HomeMy WebLinkAbout05 - 2006 Regional Transportation Improvement ProgramCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. s November 22, 2005 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department William Patapoff, P.E. 949 - 644 -3311 bpatapoff@city.newport-beach.ca.us SUBJECT: 2006 REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM (RTIP) RESOLUTION CERTIFYING FUNDING AND COMMITTING IMPLEMENTATION OF SUBMITTED PROJECTS IN THE PROGRAM RECOMMENDATION: Adopt a Resolution certifying that the City of Newport Beach has the resources to fund the projects submitted in the RTIP for fiscal years (FY) 2005 -06 to 2010 -11 and affirming its commitment to implement all of the projects submitted in the program. DISCUSSION: The RTIP is a comprehensive document that contains projects for all state and federally funded projects. Federal law requires that the RTIP be updated at least every two years and the current RTIP was last updated in 2004. The 2006 update will cover approved projects from FY 2005 -06 to 2010 -11. The Orange County Transportation Authority (OCTA) is requiring all Orange County agencies that have projects in the RTIP to adopt a resolution certifying that the agencies are committed to delivering the projects. Attachment A of the resolution lists the projects the City has included in the RTIP. The projects include the widening of Jamboree Road (requires widening the bridge over State Route 73) from Bayview Way to MacArthur Boulevard, and seven Arterial Highway Rehabilitation Program projects. More than $3.1 million in regional funds have been secured for these projects. The City's match has been estimated at over $4.6 million and will be funded through Gas Tax, Measure M Turnback, and Transportation and Circulation dollars. After receiving the resolutions from the cities, OCTA will develop the RTIP and forward it to the Southern California Association of Governments (SCAG) for inclusion in the regional RTIP. The regional RTIP will then be forwarded to Federal Highway Administration (FHWA) for review and inclusion in the Federal Transportation Improvement Program (FTIP). As required by FWA, the RTIP /FTIP must be a SUBJECT: 2006 Regional Transportation Improvement Program (RTIP) Resolution Certifying Funding and Committing Implementation of Submitted Projects in the Program November 22, 2005 Page 2 financially constrained document, which means that programming cannot exceed actual funds available. When this process is complete, local agencies are then eligible for reimbursement of funds for the various projects. Staff recommends the City Council approve the RTIP Resolution in order to receive the federal and other funding. Environmental Review: This is not required at this time and the environmental documents will be processed during the design phase. Prepared by: wit iam :.3 City Engineer Attachment: Resolution Submitted by: Stephen G.fB Lkn Public Works Director RESOLUTION NO. 2005 - 2006 RTIP (Regional Transportation Improvement Program) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CERTIFYING THAT NEWPORT BEACH HAS THE RESOURCES TO FUND THE PROJECTS SUBMITTED FOR INCLUSION IN THE FY 2005 -2006 — 2010 -2011 TRANSPORTATION IMPROVEMENT PROGRAM AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL OF THE PROJECTS SUBMITTED IN THE PROGRAM WHEREAS, the City of Newport Beach desires to include the submitted projects (Attachment A) in the Orange County Transportation Authority's (OCTA) Regional Transportation Improvement Program; and WHEREAS, the City of Newport Beach warrants that full funding is committed and available for projects submitted for programming in the first three years (FY 2005 -06, 2006 -07, 2007 -08) of the Regional Transportation Improvement Program (RTIP); and that the City of Newport Beach accepts responsibility for full funding of said projects and warrants that no additional funding allocations are required of OCTA for City of Newport Beach to fully implement said projects therefore committing that the first three years of the RTIP are financially constrained; and WHEREAS, projects programmed in years 2008 -09 thru 2010 -11 are projects expected to receive future funding through anticipated revenues, therefore all projects submitted for inclusion in the 2006 RTIP are financially constrained; and WHEREAS, OCTA as the agency responsible for short-range capital and service planning and programming for the Orange County area, requires an approved Resolution from the governing body of the Lead Agency for all projects included in the Transportation Improvement Program; and WHEREAS, OCTA also requires that the Lead Agency include a financial plan that demonstrates how the projects submitted for inclusion in the RTIP can be implemented; and WHEREAS, the City of Newport Beach, as the Lead Agency, possesses the legal authority to submit the project for inclusion in the RTIP and to finance, acquire, and construct the project. NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach does hereby: Affirm its continuing commitment to the projects submitted for inclusion in the 2006 RTIP; and Commit that the City of Newport Beach, as Lead Agency for the projects, will carry out the projects consistent with the project implementation schedule; and Certify that the City of Newport Beach will allocate the necessary local match funds contained within the project to carry out any federally approved project; and Certify that the City of Newport Beach, as the Lead Agency, will comply with applicable provisions of the California Environmental Quality Act, the National Environmental Policy Act, the Americans with Disabilities Act, the Secretary of the Interior's Standards and Guidelines for Archaeology and Historic Preservation, and any other Federal, State, and /or local laws, rules and regulations.
