RATIONALE: The proposed development will have no adverse impacts on coastal access or resources, is consistent with the City's certified LUP, with the Chapter 3 policies of the Coastal Act and past Commission actions in the area. This waiver will not become effective until reported to the Commission at their October 8-11, 1991_ _ _, meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the Administrative Code. The facility was inspected on 5/10/91 for the second time. This reinspection confirmed the facts stated below: We cannot transfer the pier permit until the following deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: 1. A City -approved anti -syphon device is required at the water connection for the water supply to the pier and float. A sketch showing the approved type of device and its installation is enclosed. The City Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the city's minimum plumbing, electrical and structural requiremenmts, and the conditions of the existing permit. All structural deficiencies must be corrected prior to transfer of the permit." A permit for plumbing or electrical work must be obtained from the Building Department of the City. PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN CORRECTED. When we have been notified, the structure will again be inspected and when the requirements have been met the pier permit will be transferred. Included in requirements for transfer of the pier permit is the $275 transfer fee and the signed transfer card. You can telephone 714-644-3044 to request a reinspection of the structure. This inspection is routine before the pier permit can be transferred. In the course of the inspection it was noted that a major modification had been made to the float without a permit or authorization by the Marine Department. This was done in violation of the City Harbor Permit Policies, Section 3.A. which state: 3.A.No person or agency shall build, maintain, extend or make structural alterations on any building, pier, piling, bulkhead, sea wall, reef, breakwater, or other structure in, upon or over the waters of Newport Harbor or the Pacific Ocean or any other water where the tide ebbs and flows within the City, or do any filling, excavating or dredging in said waters or ocean, without first obtaining a written permit to do so from the City." The inspection also revealed that the existing float structure is in a state of disrepair, with broken decking, broken pier hangers and other defects which represent a safety hazard. This is a violation of Section 4.H. of the Harbor Permit Policies, which state: "4.H. The Permittee shall keep the structures in good repair at all times. The boat is moored at Linda Island, at 27 Linda Island, I believe. Basically, the complaint lies in the fact that the boat encroaches over our client's boundary line and prevents our client from enjoying the use of his own berth, which would be on the south side of "Sea Fever". In addition, we feel that section 21 of the materials you forwarded to me may be violated. Also, it appears that the owner of "Sea Fever" is contem- plating the extension of the dock further out into the bay. You advised me that this cannot be done, but I am certain that the owner would petition for a variance. I would be somewhat interested in the merits as to that. It also appears that at this point the boat is blocking the views of the neighbors of the harbor. I don't know if this is per se a violation of City policy, but would be interested if it is a factor in determining that another violation might exist. Lastly, it appears that the reason for the boat being At its present location is to afford the boat owner convenience in running a chartering operation from that residence. I would surmise that this would be in violation of Linda 'Island covenants, and am fairly certain that an argument exists that this would be in violation of local zoning laws. I really appreciate your looking into this matter. If you have any thoughts that you could share, I'd certainly be recptive to them.
