Ohl, Deputy City Attorney, ext 3131 dohl@city.newport-beach.ca.us SUBJECT: REGULATION OF ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICES (SEGWAY) RECOMMENDATION: Staff seeks further direction from City Council on what regulations are necessary and appropriate to regulate Electric Assistive Personal Mobility Devices ( EPAMD), commonly referred to as Segways, within City limits. DISCUSSION: This topic was last before the City Council at a Study Session on April 26, 2005. Staff has prepared a draft ordinance to regulate these devices in the following manner: 1. A ban on the Oceanfront Boardwalk, Bay Front north and south sidewalk, Edgewater Plaza, both piers and all beaches. 2. No unsafe movements are allowed and segways may pass others only when it is safe to do so. 3. If the EPAMD are rented, it must be indicated on the EPAMD where they cannot go similar to surrey cycles. 4. If tours are provided, they would only be permitted to go where the EPAMD are allowed and must have two or more guides. 5. Violations would be an infraction. Staff is prepared to bring an Ordinance to Council for action with the above provisions and any additional provisions or restrictions as directed by Council. Ohl, Deputy City Attorney Attachments: Draft Ordinance F:\ users\ cat\ shared \CCstaffReports \SegwaysStudyS ession08- 23- 05.doc c- ORDINANCE NO. 2005- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, ADDING CHAPTER 12.58 TO THE NEWPORT BEACH MUNICIPAL CODE REGULATING ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICES WHEREAS, the City of Newport Beach ( "City ") is a charter city, governed by a charter adopted by the citizens of the City; WHEREAS, it has recently been suggested by the public that the City consider regulating electric personal assistive mobility devices, more commonly referred to as segways, within City limits; WHEREAS, an electric personal assistive mobility device is defined in the Vehicle Code as a self - balancing, non - tandem, two -wheel device that can turn in place, is designed to transport only one person at a maximum speed of less than 12.5 miles per hour with an electric propulsion system averaging less than 750 watts (1 horsepower); WHEREAS, a recent change to State law has expanded the definition of pedestrian to include anyone using one of these devices. Vehicle Code Section 467(a)(2); WHEREAS, State law also allows public entities, by ordinance, to regulate the time, place and manner that these devices can be operated, and allows them to be prohibited in some or all areas as determined by the local entities. Vehicle Code Section 21282; WHEREAS, other jurisdictions have restricted their use to protect the health, safety and welfare of pedestrians, motorists or persons operating electric personal assistive mobility devices on public property; and WHEREAS, the City Council's consideration should be given to regulating electric personal assistive mobility devices on the oceanfront boardwalk, bay front north and south sidewalk, the Newport and Balboa piers, Edgewater Place, public beaches and by resolution on such other public streets, sidewalks, parking lots and other public property when it is determined to be necessary to protect the health, safety and welfare of pedestrians, motorists or persons on such public property. NOW THEREFORE, the City Council of the City of Newport Beach, California, HEREBY ORDAINS as follows: J SECTION 1: The following Chapter is added to Title 12, Vehicles and Traffic and to read as follows: Chapter 12.58 ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICES REGULATIONS Sections: 12.58.010 Definitions 12.58.020 Electric Personal Assistive Mobility Device Restrictions 12.58.030 Unsafe Activity 12.58.040 Special Restrictions 12.58.050 Penalty 12.58.010 Definitions As used in this Chapter, the following terms and words shall have the following meanings: "Bay Front Sidewalk" means the concrete walkway approximately eight (8) feet in width which extends around the perimeter of Balboa Island and immediately adjacent to the bay. It is also known as bay front north and south. "Disabled Persons" means those person as defined in Vehicle Code Section 295.5. "Edgewater Place" means the concrete walkway approximately thirty (30) feet in width which extends from Coronado Street to "A" Street and is adjacent to the bay. It is also known as the Balboa Fun Zone. "Electric Personal Assistive Mobility Device" shall mean a self - balancing, non - tandem two wheeled device, that can turn in place, design to transport only one person, with an electric propulsion system averaging less than 750 watts (1 horsepower), the maximum speed of which, when powered solely by an electric propulsion system on a paved level surface, is less than 12.5 miles per hour. "Oceanfront Boardwalk" means the concrete walkway approximately twelve (12) to twenty -two (22) feet in width immediately adjacent to the sandy beach (except where the beach has been improved with parking lots or school playgrounds) and that runs from 36th Street to a point east of E Street. The boardwalk is designated as West Ocean Front and East Ocean Front on the official City atlas. "Pedestrian" shall not, for any purposes, be deemed to include an "electric personal assistive mobility device ", as defined in Vehicle Code Section 313. 2 U 12.58.020 Electric Personal Assistive Mobility Device Restrictions A. It shall be unlawful for any person to operate an electric personal assistive mobility device on the oceanfront boardwalk, bay front north and south sidewalk, the Newport and Balboa piers, Edgewater Plaza, and all beaches, or other public locations which are declared by resolution of the City Council to be hazardous to pedestrians, motorists or persons operating an electric personal assistive mobility device. The City Council may, by resolution, prohibit electric personal assistive mobility devices on public streets, sidewalks, parking lots, walkways, pathways, trails, multi - purpose shoulder lanes, parking structures, and any other public property when it is determined to be necessary to protect the health, safety and welfare of pedestrians, motorists or persons operating such devices on such public property. B. Exceptions: The provisions of this section shall not apply to: 1. Devices operated by disabled person or if tours are provided, they would be permitted to go where the devices are allowed and must have two or more guides. 12.58.030 Unsafe Activity A. No person operating an electric personal assistive mobility device shall engage in any activity which creates an unreasonable risk of injury to any person. B. No person operating an electric personal assistive mobility device shall pass any other person except when it is safe to do so. 12.58.040 Special Restrictions A. Any person who operates an electric personal assistive mobility device rental service, shop or facility must inform each person who rents such a device at the time of rental, in writing, of the restrictions contained in this section. Each electric personal assistive mobility device shall be posted to clearly inform each operator of the particular areas in the City where such devices are prohibited. B. Any person who operates an electric personal assistive mobility device rental service, shop or facility may conduct tours of two or more persons on such devices if in a location not otherwise prohibited and on sidewalks at least six feet in width to allow others to pass without moving off the sidewalk. Such tours must have at least two guides, one at the front and one at the rear. 3 r 12.58.050 Penalty Any person violating the provisions of this Chapter shall be guilty of an infraction. SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. My Segway and I have traveled the width and length of the peninsula many times over two years. It has been very valuable to travel to and from the grocery stores, pharmacies and other businesses in town. These past two years have not brought a single complaint to me and this includes from any individual including Max, who was at that first study session representing a negative position towards the Segway. I do not know this individual other than meeting him at that session. I can recall passing him a couple of times over a year ago as he sat on his front porch; I nodded pleasantly and that was it. Why after all this time has it now come to the forefront? I can turn my Segway 360 degrees in place. I can stop on a dime. I can slow down on a moments notice. Can the bicycles or roller bladers, who pass us most of the time on the boardwalk, say the same? I don't think so! The Harbor Patrol has been on my Segway as well as one member of the Newport Beach Police Department. They have without exception enjoyed it and were amazed at the control one has over it. Mr. Ridgeway was negative at the first study session. The three people against the Segway at that session were on a first name basis with him.. Well, I'm a 72 year old constituent of Mr. Ridgeway and I would appreciate his support also. Coupled with all the above we have an extremely reputable new business in the Village called Segway of Orange County. Not a tattoo parlor or T -Shirt shop by any means. The Chamber of Commerce of Newport Beach held the Grand Opening on Balboa Blvd. and commended both Jim and Dick the owners of this venture. I urge you, and the entire council, to address the important challenges ahead of you within this community. Segway LLC markets the best known brand of EPAMDs Motorized vehicles have been prohibited on the Ocean Front walk for many years. The State Legislature (SB 1918, Chapter 979) amended the Motor Vehicle Code (Section 467), effective March 1, 2003, to define riders of EPAMDs as pedestrians thus enabling the use of EPAMDs on sidewalks and the Ocean Front walk. EPAMDs are not appropriate for the heavily used Ocean Front walk, and represent a threat to pedestrians, especially children and the elderly, and to cyclists and runners. They are heavy transportation devices, powered by electricity, can obtain speeds of up to 12.5 miles per hour and can do serious harm to a person encountering one in an accident. The legislation also added Section 21282 to the Motor Vehicle Code which enables a city, by ordinance, to regulate EPAMDs including limiting, prohibiting entirely or prohibiting use in specified areas. This was done in recognition of assuring safety of pedestrians and others using sidewalks, etc. When the City ordinance prohibiting motorized vehicles was adopted, EPAMDs did not exist, so it is now necessary to amend the current City ordinance. It is very apparent to our association, whose policy statements have concurred with the City for many years in prohibiting motorized vehicles of any kind on the Ocean Front walk, that definitive regulation is needed for use of EPAMDs in Newport Beach. This is an urgent requirement for the health and safety of residents and visitors to the City. We acknowledge the enjoyable and innovative aspects of EPAMDs, but the sidewalks of the City, especially the crowded Ocean Front walk, are not appropriate for their use. An exception for use by the genuinely disabled can be made in writing the ordinance. We look forward to prompt action regarding this urgent matter. On Monday, May 2, 2005, Walk Boulder helped defeat Colorado State Senate Bill 05-239 that would have defined the motorized Segway as a pedestrian and allowed it open access to all of Colorado's sidewalks, paths and trails. Walk Boulder, Bicycle Colorado and the Colorado Parks and Recreation Association testified against the bill in the Committee hearing. Two representatives of the Segway company testified in favor of the bill. Following this testimony and Committee discussion, the bill was defeated by a Committee vote of 4-3. Later that evening, the bill was again debated by the full Senate. Following the debate, the bill was 'laid over" (until after the legislative session) and deemed dead. I am the Chair of Walk Boulder, a pedestrian advocacy group that is affiliated with America Walks, the national coalition of pedestrian advocacy groups. VOTE NO. I am here to urge you to vote NO today on Senate Bill 05 -239. THE SEGW AY BELONGS ON THE STREETS. The purpose of this bill is to define the Segway (which is clearly the motorized vehicle described in the bill) as a "pedestrian" so that it can be driven on sidewalks. As a pedestrian advocate as well as someone who favors alternate modes of transportation, 1 personally hope that the motorized Segway finds a place in Colorado's multi -modal transportation system. But, the Segway is a motorized vehicle, not a pedestrian. And, as a motorized vehicle, it belongs on streets and roads that were designed for motorized traffic, not on sidewalks that were designed specifically for people moving about on foot. SERIOUS ISSUES OF SAFETY, LIABILITY, ENFORCEMENT AND THE SLIPPERY SLOPE. Allowing the Segway, disguised as a pedestrian, to drive on sidewalks in the state will inevitably lead to serious issues of safety liability, and enforcement not only for the Segway but for other motorized gas and electric- powered so- called "personal transportation vehicles" that will follow the Segway onto the sidewalks, then paths and trails. This would lead to the inevitable slippery slope,. SPEED. The motorized Segway is fast. The bill says that the speed will be limited to 12.5 mph. Any cyclist can tell you that 12.5 mph is very fast, between 4 and 6 times faster than average walking speed if you include the walking speeds of children, the elderly, and the disabled. Speed affects the maneuverability and the stopping distance of a vehicle. A pedestrian whose average walking speed is between 2 -4 mph. can stop in an instant. The aver a abrupt stoppin, • distance for the Segway itavelin at I2.5 mph. is 18.6 feet. This can go as high as 31 fee' depending on the driver's reactio d the surface conditions. The speed of 12.5 mph is arbitrary and was decided on for the purposes of this bill The company ori6nally W t the speed at 20 mph. Also, talking about a set speed is meaningless: the governor of the motorized Segway can be overridden Also, there is noway to enforce speed Iim its set by state or Federal law, if the motorized Segway is a pedestrian. Also, no existing law could prevent the future sale of Segways capable of fatter speeds. WEIGHT. The motorized Segway is heavy. It weighs between 69 and 100 pounds and can carry a260 pound man. The cargo version has the capacity to carry an additional 300 pounds or more. The variety of similar vehicles, including the new $400 version ofihe Segway that is already on the market, would turn enforcement on the state's sidewalks paths and trails into a nightmare, WIDTH. The motorized Segway is wide, its toothed measuring up to 30 1/2 inches. Given that 42 — 48 inches is the standard width of most sidewalks, it would be difficult, if not impossible, for two Segways to pass each other on a sidewalk. let alone leaving any room for mothers pushing strollers or even for two friends walking together. H EIGHT. The motorized Segway is high, with a platform height above the pavement as high as 9 1/2 inches. Add 9 1/2 inches to the height of a 6 foot tall man and you have an intimidating figure driving along the sidewalk, Path or trail. PEDESTRIANS ARE OBSTACLES. The 35 page training manual for Segway drivers refers to "children, pedestrians, pets, vehicles and bicycles" as "obsiacles or potential hazards." The manual also warns: "ifVou let go of the Seg:vay when it is moving at any speed, it could travel much farther, risking injury to others. " The manual even wams that the motorized Segway can travel on its own if something is placed on the platform or if there is too much weight on the handlebars. 14 1___1 UNANSWERED QUESTIONS. These are all facts that the paid lobbyists for the Segway do not like to bring up. Nor do they like to talk about liabili issues• such as: a) SF,GWAY ON THE STREET. What happens when the Segway leaves the sidewalk and goes into the street? Under current law, as a "pedestrian", it must be driven against the flow of traffic. Remember that the two most common causes of bicycle /motor vehicle crashes are wrong- way riding and riding on the sidewalk. b) CONCEALED DOORWAYS. Who is liable when a pedestrian, not expecting a motorized vehicle. exits a concealed doorway, driveway, blind alley or corner and is hit and injured? Not even bicycles are permitted to drive on most sidewalks. c) THE SEGWAY KEEPS TRAVELING. Who is liable when the driver of the Segway falls off and the vehicle keeps traveling, scaring or injuring the unsuspecting child or elderly person in its path'? OPPOSED. BANNED. America Walks, the national pedestrian advocacy organization, opposes allowing the motorized Segway to be driven on sidewalks, even for those with disabilities. The use of the Segway on sidewalks has also been opposed by the American Council for the Blind and other like organizations. The Segway has been banned from the sidewalks of such cities as New York and San Francisco. SPECIAL INTEREST BILL. The bill in front of you is a special interest bill, selective legislation designed specifically to help the particular company that is marketing the motorized Segway. STEALTH MARKETING. From the beginning, the savvy marketing strategy of the Segway company has been to convince state legislators like you that the motorized Segway is a pedestrian. Here in Colorado, the company is trying to move quickly before you or towns and cities have time to give serious consideration to the safety implications for pedestrians and the liabi fty and the enforcement issues for money - strapped cities and towns. Nor does the company want you to consider the slippery slope that would occur when other gas and electr?c powered personal transportation vehicles play follow the leader and join the motorized "pedestrian "on the state's sidewalks, paths and traits. Will these other personal transportation vehictea be called "pedestrians," too? SEGWAY FRANCHISE. It is of interest that the owner of the Segway franchise in Boulder is currently promoting on his web site a motorized electric bike that travels at a speed of 45 mph and "gobbles up the trails." Why would he market it this way unless he anticipates gaining access to the trails, now off- limits to motorized vehicles? Incidentally, a cross- terrain trail version of the Segway is now available. It has 7 inch wide tires; is called 'the rugged Cross Terrain XT," and will go "practically anywhere you want it to ga. " PEDESTRIANS ARE REAL PEOPLE. Pedestrians are real people, flesh and blood, moving in spontaneous and unpredictable ways as they move about on the sidewalks. They are walkers, runners. strollers, seniors, the disabled, parents and children and people walking to and from public transit. These people feel secure and safe today on the sidewalks. At some point in the day, you and I and everyone here is a pedestrian. We pedestrians are not "electric- personal assistive mobility devices." We are not devices and we are not motorized. DON'T BE DECEIVED. We feel that by using slick word games that try to disguise what is so obviously a motorized vehicle as a human being, the proponents and marketers of the Segway are trying to deceive you and the public for their own commercial reasons. They are doing this in the same way that the tailors in the story "The Emperor's New Clothes" tried to convince palace officials and the townspeople that the naked Emperor was dressed in fabulous clothes. We trust that you, as thoughtful, elected public officials will see through this obvious ruse and be able to call the Seaway the fast, heavy, wide, tall, vertical motorized vehicle that it i5 CONSIDER SAFETY, LIABILITY AND ENFORCEMENT ISSUES AND THE SLIPPERY SLOPE. Please consider the safety, liability and enforcement consequences to real people of allowing the motorized Segway access to the Colorado's sidewalks, and eventually paths and trails. The Segway is quite obviously a motorized vehicle. not a pedestrian. This is easy to see. Please trust your eves and the facts and remember that sidewalks are for walking. Following the April 26, 2005 Study Session, I thought it appropriate to consider the opinion of other residents in the City concerning the use of EPAMDs. Attached please find a statement (the "Statement ") signed by 200 residents of the City to ban the use of EPAMDs on the oceanfront and bayfront sidewalks. These signatures reflect approximately 10 hours of activity during the last two weeks primarily in front of my home at 126 East Oceanfront. Although I refused the signature of people who did not live in the City, non -City residents overwhelmingly supported the Statement. Of all the people I discussed the matter with, only two people did not support the Statement, as one stated his grandfather was the landlord for the Segway store in the City and the other stated his son sold Razor scooters. From the above- discussed activity, I learned the primary concerns of City residents and non - residents concerning EPAMDs were: The danger of mixing of pedestrians and any type of motorized vehicle without a median in space constrained areas that are already frequently congested. • The absolute weight, mass and bottom heavy design of the Segway EPAMD that could present a danger, whether the Segway is moving or not moving, if a pedestrian or cyclist were to come into contact with it while they were walking or riding. Unlike a bike or skateboard, the Segway is virtually a stationary object when struck and does not have any crush zones that absorb impact such as the spoked wheels of a bicycle. EPAMDs would set a precedent for other motorized vehicles on the oceanfront and bayfront sidewalks. • Why should EPAMDs be permitted on the oceanfront and bayfront sidewalks because of a "loophole" when motorized scooters are already banned? The same reasoning that banned motorized scooters should be used for EPAMDs. • What EPAMDs might become as illustrated by the Segway RT that weighs 100 pounds, carries 260 pounds, features virtually fenderless tires 10" tall and 7" wide and is 30.5 inches wide. The largest previous Segway model was significantly lighter and narrower. I am currently speaking with several community leaders who have expressed great concern about the use of EPAMDs in the City, and in particular, the oceanfront and bayfront sidewalks. I have also spoken to Matthew J. Dailida, Director of US Regulatory & Government Affairs, Segway LLC. Mr. Dailida is sympathetic to the concerns I have raised and would like to find a solution. It is fair to say we are all waiting for the City's proposal and an open discussion of such proposal in another City Study Session or City Council Meeting. He purchased this conveyance for several reasons, not the least of which was because due to a loss of cartilage in his hip it is difficult for him to walk. Over the last several months there has been much debate as to the use of Segways on the boardwalk. I have heard it said that they can "sneak up on you ". I use the boardwalk generally no less than four days per week. I walk into Balboa, to church, and for pleasure between the Newport Pier and the end of the walkway. When walking alone I am able to hear a bicycle approaching from behind if the bicycle is in some way noisy (gears, chain, etc.). If the bicycle is in fact quiet, I will not hear it until it is directly behind me. If I am walking with head phones on, or walking with another person and talking, bicycles and skaters cannot be heard until they are directly upon me. Although they are illegal on the boardwalk, at least you can hear a skateboard! And trust me, a day does not go by that there are not skate boarders on the boardwalk. Many, many times bicyclists and skaters and skate boarders speed along the boardwalk with total disregard for walkers. They do not adhere to the speed limit restrictions, they do not notify you that they are coming up and passing you. Where is the passion against these folks who are already breaking city regulations? No one seems to care about that. Yet you are debating putting more regulations on our books against Segway riders. Do you know how many Segway riders are in our city? I would venture less than one dozen. And they are older, prudent. responsible citizens of this city who take care in regards to their speed and watch carefully for others using the boardwalk. Balboa Boulevard Balboa, CA 92661 949 - 673 -8770 Re: Segway Usage To all members of the Newport Beach City Council: At the April 26h Study Session and in an ongoing campaign by one Balboa resident, a number of straw men were, and have been, set up to imply that Segways are dangerous modes of transportation. Please evaluate these observations from my personal experiences carefully in your deliberations. 1. A Segway is too wide to be compatible with pedestrian traffic — a Segway is 25" wide (the width of many pedestrians and only slightly wider than the handlebars of an adult bicycle). 2. A Segway goes too fast to be compatible with pedestrian traffic —A Segway in the "yellow key" mode is incapable of exceeding 8 miles per hour, and can easily be ridden at a quarter of a mile per hour. 3. A Segway (at a combined rider and Segway weight of 290 pounds) has too much inertia at 8 miles per hour to stop quickly enough to avoid pedestrians or other moving conveyances — at 8 miles per hour a Segway can stop within 4 feet (bicycles, surreys, and skateboards cannot stop as quickly and still maintain control of the conveyances). 4. A Segway cannot be heard by a pedestrian being approached from the rear — bicycles cannot be heard either which is why prudent riders use a bell, horn or voice (on your left ") to alert those being passed. 5. A riderless Segway is a safety hazard — a Segway senses when a rider is no longer on the platform and immediately initiates a no -power mode. At this point the Segway falls forward within a few feet. No other suddenly riderless conveyance stops on its own as does the Segway. 6. Segways are not regulated because of their recent invention — on the contrary, Section 313 of the Vehicle Code (which became operative on March 1, 2003) specifically includes an electric personal assistive - mobility device for use in pedestrian areas. 7. The Segway company somehow slipped Section 313 by the State Legislature and the Governor — Article 6, Chapter 1 of Division 11 of the Vehicle Code sets forth the reasoning behind the adoption of Section 313, to wit: "reducing traffic congestion and air pollution" and in effect "minimizing environmental impacts and facilitating better use of the public ways." 8. Some walkways become too congested for Segways to operate safely — a Segway can easily move with the flow of traffic on walkways. Many prudent folks do not readily venture out on to the walkways on Memorial Day, the 4a' of July, and Labor Day whether they are walking or riding. In conclusion, it would seem that the city might prudently take a wait and see stance in regard to any regulation of Segways on walking areas where bicycles are not specifically excluded. Councilman Rosansky voiced a reasonable opinion when he stated that the city should take a wait and see attitude. Black Rock is a very interactive, social festival. The Segway let me stop and visit at will without the protruding interference of a bike. I was able to enter various camps and bars through the narrowest of walkways. Tent stakes were no issue as the HT easily finessed around them. The energy always outlasted me. The battery charge never dropped below 1/3 even after I had spent hours cruising and jaunted several trips across the city. Post Clean up Report: I'm pleased to report that the Segway survived in stellar fashion. There is no detectable playa dust or damage, After clean up it now in "new", out -of- the -box condition.
