HomeMy WebLinkAbout08 - Upper Bay and Harbor Area Mgmt PlanCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 8 April 24, 2007 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Robert Stein 949 - 644 -3322 or rstein @city.newport- beach.ca.us SUBJECT: UPPER BAY AND HARBOR AREA MANAGEMENT PLAN —AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT WITH LARRY PAUL AND ASSOCIATES FOR PROJECT MANAGEMENT RECOMMENDATION: Approve Amendment No. 1 to the Professional Services Agreement with Larry Paul and Associates of Newport Beach, California to provide project management services for the Harbor Area Management Plan and coordinate integration efforts with the Newport Bay Integrated Regional Watershed Management Plan at a not to exceed price of $30,000 and authorize the Mayor and City Clerk to execute the Agreement. DISCUSSION: The City was awarded a $487,000 grant in 2006 from the State of California Department of Water Resources to prepare an Integrated Regional Watershed Management Plan to prioritize projects and programs to accomplish Total Maximum Daily Loads (TMDL) and beneficial use goals for the Newport Bay Watershed. For practical reasons, this watershed plan has been split into two broad tasks. . 1. The first task is the preparation of a Harbor Area Management Plan (RAMP), a planning document that primarily focuses on preparing a work plan to meet the challenges confronting the City in Lower Newport Bay as well as the upper bay. Consultant proposals have been received and a consultant will be selected shortly. 2. The second task is the preparation of a strategic plan to prioritize the problems in the upper watershed (primarily those areas that are drained by San Diego Creek and Santa Ana Delhi Channel). Another memorandum is before the Council requesting an amendment to Krista Sloniouski's (Connective Issues) contract for preparation of the Integrated Regional Watershed Management Plan (IRWMP). Under this Council Memo, staff strongly recommends extending Larry Paul's contract to assist the City in the coordination and management of the HAMP and the IRWMP. Because of the many sensitive issues to be addressed and the potentially large grant funding opportunities, a high level of coordination and cooperation with watershed stakeholders (County, Cities, IRWD, Irvine Company, naturalists, and jurisdictional Upper Bay and Harbor Area Management Plan — Approval of Amendment No. 1 to Professional services Agreement with Larry Paul and Associates for Project Management April 24, 2007 Page 2 agencies) will be required. Larry Paul will act as an adjunct manager to Public Works and Harbor Resources carrying out the tasks of the HAMP and IRWMP. Under the original contract with Larry Paullexecuted August 1, 2006, Mr. Paul prepared a consultant scope of work for the HAMP and coordinated and facilitated meetings with key watershed stakeholders (County of Orange, Regional Water Quality Control Board, Irvine Ranch Water District, other cities and non - governmental organizations) to determine objectives and priorities for a watershed management plan for Newport Bay. Mr. Paul also coordinated with resource and regulatory agencies for determining grant funding priorities for potential projects in the Newport Bay Watershed. The fee for this work was $26,400. The proposed amendment to Larry Paul and Associates' contract includes the following tasks: 1. Provide project management for the HAMP including the facilitation, coordination and oversight for the development of the HAMP elements. The HAMP elements include: issues associated with contaminated sediments, Eelgrass capacity, hydrodynamic modeling for sediment and water quality issues, determination of dredging requirements for Upper and Lower Bay, assessing future sediment control measures, providing assistance for Fish and Game Upper Bay Management Plan, and providing information for modifying the Regional General Permit. 2. Coordinate the Proposition 50 efforts with the City's Area of Special Biological Significance (ASBS) and Newport Coast watershed efforts. 3. Facilitate and coordinate the integrated planning efforts of the Proposition 50 upland work with that of the Irvine Ranch Water District and County inputs. 4. Assist in the development of a preliminary prioritization list for project implementation grants that will be available through Proposition 84. 5. Facilitate and attend meetings with stakeholders and consultants. 6. Provide monthly update reports. Public Notice: Not applicable. On August 1, 2006, City and Consultant entered into a Professional Services Agreement for watershed planning services, hereinafter referred to as "Agreement." Under the Agreement, Consultant was to be paid a fee of $24,640 for the Newport Bay Watershed Management Project, hereinafter referred to as `Project." B. Pursuant to this Agreement, Consultant helped prepare a consultant scope of work for the Harbor Area Management Plan, coordinated and facilitated meetings with key watershed stakeholders (County, RWQCB, IRWD, Cities and NGOs) to determine objectives and priorities for a watershed management plan for Newport Bay, and coordinated with resource and regulatory agencies for determining grant funding priorities for potential projects in the Newport Bay Watershed. This Agreement is scheduled to expire on December 31, 2007. C. City desires to enter into this Amendment No. 1 to reflect additional services not included in the Agreement or prior Amendments and to extend the term of the Agreement to December 31, 2008. D. City desires to compensate Consultant for additional professional services needed for Project. E. City and Consultant mutually desire to amend Agreement, hereinafter referred to as "Amendment No. 1," as provided here below. NOW, THEREFORE, the parties hereto agree as follows: 1. Consultant shall perform the services outlined in the letter dated April 12, 2007 attached hereto as "Exhibit A" and incorporated in full by this reference. The services shall be performed on a time and materials basis. 2. Total additional compensation to Consultant for the services performed pursuant to this Amendment No. 1, including all reimburseable items and subconsultant fees, shall not exceed Thirty- Thousand Dollars and no/100 ($30,000.00). 3. The term of the Agreement shall be extended to December 31, 2008. 4. Except as expressly modified herein, all other provisions, terms, and covenants set forth in Agreement shall remain unchanged and shall be in full force and effect.
