Caulerpa Taxifolia was not observed at the project site.
This Pre Construction Eelgrass Survey is the result of studying this property dock system to determine the presence of
eelgrass.
This report as required in accordance with the Southern California Eelgrass Mitigation Policy (SCEMP) since eelgrass is
widely distributed throughout Southern California Coastal and Harbor Regions. This policy has been set in place to
protect marine habitats and sea grass beds that play a role in the life cycle chain for marine life to reproduce. This
survey assists development projects by contractors like you to conduct activities in conjunction with BMP's concerning
impact and management for promoting Eelgrass and controlling the spread of Caulerpa. Responsible developments by
contractors like you help protect these sensitive marine ecosystems, which in turn, protects our ocean resources.

Current Situation
Resident (Bruce Molner) at 421 Harbor Island Dr., Newport Beach, Ca, see Figure 1, has proposed to replace
existing dock with dimensions 8'-3" x 35'-8" with a proposed 9'-8" x 10'-8" concrete dock slip and replace
existing gangway. Existing 10" steel pile would remain in place, see Figure 2.
Eelgrass was not observed in construction site; see Figure 2 & Eelgrass Survey Report.
Caulerpa was not observed in any areas surveyed; see Caulerpa Survey Report.
Eelgrass Impacts
No eelgrass present in survey area. See Figure 2.
Survey Method
Survey conducted May .11, 2014 beginning at 1100 hr, at approximately N Lat +33.6139.41", W Long -
117.900421". Day was sunny, air temperature 74° F. Water was 62' F. Depth ranged from sandy beach at sea wall
to approximately 7" at end of existing dock, visibility was 4 ft. See Table 1. Survey area delineated spanning
approximately 65' ft wide paralleling sea wall to approximately 75' ft out from sea wall past end of proposed
dock to cover entire area to ensure >75% coverage of Harbor floor. Survey conducted by diver's 1' ft apart.
Lanes ran parallel with sea wall scanning approximately 2 ft on either side. Lane width was 6' wide and 4
transects were conducted starting from beach head to 10' past end of dock. See Figure 2.
Survey Findings
Dimensions of existing and proposed "in-kind" cantilever are shown in Figure 2.
Eelgrass at this proposed project site was not observed. See Eelgrass Survey Report for detailed findings and
observations. Sea life observed were round ra ys, Ulva ssp., mussels, anemones on bottom in sediment (sand
and dirt).
Discussion
No eelgrass was observed in project area. Existing dock slip is in poor condition and measures 8'-3" x 35'-8".
Existing 10" steel pipe piles are to remain in proposal and existing dock slip would be removed and new dock
installed with different dimensions of 9'-8" x 10'-8". A new gangway would also replace existing gangway and
would measure 3' x 20'. Anemones were observed on the bottom away from existing dock. Ulva ssp. was
observed on existing dock floats along with common Harbor mussels. There is no eelgrass under or around dock.
Impact to navigational waters will not change.
It is recommended to use Best Management Practices throughout the projects phases of construction.

Caulerpa Survey Reporting Form
This form is required to be submitted for any surveys conducted for the invasive exotic algae, (Caulerpa)
which is required to be conducted under federal and/or state permits and authorizations issued by the U.S.
Army Corps of Engineers, Coastal Commission, and/or Regional Water Quality Boards (Regions 8 & 9). The
form has been designed to assist to identify and control any potential impacts of the authorized actions on the
spread of Calupera. Surveys required to be conducted for this species are subject to modification through
publication of revisions to the Calupera survey policy. It is incumbent upon the authorized permittee to

eelgrass.
This report as required in accordance with the Southern California Eelgrass Mitigation Policy (SCEMP) since eelgrass is
widely distributed throughout Southern California Coastal and Harbor Regions. This policy has been set in place to
protect marine habitats and sea grass beds that play a role in the life cycle chain for marine life to reproduce. This
survey assists development projects by contractors like you to conduct activities in conjunction with BMP's concerning
impact and management for promoting Eelgrass and controlling the spread of Caulerpa. Responsible developments by

Current Situation
Resident (Bruce Molner) at 421 Harbor Island Dr., Newport Beach, Ca, see Figure 1, has proposed to replace
existing dock with dimensions 8'-3" x 35'-8" with a proposed 9'-8" x 10'-8" concrete dock slip and replace
existing gangway. Existing 10" steel pile would remain in place, see Figure 2.
Eelgrass was not observed in construction site; see Figure 2 & Eelgrass Survey Report.
Caulerpa was not observed in any areas surveyed; see Caulerpa Survey Report.
Eelgrass Impacts
No eelgrass present in survey area. See Figure 2.
Survey Method
Survey conducted May 11, 2014 beginning at 1100 hr, at approximately N Lat +33.613941", W Long -
117.900421". Day was sunny, air temperature 74° F. Water was 62' F. Depth ranged from sandy beach at sea wall
to approximately 7" at end of existing dock, visibility was 4 ft. See Table 1. Survey area delineated spanning
approximately 65' ft wide paralleling sea wall to approximately 75' ft out from sea wall past end of proposed
dock to cover entire area to ensure >75% coverage of Harbor floor. Survey conducted by diver's 1' ft apart.
Lanes ran parallel with sea wall scanning approximately 2 ft on either side. Lane width was 6' wide and 4
transects were conducted starting from beach head to 10' past end of dock. See Figure 2.
Survey Findings
Dimensions of existing and proposed "in-kind" cantilever are shown in Figure 2.
Eelgrass at this proposed project site was not observed. See Eelgrass Survey Report for detailed findings and
observations. Sea life observed were round ra ys, Ulva ssp., mussels, anemones on bottom in sediment (sand
and dirt).
Discussion
No eelgrass was observed in project area. Existing dock slip is in poor condition and measures 8'-3" x 35'-8".
Existing 10" steel pipe piles are to remain in proposal and existing dock slip would be removed and new dock
installed with different dimensions of 9'-8" x 10'-8". A new gangway would also replace existing gangway and
would measure 3' x 20'. Anemones were observed on the bottom away from existing dock. Ulva ssp. was
observed on existing dock floats along with common Harbor mussels. There is no eelgrass under or around dock.
Impacvto navigational waters will not change.
It is recommended to use Best Management Practices throughout the projects phases of construction.

Special Conditions

With reference to the plans currently under consideration at the above referenced address to
reconfigure or modify the dock system or bulkhead, the following conditions will now be in
effect:
1. The project proponent is aware of the Harbor Permit Policies (Council Policy H-1) and Title
17 of the City of Newport Beach Municipal Code. The project proponent understands that the
above referenced structure(s) is under the purview of these Policies and Codes.
2. Any future work on the above mentioned structure(s) requires permits with the City of
Newport Beach and any other applicable agencies. Painting and work considered to be
cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the proposed dock system and/or
bulkhead under consideration. Any future modifications or alterations to the dock system
and/or bulkhead may require new conditions which may override or change these conditions.
These conditions supersede all past conditions associated with this property.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. In accordance with Municipal Code 10.08.030 A. the project proponent shall obtain the
proper permits for equipment and materials storage. "Except as otherwise provided in this
section, no person shall use any public street, sidewalk, alley or parkway or other public
property for the purpose of storing or displaying any equipment, materials or merchandise, or
any other commercial purpose. B. Public streets, sidewalks, alleys, or parkways may be used
for the purpose of selling, storing, or displaying any equipment, material, merchandise or for
other commercial purposes in the following cases: ... For the temporary storage of construction
equipment or material provided a permit is issued pursuant to Chapter 12.62 of this Code and
the storage is consistent with provisions of the Uniform Building Code."
6. The project shall be implemented in conformance with the Local Coastal Program - Coastal
Land Use Plan.

7. , In accordance with Municipal Code 10.28.040 the following noise regulations apply: "A.
Weekdays and Saturdays. No person shall, while engaged in construction, remodeling, digging,
grading, demolition, painting, plastering or any other related building activity, operate any tool,
equipment or machine in a manner which produces loud noise that disturbs, or could disturb, a
person of normal sensitivity who works or resides in the vicinity, on any weekday except
between the hours of seven a.m. and six -thirty p.m., nor on any Saturday except between the
hours of eight a.m. and six p.m. B. Sundays and Holidays. No person shall, while engaged in
construction, remodeling, digging, grading, demolition, painting, plastering or any other related
building activity, operate any tool, equipment or machine in a manner which produces loud
noise that disturbs, or could disturb, a person of normal sensitivity who works or resides in the
vicinity, on any Sunday or any federal holiday."
8. Your side property lines extend in the water along their same bearing. Vessels shall
not encroach upon the neighbor's property on either side.
9. Vessels may not extend beyond the end of the fingers by more than the width of its
beam except as otherwise noted in the Municipal Code.

events conform with Consistency Certifications CC -078-99 and/or CC -077-01 and that no further federal
consistency review is necessary from the Commission for the dredging components of the projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-282, as amended. Any change in the projects may cause them to
lose their status as consistent with CC -078-99 and CC -077-01 and/or CDP 5-99-282, as amended. This
certification is based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time

Sirs:
The City of Newport Beach Environmental Division has received a
request to transfer pier permit RP13204151 for the above
mentioned property. The facility was inspected on March 31,1998.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
2. All electrical outlets must be GFI or have a twist lock
receptacle.
3. The decking on the pier that adjoins the start of the ramp is
rotted and needs to be replaced.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the permit."

The City of Newport Beach has received a complaint regarding the
pier and float bayward from 421 Harbor Island Drive, Newport Beach.
Specifically, the complaint is that a vessel is berthed in violation
of Section 21.A of the City Harbor Permit Policies, which states:

harbor permit 132-415, located at 421 Harbor Island Drive.
Specifically, the complaint is that the float bayward of 421
Harbor Island Drive has been modified in violation of Section
17.24.010 of the Newport Beach Municipal Code, which states:
17.24.010 "Permit Required for Construction or Alteration.
No person or agency shall bui'ld, maintain, extend or make
structural alterations on any building,.pier, piling, bulkhead,
sea, wall, reef, breakwater, or other structure In, upon or over
the waters of Newport Harbor or the Pacific Ocean or any -other
water where the tide ebbs and flows within the City, or do any
filling, excavating or dredging in said waters or ocean, without
first obtaining a written permit to do so from. the City. (Ord.
1099 (part), 1964: 1949 Code k 1040.0(a)."
Further, the complaint states that refuse has been left on your
beach in violation of Section 17.32.030 of the Newport Beach Municipal
Code, which states:
17.32.030 "Refuse and Vessels on Shoreline. No person shall place
or allow vessels, boats, materials, garbage, refuse, timber or
waste matter of any description to remain on or upon the shorelines
of the Pacific Ocean or on the shorelines of Newport Harbor within
the City. The City Manager may remove the same with or without
notice, at his option, and the cost thereof may be recovered from
any person owning the same, or placing or causing It to be placed
on the shoreline, in a civil action. (Ord. 1090 (part)., 1964:
1949 Code § 10500(c)).

Discussion
The applications require City Council approval under the conditions of

dredging issued by the U. S. Army Corps of Engineers, on February 12, 1974,

The staff has reviewed the projects and has determined that the work will

in the restoration of beaches bayward of private residences.
