Dear Sir:
The City of Newport Beach has received an application to transfer
pier permit # 133-79 for the property located at 79 Linda Isle,
Newport Beach, California.
The structure was inspected on 8/22/84 at which time it was determined
that the following deficiencies exist:
1. The dock ramp,including the electrical and water service to the
dock are in such disrepair that a serious safety hazard exists.
This condition is a violation of the City's Harbor Permit Policies
2. which state: "The permittee shall keep the structures in good
repair at all times. Failure to repair, when written notice
has been given by the Marine Department, shall be cause for
3. revocation of the permit."
A drawing of the existing pier and slip are needed to upgrade
4. our files- Enclosed is a copy of the format for the drawing
and a blank form.

In accordance with Section 10-D of the City Harbor Permit Policies:
"All structural deficiencies must be corrected......", it will be
necessary for these to be corrected. A permit for any electrical or
plumbing work must be obtained from the Building Department of the City.
All other work requires a Harbor Permit.
Please advise this department when the above deficiencies have been
corrected.

11 Voluntary Petition was filed on behalf of Sierra in the United
States Bankruptcy Court in Santa Ana, California under Case No. SA -
83 -00411 -AP. On March 30, 1983, a separate Chapter 11 Voluntary
Petition was filed on behalf of Paradise in the United States
Bankruptcy Court in Santa Ana, California under Case No. SA -83 -01454 -
AP. Both of these Chapter 11 proceedings are still pending at this
time. As a result, the undersigned is now and at all times has been
the Receiver - Debtor In Possession for Sierra and Paradise.
The letter is being sent to you in response to the recent
statement - i .. nvoi':ce, demand or other correspondence sent by you to

Sierra and/or Paradise. Your name, address and 1-1,e amount L
most recent statement, invoice and/or demand against Sierra and/or
Paradise have been added to the list of general unsecured creditors
for Sierra and/or Paradise so it is unnecessary for you to send any
further statements, invoices or other correspondence or to file a
Proof of Claim against Sierra and/or Paradise unless and until you
are notified otherwise in writing. At this time it appears very
unlikely that there will be any monies available for the general
unsecured creditors so there is no need for you to do anything until
you are notified. Now that your name is on the general mailing list,
you will receive copies of all Notices required by the Bankruptcy

$18-5 fee as reguired by City Ordinance 17.24.030, quoted herewith:
17.24.030."Transfer of Permit. No person shall transfer a permit
for a pier, float or similar structure granted under the provisions
of this Chapter without prior approval of the City. No person who
as an abutting owner or lessee of real property was granted a permit
for a pier, float or similar structure shall retain any right of use
in such pier, float or similar structure after having divested him-
self of the ownership or leasehold interest in such real property.
Upon such divesting, the ownership interest in such pier, floa,r or
similar structure shall remain with the person wo whom the permit
was granted, but the right of use thereof shall vest in the,.,City
until such time as a permit for s ' uch pier, float or structure is
granted to another person. Except where rights of ownership or use
have heretofore been judicially decreed, no person may heretofore
or hereafter gain any rights of ownership or use of any such pier,
float or similar structure by any purported transfer made without
such prior written approval of the City....".
At your earliest convenience, please advise this office if you have
acquired this property so thatthe necessary transfer can be accomplished
and the pier administration billing sent to the proper person. If we
do not hear from you, the City will find it necessary to follow the
strictures of use and ownership detailed above.
