and must reach thisoffice within t.hirty.(30)
calendar days. The,decision whether to issue a permit will be based on
an evaluation of the probable impact of the activity on the public
interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its r , easonably foreseeable detriments. All factors which may be
relevant to the activity will be considered; among those are conserva-
tion, economics, aesthetics, general environmental concerns, historic
values, fish and wildlife values, flood damage prevention, land use
classification, navigation, recreation, water supply, water quality,
and, in general, the needs and welfare of the people. No permit will
be granted unless its issuance is found -to be in the public interest.

This application is being brought to Council for revi'ew and action in
compliance with Section 5,C(3) which reads as follows:
"5C. Prior approval of the City Council will also be required
before issuing a permit for shore -connected structures when:
(3) The abutting upland property is zoned commercial.
The applicant, California Recreation Company, is requesting approval
to remove an existing deteriorated marina and construct a new one at
201 East Coast Highway. The channel at this location is privately
owned by the Irvine Company. The proposed marina will occupy the same
water area as the existing marina, and there will be a net reduction in
available boat spaces from the existing 127 to 102 spaces as revised.
The project will extend to the U.S. Pierhead Line as permitted under
Section 23Q of the Harbor Permit Policies which reads as follows:
"23Q. U.S. Bulkhead Sta. No. 132 to No. 137. Pier.or boat slips
will be permitted to extend to the U.S. Pierhead line.
It has been determined by Community Development and the City Attorney's
Office that under CEQAC, this project is categorically exempt under a
class 2 exemption, and an initial study and negative declaration would
not be necessary. 0

The applicant has submitted plans indicating sufficient sanitary facilities
to comply with Section 19 of the Harbor Permit Policies. -
The applicant will be sharing parking with five (5) upland businesses.
The parking requirements for these businesses have been submitted to the
Marine Department by Community Development, (letter attached). Based
on these figures and the requirements of the marina for 95 spaces, a
total of 38.1 spaces must be available.
The applicant has submitted a parking lay -out (attached) taking into
consideration the revision of the existing parking area due to the
relocation of the Coast Highway bridge. This lay -out indicates 411
parking spaces available, and this would represent a minimum number of
spaces given the total area available for parking. Therefore, with
381 spaces required, and a minimum of 411 available, there would be a
surplus of at least 30 spaces.
Vessel waste will be handled by a pump out boat owned by the applicant
and used solely by their marina tenants.

of the condition of the facilities of the Service Afloat Marina.
It is most gratifying to learn of your department's intention to require
upgrading of harbor facilities, and I sincerely appreciate your courtesy
in so informing me.
It may be of interest to you to learn that because of, and subsequent to,
my action in writing to the City Council in this regard; the operator of
the property became so abusive and belligerent in his conduct toward my
wife and me that we have felt compelled to vacate our slip, which we had
occupied for over one and one-half years, moving to Ardells.
His declaration that the docks were in excellent condition was somewhat
refuted when the main finger pier in front of his office sank that same
night. (We have photos of this).
We, and the tenants who remain there, continue to have great interest in
your upgrading efforts and will support you in all possible ways.

Gentlemen:
I have been advised that Far We -t Services, Inc. made an
informal application at the Planning Commission meeting on
August 20th for permission to install additional tables without
being required to provide the commensurate amount of additional
parking.
We, the lessors of the adjoining Reuben's restaurant, have
provided adequate parking iD conjunction with our lease and do
not feel it fair to be penalized in order to benefit the operation
of Isadore's next door to us.
Under our master lease we also operate Balboa Marina located in
front of the restaurants, (Reuben E. Lee, Reuben's, Isadore's),
and realize any further increase of restaurant parking will
further encroach on the parking spaces allotted to the marina
operation. Because of the addition of the Reuben E. Lee and
Tsadore's restaurant the parking situation has grown progressively
%%orse.
The request of the operators of Isadore's should require additional
off-site parking.

Rou'bo.n's and.the Reuben E. Lee. One member of the Planning Do-
partment visited Isadore's on Thursday, October 1 1970, and.

1: � noted,that the entire parking lot was full and pairons were

�m,ost of the patrons of Isadore's usually arrive one or two per
car and that an occupancy of 182 persons would realistically
require more than 70 parking spaces. Since only.7b.spaces are
available, the additional parking could not be found on-site.
Since the,off-street parking provisions of.the,Nunicipal Code
would only require 61 off-street parking spaces for 182 seats,
the Commission may wish to consider this request; however, if
the request were to be approved,, the Staff would recommend that
Isadore's be required to furni.sh a parkin lot attendant to
luarante ' o that no patrons of Isadorels utilize off-street park -
ng set aside for other restaurants'andLactivities in the
vicinity..
Jhe City Attorney's Office has been asked to render an opinion
whether the Planning "Ommission can consider this request as
a discussion item or whether a formal application for amendment

Upon registration as a septic tank, cesspool, sewage . seepage pit or chemical toilet
cleaner by the Health Department of the County of Orange, cle.anings may be discharged
to sewage collecting or treatment structures of the'County Sanitation Districts
of the County of Orange at the following location only:

Fountain Valley
The following regulations shall be followed at'all times:
1. Only domestic sewage and sludge may be discharged without
inspection and approval.
2. The discharge of waste containing grease, oil, sand, mud,
feathers or any material other than domestic waste may be
discharged only with the approval of the Superintendent of
Operations or the Sanitary Engineer of the Sanitation Districts.
3. Manhole covers shall be replaced properly.
4. The discharge pipe shall be kept securely closed against
leakage during travel by means of a screw cap securely
attached to the truck with a chain or cable.
5. Care shall be taken to avoid spilling material on the ground
or in any other way creating a nuisance. It will be the
responsibility of the discharger to maintain the dumping
area clean at all times.
6. Treatment Plant No. 1 is open 24 hours a day and entrance
may be secured by contacting the operator on duty.
Violation of any of the foregoing shall be cause for immediate revocation of regis-
tration. The authorized location for discharge may be changed at the discretion of
the Sanitation Districts.
