The facility was inspected on 3/15/94. We cannot transfer the pier permit until the following deficiency has/have been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: 1. An electrical outlet on the dock is not secured properly to the dock. 2. The electrical receptacles (2) must be GFI to be used in a water environment. The Newport Beach City Council Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All structural deficiencies must be corrected prior to transfer of the permit-" PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN CORRECTED. When we have been notified, the structure will again be inspected and when the requirements have been met the pier permit will be transferred. Activity - Dredge under and on all sides of a private dock bayward of the residence and dispose of the material,approximately 215 cubic yards, at LA-3, an Environmental Protection Agency (EPA) offshore disposal site. Comments should be mailed to: Los Angeles, CA 90053-2325 Water Quality - Certification that the proposed discharge will comply with the applicable effluent limitations and water quality standards is hereby requested from the location state. A certification obtained for the construction of any facility must also pertain to the subsequent operation of the facility. Cultural Resources - The latest version of the National Register of Historic Places has been consulted and this site is not listed. This review constitutes the extent of cultural resources investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Coastal Zone Management - The applicant has certified that his proposed activity complies with and will be conducted in a manner that is consistent with the approved State Coastal Zone Management Program. The District Engineer hereby requests the California Coastal Commission's concurrence or nonconcurrence. Endangered Species - Preliminary determinations indicate that the proposed activity will not affect any species designated as endangered or threatened', or their critical habitat (Endangered Species Act). Therefore, formal consultation under Section 7 (c) of the Act is not required. Authority - This permit will be issued or denied under the following authorities: Structures or work in or affecting navigable waters of the United States - Section 10, River and Harbor Act o (33 U.S.C. 403). Transportation of dredged material for purpose of dumping into ocean waters - Section 103, Marine Protection, Research and Sanctuaries Act of 1972 (33 U.S.C. 1413). Evaluation - The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion, and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. Inaddition, if the proposal would discharge dredged or fill material or the transportation of dredged material for the purpose of disposing of it in ocean waters, the evaluation of the activity will include application of the EPA Guidelines (40 CFR 230). PUBLIC NOTICE - APPLICATION NO. 89-233-GS EIS Determination - A preliminary determination has been made that an environmental impact statement is not required for the proposed work. Public Hearing - Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state with particularity the reasons for holding a public hearing. Proposed Activity for Which a Permit is Required - (1) Dredge 215 cubic yards of material bayward of the existing residence and, (2) dispose of the material at LA-3, an EPA offshore disposal site. - Additional Project Information - The applicant proposes to restore the water depth at the existing boat dock to the original design so as to provide a safe boating access during low tides and to prevent further damage to the dock during extreme low tides. The dredging operation would be performed using a hydraulic dredge. The dredged material would be transported to LA-3 by a dump barge. A sediment grain size analysis was performed on a sample collected from 57 Linda Isle. Methods of analysis followed those currently required by the U.S. Army Corps of Engineers and ASTM D422-63 (as modified). Sand comprised 90.9% of the core sample material, which passes the EPA requirement for ocean disposal (40 CFR 227.13(b)(1)). Proposed Special Conditions: That the permittee shall Notify the Commander (oan) Eleventh Coast Guard District, Union Bank Building, 400 Ocean Gate, Long Beach, California 90822, (213) 499-5410 at least 2 weeks prior to start of the activity and 30 days if buoys are to be placed, and that the permittee shall advise the Aids to Navigation Branch of any hazard to navigation, so that appropriate information can be published in the Local Notice to Mariners. A City approved anti -syphon device is required at the water connection to the pier and float. 2. 3. Cap cover on electrical plug on dock/float ismissing. 4. Electrical conduit has become loose from pier, needs to be secured by brackets. The structure was inspected on 2/23/88 and in accordance with Section 10-D of the Harbor Permit Policies it cannot be transferred until it meets City requirements. 10.D."At the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit.
