SUBJECT: VACATION OF A SEWER EASEMENT AT 721 AND 725 ST. JAMES
ROAD
RECOMMENDATIONS:
1. Hold public hearing, close public hearing.
2. Adopt a Resolution ordering the vacation of a 10 -foot wide sewer easement at
721 and 725 St. James Road as described in Exhibit "A" and depicted in Exhibit
"B ", direct staff to process the vacation, and direct the City Clerk to have the
Resolution recorded by the Orange County Recorder.
DISCUSSION:
The property owners of 721 and 725 St. James Road, Tim and Dorothy Hobin,
submitted a request for the City to vacate and abandon an existing 10 -Foot wide sewer
easement that runs approximately through the middle of the properties. The property
owners have made this request to fully use these properties for the construction of a
single - family residence. This easement is legally described in Exhibit "A" and shown in
Exhibit "B" of the attached resolution.
There is currently an 8 -inch steel sewer main in the existing 10 -foot wide easement that
will be abandoned in place as a part of the development of these properties. The
property located at 715 St. James Road will also be affected by the proposed sewer
main abandonment. The developer will construct new sewer laterals to serve the
proposed single - family residence and 715 St. James Road (see attached Exhibit).
Building plans for the new single - family residential development have been submitted to
the Building Department.
The abandonment of approximately 130 -feet of 8 -inch steel sewer main will save the
City in maintenance costs, since the sewer main is 40 -years old and is very difficult for
City crews to access.

Public Hearing Notices were posted along the proposed vacation site on February 13,
2007 and were posted in the Daily Pilot.
Environmental Review:
Pursuant to Section 15305, Minor Alterations in Land Use Limitations — Class V of
CEQA Guidelines, the requested vacation is exempt from environmental review.

Dear Fong:
This letter is to request the abandonment of the existing City of Newport Beach 8 -inch
sewer main and easement that runs through the middle of the above- referenced properties
per the attached plans and exhibits. The request is being made by Tim and Dorothy
Hobin, owners of 721 & 725 St. James Road, in order to allow the construction of a new
single - family residence.
715 St. James Road is the only upstream property served by said existing 8" main that
has to have a relocated sewer lateral in order to allow the abandonment to occur. A
redesign of the sewer lateral for 715 St. James Road has been preliminarily approved by
the Public Works Department and encompasses a new sewer lateral to the existing main
in St. James Road. Construction plans for this new lateral and the letter of approval from
Mr. Howard Gebhard, owner of 715 St. James Road, are being submitted with this letter.
The abandonment will allow the City to remove approximately 130 feet of 40 -year old
steel sewer main with limited access that has been a challenge to maintain due to its
location. Rob Hamers, the civil engineer for the project, and Tim Hobin met with
Michael Sinaccri and Ed Burt of the City who concur with the abandonment. The
preliminary design for the new 4 -inch sewer lateral for 715 St. James Road was reviewed
and approved by Steve Hook of the Building Department and a letter from Mr. Hamers to
Mr. Hook dated April 13, 2006, recapping that discussion is also included herein.
As Rob Hamers explained to you by voice mail, the new home on 721 -725 St. James
Road will sewer to the new end of the City's sewer main at the new point of termination
of the City line through the construction of an end -of -line cleanout. As we discussed,
only the sewer construction plans for the new lateral for 715 St. James Road and the
abandonment map and description are being submitted at this time. The removal of the
City sewer line and the construction of a new sewer lateral for the new home will be
included with the Grading Plan that will be part of the construction plans for the new
residence.

the construction of one new residence to replace the two existing residences at 721 -725
St. James Road.
In order to abandon 130 linear feet of existing City sewer main located•in the rear of-the
two residences, the neighboring property owner, Howard Gebhart; at 715 St. James Road
has given permission to allow his existing sewer lateral to be reconstructed to flow to the
existing sewer main in St: James Road. Based on survey information, this reconstruction
can be achieved with a sewer lateral slope of 1 %. A previous meeting was held with
Mike Sinacori and Ed Burt of the City who also supported abandoning the portion of the
City sewer main::
You stated that although the City desires a 2% grade on sewer laterals to allow for
construction tolerances, because of the benefit to the City of abandoning a 40 year old
sewer main thatwis difficult to access and clean, and because sewer laterals with slopes of
I% are allowed by the Uniform Plumbing Code, the City will accept the new lateral at
I% slope so long as the project engineer provides a statement that the as -built grade was
checked in the field and is constructed at a minimum slope of I%.
A note requiring the as -built certification of the sewer lateral grade will be placed on the
sewer improvement plans. , A letter of authorization from Howard Gebhart will be
submitted when the plans are submitted to the City for plan check.

This letter shall serve as authorization for Tim Hobin to redesign the sewer lateral on my
property changing the current connection from the 8" sewer main in the middle of my
property to an alternate sewer main in St. James Road. Mr. Hobin has agreed to cover all
costs associated with the application, plan check, permits and construction of said
redesign and improvements.
