SUBJECT: JOHN WAYNE CENTENNIAL CELEBRATION BANNERS —APPROVAL
OF ENCROACHMENT PERMIT NO. N2007 -0149
RECOMMENDATION:
Conditionally approve Newport Beach Conference and Visitors Bureau request for the
installation of 80 banners on 80 streetlight poles, from March 29, 2007 to April 29, 2007
for the John Wayne Centennial Celebration. Proposed banner installation is along
Jamboree Road, MacArthur Boulevard, Newport Boulevard, and East Coast Highway.
DISCUSSION:
The Newport Beach Conference and Visitors Bureau (NBCVB) is hosting a Centennial
Celebration commemorating John Wayne (JW100) through a series of movie
screenings and outdoor symposiums from April 19, 2007 to April 28, 2007. To
effectively promote this event to the public, NBCVB has requested that 80 private
banners be installed from March 29, 2007 to April 29, 2007 along Jamboree Road,
MacArthur Bouelvard, Newport Boulevard, and East Coast Highway. Banners on
Newport Bouelvard and East Coast Highway west of Bayside Drive are in the Caltrans
right -of -way. Staff has prepared the required Caltrans encroachment permit
applications to install the proposed banners.
The City of Newport Beach and Newport Beach Film Festival are co- sponsors of
JW100. To recognize Newport Beach Film Festival's role, NBCVB's 24" x 72" banner
design will include the Newport Beach Film Festival sponsor's name.
An admission charge will be associated with the events. NBCVB is currently applying
for a City sponsorship package. If the sponsorship package is approved, admission for
all movie screenings will be free of charge to Newport Beach residents.

JW100 will take place concurrently with the Newport Beach Film Festival. Newport
Beach Film Festival has also applied for banner installation on streetlight poles,
however, the proposed banner locations requested under this permit will not conflict
with those requested by the Newport Beach Film Festival.
Lastly, NBCVB's request to install the banners for 32 days from March 29, 2007 to April
29, 2007 will exceed the maximum installation period allowed per City Council Policy
L -16. Although this time period exceeds the maximum allowed, it should be noted that
the installation period will not conflict with other known requests for banners.
Should the City Council approve the installation of 80 private banners for 32 days, staff
recommends the following conditions of approval:
1. No banners shall be installed on traffic signal poles.
2. Banners may be installed on designated concrete streetlight poles only.
3. The applicant must provide on -going maintenance of the banners and brackets.
4. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
5. The applicant must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
6. Issuance of an approved Encroachment Permit by the City's Public Works
Department.
7. Issuance of an approved Caltrans encroachment permit for banners installed in
Caltrans right -of -way.
8. The banners shall conform to City Council Policy L -16 with the exception of the
advertisement of sponsors, installation period, and event admission fees.
9. All banners and brackets shall be removed by the end of the approved time unless
otherwise approved by the conditions stated in the Encroachment Permit.
10. All banners and brackets shall comply with the Encroachment Permit conditions.
11. If needed, the City may require removal of some of the banners to allow other
organizations to install banners at the same location and during the same time
period.

12. A minimum of two 5- inches wide half - circle wind slits per banner are required to
minimize the wind load.
13. The printed font of the sponsor, Newport Beach Film Festival, shall be the same
size or smaller than the event name.
Environmental Review:
Staff determined that the project is exempt from the California Environmental Quality
Act (CEQA) pursuant to Section 15378 of the Guidelines. This action is not considered
to be a project as defined by CEQA.
Funding Availability:
No City funds are required. The Newport Beach Conference and Visitors Bureau will
pay all costs associated with the installation and removal of the banners.
