Dear Nancy,
This will confirm that property owners in Newport Harbor may currently apply for an
Individual Permit for dredging projects at their house. These permits are always
available for homeowners as a substitute for the City's Regional General Permit (RGP
54).
Generally, an Individual Permit should be handled through a consultant as the application
is quite lengthy and cumbersome. Actually, the Individual Permit process requires the
applicant to submit separate applications to each of the federal and state agencies. In
addition, it is more costly to apply for this type of permit. However, an Individual Permit
does provide another option for the homeowner.

RE: Current Status of the City's Regional Dredging Permit

Dear Nancy,
This letter will confirm that the City of Newport Beach is currently applying for a
Regional General Permit (RGP 54) through the various federal and state regulatory
agencies. If approved, this permit will allow individual residential properties to complete
smaller dredging projects under their slips in front of their houses.
After the RGP 54 permit has been approved by the agencies, the individual property
owners will still need to apply for a permit via a simplified application to the City. This
application will then be routed to the federal and state agencies for permit conformance,
i.e. eelgrass, caulerpa and grain size reports etc...
Currently, the regulatory agencies are reviewing the City's RGP 54 permit. The Army
Corps of Engineers has issued a public notice which can be viewed at:

It is unknown when the final approval will take effect. However, it is anticipated to be
approved within the next several months.

Dear Roseanne:
Per your request to inspect the pier and dock at 96 Linda, the following deficiency has to
be corrected before the permit can be transferred. Please notify this office once the
correction has been completed.
A Backflow Prevention Device (see attached) must be installed on the water service to
the pier/dock. The purpose of this device is to protect the domestic water system from
being contaminated by sea water.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.

spection was done. It is a new dock by Swift & Swift. The escrow was not completed
at that time.
We have a new buyer and escrow company. Closing date is Aug. 12, 1999. The escrow

improve, demolish, or repair any structure, prior to its issuance, also requires the applicant for such permit

Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid=, and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #5-97-317 APPLICANT: Marianne Moy
LOCATION: 96 Linda Isle, Newport Beach, County of Orange
PROPOSED DEVELOPMENT: Revise an existing residential dock float to install an
8' x 54' with an 8' x 12' "L" and 3 new 14" concrete piles.
RATIONALE: The proposed development does not extend further channelward than
the existing adjacent docks and is within the Pierhead Line. The development
consists of an improvement to an existing dock facility at the same location:
The development will not have any adverse impacts on coastal access and
recreation or coastal resources identified in Chapter 3 of the Coastal Act.
The proposed development is consistent with adjoining development and past
Commission actions.
This waiver will not become effective until reported to the Commission at their
December 9-12. 1997, meeting and the site of the proposed development has been
appropriately noticed, pursuant to 13054(b) of the Admin.istrative Code. The
enclosed Notice Card shall remain posted at the site until the waiver has been
validated and no less than seven days prior to the Commission hearing. If
four (4) Commissioners object to this waiver of permit requirements, a coastal
development permit will be required.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 133-0069-1 for the above mentioned
property. The facility was inspected on April 17, 1997.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
2. The electrical outlets on the dock must be GFI or twist lick
receptacles for use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:

replaced.

shall be inspected for compliance with the CityyIs minimum

Dear Dr. Roisman:
It appears that prior to close of escrow on the above named
property you were not aware that a City approved anti -syphon device
was required before completing transfer of the pier permit.
As of this date we will approve the transfer of the pier permit "as
is", but will require that any future transfer of the permit must
have proof of installation of the City -approved anti -syphon device
on the water line to the dock.

Dear Tony:
This letter is in response to your letter dated September 3,
1990, to Mr. Charles Kuhn, former owner of the above property,
stating that the dock was inspected on 8/31/90, approximately 8
months after the closing of the sale of that property to Leon
Roisman.
In investigating this situation I found that the inspection
request was made to your department by Lynn Valentine, Listing
Broker, prior to close of escrow and that the request was mis-
placed by your department and was found at a much later date, as
evidenced by the date of your inspection. Escrow, however,
unaware of the misplaced request, forwarded the transfer fee of
$275.to your office.
Until the receipt of your letter of 9/3/90, escrow, the listing
and selling agents and the buyer were unaware of any problems.
In our conversation of 11.1 i/ 90, you Stczted that you would glv a a,
letter to the present owner, Leon Roisman, allowing the present
status of the dock to remain "as is" until the property is sold
to a new buyer, since it is presently listed for sale. We under-
stand that at the time of transfer that a city -approved anti
syphon device will be required in order to complete the transfer.

condition(s), a permit for the proposed development, on the grounds that the development
as conditioned will be in conformity with the provisions of Chapter 3 of the California
Coastal Act of 1976, will not prejudice the ability of the local government having juris-
diction over the area to prepare a Local Coastal Plan conforming to the provisions of
Chapter 3 of the Coastal Act, and will not have any significant adverse impacts on the
environment within the meaning of the California Environmental Quality Act.

all permitees or agent(s) authorized in the permit application have acknowledged
that they have received a copy of the permit and have accepted its contents.
V. Any development performed on this permit prior to the review by the Regional Commission
is at the applicant's risk and is subject to stoppage upon_ completion of the review
pending the Regional Commission's approval and/or .completion of any appeal of the
Regional Commission's decision.
VI. Work authorized by this permit must commence within two years from the date of approval.
Any extension of time of said commencement date must be applied for prior to expiration
of the permit.
