This is a Preliminary reports as required in accordance with the Southern California Eelgrass Mitigation Policy (SCEMP) since eelgrass is widely distributed throughout Southern California Coastal and Harbor Regions. This survey was completed within the eelgrass growing season and per the Southern California Eelgrass Mitigation Policy (SCEMP). Impacts to eelgrass were difficult to assess due to the size of the survey area and proximity of neighboring properties impacts to this site. Considerable time diving and mapping taking quadrats where possible were conducted determining visibility, depth, and tidal flow (current). Survey conducted is for the purpose of addressing the requirement to determine impact on existing natural habitat and navigational impact to waters and channel. Location Owner (Plitt Residence) at 22 Linda Isle, Newport Beach, CA is proposing to replace existing dock with a new dock having different dimensions. This survey is Preliminary Survey in accordance with SCEMP guidelines. Purpose This Preliminary survey report addresses one of the requirements under the SCEMP to establish a baseline for the density and extent of eelgrass for the purpose of evaluating future proposed impacts on existing natural habitat, in particular eelgrass within the waters of the United States (U.S.), and in Newport Harbor, California (Refer to Figure 1). Please note that this survey report is not a scientific research paper. This report is provided to a private individual with limited resources for the purpose of monitoring eelgrass habitat required by Coastal Development Commission and comply with the SCEMP. Survey Method Survey was conducted on October 26, 2014, beginning at approximately 0945 hour. The survey day was sunny, air temperature was 660 Fahrenheit (F), water temperature was 62° F. Pursuant to SCEMP, Section 3 for "Mitigation"', eelgrass habitats and potential habitats were measured. Determining sample size is complex. The dock slip was reviewed from the surface and a determination of sample size was completed prior to conducting the survey. Sample size was confirmed after a thorough evaluation of potential eelgrass habitat within project site had been completed. No additional quadrats were felt to be needed to provide reliable survey results of the potential impact area and changes that could occur in the future. A total of 6 quadrats were placed in approximately 2,700 square feet (823 meters square) of the 1 The project applicant shall map thoroughly the area, distribution, density and relationship to depth contours of any eelgrass beds likely to be impacted by project construction. This includes areas immediately adjacent to the project site which have the potential to be indirectly or inadvertently impacted as well as potential eelgrass habitat areas. Potential habitat is defined as areas where eelgrass would normally be expected to occur but where no vegetation currently exists. SCEMP 1991. The sample size was believed to be adequate because of the pattern of the eelgrass near the shoreline. Expected eelgrass patterns, although ever changing, are expected to be fairly similar over time. For the potential impact area around the dock slip, the sample size is 0.22 percent (6 square feet sample size/2,700 square feet area of potential impact). (Refer to Figure 2). Thus, the largest sample areas would be where it is important to measure impacts to eelgrass (and potential) habitat. Determining location and placement of 6 quadrats as per requirements of SCEMP is complex and must be completed using numerous considerations, in addition to considerations of habitat suitability, primarily in association with the level of expected impact from the proposed project. After an initial over - water and under -water review of the eelgrass area, quadrant locations were selected representing a range of suitable habitat, potential habitat and anticipated impacts to eelgrass habitat from around Clients dock slip. (Refer to Figure 2). As described above, 6 quadrants were placed within survey area (2,700 square feet). Each quadrant measured one square foot (0.3 meter) and was used to measure eelgrass density. They were placed in depths of 9 feet (2.7 meters), 11 feet (3.3 meters), 12 feet (3.6 meters) and 15 feet (4.5 meters). Eelgrass in Southern California has been found in depths of up to 98 feet (27.8 meters)2; however, eelgrass is primarily found up to 20 feet (6.1 meters) in depth in this type of sheltered intertidal habitat3, and therefore representative depths found within the dock slip were selected, including potential habitat found within the dock slip. Due to limited private individual resources, a basic assumption was made the eelgrass presence is considered to be the most likely area to support suitable eelgrass habitat within the survey area in the future. (Refer to Figure 2). Other considerations must be discussed as there are factors within this dock slip that appear to be limiting the growth of eelgrass beyond a certain depth (Refer to Figure 2 and the Discussion section of this report below). Survey area was delineated as 45 feet by 60 feet (2,700 square feet) and accounted for minimum of 60' out from sea wall. Diver transects ran parallel with sea wall running 45' lengths. Survey was conducted with 2 divers spaced approximately 1 foot apart. Lanes ran parallel to sea wall and the width of each lane was 5 feet wide with divers scanning approximately 1 foot on either side starting out 60 feet from sea wall, thus, 12 transects were conducted (Refer to Figure 2) covering the entire area to ensure >75% coverage of bay floor. A 1' square (0.3 meter square) grid was used to take 6 quadrant samplings. (Refer to Figure 2). Exact location of eelgrass estimated in Figure 2 & 3 were based on this information; 6 gaudrats placed in the expected areas adjacent to existing "U" shape dock slip. As per the SCEMP and due to the size of the dock slip, other potential eelgrass habitats were also observed and found barren of eelgrass in what might be considered potential habitat. (Refer to Figure 2). All 6 quadrats were placed in areas where eelgrass is present and probably has grown for several years; exact length of time is unknown. Potential eelgrass habitat was surveyed and determined abiotic parameters are consistent with existing eelgrass habitat. A review of any potential differences in the eelgrass habitat and potential eelgrass habit could be compared. 2 California Department of Fish and Game. Description of Existing Habitat and Conditions According to SCEMP, Section 3, "Mitigation", factors to be considered in delineating potential habitat areas include appropriate circulation, light, sediment, slope, salinity, temperature, dissolved oxygen, depth, proximity to eelgrass, history of eelgrass coverage, and etc. The data in this report is compared with the data of habitat in P.L.A. Erftemeijer and K.E. van de Wolfshaar (2006) report that describes minimum tolerated, optimum range and maximum tolerated conditions for Zostera marina eelgrass and personal experience of diving in Southern California Bays. (Refer to Dive Observations and Discussion below)4. Please note that in general, abiotic parameters are generally stable year around for this site location. Dive Observations of 22 Linda Isle: Depth: Depth ranged from 9 feet near shore to 15 feet at end of survey area at a length of 60 feet out from sea wall and 45' wide along sea wall. (Refer to Figure 2). Appropriate Circulation: Circulation in this particular dock is likely similar to the circulation pattern in the main channel of the Newport Harbor because of proximity of this survey area to the main channel. Light: Within the dock slip, visibility was > 1 foot and murky due to particulate matter in water. The origin of the particulate matter is unknown, but is likely to be the same as the condition in the nearby Harbor channel. Sediment: The survey area bottom substrate was fine sand, shell fragments and dirt or clay (sediment). Salinity: Salinity would be expected to be the same in the dock slip as in Newport Harbor. Temperature: Water temperature variation ranges from 59' to 62° F in Newport Harbor, California. Water temperature is likely higher due to shallow waters and higher than normal daily temperatures at time of survey. Dissolved oxygen: Hypoxia, which is generally defined as dissolved oxygen levels that are less than 2 to 3 mg/L and creates dead zones where this condition is present in some locations of Newport Harbor from water runoff of Newport Beach City. Dissolved oxygen in Harbor Waters near 22 Linda Isle, Newport Beach, CA can range from 4.2 mg/L to 10.3 mg/L due to several Abiotic factors. What is important here is this range is acceptable for eelgrass habitats. At time of survey dissolved oxygen was approximately 8.5 mg/L using the LaMotte Dissolved Oxygen Test Kit. Depth: The depth of the eelgrass habitat measures between 9' and 15' feet and 6 eelgrass patches. Potential eelgrass habitat measures 9-15 feet in depth as well. (Refer to Figure 2). Proximity to eelgrass coverage: The potential eelgrass habitat is located immediately adjacent to the eelgrass habitat so eelgrass has the potential to spread. Low Tide Exposure: Optimum conditions for eelgrass habitat include less than 0 to 5 percent of the time for low tide exposure. Due to the dock's location in the southern portion of Newport Harbor, the proposed dock slip would not have any low tide exposure. Slope: Slope descent increases as distance increases from sea wall. The slope of survey site bottom depth starts at 9 feet at the sea wall and slopes 60 feet out from sea wall, where the depth is 15 feet with an overall slope of 10 percent (6 foot depth differential / 60 feet from sea wall). The slope of the eelgrass covered portion of the survey area was small due to all 6 patches having very small areas covered (0 foot depth differential / varied feet from sea wall differential) is 0 percent. The potential eelgrass (eelgrass absence) habitat slopes from 9 foot depth at sea wall to 15 foot depth 60 feet from sea wall (6 feet depth differential / 60 feet non-eelgrass extending out from sea wall) and has a slope of 10 percent. There is a 0 percent difference in slope between the eelgrass habitat and the potential eelgrass habitat since they parallel from sea wall to channel. The contour of bottom is a slow descent from sea wall out to the channel at a slightly increasing rate evenly paralleling the length of the sea wall within the surveyed area. Circulation: Please note that this tide information is not exact as circulation is difficult to estimate in the Newport Harbor because there are no gauges available in that area. However, circulation would be anticipated to be similar as in the Newport Harbor channel. Fauna: Observation included common species of Newport Harbor mussels on piles6 and common round rays (Urobatis halleri; rays)7. Other factors effecting eelgrass growth is visibility, dissolved oxygen, and water depth. Some areas of Newport Harbor show signs of hypoxia and no marine life exists in these areas. A complete study of dissolved oxygen in Newport Harbor has not been conducted but having dived nearly 50% of the Harbor since 1995 and observed large areas devoid of much of the marine life. Eelgrass: Eelgrass was observed within the survey area. (Refer to attached Eelgrass Survey Reporting Form and Figures 2). Due to murky water and a less than 1-3' foot visibility pictures underwater were not possible but did not hinder surveyor to determine eelgrass distribution, eelgrass density in relation to depth, and eelgrass lengths, including sediment type, slope and contour of bottom. A total of 6 quadrats were taken at varying depths and distances from the sea wall. Figure 2 & Table 2 list all quadrats taken in relation to existing and potential eelgrass habitats and are shown as blue stars in Figure 2 and listed in Table 2 with bounding coordinates in Table 3. This Preliminary surveys site has existing "U" shape dock structure. This survey was conducted within existing floating dock system (Refer to Figure 2). Eelgrass distribution was observed as Patches 1,2,3,4,5,E as shown in Figure 2, Table 2 & 3. Density and length throughout survey area was uniform and documented in Figure 2, Tables 1 and 2. After the 15 foot depth mark eelgrass was not observed towards the channel. . (Refer to Figure 2). Eelgrass Patches 3 at the 15 foot depth was directly below the end of the finger. Eelgrass patch 5 inside the slip at 11 foot depth was directly below the dock. Eelgrass Patches 1 and 2 were at the 15 foot depth and approximately 5 feet from end of dock fingers. Eelgrass Patches 4 and 6 were on the property line either side of the dock at the 14 foot depth each. Discussion: First, it is important to understand that SCEMP requires a level of assessment in accordance with the level of impacts, and does not require an exhaustive research report. The observational survey report should provide a baseline for evaluation of future impacts to eelgrass. The survey should provide an assessment of the survey site such that the baseline can be used to adequately assess impacts to eelgrass in two sequential years if required under SCEMP. Thus, a selection of sample size and evaluation of the quadrats are of primary importance. Second, it is important to know the history of dock slip. Historically, the existing dock has been present for several years. The distribution of eelgrass within bay and estuarine systems is defined by numerous variables, including light, temperature, salinity, substrate, wave exposure, currents and nutrient availability. Eelgrass forms extensive meadows in soft -bottom habitats from the low intertidal to depths of about 20 feet (6 meters), and from sheltered areas to exposed coasts. In southern California, eelgrass has been reported to occur as deep as 98 feet (30 meters). Optimum temperatures for eelgrass growth seem to lie between 50 and 680F (10 and 200C). However, eelgrass is known to survive with a lower tolerance level of 21 OF (-6°C) and an upper level of 104.9°F (40.50C). A salinity range of 10 to 30 parts per thousand is optimum for growth.$ In general, low circulation (<5 cm/second) to medium circulation (20 — 40 cm/second) is considered an optimum range of circulation for eelgrass to grow9. Circulation in the canal is consistent with a slight current and comes from the main Bay body of water in Newport Harbor. This slight current could account for eelgrass in the outer portion of the dock slip into the channel. It is likely other causes for this eelgrass proliferation into the canal exist, it was not possible fully analyze the environmental impacts due to limited resources of the customer. However, circulation observed is expected to be suitable to support eelgrass. Reduction in light due to turbidity has been identified as a major cause of the loss of seagrasses worldwide (Shepherd et al., 198910; Green and Short, 200311). Particulate matter in Newport Harbor is high, but is likely equal in all areas of the dock slip. Visibility in Newport Harbor is low due to an increased density of particulates in the sea water. Low visibility has effect on sunlight penetration into water and is a limiting factor for eelgrass existing at deeper than 12-15' depths. This measurement varies throughout Newport Harbor. Sediment is a general term describing Newport Harbor bottom make up which sediment is in this case made up of dirt to silt to clay saturated with traces of fine sand and shell fragments. Gravel has been noted while diving throughout most Newport Harbor docks but not observed at this survey site. Bedrock does exist and sometimes forms an obstruction whether rocks/boulders/refuse at varying depths roughly averaging 20 feet below bottom existing slowing down pile installations. This bedrock does not appear to have a visible impact on the surface of the bottom of Newport Harbor water ways. Existing "U" shape dock slip has 6 eelgrass patches. Patches 3 and 5 are directly below existing dock slip. Refer to Figure 2. Proposed "I" shape dock slip would not be shading any of the existing eelgrass patches. In fact; eelgrass patch 3 would be approximately 10 feet from proposed dock slip and eelgrass patch 5 would be approximately 2 feet from proposed dock slip. Refer to Figure 3. Conclusion A total of 6 quadrats were placed in survey area. In addition to the general results of the survey, the results in Table 2 and 3 of each quadrat should be used in evaluating any future surveys conducted and potential future mitigation. Proposed dock slip would not shade existing eelgrass patches. The facility was inspected on August 28, 2000. We cannot transfer the pier permit until the following deficiencies have been corrected and we have been notified of the corrections: The dock has been modified from the structure approved by the City of Newport Beach. A new section (approximate 8X12) of dock is adjoining the original dock. To retain this additional section, an application must be obtained from the City of Newport Beach Building Department and submitted to that department. The only other option is to remove the section of dock. The pier must have a backflow prevention device in accordance with Title 17 of the California Administrative Code. A drawing showing the approved installation technique and approved devices is attached to this letter. The Newport Beach City Council Harbor Permit Policies require that at the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum standards, and the conditions of the existing permit. All structural deficiencies must be corrected prior to transfer of the permit. Please advise this department when the above deficiencies have been corrected. CALIFORNIA 90053 General Permit GP004 Newport Bay 1 November 1977 TO WHOM IT MAY CONCERN: The District Engineer, Los Angeles District, Corps of Engineers announces the issuance of a general permit.covering the installation of privately - owned boat docks in Newport Bay, a Navigable Water of the United States, as required -by Section 10 of the River and Harbor Act of 3 March 1899. This permit is issued in accordance with the provisions of 33 C.F.R. 3209 322, 325-26 and, 328-29, titled, "Regulatory Program of the Corps of Engineers" which provides that the District Engineer may issuea general permit for activities which are substantially similar in nature, that cause only minimal adverse environmental impacts when performed separately and have minimal adverse cumulative effect on the environment. Upon issuance of a general permit, all: activities meeting the established cri- teria are approved and will not require the submission of individual permit applications. This general permit also authorizes the modification and replacement of existing boat docks but not the installation of new boat docks where none exist in Dover Shores and around the perimeter of Balboa Island. Under no circumstances will the general permit, allow boat dock construction requir- ing bulkheading, dredging, or filling below the Mean Higher High Water (MHHW),.,elevation or in wetlands. Construction of a boat dock will not be allowed across any beach designated for community or -public use, unless the.new dock will replace an existing dock and cause no additional encum- brances on.beach recreation. Typical drawings, depicting the most common types of installations that are covered by this general permit, are included in this notice along witha map showing those Navigable Waters of the United States where the general permit is applicable.. The general permit covers both existing and proposed facilities within any of the private property boundaries shown on the -attached drawings. Individual: boat docks that do not conform to the established general criteria will require a separate permit. The general permit is not SPLCO-N 1 November 1977 General Permit GP004 applicable to commercial or public marinas nor to structures extending bayward of the pierhead line The general permit is issued for a period of five (5) years from the effective date of this permit. DEFINITIONS: a. The term "navigable waters of the United States" means those waters of the United States that are subject to the ebb and flow of the tide shoreward to the mean high water mark (mean higher high water mark on the Pacific coast) and/or are presently used or have been used in the past, or may be susceptible to use to transport interstate or foreign commerce. (See 33 CYR 329 for a more complete definition of this term.) b. The term "wetlands" means those areas that are inundated or saturated by surface or ground water at a frequency and duration suffi- cient to support, and that under normal circumstances do support, a preva- lence of vegetation typically adapted for life in saturated soil condi- tions. Wetlands generally include swamps, marshes, bogs and similar areas. c. The term- "adjacent" means bordering, contiguous, or neighboring. Wetlands separated from other waters of the United States by manmade dikes or barriers, natural river berms, beach dunes and the like are "adjacent wetlands." SPECIAL CONDITIONS: a. The permittee shall notify the District Engineer in writing at least fifteen (15) days prior to the initiation of the work. This noti- fication shall include the dock length, location of the dock by lot and tract number, and the name, address, and telephone number of the per- mittee. b. The permittee shall comply with the City of Newport Beach and County of Orange or other local authority in the construction and place- ment of the dock. c. Docks shall not exceed 800 sq ft of float or pier surface. d. The permittee shall submit project plans to the state of California Regional Water Quality Control Board, Santa Ana Region, and shall obtain approval from the Regional Board prior to initiation of any work authorized herein. 2 i SPLCO-N 1 November 1977 General Permit GP004 STANDARD CONDITIONS: a. That all activities identified and authorized herein shall be con- sistent with the terms and conditions of this general permit; and that any activities not specifically identified and authorized herein shall constitute a violation of the terms and conditions of this general permit which may result in the institution of such legal proceedings as the United States Government may consider appropriate, whether or not this general permit has been previously modified, suspended or revoked in whole or in part. b. That the permittee agrees ,to make every reasonable effort to pro- secute the work authorized herein in a manner so as to minimize any adverse impact of the work on fish, wildlife and natural environmental values. c. That the permittee agrees to prosecute the work authorized herein in a manner so as to minimize any degradation of water quality. d.That the permittee shall permit the District Engineer, or his authorized representative(s) or designee(s) to make periodic inspections at any time deemed necessary -in order to assure that the activity being .performed under authority of this general permit is in accordance with the terms and conditions prescribed herein. e That the permittee shall maintain the structure or work authorized herein in good condition and in accordance with the drawings attached hereto f. That this general permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and that it does not authorize any injury to property or invasion of rights of any infringement of Federal, State, or local laws or regulations, nor does it obviate the requirement to obtain State or local assent required by law for the, activity authorized herein. g. That this.general permit does not authorize the interference with any` -existing or proposed Federal Project and that the permittee shall not be entitled'to compensation for damage or injury to the structures or work authorized herein which may be.caused by or result from existing or future operations undertaken by the United States in the public interest. h. That this general permit may be summarily suspended, in whole or in part upon `a finding by the District Engineer that immediate suspen- sion of the activity authorized herein mould be in the general public interest. 3 SPLCO-N 1 November 1977 General Permit GP004 i That this general permit may be either modified, suspended or revoked, in whole or in"part, it the Secretary of the Army of his author- ized representative determines that there has been a violation of any of the terms of conditions of this permit or that such action would other- wise be in the public interest. Any such modification, suspension, or revocation shall become effective thirty (30) days after publication of written notice of such action which shall specify the facts or conduct warranting same. J. That'any modification, suspension, or revocation of this general permit shall _not be the basis for any claim for damages against the United States. k. That no attempt shall be made by the owner to prevent the full and free use by the public of all navigable waters at or adjacent to the activity authorized by this general permit. 1 That if the display of lights and signals on any structures or work authorized herein is not otherwise provided for by law, such Lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the expense of the permittee. m. That if and when the permittee desires to abandon the activity authorized herein he must restore the area to a condition satisfactory to the District Engineer:, n. That there shad be no unreasonable interference with navigation by the existence or use of the activity authorized herein. o. That permittee hereby recognizes the possibility that the struc- ture permitted herein may be subject to damage by wave wash from passing vessels. The issuance of this general permit does not relieve the per mittee from taking all proper steps to insure the integrity of the struc- ture permitted herein and the safety of boats moored thereto from damage by wave wash and the permittee shall, not hold.the United States liable for such damage.
