Agenda Item No. 22
February 27, 2007
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: Planning Department
David Lepo, Planning Director
949-644-3228;diepo@city.newport-beach.ca.us
SUBJECT: Planning Commission Agenda for February 22, 2007
Report of the actions of the Planning Commission Meeting:
Item 1: The minutes of February 8, 2007 were approved as corrected (All Ayes).
Item 2: Fancher Development Services (PA2006 -269))
849 Newport Center Dr.
Request to amend an existing Use Permit to allow an eating and drinking
establishment to extend their hours of operation to 2:00 a.m., seven days a week.
This item was approved. (All Ayes)
Item 3: Advanced Real Estate Services (PA2005 -196)
201 & 207 Carnation Avenue and 101 Bayside Place
The application would allow the demolition of an existing 14 -unit apartment
building and a single - family home and the construction of a 7- level, 9 -unit
multiple - family residential condominium complex with subterranean parking on a
1.4 acre site located bayward of the intersection of Ocean Boulevard and
Carnation Avenue. The existing General Plan, Coastal Land Use Plan and
Zoning Designations of a small portion of the site (584 square feet) would be
changed to be consistent with the larger portion of the site (from two- family
residential to multi - family residential). The application includes a tentative tract
map for the creation of 9 "airspace" condominium units for individual sale and.
The Modification Permit application requests the encroachment of subterranean
portions of the building within the front and side yard setbacks. Lastly, the
Coastal Residential Development Permit application relates to replacing lost units
occupied by low or moderate - income households. No units meeting this criteria
are known to exist and therefore, no replacement of affordable housing is
required.
This project, known as "The Aerie ", would be built on the coastal bluff near
Carnation and Ocean. Interpretation and application of Local Coastal Program
policies, in particular those relating to views to the bluffs and natural resource
protection, were at the heart of the Planning Commission discussion. After a
presentation by the project architect, Brion Jeanette, and project proponent, Rick
Page 2
Julian, the Commission focused on the "predominant line of existing
development" concept as it relates to regulation of the location and bulk of the
proposed structure and the extent to which the coastal bluff would be altered by
the new building. Commissioners viewed a photographic simulation comparing
the view to the site from the water in its present state with site with that of the
simulated portrayal of the site with the new 7 -story structure. The Planning
Commission ultimately reached consensus that modification of the westerly
portion of the proposed condominium building would be needed before the
project could be found to conform to the Local Coastal Program policies. The
applicant agreed to modify the design of the project consistent with Planning
Commission direction and to work with staff in revising the draft Mitigated
Negative Declaration to address perceived shortcomings indicated by
Commissioners. The project was continued to the April 5th Planning
Commission meeting. (All Ayes)
Item 4: Mariners Mile Gateway, LLC (PA2006 -279)
100 -600 West Coast Highway
Request for Comprehensive Sign Program CS2006 -012 for the previously
approved Bel Mare Shopping Center. In addition, the Planning Commission will be
reviewing the project's landscape plan and evaluating proposed refinements to
exterior elevations to determine their substantial conformance with the approved
project.
There being no objections, this item was tabled to later date uncertain to allow the
applicant time to address unresolved issues with the project submittal.
