Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, thisdecisionwill become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.

LOCATION: 106 Linda Isle, Newport Beach
PROPOSED DEVELOPMENT: Demolish existing dock, piling and ramp and construct a
new dock, piling, pier and ramp
RATIONALE: The addition will not exceed the U. S. pierhead line and has no
potential for significant adverse impacts on coastal resources or public
access.
This waiver will not become effective until reported to the Commission at their
September 12-15, 1989 meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Reference is made to your request of May 30, 1989 (89-367-GS). Under the
provisions of Section 10 of the Rivers and Harbors Act of March 3, 1899 (33
U.S.C. 403), you are hereby authorized to modify the existing boat dock in
Newport Bay at 106 Linda Isle, Newport Beach, California, as shown on the
enclosed drawings and subject to the enclosed conditions.
The owner or authorized responsible official must sign and date all copies
of this Letter of Permission (LOP) indicating that he/she agrees to the work
as described and to comply with all conditions. One of the signed copies of
this Letter of Permission must be returned to the Corps of Engineers (a pre -
addressed envelope is enclosed for your convenience). Notice of the
commencement of the activity must reach this office at leastiodays before the
activity actually starts. Please use the enclosed card.

Dear Sir:
The Cityy of Newport Beach has received an application to transfer pier permit
# 103-U for the property located at 106 Linda Isle.
The structure was inspected on 8/16/85 at which time i.t was determined
that the following deficiencies exist:
1. A City -approved backflow prevention device is required at the pier water
connection.

Section 10.D. of the City Harbor Permit Policies states:
"At the time of transfer -all harbor structures -shall be inspected for
compliance with the City"s minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the permi't."
All the above deficiencies., except those noted as "Informational" must be
corrected before the pier permit is transferred. Electrical or plumbing work
.require a permit from the City Building Department. All other work requires
a permit from the Marine Department. -
Please advise this department when the above deficiencies have been corrected.
Another inspection will be made, and when the problem is solved the pier permit
will be transferred to the new owner.

Dear Sir:
A check of the City's Harbor Permit files has revealed that the
permit for the pier and float at 106 Linda Isle, Newport
Beach is registered to Daniel Bailey.
A transfer application must be completed and a transfer fee
paid each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows:
"No person shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City".
Failure to pay the transfer fees can be grounds 'for revocation of
the Harbor Permit in accordance with Chapter 17.24.090 of the
Municipal Code.
Your cooperation in bringing this permit up to date will avoid
any action by the City.

Sirs:
The accompanying statement of account for the pier permit at
106 Linda Isle, Newport Beach is explained as follows:
The charge for a pier permit for 1983 was $30. Since that was
not paid during the year the penalty for non-payment was 100%
or $30. The policy set by the City regarding delinquent
accounts is written on the bottom of the statement.
The charge for a pier permit for 1984 is $35. You paid only
$30.
The result is that you still owe the City of Newport Beach
$65 for the aforesaid pier permit.
The Municipal Code required that every permit holder who
maintains a pier shall pay an annual registration fee to the
City. Failure to pay this fee plus accrued penalties may
constitute grounds for revocation of the permit.

TRANSFER OF PERMIT INSTRUCTIONS
1. Submit application in quadruplicate on cards provided by the
Tidelands Administrator. DO NOT REMOVE CARBON FROM CARD SETS.
Complete the following information on cards:
a. Name: Name of new owner
b. Address: Street address of facility
c. Mailing address of new owner
d. Telephone number of new owner
e. Fee: $220..00 ,
f. Application portion:
(1) Fill in permit number if known. If not known, leave
blank and the number will be supplied by the Marine
Department.
(2) Type or print names of sellers and buyers.
(3) Obtain signatures of sellers, buyers and joint owner,
if appropriate.
2. When approved, the applicant will receive a copy of the appli-
cation signed by the Tidelands Administrator. Any special con-
ditions pertaining to the -facility will be listed on the card
and the dates or previously issued permits or approvals by
other agencies will be indicated.
3. If.the new owner desires a copy of the drawing of the.facility,
he may purchase one from the Tidelands Administrator for $1.00.

Dear Mr. Peppers:
On March 7, 1977, this department received an application to
transfer the Harbor Permit from you to Mr. Firestone for the
structure located at 106 Linda Isle. Upon attempting to
accomplish this transfer, it was discovered that the permit
had not been transferred from the previous owner, Mr. Garic.
In accordance with the City Harbor Permit Policies, Section
H-10, a transfer must be completed each time there is a change
in ownership of the upland property.
To accomplish this transfer, a transfer card must be completed
and forwarded to this department, along with the $150.00 trans-
fer fee.
The enclosed transfer card has been completed except for the
needed signatures. Please sign the card as indicated and
forward along with the transfer fee.
