Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 13-0034-1 for the above mentioned property.
The facility was inspected on April 17, 1997.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
2. The electrical outlets on the dock must be GFI or twist lick
receptacles for use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:
10. D . "At the time of transfer, all harbor structures
shall be inspected for compliance with the City' s minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."

Section 10 paragraph B of the City Harbor Permit
Policies states:

property, a request shall be made to the City
to transfer the permit".
The fee for this transfer, as established by Section 5

I wish to call to your attention the non-compliance with
regulations of the pier at 34 Linda Isle. The specific areas
of non-compliance are the following:
'k1. The pier is approximately 32 feet from the extension
of the property line on the east side, rather than
5 feet as allowed.
2. The pier protrudes beyond the pier line.
3. The pier is less than 5 feet from the bulkhead, and
5 feet is the minimum distance allowable by the Linda
Isle regulations.
4. The ramp is attached directly to the bulkhead, rather
than to the 10 foot by 14 foot platform, which is at
variance with the drawing on file at the city and
with regulations.

APPLICATION TO: .Add an additional 8'x30slip to the existing slip float
at #34 Linda Isle.
APPLICANT: Mr. Marshall Duffield
RECOMMENDATION: If desired, approve the application, subject to obtaining
a Harbor Permit from Orange County.
DISCUSSION: A. The prior approval of the City Council is required
because the applicant desires to construct a double slip
in front of a single family residence in violation of the
Harbor Permit Policies. County approval is required
because the proposed facility is over tidelands claimed
by Orange County.
B. Because of the unusual nature of this request, all
residents within 300 feet of the proposed facility were
advised of Mr. Duffield's application on 20 Januaryand
were told that the Council would consider the application
at its regular meeting on 9 February. There_ has been no
response to the notification.
C. The Irvine Company has no objection to this construc-
tion.
D. The Council has previously authorized two similar
double slip facilities on Linda Isle. The double slip
bayward of #40 Linda Isle was approved on 26 August, 1968;
and the double slip bayward of #42 Linda Isle was approved
on 24 February, 1969.

CONDITIONS
The Applicant Warrants and Agrees That:
1. The attached exhibit furnished by the applicant shows accurately the location, extent, and character of the
work for which this permit is granted.
2. The County tidelands utilized under this permit are for the recreational use of the fee owners or long-term
lease holders of the adjacent uplands, and if the facilities are rented, leased, or used in any manner for the
applicant's financial gain, the permit will be automatically forfeited.
3. This permit is not subject to transfer, assignment, alienation, pledging or hypothecation; any change in owner-
ship requires a new permit.
4.- The County of Orange retains authority to cancel the permit without cause upon 30 days written notice to the
Permittee's current mailing address kept on file with the Orange County Harbor District, 1901 Bayside Drive,
Newport Beach, California 92662.
5. In the event the Permittee is requested to remove any facilities, the removal will be made and the site re-
stored to its prior unimproved condition at no expense to the County ortheHarbor District. If the facilities
are not removed as requested, the Permittee acknowledges the financial responsibility and agrees to reimburse
the County- or the Harbor District for any expense.incurred in the removal of the facilities.
6. All facilities covered by this permit shall be maintained in good repair and failure to comply will be cause
for cancellation of the permit.
7. The permit shall be automatically forfeited in the event the facilitlee,unu ecL.laay rhp 4for a
period of one year..
8. In the event the County adopts a policy for the renting of tidelands to the adjacent property owners, the area
covered by this permit will be subject to the fee so established.
9. The County of Orange and the Orange County Harbor District shal lro

arising out of use of these tidelands.
10. This permit authorizes use of County tidelands only and does not eliminate the need for other permits for con-
struction and use of facilities, as may be required by other governmental agencies.

or lot and the use of the improvement is reserved for the occupants of the abutting
