SUBJECT: Resolution 2005 -_ Relating to executing a Proposition 40 Phase II
grant agreement with the State Water Resources Control Board
ISSUE:
Should the City execute a Proposition 40 Phase II grant agreement from the State
Water Resources Control Board in the amount of $625,000 to implement the Newport
Island Channels Circulation Improvement Project?
RECOMMENDATION:
Adopt Resolution 2005- authorizing the City to execute an agreement with the
State Water Resources Control Board under the Proposition 40 Phase II - Watershed,
Clean Beaches and Water Quality Act.
DISCUSSION:
This agenda item seeks the Council's permission to execute an agreement with the
State Water Resources Control Board to obtain funding for implementation of the
Newport Island Channels Circulation Project (Project).
Newport Island Channels (NIC) is located at the west end of Lower Newport Bay, and
has a limited hydraulic connection with the bay that subsequently hinders tidal flushing.
City staff believe this poor circulation plays a major role in the poor water quality in this
area.
Beginning in 2002, City staff were directed to seek solutions to improve water quality
around Newport Island. The following pilot tests and studies have been conducted to
date:

• InStreem Units - pilot testing of mechanical flow enhancers (InStreem) to improve
water circulation and mixing with the bay. During the 10 day test local residents
and stakeholders had the opportunity to observe the InStreem unit and provide
comments to the City. In general, folks believed the unit was effective in
enhancing water circulation, but expressed concerns relative to noise and
potential impacts to boat traffic.
• Submerged Pumps - a study was conducted to evaluate the use of submerged
pumps to enhance water circulation. The study concluded that submerged
pumps can increase water circulation; however, they are very expensive to
purchase and maintain.
• Oloids - pilot testing of yet another mechanical flow enhancer (the Oloid). Similar
to the InStreem an Oloid was installed to evaluate its ability to improve water
circulation and mixing with the bay. However, unlike the InStreem - the Oloid (a
much smaller device) was not met with objection by local residents relative to
size and noise issues.
Based on City's flow measurements and positive feedback from residents, City staff
submitted and was awarded a $625,000 grant from the State Water Resources Control
Board to purchase and install fifteen Oloids at strategic locations (as suggested by
numerical modeling with final locations determined in consultation with NIC property
owners) around Newport Island to circulate and improve water quality in this area.
Environmental Review: A Negative Declaration is being prepared, and will be
completed before installation of the Oloid device.

RESOLUTION NO. 2005-
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
RELATING TO DESIGNATING A REPRESENTATIVE TO SIGN A PROPOSITION 40
AGREEMENT, AND ANY AMENDMENTS THERETO, FOR THE NEWPORT ISLAND
CHANNELS CIRCULATION IMPROVEMENT PROJECT (Project)
WHEREAS, voters of the State of California passed Proposition 40 (the
Watershed, Clean Beaches and Water Quality Act of 2002) in September 2002; and
WHEREAS, the City Council of the City of Newport Beach supported the passage
of Proposition 40 in 2002; and
WHEREAS, Proposition 40 Phase II includes $22.2 M in funding for various
programs and measures to implement projects that protect and restore California's
coastal water quality; and
WHEREAS, the City applied for and tentatively received a grant from the State
Water Resources Control Board to address water quality in the Newport Island
Channels area; now, therefore be it
RESOLVED by the City Council of the City of Newport Beach that it hereby:
1. Authorizes the City Manager of Newport Beach to execute an agreement and any
amendments for a Prop 40 Phase II grant relating to the Project; and
2. Certifies that the City has or will have sufficient funds to operate and maintain the
Project; and
3. Appoints the City Manager as agent to conduct all negotiations, execute and submit
all documents including, but not limited to, agreements, amendments, payment
requests, and so on, which may be necessary for completion of the Project.
ADOPTED this 13th day of December, 2005.
