OWNER -BUILDER DECLARATION
I hereby affirm that I am exempt from the contractor's license law for the following reasons:
(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit
subjects the applicant to a civil penalty for not more than five hundred dollars ($500).
I, as owner of the property, or my employees with wages as their sole compensation,
will do the work, and the structure is not intended or offered for sale (Sec. 7044, Business and
Professions Code: The Contractor's License Law does not apply to an owner of property who
builds or improves thereon, and who does such work himself or through his own employees,
provided that such improvements are not intended or offered for sale. If, however, the
building or improvement is sold within one year of completion, the owner -builder will have
the burden of proving that he did not build or improve for the purpose of sale).

PROPOSED REPLACEMENT OF FLOATING DOCK, ALICE RINDERLEE, 82 LINDA
ISLE DRIVE, NEWPORT BEACH, ORANGE COUNTY
Dear Ms. Swift:
If standard dock construction methods and materials are utilized, this project should not adversely
impact water quality. A statement has been submitted that there will be no waste discharged from
the proposed project. Based on these assurances, clearance is provided.
However, should the Army Corps of Engineers determine that this project requires a Section 404
permit, it will be necessary for the project proponent to obtain from this Board a Water Quality
Certification under Section 401 of the Clean Water Act.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis Developments
Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit application for the development
described below, the Executive Director of the Coastal Commission hereby waives the requirement for
a Coastal Development Permit pursuant to Section 13238.1, Title 14, California Code of Regulations.
If, at a Eater date, this information is found to be incorrect or the plans revised, this decision will
become invalid; and, any development occurring must cease until a coastal development permit is
obtained or any discrepancy is resolved in writing.

LOCATION: 82 Linda Isle, Newport Beach (Orange County)
PROPOSED DEVELOPMENT: Demolish and rebuild existing private 'boat dock. The proposed project
includes: replacing threel2-inch diameter dock pilings with three 14-inch diameter dock pilings. No
dimensional changes are proposed. The existing dock ramp and cantilevered deck will not be
modified. Dredging is not proposed.
RATIONALE: The subject site is a lot located between the first public road and the sea. An Eel
Grass Inspection by the City of Newport Beach Fire and Marine Department states that no Eel Grass is
present in the project area. The proposed development is consistent with the City of Newport Beach
Land Use Plan. The proposed project does not intensify the use of the property. The proposed project
design is also compatible with the character of surrounding development and does not have any
negative affects on visual resources or coastal access. Coastal access is available near the site at
Bayside Drive Park. The project is consistent with Chapter 3 policies of the Coastal Act and previous
Commission approvals, and will not prejudice the City's ability to prepare an LCP.
This waiver will not become effective until reported to the Commission at their February 15-18, 1999
meeting and the site of the proposed development has been appropriately noticed, pursuant to
13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the
site until the waiver has been validated and no less than seven days prior to the Commission hearing.
