The permittee shall send one (1) copy of the post -dredging report for each completed individual
dredging project to the Corps and the CCC documenting compliance with all general and
special conditions defined in this permit. The post -dredging report shall be sent within 45 days
after completion of the complete individual dredging project authorized in this permit. The

Commission staff have reviewed the information submitted and determined that the above referenced dredging
events conform with Consistency Certifications CC-078-99 and/or CC-077-01 and that. no further federal
consistency review is necessary from the Commission for the dredging components of the projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC-078-99 and CC-077-b1 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-2.82, as amended. Any change in the projects may cause them to
dose their status as consistent with CC-078-99 and CC-077-01 and/or CDP 5-99-282, as amended. This
certification is based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time
must cease until a new determination regarding conformance with CC-078-99 and CC-077-01 and/or CDP 5-99-
282, as amended, is obtained.

No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54
will expire. A general permit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize interference with any
existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other

read the U.S. Army Corps of Engineers permit, RGP#54 and the California Coastal
Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I
will comply with all of the conditions of those permits. I will further hold the City
harmless from and indemnify them against any claim for damages arising out of the
exercise of these permits. In addition, I, as the applicant shall reimburse the City of
Newport Beach for all attorney's fees and other costs expended by them in defending
any claim, lawsuit, or judgment arising out of the activities of the applicant carried on
under the authority of such permit.

Shellmaker. The sample consists of a SILTY CLAY TO CLAYEY SILT (CL-ML): olive to
black (2.5Y 2.5-4/1-3); saturated; trace of fine sand; scattered seashell fragments. The
sample was obtained from the Willford Residence, 62, 63 & 64 Linda Isle Drive, Linda Isle,
Newport Beach, California at a depth of -6.0 feet to -3.5 feet MLLW.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until al coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER # 5-92-0.85 APPLICANT: Sandy Wi l lford
LOCATION: 62 Linda Isle, Newport Beach, Orange County.
PROPOSED DEVELOPMENT: Revision of an existing U-shaped boat dock resulting in
a nine foot wider dock. The outer finger will be shortened to 28 feet and the
inner finger will be lengthened by nine feet to sixty feet from the bulkhead.
The proposed dock will be within the U.S. Pierhead Line.
RATIONALE: The proposed development will have no adverse impacts on coastal
access or resources, is consistent with the City's certified LUP, with past
Commission actions and with the Chapter Three policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their
May 12-15, 1992 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Recommendation:
If desired, approve the application subject to the following
conditions:
1. Approval of plans and specifications by the City Public
Works Department,
2. Approval of California Coastal Commission,
3. Approval of U.S. Army Corps of Engineers.
Discussion•
This application is before the City Council as required by Section
20.C. of the City Harbor Permit Policies, which state:
20.C. "The projection of the property line bayward of the same
bearing from the bulkhead shall generally be used in determining
the allowable set -backs for piers and floats. Because there are
certain physical conditions which preclude the strict applications
of this policy without prejudice to adjoining properties, council
approval will be required in areas where precise projections of the
property line have not been determined and the following conditions
occur (2) Where curves or angles exist in the bulkhead line".
As the attached drawing indictes, the applicants' propose a
widening of the U-shaped float on each side of the dock. The
proposed widening of the dock will continue to keep it within the
Harbor. Policies requirements for set -backs and bayward extensions
of floats. The applicants have submitted their revision through
the architecture committee for the homeowner's association on Linda
Isle and their approval is attached also.

I have reviewed the plans as presented to me by Mr. White on
September 27, 1991 for revisions to your dock located at #62 & #63
Linda Isle. Your plans are approved as submitted with the addition
of the indicated 5' setback line adjacent to #61. A licensed
surveyor may be required to verify the final placement of the dock
and new pilings before final approval at completion of construction.
Enclosed I am forwarding to you a stamped set of plans for your
use. Refer to the Associations Remodel Guidelines for further
rules and regulations required during construction. Please return
pages 49, 50, & 51,signed,to me for your file. Refer to Float Dock
and Ramp Development Standards for further information.
The Architectural Committee's approval of'your plans and specif-
ications relates solely to the layout of the dock. The Architect-
ural Committee has made no investigation regarding the legality
or structural quality or soundness of the proposed improvements.
You and your conL_acLor are responsiblc for undert .kJng adequate
structural design for the improvements and thereafter constructing
and maintaining them in accordance with a) the approved plans and
specifications, and b) applicable governmental codes, laws, or-
dinances and regulations. The Architectural Committee's approval
of your plans and specifications does not alter or modify your
obligation to comply with all established building requirements
for your property and with all laws, ordinances, rules and reg-
ulations now or hereafter made by any governmental authority
affecting your property.

Isle, we object to Mr. Sandy Willford's proposed modifications
to his dock located at 62 Linda Isle.
Quite honestly, we are baffled by the fact that while
Mr. Simon was asked to dot every "i" and cross every 'It" and.
was requested to obtain his neighbor's approval before Board
approval, Mr. Willford apparently does not have to comply with
the same requirements. This apparent double standard is
unacceptable.
Before the Homeowners Association Board Makes a final
determination on Mr. Willford's proposed plans, Mr. Simon
should be given the same courtesy afforded to Mr. Willford
Specifically, Mr. Simon requests an opportunity to review the
detailed plans (he has only seen a reduced version) and an
opportunity to voice his objection, if any, at the next Board
meeting.

I wrote your offices on 11 July 1986 relative to the request
of Mr. and Mrs. Jim Shea to make changes in the config-
uration of their dock at #61 Linda Isle.
Since that date we have moved into our home at #62 Linda
Isle and have seen the problems that the Sheas have docking
their boat with only an end tie.
My wife and I hereby withdraw our objections to the request
of Mr. and Mrs. Shea and grant our consent to their con-
structing a dock in accordance and compliance with the draw-
ing attached and all rules and regulations of the city per-
taining to docks and uses of them.

the berthing of the "Lucia" at your residential dock. As you
know, to berth the vessel at your residence now is in violation
of the Newport Beach Harbor Permit Policies. Once the dock has
been revised there should be no problem, but in the meantime
the vessel must be berthed elsewhere.

Recommendation:
If desired, approve the application, subject .to approval of the
Army Corps of Engineers.
Discussion:
This harbor permit application is before the City Council as required
by Section 5 (B) of the Newport Beach Harbor Permit Policies, which state
5.B. "Prior approval of the City Council will be required before the
Marine Department may issue any permit that does not conform to the
standard harbor drawings and the adopted Harbor Permit Policies."
The current configuration of the float is too small for the applicant's
Vessel. The revision will give the applicant sufficient room to berth
his boat and still be in compliance with the City's Harbor Permit
Policies.
The revisions as planned (see attached drawing) has the approval of
the Linda Isle Community Association (attached). In addition to this,
the applicant has gotten signed approval from the following neighbors:
1. George Thagard #60 Linda Isle
2. Plug White #63 Linda Isle
Notices have been placed on adjacent properties making them aware
of the City Council's consideration of this application as required
by Section 5 (G) of the Newport Beach Harbor Permit Policies, as quoted`:
5.G. "Before issuing a Harbor Permit, for any unusual type of,harbor
structure, or for a structure on which the applicant proposes a use that
is not in keeping with the surrounding area, all bayfront property
owners or, long term lessees within 300' of the proposed work shall be
notified in writing by the Marine Department."

Minutes of a Special Meeting of the Architectural Committee was.. held
at 17 Linda Isle, Newport Beach, California, August 3, 1981 at 7:30 p.m.
The meeting was called to order at 7:30 p. m.

A Quorum was present.
The purpose of the meeting is to revue, in full committee, the request
by Mr. Tom Burris, resident #61 Linda Isle to remodel his existing boat
dock.
Chairman Sparr presented the proposal plan for the dock remodel and asked
for discussion.
George Argyros expressed his concern for the possible intrusion of his
"view corridor" if a large boat is docked in the remodeled slip.
Plug White, President of the L. I. C. A. covered the possible disadvantages
of large boats in 'small restricted slip areas.
Richard Elliott, Committee member reminded those present that the Architectral,
Committee was concerned at this meeting with the legality of.the dock remodel
and that control of future use of the dock would be a function of the L. I.
Board.
Forest Olson, Committeeman, discussed in detail his discussion with legal
ccounsel regarding the rights of the Committee.in addressing this matter.
The Chair pol led .all present and received a unaimous approval 'tothe
remodel of the dock as planned.
Richard Elliott moved that the propsed dock remodel be approved by the
Committee with conditions that the use and occupancy of the completed
remodel, be in compliance with the Covenanants, Conditions and Restrictions
as recorded; with the L. I.,C. A. By -Laws; and with all ordinances,, rules
and regulations of any and all governmental bodies having jurisdiction.
The motion was seconded by Forest Olson The Votewas passed
The meeting was adjourned at 8:45 p.m,
