COMPLETION REPORT
The permittee shall send one (1) copy of the post -dredging report for each completed individual
dredging project to the Corps and the CCC documenting compliance with all general and
special conditions defined in this permit. The post -dredging report shall be sent within 45 days
after completion of the complete individual dredging project authorized in this permit. The
post -dredging report shall include the following information for the completed individual

read the U.S. Army Corps of Engineers permit, RGP#54 and the California Coastal
Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I
will comply with all of the conditions of those permits. I will further hold the City
harmless from and indemnify them against any claim for damages arising out of the
exercise of these permits. In addition, 1, as the applicant shall reimburse the City of
Newport Beach for all attorneys fees and other costs expended by them in defending

events conform with Consistency Certifications CC-078-99 and/or CC-077-01 and that no further federal .
consistency review is necessary from the Commission for the dredging components of the projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from the Commission for the beach disposal components of the projects.

This is in reply to your applications dated June 21, 2005, for Department of the Army
Permits to conduct maintenance dredging, per Regional General Permit No. 54 in Newport Bay,
Newport Beach, Orange County, California. This letter authorizes maintenance dredging at
five project sites within Newport Bay (see below).

Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54. As long as you comply with the general permit conditions of RGP No. 54, an
individual permit is not required.
Furthermore, you must comply with the following non -discretionary Special Condition:
1. The permittee shall complete all dredging and beach disposal activities prior to
January 24, 2006. Should additional time be required, the permittee shall conduct a new
eelgrass presence/absence survey per the requirements of the Southern California Eelgrass
Mitigation Policy (see: http://swr.nmfs.noaa.gov/hcd/eelpol.htm) and submit results to the
Corps with a request for additional time.
2. The permittee shall confirm coordinates for location of offshore disposal site with City
Harbor Resources Division of all material approved for ocean disposal prior to the disposal of
material. The location of the designated site for LA-3 is expected to change in September 2005.
A general permit does not grant any property rights exclusive privileges. Also, it does not
authorize any injury to the property or rights of others or authorize interference with any
existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other
Federal, State, or local authorizations required by law.

Dear Agencies,
Please accept the attached dredging application for your review. I am writing to explain
the reason for the lag time between the original submittal date and the current request for
review by your departments.
As you can see, the application was submitted in late July 2004 and the applicant
requested the City to perform the eelgrass inspection. However, the next available
negative tide to perform a survey during working hours occurred many months later on
October 14, 2004. The surveys were performed, but unfortunately, the results were filed
away and not matched to the applications. Hence, the applications remained in a different
file until this problem was brought to our attention a few weeks ago.
Harbor Resources has taken steps to ensure that this does not happen in the future. We
sincerely apologize for any inconvenience this may have caused you and hope that the
following applications will be approved as the applicants are quite concerned.

Shellmaker. The sample consists of a SILTY CALY TO CLAYEY SILT (ML-CL): black to
very dark gray to dark olive gray (5Y 2.5-3/1-2); saturated; trace of fine sand. The sample
was obtained from the Salata & Hartuniun Residences, 98 & 99 Linda Isle Drive, Newport
Beach, California at a depth of -1.0 feet to -3.5 feet MLLW.

and Ramp and appurtenances thereto, located at 99 Linda Isle Drive, in
Newport Bay, bayward of Lot 99, Tract 4003, Newport Beach, Orange County,
California, as shown on the drawing accompanying this notice.
PURPOSE AND USE: To provide a dock for small boats.
FEDERAL, STATE AND LOCAL AUTHORIZATIONS: City of Newport Beach. Approval
will also be required from the Coastal Zone Conservation Commission prior
to issuing permit.
ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environmental
Impact Statement on this activity unless significant detrimental effects
are brought to our attention.
CRITERIA: Your written comments or objections should include the number
and date of this notice and must reach this office within thirty (30)
calendar days. The decision whether to issue a permit will be based on
an evaluation of the probable impact of the activity on the public interest.
That decision will reflect the national concern for both protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the activity must be balanced against -its reason-
ably foreseeable detriments. All factors which may be relevant to the
activity will be considered; among those are conservation, economics,
aesthetics, general environmental concerns, historic values, fish and
wildlife values, flood damage prevention, land use classification, navi
gation, recreation, water supply, water quality, and, in general, the
needs and _welfare of the people. Details of changed conditions on the
