As the Commission met that evening I brought this matter up off agenda: The Commission graciously acted upon it. The Commission recommends the'pier transfer of ownership permit: be executed by the lDirector subject to the following: 1.'; Execution by the new owners of a tidelands use and occupancy rental j agreement. 2. A determination by EMA Central Permits that the structure does not include a cantilevered deck upon or over county tidelands in question. The cantilevered deck issue is a touchy one. County Counsel customarily maintains that such decks, which are an extension of landside living space upon or over public tidelands, are not a permissible use as the deck does nothing to further commerce, fisheries and navigation. However, the City of Newport Beach pier permit policies permit such decks. Therefore, prac- tically, such decks are prohibited only on county tidelands within Newport .Harbor, which constitutes perhaps 10% or less of the total private piers in Newport Harbor. It is known there are many cantilevered decks in exist- enceon Linda Island, as allowed by the city, thus this Commission condition. If an expection discloses that such a deck does exist, we should bring the matter back before the Commission for a recommendation perhaps to the Board of Supervisors. It is noted the UCB`representative appears confused in his letter of July 16 as to the multitude of permit fees applicable. While to the bank official. it may seem that a duplication exists, the simplest explanation is that the City of Newport Beach has a permit and inspection fee system for all con- struction within the city limits. The County of Orange has a fee system as landlord or property --,mer of ti.d'elards *,which happen to be within the city.
