TITLE: Schedule Extension of Orange County Transportation Authority (OCTA) Measure
M2 Grant Funds for Newport Boulevard Widening (Via Lido to 30th Street) Project
C -4881 (CAP12 -009)
ABSTRACT:
Staff wishes to submit a request to OCTA to extend and delay Measure M2 competitive funding allocation
for the Newport Boulevard Widening project (Via Lido to 30th Street). OCTA requires City Council
approval before staff can submit this request.
RECOMMENDATION:
Approve the submittal of a schedule extension to OCTA for the Newport Boulevard Widening project (Via
Lido to 30th Street).
FUNDING REQUIREMENTS:
The schedule extension request does not require additional funding.
DISCUSSION:
City staff successfully obtained Measure M2 competitive grants (right -of -way and construction) to fund a
portion of the Newport Boulevard Widening (Via Lido to 30th Street) project (OCTA Application No. 14-
NBCH- ACE - 3720). Measure M2 grant for the construction phase in the amount of $1,194,000 is currently
programmed for fiscal year 14 -15. Due to lengthy negotiations with property owners, the right -of -way
phase for this project took longer than originally anticipated and has pushed the construction phase. The
right -of -way phase was completed in October 2014. In addition, the City is currently processing a Coastal
Development Permit (CDP) with the California Coastal Commission, which is anticipated in the summer of
2015.
In accordance with the OCTA grant guidelines, the City must obligate funds within the programmed fiscal
year. Specifically, the City is required to award a construction contract before June 30, 2015. Staff
recognizes that this schedule will not be met due to the reasons mentioned above. OCTA grant guidelines

also allow local agencies a one -time schedule extension for up to 24 months. With City Council's approval,
staff would like to submit a 24 month schedule extension request to OCTA in order to delay the
programmed funds to FY 16 -17. Construction of this project is currently scheduled to start in January
2016. If this schedule is met, staff will request to advance the funds to FY 15 -16 in order to receive
reimbursement shortly after the award of the construction contract.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality
Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably
foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as
defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).
