The projection of the property line bayward of the same bearing from the bulkhead shall generally be used in determining the allowable set -backs for piers and floats. Because there are certain physical conditions which preclude the strict application of this policy without prejudice to adjoining properties, Council approval will be required in areas where precise projections of the property line have not been determined and the following conditions exist: (2) Where curves or angles exist in the bulkhead line". The applicant's pier is a joint pier located within the lagoon of Linda Island and in one of the locations where the bulkhead is curved and the permit zones, as a result, are pie shaped, getting smaller as they go bayward. The applicant is proposing a revision of a joint dock bayward of 60 and 61 Linda Isle to accomodate a larger vessel than can currently be accomodated. The proposed revision will give the applicant sufficient space to berth his vessel bayward of his residence and, as proposed, will conform to the existing Harbor Permit Policies as regards bayward extension of the float and setback of the float relative to the side property lines. Historically the Marine Department has not enforced area homeowner association CC&Rs. In the past on Linda Isle we have requested that an applicant for a new or revised Harbor Permit submit his plans to the appropriate persons in the homeowner's association prior to bringing it to the City Council. In this case the applicant submitted his plans and specifications to Linda Isle Community Association, showing his proposed dock revision. As of this date the association has failed to approve or disapprove the applicant's proposal. Based upon a review of the pertinent sections of the Linda Isle CC&Rs the applicant's attorneys feel that Mr. Simon has complied with the requirements of the CC&Rs and the association's failure to respond within 30 days of the plans being submitted, constitutes an automatic approval. The adjacent property owner at 62 Linda Isle has concern about the modifications of the dock relative to the size of the vessel that will _be berthed there. The proposed revision is. within Harbor Policy guidelines as regards setbacks and bayward extension of the float. The size vessel that is proposed to be berthed at the slip can be berthed in compliance with the policies, and if properly berthed should not cause a navigational problem relative to the dock at number 62. In accordance with the Declaration of Covenants, Conditions and Restrictions ("CC&Rs") of Tract No. 4003 in Orange County, California, Mr. Simon submitted the plans and specifications showing the nature of his proposed dock reconfiguration to the Linda Isle Community Association (the "Community Association"). Under the CC&Rs, if the Community Association Architectural Committee (or its designated representative) fails to approve or disapprove of the dock's design and location within 30 days after submission of the plans and specifications to it, Mr. Simon's dock is automatically approved. Article VI, Section l of the CC&Rs for Tract No. 4003 provides as follows: Section 1. Architectural Approval. In the event said Committee or its designated representative, fails to approve or disapprove such design and location within thirty (30) days after said plans and specifications have been submitted to it, approval will not be required, and this Article will be deemed to have been fully complied with. (Emphasis added). Mr. Simon submitted his original dock reconfiguration plans in mid-1990. Consequently, those plans have now been automatically approved (i.e., no approval is necessary). Recently, on August 9, 1991, Mr. Simon mailed a revised version of the plans to Charles L. Howell, Architectural Administrator for the Community Association. The plans were originally shown to Mr. Howell on July 30, 1991. Even if the latter August 9, 1991 date is utilized with respect to the 30 -day provision of the CC&Rs, and even allowing 5 extra days for local mailing, the 30 -day period would lapse, at the latest, on September 13, 1991. Mr. Simon hereby requests that the Marine Department of the City of Newport Beach issue a Harbor Permit forthwith. In the event that the Marine Department determines that City Council approval, or any other approval or action, is necessary prior to the issuance of the Harbor Permit, please notify the undersigned immediately. The Board of Directors of Linda Isle Community Association has given me a copy of a letter which was to be sent to you to the effect that the purported approval was not that of the Associa— tion, but only one part of the approval process. The Board has requested that Mr. Simon, #61, provide more accurate drawings. One of the problems is that the drawings are not an accurate representation of the situation. if you received a copy of the large drawings, for example, you will find that the width of the dock area is listed at 1716.11. However, in the small drawing submitted for the permit shows the distance from the side of the longer dock to the property line as being 1716". There are other very important errors in the drawings submitted. Since the Association is still considering the matter, and the drawings are to be corrected and re—submitted, I believe that action on the part of the city is premature. In any event, even as drawn, if Mr. Simon is allowed to change the configuration of his dock, his boat will extend into his 5' set back area and in front of the south side of my dock to such an extent that I will not be able to navigate straight out of that area. Also, will I be able to get a permit to do with my property exactly as Mr. Simon is proposing to do? Because of the angles, our boats, if equal in size, will be in contact with one another. Archi tectimal Committee - Maurice Liken Association Architect Tim Howell, advised the Board that architectural matters during+the'month were routine in nature and that plans being received from Homeowners are being processed in a timely manner. The Board was advised that the final draft of the Linda Isle Community Association Development Standards is being completed by Management Service Company after revision by the Board and Association Architect and that copies of the final draft will be distributed to the Board for review prior to the next meeting. Homeowners at #62 and #63 appeared before the Board to discuss the proposed construction of the dock at #61, expressing concerns over the size of the dock in the curved area, as well as expression of concerns over intrusion into the bay area. After discussion, the Board requested that Management Service Company communicate with the Building Department of the City of Newport Beach indicating that the Board is delaying any action at this time pending further review, and that Association Architect Tim Howell's letter of preliminary approval is not to be construed as approval from the Board of Directors at this time. (Thagard abstained) The Board was advised that operations at the Clubhouse during the recent month have been rQutine.in nature. The Board was advised that the playground equipment is still scheduled for replacement and the equipment will be subsequently ordered and installed in the sandy area adjacent to the Clubhouse. The Board was advised that entitlements to the common area and the issue of long term leases held by the Irvine Company has apparently been resolved, and the Irvine Company reportedly transferred title to the Association and the information will be subsequently provided to the Association Attorney and Management Service Company. LINDA ISLE COMMUNITY ASSOCIATION MINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS JUNE 18, 1991 The meeting was called to order by President Jack Garner in the Association Clubhouse at 7:07 PM, with the following quorum present: Directors Present: Directors Absent: Jack Garner Robert Shackelton Maurice Liken George Hill George Thagard Robert Amstadter Leon Lyon None Also Present: Homeowners and Representatives , #62 - #63, Tim Howell, Association Architect, William E. Korb, Administrator Management Service Company Homeowner information presented at the Board meeting and the contents of those discussions are recorded in the appropriate sections of these minutes. The minutes of the May 21, 1991 meeting was approved as submitted. ON "I AIX �4 099VON14 Management Service Company reported that the financial reports through May, 1991 have been distributed to all members of the Board of Directors and.the substance of those reports were reviewed and discussed at this month's meeting. Management Service Company advised the Board that State Farm Insurance has provided an endorsement increasing the umbrella policy at $4,000,000 which is the maximum amount in addition to the $2,000,000 common area liability coverage, which is the maximum available limit for the combined policies. LINDA ISLE COMMUNITY ASSOCIATION MINUTES OF THE REGULAR MEETING -OF THE BOARD OF DIRECTORS JUNE 18, 1991 Page Two The Board was advised that the preliminary Association audit has been received from the Certified Public Accounting Firm of Jack Sinclair and that the audit is currently under review by the Association Treasurer prior to final publication and distribution to all members of the Association. Association Architect Tim Howell, advised the Board that architectural matters during the month we e.routine in nature and,;that plans being received from Homeowners are being processed in a timely manner. The Board was advised that the final draft of the Linda Isle Community Association Development Standards is being completed by management Service Company after revision by the Board and Association Architect and that copies of the final draft will be distributed to the Board for review prior to the next meeting. Homeowners at #62 and #63 appeared before the Board to discuss the proposed construction of the dock at #61, expressing concerns over the size of the dock in the curved area, as well as expression of concerns over intrusion into the bay area. After discussion, the Board requested that Management Service Company communicate with the Building Department of the City of Newport Beach indicating that`the,Board is delaying any action at this time pending further review, and that Association Architect Tim Howell's letter of preliminary approval is not to be construed as approval from the Board of Directors at this time. k&5Z= (Thagard abstained) The Board was advised that operations at the Clubhouse during the recent month have been routine.in nature. The Board was advised that the playground equipment is still scheduled for replacement and the equipment will be subsequently ordered and installed in the sandy area adjacent to the Clubhouse. As much as we would like to be good neighbors and agree with the idea, for many reasons we cannot. 1. Some lots on the island are shaped to accomodate larger boats. #42, 43 and the like were designed to have them. Ours were not. For those of us in our area, we would be overcrowded with boats if we all tried to enlarge and maximize the size of boats in our slips by cramming them in. Thus, inherent in the size , configuration and location of our lots, we are limited to boats smaller than yours. If we want. larger boats, we will have to buy a home which could handle them without overwhelming it and the adjacent homes. 2. Theoretically, were you to rebuild you dock as you suggest, you, or your successor could possibly bring in a seventy foot or longer boat. It would be long and narrow, of course, but it could possibly be done. For us, we must preclude that possibility, and the only practical way is to limit the width of the slip. 3. The shape of our lots argue against the changes. Lots 60,61, 62 and 63 all converge to a point in the water. All are similarly configured. Since we all come to a common point, we have a special, further limitation that most other lots do not have. We all run together and, unless our boats are limited in size, will interfere with the navigation of one another. 4. In keeping with item #3, since lots 60, 61, 62 and 63 are all similarly configured, it follows that each should have equal docking and boat size capability. We cannot all make the changes you propose. - 5. A view of the area is a major part of the reason we selected the lots that we did. The placement of a larger boat at #61 would diminish our view. 6. #62 had agreed with the Sheas, your predecessors, to allow the rebuilding of the dock at #61 to conform to the original design. The Sheas had had a side tie only. Because of the design, it was extremely difficult to moor the boat. #62 agreed to the modification because of the committment of the Sheas to 1 build the dock to limit the size of the boat. We believe that that arrangement should continue. Certainly it should not be changed without a new agreement between the owners of #6.1 and #62. 7. We believe that if the changes proposed were effectuated, the values of Lots #.62 and #63 would be substantially decreased. 8. The plans submitted to us appear to be greatly inaccurate,. Overlaying them, for example, shows that they are not similar. Landmarks and locations of docks and property and set back lines do not coincide. We are not sure that the plan submitted would even work, since they are not drawn to scale and lack accuracy. Without a survey, tolerances being as close as they are, it is almost impossible to determine whether the docks could be modified to house your boat. Another example of the inaccuracy is that the drawing shows the southerly finger of #62's dock being on the set back line. It actually could go bayward another eight feet before it touches the set back line. 9. Aside from the drawings, rough measurements would indicate that the dock builders, who installed the new Shea dock, put part of the finger into the set back line. If that is true, it should have been made shorter or the space of the slip been made less wide. If there is any change, that error should be verified and, if error does exist, corrected. 10. According to the original deed to lots 60, 61, 62 and 63, we were each given an exclusive easement over Lot A of the association to the extent of sixty feet from our bulkhead line. We have no rights beyond that other than in common with all the homeowners. Your main dock extends sixty feet from your bulkhead. Therefore, the limit of your docking space is at the end of your dock. Parking a boat which extends beyond is an encroachment into the part of. Lot A, which belongs to all of us. it is a hindrance of our free navigation of a common area. It would be like parking a sixty foot motor home into the common street of the association. 11. Combining the above, the embodiment of the restrictions is fairly well spelled out in the CC & Rs, architectural rules and other association documents. We believe that your boat is beautiful and a pleasure to see. We are sorry that we believe that it just does not belong at Lot #61. We hope that you will understand our concerns and that over the years, our friendship will grow. Recommendation: If desired, approve the application subject to the following conditions: 1. Approval of the plans and specifications by the City Public Works Department 2. Approval of the California Coastal Commission 3. Approval of the US Army Corps of Engineers Discussion• This application is before the City Council as required by Section 20.C. of the Newport Beach Harbor Permit Policies, which states: 20.C."SetBacks. The projection of the property line bayward of the same bearing from the bulkhead shall generally be used in determining the allowable set -backs for piers and floats. Because there are certain physical conditions which preclude the strict application of this policy without prejudice to adjoining properties, Council approval will be required in areas where precise projections of the property line have not been determined and the following conditions exist: (2) Where curves or angles exist in the bulkhead line". The applicant's pier is a joint pier located within the lagoon of Linda Island and in one of the locations where the bulkhead is curved and the permit zones, as a result, are pie shaped, getting smaller as they go bayward. The applicant is proposing a revision of a joint dock bayward of 60 and 61 Linda Isle to accomodate a larger vessel than can currently be accomodated. The proposed revision will give the applicant sufficient space to berth his vessel bayward of his residence and, as proposed, will conform to the existing Harbor Permit Policies as regards bayward extension of the float and setback of the float relative to the side property lines. Historically the Marine Department has not enforced area homeowner association CC&Rs. In the past on Linda Isle we have requested that an applicant for a new or revised Harbor Permit submit his plans to the appropriate persons in the homeowner's association prior to bringing it to the City Council. In this case the applicant submitted his plans and specifications to Linda Isle Community Association, showing his proposed dock revision. As of this date the association has failed to approve or disapprove the applicant's proposal. Based upon a review of the pertinent sections of the Linda Isle CC&Rs the applicant's attorneys feel that Mr. Simon has complied with the requirements of the CC&Rs and the association's failure to respond within 30 days of the plans being submitted, constitutes an automatic approval. The adjacent property owner at 62 Linda Isle has concern about the modifications of the dock relative to the size of the vessel that will be berthed there. The proposed revision is within Harbor Policy guidelines as regards setbacks and bayward extension of the float. The size vessel that is proposed to be berthed at the slip can be berthed in compliance with the policies, and if properly berthed should not cause a navigational problem relative to the dock at number 62. Attached to this report and marked Exhibit "A" is a surveyed scale drawing of the piers showing the proposed revision and the adjacent slip. Exhibit "B" is a drawing depicting the revised slip and the size vessel the applicant proposes to berth there. We have had reports from homeowners on Linda that that the previous design precipitated considerable navigational problems between the then owners of #62, Argyros, and the owners of #61, and that antagonisms between the parties were so great that litigation became imminent. It was only when the dock at #61 was changed from what is now proposed to that that now exists that the problems ended. As much as we would like to help our neighbors in #61, we would more like to not reinstate a much more volatile condi— tion. Therefore, reluctantly we do object to any modification of the existing waterway structures. The owners of #61 have declined any limitations on their use of the proposed dock modifications. W. Sparr, Committee Chairman Richard Elliott, Committeeman Forest E. Olson, Committeeman Plug White, Association President George Argyros,,Resident #62, Linda Isle A Quorum was present. The purpose of the meeting is to revue, in full committee, the request by Mr. Tom Burris, resident #61 Linda Isle to remodel his existing boat dock. Chairman Sparr presented the proposal plan for the dock remodel and asked for discussion. George Argyros expressed his concern for the possible intrusion of his "view corridor" if a large boat is docked in the remodeled slip. Plug White, President of the L. I. C. A. covered the possible disadvantages of large boats in small restricted slip areas. Richard Elliott, Committee member reminded those present that the Architectral Committee was concerned at this meeting with the legality of the dock remodel and that control of future use of the dock would be a function of the L. I. Board. Forest Olson , Committeeman, discussed in detail his discussion with legal counsel regarding the rights of the Committee in addressing this matter. The Chair polled all.pr.esent and received a unaimous approval to the remodel of the dock as planned. Richard Elliott moved that the propsed dock remodel be approved by the Committee with conditions that the use and occupancy of the completed remodel be in compliance with the Covenanants, Conditions and Restrictions as recorded; with the L. I. C. A. By -Laws; and with all ordinances, rules and regulations of any and all governmental bodies having jurisdiction. The motion was seconded by Forest Olson. On November 22, 1931 the Marine Department received a telephone complaint from Mr. Plug"White of #62 LindaIsle.` Specifically, the complaint was that a vessel was being moored at #60 Linda Isle in violation of section 21B of the Harbor Permit Policies, which states: "Any boat moored at a pier, dock or float shall not extend bayward a distance of more than the width of its beam beyond the pier, dock or float. A field inspection by staff on November 23 verified that the vessel "Lucia", belonging to Mr. Ton Burris the property owner of #60 Linda Isle, was in fact in violation of the above quoted policy.- This was not the 'first time this violation has existed and the Marine Department has com- municated with Mr. Burris regarding this in the past (see attached letter) The staff feels that .the intent of the above Harbor Permit Policy was to provide for uniform use, at private piers and floats, in that area of the bay that `a vessel would extend into beyond the permit zone.` This area is typically the public navigable area of the harbor. By allowing a vessel to extend into this area in violation of the above Harbor Permit Policy in effect allows an encroachment into the public navigable areas of the harbor. In addition to this technical encroachment, the vessel in violation breaks the uniformity of the navigable channel and can present a hazard to navigation. As the attached letter indicates, the "Lucia has a 14' beam, and therefore could extend into the channel 14 feet. The vessel in fact extends 20 feet beyond the structure and it is this additional six feet that doses the hazard .and the violation -of the Harbors and Navigation Code Section' §131. PPesent: E. W. Sparr, Committee Chairman Richard Elliott, Committeeman Forest E. Olson, Committeeman Plug 11hite, Association President George Argyros, Resident #62, Linda Isle A Quorum was present. The purpose of the meeting is to revue, in full committee, the request by Mr. Tom Burris, resident #61 Linda. Isle to remodel his existing boat dock. Chairman Sparr presented the proposal plan for the dock remodel and asked for discussion. George Argyros expressed his concern for the possible intrusion of his "view corridor" if a large boat is docked in the remodeled slip. Plug White, President of the L. I. C. A. covered the possible disadvantages of large boats in small restricted slip areas. Richard Elliott, Committee member reminded those present that the Architectral Committee was concerned at this meeting with the legality of,,the dock remodel and that control of future use of the dock would be a function of the L. I. Board. Forest Olson Committeeman, -discussed in detail his discussion with legal counsel regarding the rights of the Committee in addressing this matter, The Chair polled all.present and received a unaimous approval to the remodel of the dock as planned. Richard Elliott moved that the propsed dock remodel be approved by the Committee with conditions that the use and occupancy of the completed remodel be in compliance with the Covenanants, Conditions and Restrictions as recorded; with the L. I. C. A. By -Laws; and with all ordinances, rules and regulations of any and all governmental bodies having jurisdiction. The motion was seconded by Forest Olson. Burris 61 Linda Isle Newport Beach, -CA 92663 Dear Mr. Burris: As you are aware, the Newport Beach Marine Department has received several complaints regarding the residential slip at #61 Linda isle. Specifically, the complaints are that the vessel "Lucia"'is being berthed at this slip in violation of Section 21:B, of the Newport Beach Harbor PermitPolicies, which states: 21.B."Any boat moored at a pier, dock,,or float shall not extend bayward a distance of more than the width of its beam beyond the pier, dock or float." On July 14 we verified the situation in the field, and found the "Lucia" had approximately a 14' beam, and it was extending bayward of the slip approximately 20 feet, a clear violation of the above quoted policy. To rectify this situation the "Lucia" must be relocated. The slip in which it is berthed, as currently constructed, cannot accomodate a vessel of the "Lucia's" length.
