law for the following reasons: (Sec.7031d.5, Business and
Professions Code) �ny City or County which requires a permit to
construct, alter�'! improve, demolish, or repair any structure,

permit to file a signed statement that he is licensed pursuant to
the provision of the Contractors License Law (chapter 9,

Wc are the new purchasers of the home at 69 Linda Isle and are in receipt of
your letter dated November 21, 1996 outlining the deficiencies in the pier at
that location. We have noted your comments about the condition ' of the dock
and the recommendations for the change in the electrical and water connections.
We currently plan to close escrow the middle of January and will be involved in
re-inodeling the home. We request that you proceed to approve the� transfer of
the pier permit at this time with the understanding that we commit to substantial
repairs or replacement of the dock within 1997. Many thanks for your

harbor permit for the above property to Lew and JoAnne
Coppersmith.
The corrections noted on the November 21, 1996, pier inspection

Sirs:
The City of Newport Beach Marine Department has received a reguest
to transfer pier permit 133-0069-1 for the above mentioned
property. The facility was inspected on November 20, 1996
We cannot transfer the pier permit until the following deficiency
has/have been corrected and wE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
2. Portions of the dock, around the perimeter, has dry rot and
must be repaired. The piling frame on the east side of the dock
needs to be attached more securely to the deck.
3. The electrical outlets must be GFI for use in a water
environment. The box on the west side of the dock has become loose.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City Is n-Linimum.
plumbing, electrical and structural. requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit-"

Dear Permittee:
The Finance Department has indicated that the fee for above Harbor
Permit for the year 1991 has not been paid and there is currently
an outstanding balance due of $110.00.
Failure to pay this fee within 30 (thirty) days of receipt of this
letter will result in the Marine Department recommending that the
pier permit be revoked as provided by Section 17.24.090 of the
Newport Beach Municipal Code, which states:
17.24.090 "Any permit heretofore or hereafter granted for any
structure or work in the waters of Newport Harbor or,the Pacific
Ocean may be revoked by the City Council upon the following
grounds: (4) If the permittee has failed for a period of sixty
(60) days to pay the fee or fees heretofore or hereafter imposed
for the occupancy of tidelanhds, filled tidelands or submerged
lands upon which such work or structure exists-"

The structure was inspected on 12/31/85 at which time it was determined
that the following deficiencies exist:
1. The anti -syphon devi'ce at the water connection to the pier must
be replaced with a Ci'ty-approved.anti'-syphon (back.flow preventi-ve)
device.

Another inspection will be made, and if the deficiency is solved, it . will
then be possible to transfer the pier to the new owner.

(p) That no attempt shall be made by the permittee to prevent the
full and free use by the public of all navigable waters at or adjacent
to the activity authorized by this permit.
(q) That if the display of lights and signals on any structure'or
work authorized herein is not otherwise provided for by law, such
lights and signals as may be prescribed by the United States Coast
Guard shall be installed and maintained by and at the expense of the
permittee.
(r) That this permit does not authorize or approve the construction
of particular structures, the authorization or approval of which may
require authorization by the Congress or other agencies of the Federal
Government.
(s) That if and when the permittee desires to abandon the activity
authorized herein, unless such abandonment is part of a transfer
procedure by which the permittee'is transferring his interests herein
to a third party pursuant to Condition (v) hereof, he must restore
the area to a condition satisfactory to the District Engineer.
(t) That if the recording of this permit is possible under applicable
State or local law, the permittee shall take such action as may be
necessary to record this permit with the Register of Deeds or other
appropriate official charged with the responsibility for maintaining
records of title to and interests in real property.
(u) That there shall be no unreasonable interference with navigation
by the existence or use of the activity authorized herein.
(v) That this permit may not be transferred to a third party without
prior written notice to the District Engineer, either by the trans-
feree's written agreement to comply with all terms and conditions of
this permit or by the transferee subscribing to this permit in the space
provided below and thereby agreeing to comply with all terms and conditions
of this permit. In addition, if the permittee transfers the interests
authorized herein by conveyance of realty, the deed shall reference this
permit and the terms and conditions specified herein and this permit
shall be recorded along with the deed with the Register of Deeds or other
appropriate official.
