Commission staff have reviewed the information submitted and determined that the above referenced dock
construction projects conform with the submittal requirements established under Consistency Certification CC -
031 -06 the Special Conditions of Coastal Development Permit 5-06-117. Please note that the eelgrass and
Caulerpa taxifolia surveys completed are only valid for a Limited time period and that additional surveys must be
completed and submitted to Commission staff for review if the proposed dock projects listed above do not
commence prior to expiration of the initial survey. In addition, please note that this authorization shall expire on
October 23, 2009 and that all authorized work must be completed prior to that date. Finally, please note there are
ongoing obligations relative to water quality protection established in the authorization which must be implemented
for the entire life of the approved development.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -031-06 and/or conform with the terms and conditions of
Coastal Development Permit 5-06-117. Any change in the projects may cause them to lose their status as
consistent with CC -031-06 and/or CDP 5-06-117. This certification is based on information provided by the City of
Newport Beach. If, at a later date, this information is found to be incorrect or incomplete, this letter will become
invalid, and any development occurring at that time must cease until a new determination regarding conformance
with CC=031-06 and/or CDP -5-06-117, is obtained,

Coastal Commission Permit 5-06-117 & Federal Consistency Certification CC -031-06, the Army Corps
of Engineers Regional General Permit 54 (File No. 200501233 -DPS) and the California Regional Water
Quality Control Board General Certification for Regional General Permit No. 54 for construction in
Newport Harbor and that I will comply with all of the conditions in those permits. I also certify that by
acceptance of this Permit, the applicant acknowledges and agrees that the site may be subject to hazards
from waves and erosion.
I will further hold the City of Newport Beach harmless from and indemnify the City against any claim for
damages arising out of the exercise of these permits. In addition, I shall reimburse the City of Newport
Beach for all attorney's fees and other costs expended by them in defending any claim, lawsuit, or
judgment arising out of the activities of the applicant carried on under the authority of such Permit.
I understand that any work authorized must be completed by October 23, 2009, after which a new
authorization is required.
Per the RGP Permit, all dock construction applications will be processed by the various agencies through
monthly batch submittals sent to them by Harbor Resources. Therefore, all dock construction applications
must be submitted to and received by Harbor Resources by the 1St Monday of every month. Applications
submitted prior to this deadline are encouraged and appreciated.

Dear Mr. Blair:
The Coastal Commission staff has received the above -ref reooed "zoo ef%ats- det=mination for
ocean disposal of 830 cubic yards of material to be dredged at 41 Linda Isle in Newport
Beach. The project would have been, coveredby previous Cvnunission actions (CDP 5-99-282
and Consistency Certification CC -078-991 CC -07701); however those authorizations have
expired. The dredging is exempt from CDP requirements; however the dredging and diapasal
are both subject to federal consistency review. The applicant has complied with the pre-
cor=ruation permit conditions that would have applied had the permit not lapsed.. The material
is suitable for ocean disposal, eelgrass beds would not be affected, and the material is not
suitable for b=b tepleatishmeat. The Commission staffhas typically waived tate requirement
for a consistency certification for these types of situations where aceart disposal at EP.A-
approved ocean disposal sites (including LA -3) of clean, non -sandy material is proposed. The
Commission staffis willing to similarly waive the federal consistency provisions, provided that
the applicant also comply with the remaining permit conditions that would have applied,

(e) If turbid conditions are generated during construction a silt curtain shall be

sides, shall be locared as fir away as possible from drain inlets and any
waterway, and shall not be stored in contact with the soil;
(g) All debris and trash shall be disposed of in the proper trash and recycling
receptacles at the end of each constmetiou day;
(h) The discharge of any hazardous materials into the harbor or any receiving
waters shall be prolu'bited;
(i) Prior to commencement of beach nourishment the boundaries of any
ealgrass meadow within the general project area shall be marked with
buaye so that egnigment and vessel operators shall avoid damage to
celgrass meadows;
G) Barges and other vessels shall be armored a minimum of 15 feet from any
eelgrass bed. Anchors aad.anrbor chains shall not cacnoacb into any
eelgrass bed_
(k) Barges and other vessels shall avoid transit over any eelgrass meadow to
tbien=imrms extent practicublo. Where transit over edgraw beds is
tmavoideble auch transit shall only occur during high tides when
grounding and potential damage to eelgrass can be avoided.

Hi Steve,
As I mentioned in our phone conversation today, it appears there may be some hope for you to complete your
dredging sooner rather than later. After speaking with Karl Schwing of the Coastal Commission, he suggested
that you compose a letter to him asking for your previously approved application to be considered for a Federal
Consistency Review. In this letter, you would need to briefly describe the project, the total cubic yards requested
to dredge, the disposal method (LA -3 ocean disposal) etc... All of this information is already on your application.
Please CC me on this letter so I can keep a copy in the file.
Along with this letter, please also include the rest of your original application (eelgrass, caulerpa surreys etc...) I
will mail them to you this week. I have a feeling this may work. The one caveat is that they may demand another
eelgrass inspection because it has been so long from the last inspection.
If this request for Federal Consistency Review does not work, then you will still have 2 options for dredging:
1) Apply for an Individual Permit. This requires more work and form completion. It'll also take another few
months to work through the application process, along with more application fees. I wouldn't recommend this.
2) Wait until April or so for the City's new Regional General Permit to be in effect. You'll still need to resubmit
your application and you may need another eelgrass / caulerpa inspection, but it'll get approved fairly quick and
shouldn't cause you much distress.
I think this should answer all of your questions. Let me know if you need further clarification.

(RGP) No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2006 to accommodate the
requested year extension past the expiration of RGP No. 54. A general permit does not grant
any property rights exclusive privileges. Also, it does not authorize any injury to the property
or rights of others or authorize interference with any existing or proposed Federal project.

COLLECTION
Samples collected by a hand coring device driven into a representative area of the dredge
site and receiving beach. Stored in plastic containers and immediately delivered to the lab.
SAMPLE PREPARATION
Entire sample transferred into 1 liter glass containers, deionized water added, and
mixed to desalt and disperse the sediment. The sediment is allowed to completely
settle and the clear water is removed by siphoning. The sample is placed in a drying
oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry
sample is transferred to a desiccator for cooling. The sample is disaggregated and a
Riffle sediment splitter is used to evenly split the sample to reduce the quantity of
material to be analyzed to an allowable retention weight for the sieves.
SAMPLE ANALYSIS
The dry split fraction is processed through a # 10 U.S. standard sieve to remove the
gravel/shell fraction of the sample. The material retained on the sieve is weighed and
value recorded. The material passing through the # 10 sieve is wet sieved through a
#230 sieve to remove the silt/clay fraction. The material retained on the sieve is
transferred back into the glass container and placed back into the drying oven at 50°C.
The remaining sample is allowed to completely dry and the material is weighed and
recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting
the gravel/shell and sand fractions from the total analysis weight.

We cannot transfer the pier permit until the following deficiencies have been corrected
and the property has been re -inspected:
1. It needs 2 new testable Backflow Prevention Devices installed (please see diagram).
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural deficiencies
must be corrected prior to transfer of the permit."
Please call 644-3034 to request a reinspection. Once the property has passed

The City of Newport Beach Marine Departmen'%-, has received.arequest
to transfer pier permit # 134-41 for the property located at 41
Linda Isle, Newport Beach,�CA.
We cannot transfer the pier permit until the folowing
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED
OF. THE CORRECTION:
1. A city approved anti -syphon device is required at the water
connection to the pier and,float.
The structure was inspected on 7/21/88. The City Harbor Permit
Policies state:
10.D. "At the time of transfer, all harbor structures shall
be inspected for compliance with the City's minimum plumbing,
electrical and structural requiremenmts, and the conditions of the
existing permit. All structural deficiencies must be corrected
prior to transfer of the permit."
A permit for plumbing or electrical work must be obtained from the
Building Department of the City.
PLEASE ARISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again
be inspected and when the requirements have been met the pier
permit will be transferred.
