SUBJECT: Resolution 2005 - — Acceptance of a $65,000 Department of
Boating and Waterways Grant for the Vessel Pumpout Station
near the American Legion
ISSUE:
Should the City accept a $65,000 grant from the California Department of
Boating and Waterways Grant to construct a new vessel pumpout facility at the
American Legion?
RECOMMENDATION:
1. Adopt Resolution 2005 -_ agreeing to accept a $65,000 grant from the
California Department of Boating and Waterways for a new vessel
pumpout facility.
2. Direct staff to pursue construction of the facility.
BACKGROUND:
In January 2005, the American Legion pumpout facility was deemed unsafe for
public use and subsequently closed. As a result, the pump out was relocated
approximately 30 feet away to the 15th Street public dock. Because this location
was not satisfactory to the needs of the boating community and the public users
of the dock, a Department of Boating and Waterways (DBAW) grant application
was completed to request funds for rebuilding the American Legion pumpout
facility and to add an additional pumpout station.

Harbor Resources has received preliminary approval from DBAW to provide
$65,000 to cover the full reconstruction and upgrade costs for this project. Prior
to finalizing the contract, DBAW has requested that the City adopt a resolution
agreeing to the grant and its broad terms. At the Harbor Commission's
September 14, 2005 meeting, the Commission unanimously recommended that
the City Council adopt the attached resolution. The Commission decided to
adopt its own resolution as well.
ENVIRONMENTAL REVIEW:
This project will be categorically exempt from CEQA under Section 15302
(Replacement or Reconstruction) of the CEQA Guidelines.
PUBLIC NOTICE:
This agenda item has been noticed according to the Ralph M Brown Act (72
hours in advance of the public meeting at which the City Council considers the
item).

A RESOLUTION OF THE NEWPORT BEACH CITY COUNCIL
REQUESTING A GRANT IN THE AMOUNT OF $65,000 FROM THE
DEPARTMENT OF BOATING AND WATERWAYS FOR THE
DEVELOPMENT OF A BOAT PUMPOUT / DUMP STATION FACILITY
AT THE AMERICAN LEGION, 215 15TH ST., NEWPORT BEACH, CA
92663.
THE NEWPORT BEACH CITY COUNCIL HEREBY FINDS, RESOLVES AND ORDERS
AS FOLLOWS:
WHEREAS, the City of Newport Beach is desirous of improving / developing a
boat pumpout station facility at the American Legion to meet the needs of boaters and to
provide public access to these facilities; and
WHEREAS, the Department of Boating and Waterways is authorized to provide
grants to cities, counties, districts and other public agencies for the construction and
development of boat pumpout / dump station facilities; and
WHEREAS, the City of Newport Beach is willing to enter into an agreement to
provide for the operation and maintenance of the proposed facilities at no cost to the
State;
NOW THEREFORE, BE IT RESOLVED, that the City Council by adoption of this
resolution hereby request that the Department of Boating and Waterways provide a
grant for the purpose of improving / developing a public use boat pumpout / dump station
at the American Legion; and
BE IT FURTHER RESOLVED that the City Council agrees to accept the grant.
PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL THIS 27TH DAY OF
SEPTEMBER, 2005 BY THE FOLLOWING VOTE.
