Saturday, November 6, 2010 10:00 AM Peter and Mary Muth Interpretive Center Dredging — Lower Bay Corps Colonel Mark Toy Visit to Newport Beach With Corps staff, Council Members, Commissioner Rhyne and senior staff to discuss: • Lower Bay • Santa Ana Marsh (Newport Slough area) • Upper Bay completion Lower Bay funding has about $2.5 M in federal funds Waiting for President's budget in January for possible increase • This amount is enough to start a dredging project for minimal quantities • Possible that the Corps could start dredging in 2011 1► Ib: V:ul Oj LONG BEACH r raearcm"M October 18, 2010 Mr. Chris Muter City of Newport Beach Harbor Resources Division 829 Harbor Island Drive Newport Beach, CA 92660 Subject: Application for Placement of Dredged Material in the Pon of Long Beach Middle Harbor Fill Site - Lower Newport Bay Maintenance Dredging Project Dear Mr. Miller. The City of Newport Beach (City) recently submitted an application to the Port of Long Beach (Port) to place approximately 700,000 cubic yards (cy) of dredged material from the City of Newport Beach/U.S. Army Corps of Engineers Lower Newport Bay Project, into the Middle Harbor Slip 1. The Port has now completed the review of third party applications and, based on our review of your application submittal, your material appears to be suitable for placement within certain areas of the fill. However, at this time it does not appear that there is capacity for your material in the fill project. IFcapacity should become available, additional geotechnical data —as requested in the Port's Inter to the City dated August 26, 2010 —will need to be provided for further evaluation before the materials will be considered for future placement. Although this project was not selected for placement in the first phase of Fill, there may be additional opportunities in the future, including the second phase of the slip fill (anticipated to begin in 2014). The City is encouraged to stay in contact with the Pon regarding future opportunities and is welcome to submit an application for this material when the solicitation is released for third party material for the second fill phase. Attached is the preliminary list of projects tentatively accepted for the fill, with corresponding placement location and schedule information. The Port will be presenting the results of the application process and tentative fill plan to the Contaminated Sediment Task Force (CSTF) for comment and discussion. The Port will then consider CSTF's input and finalize the fill plan in consultation with individual applicants. The City will be notified of the date and location of the CSTF meeting once it has been scheduled. Thank you for your participation in the application process. The Port has completed the review of third party applications and, based on our review of your application submittal, we are pleased to inform you that your project qualifies for placement in the fill site and is conditionally approved for placement in Layer I of the fill. Attached is the preliminary list of projects tentatively accepted for the fill, with corresponding placement locations and schedule information. The Port will be presenting the results of the application process and the tentative fill plan to the Contaminated Sediment Task Force (CSTF) for comment and discussion. The Port will then consider CSTF's input and finalize the fill plan in consultation with the individual applicants. Meet the established placement schedule for this project. Ensure that project funding, insurance requirements, Memorandum of Agreement, and other related documents have been satisfied. Develop a project- specific fill plan with Port engineers. We expect a decision next week. The RFP for the RGP -54 Permit has ended. Proposals will be reviewed by the committee next week. Harbor Resources cost of service fees will be discussed at the Council Study Session on October 26. Harbor Area Management Plan (HAMP) will be considered by Council on November 9.
