In 1997, a Harbor Permit was issued to the property owner of 34 and 35 Linda Isle for residential pier construction. Both of the properties were held by the same owner. The dock is an L-shaped configuration with 45'x14' short side and 105'x12' length with seven 16" octagonal guide piles. The Special Conditions of this Harbor Permit allow the berthing of one 105 foot and one 44 foot maximum length vessel. The dock system was approved according to the following timeline January 6, 1997 Application submitted to Harbor Resources January 17, 1997 Linda Isle Community Association approved plans for dock configuration February 14, 1997 Approval in Concept issued March 7, 1997 Engineer's plans approved by Public Works with Special Conditions March 11, 1997 County of Orange issued Encroachment Permit March 14, 1997 CCC issued De Minimus Waiver 5-97-035W March 21, 1997 Army Corps of Engineers approved dock system March 24, 1997 Harbor Permit 134-35 issued by Wes Armand June 3, 1997 Final Inspection by Wes Armand determined dock revision built to specifications and plans approved by the City of Newport Beach To date the properties have been transferred and are held by one property owner. The dock is built according to City guidelines and has been properly permitted. In the future, should ownership be divided, then options for the dock system may include: a shared pier agreement between 34 and 35 pending Linda Isle Community Association approval; dock tear down and possible reconstruction at one or both properties. At this time, the City of Newport Beach has no further interest pursuing investigations regarding the dock configuration at 34 and 35 Linda Isle. I have enclosed a plot plan showing the boat as it will appear at the new dock. My neighbor, Mr. Ed Hirschman, lot #33, has indicated concern that a large twat could block his view. to the northwest. As you can see by the plot plan, Mr. Hirschman's view would actually be improved over his existing view with my boat and Mr Herbst's present boat. Mr. Hirschman agrees that Mr. Herbst's boat is not a problem. His main concern is that Mr. Herbst may sell the property five or ten years from now and someone with a huge three-story yacht will move in and block his northwesterly view. There is nothing in the by-laws of Linda Isle that have to do with the obstruction of view to the left or right of one's home. Also, a three-story yacht would be much too wide to fit` in Mr. Herbst's dock. I moved onto the island in 1989 because it is a boat -oriented community. You can buy a home on Spyglass Hill for far less money and the views are spectacular. At the time of the purchase there were at least 10 houses for sale on Linda Isle. We chose 33 because of the open view of the Harbor. My neighbors located at #34 and #35 Linda Isle informed me that Mr. Herbst, who owns #35, is purchasing the property at #34. Mr Herbst is intending to erect a dock of "unusual construction" running parallel to both properties in order to park a vessel which is in excess of 100 feet. They have requested my approval (copy of plan enclosed). I am sorry that I cannot in good faith approve of this plan for the following reasons: 1. I do not want to obstruct my existing view of the harbor in any way. 2. If the view was impaired it could adversely affect the value of my property. 3. It appears that physically docking such a large vessel could possibly damage my own property if the water was rough (I am not an authority). 4. At this time it is my understanding that the plan is to have a low fishing boat. But what if a larger vessel such as "RusAlka" or "Pizzaz" or some Riva type boat which is 25 feet wide and at least 40 feet high were to be docked there permanently. This would obstruct my view towards the turning basin and northward and would definitely affect future salability of my home. Sincere Edward G. BOX 1768, NEWPORT BEACH, CA 92659-1768 cq c., FO RN`P August 22, 1991 Jean Watt 4 Harbor Island Newport Beach, CA 92660 Re: Harbor Permit 134-35 for the property bayward of 35 Linda Island Dear Ms. Watt: In May of 1991 we contacted the property owner at 35 Linda Isle, based on a complaint we had received from an adjacent property owner, in regard to an encroaching hydro -hoist. Our harbor inspector, Wes Armand, inspected the property and found that the hydro -hoist was encroaching into the 5 foot set back of the property at number 36 Linda Isle. Based on that encroachment we corresponded with the property owner at number 35 and told him that the hydro hoist must be brought within the extensions of the property lines. It has been the City's policy in the past to treat hydro -hoists as vessels, rather than as part of the dock structure. Therefore, the hydro -hoist would be allowed to go all the way over to the side property line, rather than to respect the five foot setback line as piers and docks are required to do. At the most recent meeting of the Tideland Affairs Committee this policy was discussed by committee members and they felt that at this time there was no need to change it. Throughout the harbor we have approximately 5 or 6 hydro hoist lifts adhering to this policy and this has presented little or no problem. . In the future we will respond to any complaints from the property owners of #36 Linda, and make sure that the hydro hoist stays within the extension of the property lines. Specifically, the complaint is that there is a vessel berthed in violation of Section 21.A. of the City Harbor Permit policies, which states: 21.A. "boats moored at private or public docks shall not extent beyond the projection of the property lines of the property to which the dock facility is connected...". - A field inspection revealed that the vessel berthed on the hydro lift is in a position that has it extending across the property line at 36 Linda Island, and is in violation of the above stated code. Apparently the hydro lift is not secured tight enough and drifts across the property line. Please make the necessary corrections to conform with the Harbor Permit Policies. Recommendation: If desired, deny the application in accordance with the City Council Harbor Permit Policies. Background: On August 8, 1983, the City Council reviewed a Marine Department Staff Report that recommended denial of the subject application and referred the matter to the Tidelands Affairs Committee. The Tideland Affairs Committee visited the property on August 22 and discussed the subject with Mr. Strube. On November' 9, 1983 the committee recommended that the staff contact the applicant and suggest that he redesign the float system to an inverted "T" shaped design to accomodate the applicant's desire to berth a second vessel in front of his property. The applicant, on November 28, 1983, requested that staff refer, the subject application to the full City Council for appeal of the City Council's Harbor Permit Policy which allows only a single slip bayward of residential property. The commi ' ttee suggested that the second vessel" be side -tiled to the existing single slip, or that the applicant could redesign the single slip to an inverted "V� shape configuration, where each vessel would then be side -tied. This type of berthing is not as convenient, noridoes it protect the vessels as well as two "U" shaped slips; however',, it does offer the applicant an alternative without creating the potential for'fu rther precendence on Linda Isle and other areas of Newport Bay. As the attached plan shows, the applicant proposes a revision of his existing slip which would create two slips bayward of his property. This proposal does not conform to Section 1.E. of the Harbor Permit Policites, which states: 1.E. "In R-1 zones, only a single pier and float or slip shall be permitted bayward of each parcel or lot." This policy has been in effect since the original policies were adopted in 1964. This limitation in R-1 zones was designed to discourage the renting of boat slips in residential areas that multiple slips might encourage, and to reduce the potential for parking, noise and other problems that might flow from a rental situation.
