ITEM NO. 1 APPROVAL OF MINUTES ACTION: Approve or modify minutes of March 8, 2007 ITEM NO. 2. Weekes Residence (PA2006 -219) 709 Kings Road SUMMARY: Request to allow a residence to exceed the height limit by six inches pursuant to Municipal Code Chapter 20.91. ACTION: The property owner has requested a continuance of this project and asks that the application be taken off the calendar. (Variance No. 2006 -003) CEQA COMPLIANCE: This project has been determined to be categorically exempt under the requirements of the California Environmental Quality Act under Class 2 (Replacement of Existing Structures). ITEM NO. 3. Eddie V's Wildfish Restaurant (PA2005 -036) 1370 Bison Avenue SUMMARY: A twelve -month review of the restaurant's approved valet/parking management plan. ACTION: 1) Conduct public hearing; and 2) Grant additional time to allow the restaurant operator to finalize a revised valet/parking management plan with The Irvine Company; or 3) Initiate proceedings for revocation of Use Permit No. 2005 -008 CEQA COMPLIANCE: This project has been determined to be categorically exempt under the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities) ITEM NO. 4. The Wine Gallery (PA2006 -271) 2411 E. Coast Highway SUMMARY: Request to allow the expansion of an existing retail wine store that currently has accessory, on -site wine tasting, pursuant to Municipal Code Chapter 20.89 (Alcoholic Beverage Outlets). The applicant also is requesting to extend the closing hour of the store from 9:00 pm to 10:00 pm on Fridays and Saturdays only ACTION: 1) Conduct public hearing; and 2) Adopt Resolution approving Use Permit No. 2006 -038 CEQA COMPLIANCE: This project has been determined to be categorically exempt under the requirements of the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities). ITEM NO. 5. SUMMARY: Parking In -Lieu Parking Fee Report ACTION: Receive and file. CEQA COMPLIANCE: Not defined as a project and, therefore, not subject to the requirements of the California Environmental Quality Act. ITEM NO. 6. (6 Ayes, 1 Absent). Item 2: Weekes Residence (PA2006 -219) 709 Kings Road Request to allow a residence to exceed the height limit by six inches pursuant to Municipal Code Chapter 20.91. This item was continued to date uncertain at the request of the applicant. The applicant's architect is revising the roof configuration for the proposed new dwelling to comply with the height limit and preclude the need for a variance. A submittal for plancheck is expected prior to April 1st as the applicant has been advised that a submittal after that date will require review under the new design guidelines for one and two - dwelling residences. The sheer bulk of the proposed structure and excavation of the bluff are potentially inconsistent with the new guidelines. (6 Ayes, 1 Excused) Item 3: Eddie V's Wildfish Restaurant (PA2005 -036) 1370 Bison Avenue A twelve -month review of the restaurant's approved valet/parking management plan. This item was approved with Commission direction that staff work with the applicant and landlord (Irvine Company) to work out details of a revised parking plan submitted this week. Commission direction includes on -going staff monitoring of the effectiveness of the plan and its continued implementation. (5 Ayes, 1 No, 1 Excused) Page 2 Item 4: The Wine Gallery (PA2006 -271) 2411 E. Coast Highway Request to allow the expansion of an existing retail wine store that currently has accessory, on -site wine tasting, pursuant to Municipal Code Chapter 20.89 (Alcoholic Beverage Outlets). The applicant also is requesting to extend the closing hour of the store from 9:00 pm to 10:00 pm on Fridays and Saturdays only. This Rem was approved with Commission modifications of conditions to ensure that the applicant is clear as to limitations on wine - tasting venues in light of Fire and Building Departments' prohibition on public access to the basement. (6 Ayes, 1 Excused) Item 5: Parking In -Lieu Fee Report Commissioners agreed that development of a comprehensive parking program is needed and requires consideration of a variety of components including in -lieu fees, the effect of parking waivers, and user -paid parking.
