Since that initial work, the engineering firm and its insurance company have failed to communicate with us appropriately. At this point, the work has not been completed and litigation is possible. The dock units and methods of attachment must be approved by the Marine Department and the City Public Works Department prior to installation. 2. Applicant contact the Sheriff's Harbor Patrol and meet any conditions they might impose prior to installation. 3. The applicant must have the plan reviewed by the City Fire Department and meet any requirements they may have, prior to installation. 4. Discussion: This application is before the City Council as required by Section 5.C.4 of the Harbor Permit Policies, which state: 5.C.4. "Prior approval of the City Council will be required before issuing a permit for shore -connected structures when approved bulkhead lines,Wrhead lines, or setback lines do not exist". }1RO1 �i i i COMM DATE 3 - 4 - f y D The applicant wishes to temporarily revise the docks at the Newport Dunes and at the Lido VillageMarina to make space available for his twenty-first annual Newport Harbor Boat Show. The revision at the Dunes will consist of temporary docks attached to permanent marina facilities to allow for additional berthing at the Newport Dunes during the boat show, as depicted on the attached drawing submitted by the applicant, marked Exhibit A. The docks at Lido Village will consist of placing approximately 580 feet of float, 60 feet bayward of the existing floats, to be secured by 10 temporary pilings, as depicted on the applicants attached diagram, marked Exhibit B. The location at Lido Village has been used over the last five or six years, and there has been no increase in size in the temporary docks. _This is the second year that the Newport Dunes site has been used for the boat show and a temporary revision of the docks was approved by the City Council in 1992. The Marine Department is unaware of any complaints regarding the temporary installation of the docks at that site. The applicant has discussed the configuration of the temporary docks with both the City of Newport Beach Fire Department and the orange County Sheriff's Harbor Patrol. The Marine Department would recommend that the City Council approval be contingent upon the applicant satisfying any additional conditions that those two agencies might have prior to the dock installation. The docks will be installed beginning March 29, 1994, and will be removed by April 11, 1994. The location map and plan sheet show that the area to be dredged is adjacent to A, B and C docks at the Dunes Marina where safe navioation is severely restricted at low tide. Dredging will be performed between the bulkhead and pierhead lines and be limited to a maximum depth of -5.0 MLLW consistent with the requirements of Special Conditions 6 and 10. Dredainq quantities will be limited by contract not to exceed 600 cubic yards. The plan sheet shows locations of six (6) samples taken for particle size analysis. Exhibit A shows the results of these analyses and indicates that all samples have greater than 90% sand. In conformance with Special Conditions No. 14b-1, 2 and 3 the dredged material will be disposed of at the LA-3 disposal site. Per Special Condition No. 7 a detailed survey of the dredqe area was performed and the presence of eelgrass (Zostera marina) was not found in or adjacent to the project area. By copy of this letter as required in Special Condition No. 9. The U.S. Fish and Wildlife Service, California Department of Fish and Game and National Marine Fisheries Service will receive a 15 day advance notification. The dredger will be required by contract to make the necessary Coast Guard notifications in Special Conditions No. 1 and 5. That the dredging.operations shall.be restricted to a maximum depth of -4.0 to -6.0 MLLii, including:the one -foot overdredge. 11. That beach restoration discharges shall not exceed 500 cubic yards per site per year. 12. The dredged material shall either be: a. discharged onto adjacent areas for beach replenishment, or b. disposed of at LA-3, an Environmental Protection Agency offshore disposal site if: 1. a grain size analysis is performed at each dredging site and X shows that the material is composed predominantly of sand, gravel, rock, or any other naturally occurring bottom material with particle sizes larger than silt (less than 10% fines). The core sample to be used for the grain size analysis shall be driven to project depth plus one foot for overdredge. If the material proposed for dumping is found not to be composed predominantly of sand, gravel, rock; -or any other naturally occurring:bottom material with particle sizes larger than silt (greater than 10% fines), then a full bioassay test shall be performed on the proposed dumping material.. Also; a reference sample must be taken from LA-3 for a comparison. 2. the site from which the material proposed for dumping is to be taken is far removed from known existing and historical sources of pollution so as to provide reasonable assurance that such material has not been contaminated by such pollution; and x 3. the amount of material proposed for dumping is less than 1,000 cubic yards. 15. If the permittee is not able to dispose -of the dredged material at LA-3 or use the material for beach replenishment, the permittee shall dispose of the material inland.
