RECOMMENDATION
Remove from calendar.
STATUS
The applicant has withdrawn their application for General Plan Amendment No.
2006 -006. The application requested to amend the previous General Plan to
increase the maximum allowable development permitted for the Country Club by
10,000 square feet, for a total maximum development allocation of 75,000 square
feet. However, the 2006 General Plan update that increases the development
allocation of the site to 75,000 square feet has rendered this application
unnecessary. The applicant's withdrawal letter has been attached for reference.
No further action required.

As you know, Big Canyon Country Club filed an application for a General Plan amei
July 7, 2006. The application sought approval of an additional entitlement of 10,000
beyond the entitlement allowed in the General Plan in effect at the time the applicatic
Subsequent to that time, the City Council certified an environmental impact report ar
approved of a new General PIan. Among other things, the new General Plan increase
entitlement of the Club by 10,000 square feet. Thereafter, a lawsuit was filed by Stoi
Our Newport that contested the adequacy of the EIR under the California Environme
Act (CEQA). In November, 2006, the land use element of the new General Plan wa
before the voters for confirmation by way of Measure V. Measure V passed, renderi
Club's application moot, assuming the SPON CEQA lawsuit was resolved.
Our representative has been advised by the City Attorney's office that SPON has
CEQA lawsuit, and therefore, the land use element of the new General Plan is efi
respects.
Based upon the above, Big Canyon Country Club withdraws its application for a
amendment.
