construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis Developments
Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit application for the development
described below, the Executive Director of the Coastal Commission hereby waives the requirement for
a Coastal Development Permit pursuant to Section 13238.1, Title 14, California Code of Regulations.
If, at a later date, this information is found to be incorrect or the plans revised, this decision will
become invalid; and, any development occurring must cease until,a coastal development permit is
obtained or any discrepancy is resolved in writing.
WAIVER#: 5-99-398 APPLICANT: Charlene. B. Shanholtzer
LOCATION: 9 Linda Isle, Newport Beach (Orange County)

RATIONALE: The subject site is a lot located between the first public road and the sea within the
private community of Linda Isle. An Eel Grass Inspection by the City of Newport Beach Fire and
Marine Department states that no Eel Grass is present in the project area. The proposed development
is consistent with the City of Newport Beach Land Use Plan. The proposed project does not intensify
the use of the property. The proposed project design is also compatible with the character of
surrounding development and does not have any negative affects on visual resources or coastal
access. Coastal access is available near the site at Corona del Mar State Beach. The project is
consistent with Chapter 3 policies of the Coastal Act and previous Commission approvals, and will not
prejudice the City's ability to prepare an LCP.
This waiver will not become effective until reported to the Commission at their January 11-14, 2000
meeting and the site of the proposed development has been appropriately,noti.ced, pursuant to
13054(b) of the California Code of Regulations. The enclosed "Notice :Card .shall remain, posted at the
site until the waiver has been validated and no less than severs' days prior to the 'Commission hearing.
If four (4) of the Commissioners object to this waiver of permit requirements, a coastal development
permit, will be required.

If standard dock construction methods and materials are utilized, this project should not adversely
impact water quality. A statement has been submitted that there will be no waste discharged from
the proposed project. Based on these assurances, clearance is provided.
However, should the Army Corps of Engineers determine that this project requires a Section 404
permit, it will be necessary for the project proponent to obtain from this Board a Water Quality
Certification under Section 401 of the Clean Water Act.

pier (PIER #RP 13300091).
As you can see I have already gone through all the formalities of the transfer but your
office has neglected to recognize or record my ownership of this pier. I paid the required
transfer fee of $300.00 in my escrow fees in November, 1994. Since then I have paid my
annual pier permit fees in a timely matter. I have also filled out the transfer card and it
was signed and returned by the previous owner.
I would also like to know why the annual permit fees have been increased from '$70.00
to $75.00.
Please reply to this correspondence as soon as possible. I will be looking forward to
hearing from you regarding all the errors or oversights in the handling of this account.

to re -inspect the property located at #9 Linda Island, The facility
was re -inspected on November 23, 1994.
We cannot transfer the pier permit until the following deficiency
has been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION:
1. The electrical outlets on the dock must be GFI or twist lock
receptacles for use in a water environment. Must be replaced.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, . all harbor structures
shall be inspected for compliance with the City' s minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit

November 7, 1994.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE

1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
