Any City or County which requires a permit to construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires the applicant for such permit to file a signed statement that he is licensed pursuant to the provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis for the alleged exemption. A statement has been submitted that there will be no waste discharged from the proposed project. Based on these assurances, clearance is provided. If, at a Eater date, this information is found to be incorrect or the plans revised, this decision will become invalid; and, any development occurring must cease until a coastal development permit is obtained or any discrepancy is resolved in writing. The existing dock ramp and cantilevered deck will not be modified. Dredging is not proposed. RATIONALE: The subject site is a lot located between the first public road and the sea. An Eel Grass Inspection by the City of Newport Beach Fire and Marine Department states that no Eel Grass is present in the project area. The proposed development is consistent with the City of Newport Beach Land Use Plan. The proposed project does not intensify the use of the property. The proposed project design is also compatible with the character of surrounding development and does not have any negative affects on visual resources or coastal access. Coastal access is available near the site at Bayside Drive Park. The project is consistent with Chapter 3 policies of the Coastal Act and previous Commission approvals, and will not prejudice the City's ability to prepare an LCP. This waiver will not become effective until reported to the Commission at their February 15-18, 1999 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing.
