Dear Mr. Friedman:
Reference is made to your request dated October 26, 2009 (File No. SPL-2009-00845-FBV).
Under the provisions of Section 10 of the Rivers and Harbors Act of March 3, 1899 (33 U.S.C. 403),
you are hereby authorized to conduct the work described below at 37 Linda Isle in Newport Bay
within the City of Newport Beach, Orange County, California, as shown on the enclosed
drawings.
Specifically, you are authorized to conduct the following activities affecting_ waters of
the U.S.:
1. Replace an existing 960 square foot "U" shaped dock system with a 760 square foot "L"
shaped dock system re -using the existing gangway and pier platform; and
2. Remove existing piles and install four 18" diameter concrete piles.
The owner or authorized responsible official must sign and date all copies of this Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the. activity (within 10 days following the end of construction).
Furthermore, you are hereby advised that the Corps of Engineers has established an
Administrative Appeal Process which is fully described in 33 CFR Part 331. The complete appeal
process is diagrammed in the enclosed Appendix B.

above referenced structure(s) is under the purview of these Policies and Godes.
2. Any future wprfi on the above mentioned strume(s) requires permits with the City of
Newport Beach and any other applicable agencies. Painting and work considered to be
cosmotie in nature does not require a permit.
3. The conditions set forth in this document pertain to the proposed dock system anp/or
bulkhead under consideration- Any future modifications or alterationa to the dock system

4, Only Marine oriented uses are allowed on the pier, pier platform, gangway and float, Patio

section, no person shall use any public streot, sidewalk, alley or parkway or other public
property for the purpose of storing or displayiN any equipment, materials or merchandise, or

grading, demolition, painting, plastering or any other related building activity, operate any tool,
equipment or machino in a manner which produces loud noise that disturbs, or could disturb, a
parson of normal sensitivity who works or resides in the vicinity, on any weekday except

Sirs:
The City of Newport Beach Marine Department has received
a request to transfer pier permit 134-37 at 37 Linda Isle.
The structure was inspected for a second time on October 4,
1988. At that time it was determined that the correct
anti -syphon device has been installed at the water connection
to the pier and float and is now approved.
The inspector determined at this time, however, that the
structural deficiencies of the float must be corrected
before we can transfer the permit. A large portion of
the dock is underwater and needs to be repaired with new
floats.
Please let us know when this deficiency has been corrected.
When we are so notified, the structure will again be inspected,
and if the requirements have been met the pier permit will
be transferred after the $260 transfer fee has been received.

ask questions in regard to the above.

In reviewing our files of pier permits we note that on 9/26/88 a
request was made to transfer pier permit 134-37 for the property at
37 Linda Isle, Newport Beach. The pier permit at this address was
not transferred for the following reasons:
Correction required as the result of the Marine Department pier
inspections have not been done.
The Newport Beach, Harbor Permit Policies require that the pier
permit be transferred upon the sale of the abutting upland
property. Failure to transfer will result in additional fees and
revocation of the pier permit.
City requirements must be met before the permit can be transferred.
Please contact this office to let us know if the above requirements
have been completed. At your request we will re -inspect the
facility. If the requirements have been met we -will then transfer
the pier permit.

The City of Newport Beach has received a request to
transfer the pier and float at the above address.
We have not transferred the pier as of this date due
to a deficiency in the dock. Specifically a large
portion of the dock is under water and needs repair.
On October 5, 1988 we corresponded with the realty
company handling the sale of the above property and
a copy of that letter is attached for your information.
As of November 4, 1988 the repairs to the pier discussed
in the attached letter have not been made.
If we have not received information relative to the
repair of the above facility within 15 days, it will
be necessary for us to turn this matter over to the
City Attorney's office for followup.

Dear Sir:
The City of Newport Beach Marine Department has received a request
to transfer pier permit #0134-0037 for the property located at 37
Linda Isle, Newport Beach, CA.
The structure was inspected on September 28, 1988 and in
accordance with Section 10-D of the Harbor Permit Policies, it
cannot be transferred until it meets City requirements. The
policy states:
10.D.."At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of
the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit."
We cannot transfer the permit until the following deficiencies
have been corrected and we have been .notified of the correction:
A city approved anti -syphon device is required at the water
connection to the pier and float. Please see attached drawing
indicating the approved installation.
A portion of the dock is nearly under water and needs to be
repaired with new floats. This last is an item of Notice Only and
will not deter transfer of the pier permit.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. When we are so notified, the structure will be
inspected again and when the requirements have been met, the pier
permit will be transferred.

This is in response to your letter. of November 18, 1986 relative to the public property
encroachment permit submitted to you on November 7, 1986 for your continued use of County '
owned tidelands at 37 Linda Isle for your private pier for the calendar year of 1986.-
The legislature of the State of California on May 25, 1919 granted to the County of Orange
those tidelands adjacent to your property. Littoral land owners may be granted permission
to use these tidelands for ` private recreational piers through the processing of an
encroachment permit. The County's established fee for the processing of such a permit
and the rental of such lands has been set by the Board of Supervisors at $150.00 annually.
This nominal fee is a token rental fee and to partially defray processing costs and not a
form of taxation.
The -City of Newport Beach has jurisdictional authority over this area and any permits
required by the City and related fees aie items that should be directed, to the City of
Newport Beach.
In essence, the previously submitted permit application to you is intended for authorizing
your use of public owned tidelands under the authority of the County of Orange. Your
execution of the subject permit and return to this office with the fee of $150.00 will be
appreciated. If you have any questions on this matter, please contact the undersigned at

Enclosed is a copy• -of the paperworkreceived from the Orange County Environ-
mental Management Agency (E.M.A.) on November 12, 1986. Also enclosed, is a
copy of the Annual Pier Permit statement from the City of Newport Beach,
received February 6, 1986. (Please note that the property was recently pur-
chased from Mr. Miller by the undersigned)
When the second set of documents was received, we phoned Mr. Zack Faqih, .
Division Representative, E.M.A., (714/834-3474) for clarification. The
only information he was able to provide was that this was a new -tax due
for the calendar year 1986," as approved by your Board -on May 27, 1986, it
would be an annual fee and that the delay in sending the. paperwork was
the fault of your Board.
We then phoned the City of Newport Beach and spoke with Mr. Tony Melum,
TidelandsAdministrator for the City (714/640-2236) He explained that
the City would Continue to require a pier permit and that there were
"only about 100 property owners" effected by this duplicate pier permit
requirement.
Since only a tiny percentage of the homeowners in Newport Beach have been
selected for this double taxation, we will assume that an error had been
made. Neither of the gentlemen we spoke with has the authority to decide
just which taxing authority has jurisdiction over this issue and they
suggest we write to you, for that decision.

The City of Newport Beach Marine Department has received
a request to transfer pier permit 13.4-37 at 37 Linda Isle.
The structure was inspected for a second time on October 4,
1988. At that time it was determined that the correct
anti -syphon device has been installed at the water connection
to the pier and float and is now approved.
The inspector determined at this time, however, that the
structural deficiencies of the float must be corrected
before we can transfer the permit. A large portion of
the dock is underwater and needs to be repaired with new
floats.
Please let us know when this deficiency has been corrected.
When we are so notified, the structure will again be inspected,
and if the requirements have been met the pier permit will
be transferred after the $260 transfer fee has been received.
