Dear Sirs:
Regarding a pier permit transfer for the property located at 50
Linda Isle, Newport Beach, the structure was inspected on July 21
1994, at which time it was determined that it conforms to City
standards.
Once we have received the pier transfer card, signed by both the
previous owner and the new owner, and the $300 transfer fee, we
will be able to tra r the pier permit.

Dear Pier Permittee;
The Finance Department has notified the Marine Department that the annual Pier Fee for
your Pier Permit for 1994 is seriously in arrears.
Section 17.24.090 #4 of the Newport Beach Municipal Code reads as follows:
17.24.090. #4 "Revocation of Permit. Ground for Revocation. Any permit
heretofore or hereafter granted for any structure or work in the
waters of Newport Harbor or the Pacific Ocean may be revoked by
the City Council upon any of the following grounds:
4. The permittee has failed for a period of sixty (60) days
to pay the fee or for the occupancy of tidelands, filled
tidelands or submerged lands upon which such work or
structure exists."
Therefore, you are hereby notified that failure to pay the fee and any penalties by August
15, 1994, will result in the Marine Department recommending to the City Manager that
your pier permit be revoked.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0133-0050-1 for the property located at 50
Linda Isle, Newport Beach, CA. The facility was inspected on May
19, 1994.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1..A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed.
A permit for plumbing -work may be obtained from the Building
Department of the City.
The Newport Beach City Council Harbor Permit. Policies state:
10.D. "At the time of transfer,. all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred. Included in requirements for transfer of the

Dear Sir:
The City of Newport Beach has attempted to contact the current
owner of 50 Linda Isle to request he complete the application to
transfer the permit into his name from the previous owner. (see
attached)
However we have not received a reply regarding this requirement.
Therefore the current request on the part of Mr McCackin/simili to
transfer the permit to the buyer..of 50 Linda Isle must be done in
conjunction to obtainitg the transfer card and fee for the permit
to be in their name. If it is not possible to obtain -the signature
of the seller who sold the property to McCackin/Simili, then at
least this department must have a signed transfer card with them as
the buyer and the $300,fee.

It has come to the attention of the Marine Department that Larry
Pacini is the listed owner of the property and he no longer owns
the property. The current owner should be the name on the pier
permit listed in our files. The pier permit has never been
transferred.
The City Council Harbor Permit Policies state:
10. " Permits for harbor structures are issued subject to the
condition that any improvements constructed shall not be sold in
whole or part, leased, or transferred, without the written consent
of the City", and
4.C. "The permit is not transferable without the written consent of
the City of Newport Beach".
We enclose "Instructions for Pier Permit Transfer" and a transfer
card. Please complete the card as indicated. The signatures of both
buyer and seller are required on the card. Please return the signed
card to the Marine Department of the City of Newport Beach. The
$300 transfer fee should be included.

The City of Newport Beach Marine Department has received a request
to transfer pier permit 0135-0050 for the property located at 50

12/06/93.
We cannot transfer the pier permit until the fallowing deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
