STANDARD CONDITIONS:
Notice of Receipt and Acknowledgment. The permit is not valid and development shall not
commence until a copy of the permit, signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. Interpretation. Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. The permit may be assigned to any qualified person, provided assignee files with
the Commission an affidavit accepting all terms and conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the permittee to bind all future owners and possessors;
of the subject property to the terms and conditions.
SPECIAL CONDITIONS: See pages six and seven.
EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby det ' ermines that the proposed development is a category of
development which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act. If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Pronect Description and Background
1 Promect Description
Installing a 6'x 34'finger to an existing dock and also adding a 16" x 35' guide pile (Exhibit #3).
The floating dock will only be used for boating related purposes.
The subject site is located in the locked gate community of Linda Isle in Lower Newport Bay in
the City of Newport Beach (Exhibits #1-2). No public access currently exists through the site.
However, the project will have no impacts on existing coastal access. Public access to the
harbor exists in the area across -the channel from the Linda Isle community along the public
walkways on Lido Island and Balboa Island (Exhibit #1). The -dock project is for boating
recreation purposes and is associated with an existing single family home. The site has been
surveyed by the City of Newport Beach Harbor Resources Division for eelgrass and no eelgrass
was discovered within 15 feet of the project area. The proposed project has received approval
in concept from the City of Newport Beach Harbor Resources Division. The applicant has

applied for permits from the U.S. Army, Corps of Engineers and the California Regional Water
Quality Control Board (RWQCB). The RWQCB has determined that the proposed project will
not adversely impact water quality if standard construction methods and materials are used.
B. Marine Resources
The proposed project is located in and over the coastal waters of Lower Newport Bay (Exhibits #1 -2).
Lower Newport Bay is a critical coastal water body on the federal Clean Water Act 303(d) list of
"impaired" water bodies. The designation as "impaired" means that water quality within the water
body does not meet State and Federal water quality standards designed to meet the 1972 Federal
Clean Water Act goal of "fishable, swimmable" waters. In Newport Harbor, the listing cites elevated
concentrations of metals, pathogens, nutrients, pesticides, and toxic organic compounds from a
variety of sources including urban runoff, boatyards, contaminated sediments, and other unknown
non -point sources as the reason for listing the harbor as an "impaired" water body. The listing is
made by the California Regional Water Quality Control Board, Santa Ana Region (RWQCB),.and the
State Water Resources Control Board (SWRCB), and confirmed by the U.S. Environmental
Protection Agency. The RWQCB has targeted the Newport Bay watershed, which would include
Newport Harbor, for increased scrutiny as a higher priority watershed under its Watershed Initiative.
The standard of review for development proposed in coastal waters is the Chapter 3 policies of the
Coastal Act, including the following marine resource policy. Section 30233 of the Coastal Act limits
the fill of open coastal waters.
Section 30233 of the Coastal Act states:
(a) The diking, filling, or dredging of open coastal waters, wetlands, estuaries, and lakes shall
be permitted in accordance with other applicable provisions of this division, where there is no
feasible less environmentally damaging alternative, and where feasible mitigation measures have
been provided to minimize adverse environmental effects, and shall be limited to the following:
(4) In open coastal waters, other than wetlands, including streams, estuaries, and lakes,
new or expanded boating facilities and the placement of structural pilings for public
recreational piers that provide public access and recreational opportunities.
The Coastal Act limits the fill of open coastal water and also requires that any project which results in
fill of open coastal waters provide adequate mitigation. Section 30233 of the Coastal Act allows fill of
open coastal waters, such as Lower Newport Bay, for recreational boating purposes. The proposed
project requires installing one new pile, which constitutes fill. The installation of this pile will displace
habitat bottom. The fill required by the project is for a recreational boating facility, an allowable
purpose under 30233 (4) of the Coastal Act. The project can be consistent with Section 30233,
however, only if it is the least environmentally damaging feasible alternative and feasible mitigation
measures have been provided to minimize environmental effects. In order to anchor the proposed new
finger securely, one additional pile is necessary. This is the minimum number of piles necessary to
adequately support and anchor the new proposed finger. The proposed project will use the minimum
number of piles thereby minimizing the amount of fill needed to support the allowable use. Thus, the
project as proposed is the least environmentally damaging alternative. Section 30233 also requires
that any project which results in fill of open coastal waters also provide adequate mitigation. The
proposed project meets this requirement because the pilings are self mitigating by providing vertical
habitat for marine organisms.
For the reasons listed above, the Commission finds that the proposed project is consistent with Section
30233 of the Coastal Act.

C. 'Water Quality
The proposed project is located in and over the coastal waters of Lower Newport Bay (Exhibits #1 -2).

for development proposed in coastal waters is the Chapter 3 policies of the Coastal Act, including the
following water quality policies. Sections 30230 and 30231 of the Coastal Act require the protection of
biological productivity, public recreation, and marine resources.
Section 30230 of the Coastal Act states:
Marine resources shall be maintained, enhanced, and where feasible, restored. Special
protection shall be given to areas and species of special biological or economic significance.
Uses of the marine environment shall be carried out in a manner that will sustain the biological
productivity of coastal waters and that will maintain healthy populations of all species of marine
organisms adequate for long-term commercial, recreational, scientific, and educational purposes.
Section 30231 of the Coastal Act states:
The biological productivity and the quality of coastal waters, streams, Wetlands, estuaries, and
lakes appropriate to maintain optimum populations of marine organisms and for the protection of
human health shall be maintained and, where feasible, restored through, among other means,
minimizing adverse effects of waste water discharges and entrainment, controlling runoff, -
preventing depletion of ground water supplies and substantial interference with surface water
flow, encouraging waste water reclamation, maintaining natural vegetation buffer areas that
protect riparian habitats, and minimizing alteration of natural streams.
The construction will occur over and in the water. Construction of any kind adjacent to or in coastal
waters has the potential to impact marine resources. The Bay provides an opportunity for water
oriented recreational activities and also serves as a home for marine habitat. Because of the coastal
recreational activities and the sensitivity of the Bay habitat, water quality issues are essential in review
of this project
Construction Impacts to Water Quali
Storage or placement of construction materials, debris, or waste in a location subject to erosion and
dispersion or which may be discharged into coastal water via rain, surf, or wind would result in adverse
impacts upon the marine environment that would reduce fhe biological productivity of coastal waters.
For instance, construction debris entering coastal waters may cover and displace soft bottom habitat.
In addition-, the use of machinery in coastal waters not designed for such use may result in the release
of lubricants or oils that are toxic to marine life. Sediment discharged into coastal waters may cause
turbidity, which can shade and reduce the productivity of foraging avian and marine species ability to
see food in therwater column. In order to avoid adverse construction -related impacts upon marine

resources, Special Condition #1 outlines construction -related requirements to provide for the safe
storage of construction materials and the safe disposal of construction debris.
Special Condition -#1 requires that the applicant dispose of all demolition and construction debris at an
appropriate location. This condition requires the applicant to incorporate silt curtains and/or floating
booms when necessary to control turbidity and debris discharge. Divers shall remove any non-
floatable debris not contained in such structures,that sink to the ocean bottom as soon as possible.
Best Management Practices
The proposed dock project will allow for the long term berthing of boat(s) by the homeowner. Some
maintenance activities if not properly regulated could cause adverse impacts to the marine
environment. Certain maintenance activities like cleaning and scraping of boats, improper discharges
of contaminated bilge water and sewage waste, and the use of caustic detergents and solvents, among
other things, are major contributors to the degradation of water quality within boating facilities. As
mentioned above, Lower Newport Bay provides a home for marine habitat and also provides
opportunity for recreational activities. The Bay eventually drains into the Pacific Ocean through tidal
flushing.
To minimize the potential that maintenance activities would adversely affect water quality, the
Commission imposes Special Condition #1 that requires the applicant to follow Best Management
Practices to ensure the continued protection of water quality and marine resources. Such practices that
the applicant shall follow include proper boat cleaning and maintenance, management of solid and
liquid waste, and management of petroleum products, all of which associated with the long term
berthing of the boat(s) (more thoroughly explained in Special condition #1 of this permit).
Therefore, only as conditioned to minimize construction related impacts during the dock repairs and to
follow the Best Management Practices listed in Special Condition #1 does the Commission find the
proposed project consistent with Section 30230 and 30231 of the California Coastal Act.
D. Local Coastal Program
Section 30604(a) of the Coastal Act provides for the issuance of coastal development permits directly
by the Commission in regions where the local government having jurisdiction does not have a certified
local coastal program. The permit may only be approved if the Commission finds that the proposed
development will not prejudice the ability of the local government to prepare a Local Coastal Program
which conforms with the Chapter 3 policies of the Coastal Act.
The Newport Beach Land Use Plan was effectively certified on May 19, 1982. The City currently has
no certified implementation plan. Therefore, the Commission issues CDP's within the City based on
the development's conformance with the Chapter 3 policies of the Coastal Act The LUP policies may
be used for guidance in evaluating a development's consistency with Chapter 3. The City's LUP states
that the City seeks to insure the highest quality of water in the bay.and along their beaches. The
proposed project is conditioned to adhere to construction responsibilities, debris removal and Best
Management Practices. Thus, the proposed project is not expected to create additional adverse
impacts to water quality and the marine environment and.therefore promotes the highest quality of
water in the Bay and along the beaches.
As explained above, the proposed development is consistent with Chapter 3 policies of the Coastal Act
and with the LUP. Therefore, approval'of the proposed development will not prejudice the City's ability
to prepare a Local Coastal Program (Implementation Plan) for Newport Beach that is consistent with
the�Chapter 3 policies of the Coastal Act as required by Section 30604(a).

E. California Environmental Quality Act (CEQA)
Section 13096(a) of title 14 of the California Code of Regulations requires Commission approval of
Coastal Development Permit applications to be supported by a finding showing the application, as
conditioned by any conditions of approval, to be consistent with any applicable requirements of the
California Environmental Quality Act (CEQA). Section 21080.5(d)(2)(A.) of CEQA prohibits a proposed
development from being approved if there are feasible alternatives or feasible mitigation Measures
available which would substantially lessen any significant adverse effect which the activity may have on
the environment.
The proposed project as conditioned has been found consistent with the marine resources policies of
the Coastal Act. As conditioned, there are no feasible alternatives or feasible mitigation measures
available which would substantially lessen any significant adverse impact which the activity may have
on the environment. Therefore, the Commission finds that the proposed project can be found
consistent with the requirements of the Coastal Act to conform to CEQA.
SPECIAL CONDITIONS -
1.
A. Construction Responsibilities and Debris Removal
(a) No construction materials, equipment, debris, or waste will be placed or stored
where it may be subject to wave, wind, or rain erosion and dispersion.
(b) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(c) Machinery or construction materials not essential for project improvements will
not be allowed at any time in the intertidal zone.
(d) If turbid conditions are generated during construction a silt curtain will be utilized
to control turbidity.
(e) Floating booms will be used to contain debris discharged into coastal waters
and any debris discharged will be removed as soon as possible but no later
than the end of each day.
(f) Non -buoyant debris discharged into coastal waters will be recovered by divers
as soon as possible after loss.
B. Best Management Practices Program
By acceptance of this permit the applicant agrees that the long-term water -borne
berthing of boat(s) in the approved dock and/or boat slip will be managed in a manner
that protects water quality pursuant to the implementation of the following BMPs.
(a) Boat Cleaning and Maintenance Measures:
1 In -water top -side and bottom -side boat cleaning shall minimize the
discharge of soaps, paints, and debris.
2. In -the -water hull scraping or any process that occurs under water that
results in the removal of paint from boat hulls shall be prohibited. Only
detergents and cleaning components that are designated by the
manufacturer as phosphate -free and biodegradable shall be used, and
the amounts used minimized.

3. The applicant shall minimize the use of detergents and boat cleaning
and maintenance products containing ammonia, sodium hypochlorite,
chlorinated solvents, petroleum distillates or lye. .
(b) Solid and Liquid Waste Management Measures:
1. All trash, recyclables, and hazardous wastes or potential water
contaminants, including old gasoline or gasoline with water, absorbent
materials, oily rags, lead acid batteries, anti -freeze, waste diesel,
kerosene and mineral spirits will be disposed of in a proper manner and
will not at any time be disposed of in the water or gutter.
(c) Petroleum Control Management Measures:
1 Oil absorbent materials should be examined at least once a year and
replaced as necessary. The applicant will recycle the materials, if

prevent oil and fuel spills. Boaters are also encouraged to. use

or steam cleaning services as much as possible to clean oily bilge
areas. Clean and maintain bilges. Do not use detergents while
cleaning. The use of soaps that can be discharged by bilge pumps is
discouraged.

On 18 November 2004, the California Coastal Commission granted to Sergio Liovio
Coastal Development Permit 5-03-458, subject to the attached Standard and Special
Conditions, for development consisting of: Remove an existing 6'x 25' section of an
existing dock and one (1) 14" diameter pile and install an 8'x 50 finger and three
(3) 16" diameter piles. The project will impact 987 square feet of eelgrass that
would be transplanted elsewhere on-site or otherwise mitigated at a 1.21 ratio.
More specifically described in the application file in the Commission offices.
The development is within the coastal zone in Orange County at 20 Linda Isle,
Newport Beach.

1. Notice ofReceipt and Acknowl-edg-ment. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
permittee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years
from the date on which the Commission voted on the application. Development
shall be pursued in a diligent manner and completed in a reasonable period of
time. Application for extension of the permit must be made prior to the expiration
date.
3. Inter2retation., Any questions of intent or interpretation of any condition will be
resolved by the Executive Director or the Commission.
4. Assignment. The permit may be assigned to any qualified person, prov ided.-
assignee files with the Commission an affidavit accepting all terms�and -
conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditio . ns shall
be perpetual, and it is the intention of the Commission and the permittee to bind
all future owners and possessors of the subject property to the terms and
conditions.
SPECIAL CONDITO h S':
1. REVISED PROJECT DESIGN
A. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT,
the applicant shall submit, for review and approval of the Executive
Director, revised plans indicating that the float portion of the proposed
boat dock is constructed of open, grated material, as proposed by the
applicant, to maximize penetration of sunlight to the water below.
B. The permittee shall undertake development in accordance with the
approved final plans. Any proposed changes to the approved final plans
shall be reported to the Executive. Director. No changes to the approved
final plans shall occur without a Commission amendment to this coastal
development permit unless the Executive Director determines that no
amendment is required.

2 FINAL EELGRASS MITIGATION PLAN
A PRIOR TO]SSUANCE OF THE COASTAL- DEVELOPMENT PERMIT,
the applicant shall submit, for review. and approval of the Executive
Director, a revised final eelgrass mitigation plan for transplanting and
replacement of eelgrass adversely impacted by the project. The plan shall
be prepared in consultation with the California Department of Fish and
Game and the National Marine Fisheries Service (NMFS). The plan shall
be prepared consistent with the requirements identified below and the
requirements of the Southem California Eelgrass Mitigation Policy
(SCEMP), including but not limited to the requirements outlined relative to
mapping, and mitigation site, size, techniques, monitoring and success
criteria, but excepting the allowed exclusions and timing requirements that
conflict with the requirements identified below.
The plan, shall provide that:
(a) As proposed, all eelgrass impacts shall be,mitigated at a
minimum 1.21 (mitigation to impact) ratio;
(b) adveme,impacts to:eelgrass shall be mitigated, on-site to. e
th
maximum extent feasible and for the portion that cannot feasibly
be mitigated on site, off-site mitigation within one or more of the
(6) six sites previously identified by the applicant. The final
location of all on-site and off-site mitigation shall be specifically
Apritified;
(c) the mitigation site(s) shall be covered with eelgrass at pre -project
densities of the impacted site within five years of the initial
planting;
(d) initial planting at the mitigation site(s) shall be completed prior to
commencement of construction of the portions of the approved
project that would have direct impacts upon eelgrass beds,
(e) a report that describes densities, and recommended maintenance
and replanting measures shall be submitted annually to the
Executive Director;
(f) a comprehensive report describing the results of the plan shall be
submitted at the end of the proposed seven-year period;

is wholly or partially unsuccessful.

B. The permittee shall undertake development in accordance with the
approved final plans. Any proposed changes to the approved final plans

PRE -CONSTRUCTION EELGRASS SURVEY
A.
Pre -construction Eelgrass Survey. A valid pre -construction eelgrass
surveyshall �be completed during the po . riod of active growth of eelgrass
(typically March through October). The pre -construction survey shall be
completed prior to the beginning of construction and shall be valid until the
next period of active growth. The survey shall be prepared in full
compliance with the "Southern California Eelgrass Mitigation Policy"
Revision 8 (except as modified by this condition) adopted by the Natio nal
Marine Fisheries Service and shall be prepared in consultation, with the
California Department of Fish and Game. The applicant shall submit the
new eelgrass survey for the review and approval of the Executive Director
within five (5) working days of completion of the new eelgrass survey and
in any event no later than fifteen (15) working days prior to
commencement of construction. If the new survey identifies, within the
proposed project area, any eelgrass which is not documented in the
eelgrass survey described in the final eelgrass mitigation plan approved
by the Ex Director pursuant to Special Condition No. 2, the newly
identified eelgrass shall be transplanted prior to commencement of
construction at a 1.2:1 (mitigation to impact) ratio at the same .
transplantation location(s) identified in the final eelgrass mitigation plan
described in Special Condition No. 2 above. The transplantation shall
occur consistent with all provisions of the mitigation plan described in
Special Co6dition No. 2.
B. Post Construction Eelgrass Survey. After completion of project
construction, the applicant shall survey the project site to determine the
quantity of eelgrass that was adversely impacted. This post -construction
survey shall be completed in the same month as the pre -construction
survey during the next, growing season immediately following the
completion of construction within coastal waters. The survey shall be
prepared in full compliance with the "Southern California Eelgrass
Mitigation Policy" Revision 8 (except as modified by this condition)
adopted by the National Marine Fisheries Service and shall be prepared in
consultation with the California Department of Fish and Game. The
applicant shall submit the post -construction eelgrass survey for the review
and approval of the Executive Director within thirty (30) days after
completion of the survey. If any eelgrass has been impacted in excess of
those disclosed pursuant to Special Condition No. 2., the applicant shall

replace the additionally impacted eelgrass at a 1.21 (mitigation to impact)
ratio at the.transplantation site(s) and in accordance with the mitigation
plan described in Special Condition 2 above.
4. PRE -CONSTRUCTION CAULERPA TAXIFOLIA SURVEY
'A. Not earlier than 90 days nor later than 30 days prior to commencement or
re -commencement of any development authorized under this coastal
development permit (the "project"), the applicant shall undertake a survey
of the project area and a buffer area at least 10 meters beyond the project
area to determine the. presence of the invasive alga Caulerpa taxifolia.
The survey.shall include a visual examination of the substrate.
B. The survey protocol shall be prepared in consultation with the Regional
Water Quality Control Board, the California Department of Fish and Game,
and the National Marine Fisheries Service.
C..
Within five (5) business days of completion of the� survey, -the, applicant
Shall submit the survey:
L; for the review and, approval of the -Executive Director; and
ii. to the Surveillance Subcommittee of the Southern California
Caulerpa Action Team (SCCAT). The SCCAT Surveillance
Subcommittee may be contacted through William Paznokas,
California Department of Fish & Game (858/467-4218) or Robert
Hoffman, National Marine Fisheries Service (562/980-4043).
D. If Caulerpa taxifolia is found within the project or buffer areas, the
applicant shall not proceed, with the project until 1) the applicant provides
evidence to the Executive Director that all C. taxifolia discovered within the
project area and all C. taxifolia discovered within the buffer area have
been eliminated in a manner that complies with all applicable
governmental approval requirements, including but not limited to those of
the California Coastal Act, or 2) the applicant has revised the project to
avoid any contact with C. taxifolia. No revisions to the project shall occur
without a Coastal Commission approved amendment to this coastal
development permit unless the Executive Director determines that no
amendment is legally required.

CONSTRUCTION RESPONSIBILITIES AND DEBRIS REMOVAL
The permittee shall comply with the following con stru ction-related: requirements:
A. No construction materials, equipment, debris, or waste shall be placed or
stored where it may be subject to tidal and wave erosion and dispersion.
B. Any and all debris resulting from construction activities shall be removed
from the site within 10 days of completion of construction.
C. Machinery or construction materials not essential for project improvementc
shall not be allowed at any time in the intertidal zone.
D. Sand from the beach, cobbles, or shoreline rocks shall not be usedfor
construction material.
E. If turbid,conditions are generated during construction a silt curtain shall be
utilized to control turbidity.
F. Measures shall be taken to ensure that barges do not ground and impact
eelgrass sites.
G. Floating booms shall be used to contain debris discharged into coastal
waters and any debris discharged shall be removed as soon as possible
but no later than the end. of each. day.
H. Non -buoyant debris discharged into coastal waters shall be recovered by
divers as soon as possible after loss.
1. Reasonable and prudent measures shall be taken to prevent any
discharge of fuel or oily waste from heavy machinery, pile drivers, or
construction equipment or power tools into coastal waters. The applicant

,Wt's.contractors shall have adequate equipment available to
contain any such spill immediately.
J. All stock piles and construction materials shall be covered, enclosed on all
sides, shall be located as far away as possible from drain inlets and any
waterway, and shall not be stored in contact with the soil.
K. All debris and trash shall be disposed of in the proper trash and recycling
receptacles at the end of each construction day.
L. The applicant shall use the least damaging method for the construction of
pilings and any other activity that will disturb benthic sediments. The
applicant shall limit, to the greatest extent practicable, the suspension of
benthic sediments into the water column.

BEST MANAGEMENT PRACTICES PROGRAM
By acceptance�of this permit the applicant agrees that the longrterm water -borne
berthing of boat(s) in the approved dock and/or boat slip will be managed in a
manner that. protects water quality pursuant to the implementation of the
following BMPs.
A. Boat Cleaning and Maintenance Measures:
1. In -water top -side and bottom -side boat cleaning shall minimize the
� - discharge of soaps, paints, and debris..
2. In -the -water hull scraping or any process that occurs un ' der water that
results in the removal of paint from boat hulls shall be prohibited. Only
detergents and cleaning components that are designated by the
manufacturer, as phosphate -free and biodegradable shall be used, and
the amounts used minimized.

�-3. The applicant shall minimize the use of detergents, oat
and maintenance products containing ammonia, sodium hypochlorite,
chlorinated solvents, petroleum distillates or -lye.
B. Solid and Liquid Waste Management Measures:
1 . All trash, recyclables, and hazardous wastes or potential water
contaminants, including old gasoline or gasoline with water,
absorbent materials, oily rags, lead acid batteries, anti -freeze,
waste diesel, kerosene and mineral spirits shall be disposed of in a
proper manner and shall not at any time be disposed of in the water
or gutter.
C. Petroleum Control Management Measures:
1. Oil absorbent materials shall be examined at least once a year and
replaced as necessary. The applicant shall recycle the materials, if
possible, or dispose of. them in accordance with hazardous waste
disposal regulations. The boaters shall regularly inspect and maintain
engines, seals, gaskets, lines and hoses in order to prevent oil and fuel
spills. Boaters shall also use preventive engine maintenance, oil
absorbents, bilge pump -out services, or steam cleaning services as
much as possible to clean oily bilge areas and shall not use detergents
while cleaning. The use,of soaps that can be discharged by bilge
pumps is prohiblied.

Beach on June 10, 2003.
We cannot transfer the pier permit until the following deficiencies have been corrected
and the property has been re -inspected:
1. It needs a GFI, ground fault interrupter on the electrical line to the dock.
The Newport Beach City Council Harbor Permit Policies state:
1 O.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural deficiencies
must be corrected prior to transfer of the permit."
Please call 644-3034 to request a reinspection. Once the property has passed
reinspection the dock will be transferred.

Linda Island, Newport Beach, the structure was re -inspected on
December 14, 1993, at which time it was determined that it conforms
to city standards.
Once we have received the pier transfer card, signed by both the
previous owner and the new owner, and the $300 transfer fee, we
will be able to transfer the pier permit.

The City of Newport Beach marine Department has received a request
to transfer pier permit 0135-002-1 for the property located at 20
Linda Island, Newport Beach, CA. The facility was inspected on
12/09/93.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
The electrical outlet on the dock is hanging loose from the dock
and needs to be reattached.
The Newport Beach City Council Harbor Permit Policies state:
10. D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred. Included in requirements for transfer of the
pier permit is the $300 transfer fee and the signed transfer card.

Linda Isle, Newport Beach, CA. The facility was inspected on
5/2/89.
We cannot transfer the pier permit until the folowing
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED
OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water
connection to the pier and float. A drawing and description of
the device approved by the City is enclosed.
Please note that the existing anti -syphon device is not the type
that is required by the Municipal Code.
The City Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requiremenmts, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the permit."
A permit for plumbing or electrical work must be obtained from the
Building Department of the City.

DISCUSSION: A., Prior.approval of the City Council is required
because the proposed float does not conform to
the standard harbor drawings.
B. The water area between the bulkhead and the pierhead
line bayward of Lot.20 Linda Isle is unusually large.
C. Although the proposed float is large and a somewhat
unusual shape, its design conforms to all set back
requirements and it does not interfer in any way with
the adjacent harbor -facilities -or the navigable channel.
D. Mr. Bishop desires to moorlone 30 foot sailboat along
the finger float. The swim float and small, boat area
will be used for storing two small sailboats -out of the
water when they are not being used.
E. The water area bayward of Lot 20 Linda Isle.is over
tidelands claimed by.the County of Orange. The Orange
County Harbor Commission approved this'application
on March 9, 1971, and a County Permit has been issued.
This application has also been approved by the Corps
of Engineers, 3-11-71;,the Irvine Company, 8-5-70;,
and the Joint Harbor Committee on 3-9-71.
F. In summary,, as previously stated, the situation is
somewhat unusual with respect to,the water area and
the size of the float which are both large. The
Proposed installation does conform to all other
Harbor Permit Policies, does not interfer with adjacent
harbor facilities and has received approvals from all
other agencies involved.

the City of Newport Beach. The receipt for payment of the application

A non-exclusive revocable permit for the non-commercial use of County tidelands is
hereby granted to the owner or long term leaseholder of the adjacent uplands, for
the purpose of encouraging I recreational boating in Newport Harbor. The permit is
subject to all conditions abd limitations referred to in the application..
IN WITNESS WHEREOF, the Director of Harbors, Beaches and Parks, Acting on Authority
delegated by Board of Supervisors Resolutions 69-836 and 70-32, hereby grants the
Permit on behalf of the County.

CONDITIONS
The Applicant Warrants and Agrees That:
1. The attached exhibit furnished by the applicant shows accurately the location, extent, and character of the
work for which this permit is granted.
2. The County tidelands utilized under this permit are for the recreational use of the fee owners or long-term
lease holders of the adjacent uplands, and if the facilities are rented, leased, or used in any manner for the
applicant's financial gain, the permit will be automatically forfeited.
3. This permit is not subject to transfer, assignment, alienation, pledging or hypothecation; any change in owner-
ship requires a new permit.
4. The County of Orange retains authority to cancel the permit without cause upon 30 days written notice to the
Permittee's current mailing address kept on file with the Orange County Harbor District, 1901 Bayside Drive,
Newport Beach, California 92662.
5; In the event the Permittee is requested to remove any facilities, the removal will be made and the site re-
stored to its prior unimproved condition at no expense to the County or the Harbor District. If the facilities
are notremoved as requested, the Permittee acknowledges the financial responsibility and agrees to reimburse
the County or the Harbor.District for any expense incurred in the removal of the facilities.
6. All facilities covered by this permit shall be maintained in good repair and failure to comply will be cause
for cancellation of the permit.
7. The permit shall be automatically forfeited in the event the facilities are unused by the applicant for a
period of one year.
8. In the event the County adopts a policy for the renting of tidelands to the adjacent property owners, the area
covered by this permit will be subject to the fee so established.
9. The County of Orange and the Orange�County Harbor District shall be held harmless from any and all liabilities
arising out of use of these tidelands.
10. This permit authorizes use of County t idelands only and does not eliminate the need for other permits for con-
struction and use of facilities, as may be required by other governmental.agencies.
11. The improvement is I imited to a single pier and float or sl ip bayward of each parcel
or lot and the use of the improvement is reserved for the occupants of the abutting
upland property.

cation. This item will be heard,by the City Council -on Monday,
March,22,,1971.: The -.Council meeting commences at 7:30 p.m., but,
harbor.permits come up about mid -way through the Council agend . a.
It is difficult to predict the exact time, but I would suspect
it would be after 9:00 p.m. Although it is not mandatory, I
would recommend that either you or your representative bd present
at the Council meeting.
Unfortunately Mr. Dawes and I will both be out of town on the
22nd due to prior commitments. I do not anticipate any problem',
and I will brief another member of the City staff on this matter
in the case any further questions are asked by the Council.
