to be corrected. The A/S device and a plug that needed to be
upgraded to GFI.
The owner was on site and understood what needed to be done. He

Reference is made to your request of August 20, 1990 (Permit no. 90 -364 -
GS). Under the provisions of Section 10 of the Rivers and Harbors Act of
March 3, 1899 (33 U.S.C. 403), you are hereby authorized to remove the
existing dock, ramp, pier, and piling, and install a new dock, ramp, and
piling in Newport Bay at No. 6 Harbor, Newport Beach, Orange County,
California, as shown on the enclosed drawings and subject to the enclosed
conditions.
The owner or authorized responsible official must sign and date all copies
of this Letter of Permission (LOP) indicating that he/she agrees to the work
a's described and to comply with all conditions. One of the signed copies of
this Letter of Permission must be returned to the Corps of Engineers (a pre -
addressed envelope is enclosed for your convenience). Notice of the
commencement of the activity must reach this office at least 10 days before
the activity actually starts. Please use the enclosed card.

existence at the time the property is transferred, the terms and conditions of

Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained 'or any discrepancy
is resolved in writing.
WAIVER # 5-90-943, APPLICANT: Tom Tedesco
LOCATION: #6 Harbor Island Dr., NEWPORT BEACH
PROPOSED DEVELOPMENT: Remove existi ng dock, pile, ramp and pier and construct
new dock, pile, ramp and pier. The new dock will be 28' wide and extend 61'
beyond the bulkhead line and will be within the pierhead line. The
configuration of the proposed dock is U shaped.
RATIONALE: The proposed development will havve no adverse impacts on coastal
access or resources, is consistent with the Chapter 3 policies of the Coastal
Act, the City's Land Use Plan and past Commission actions.
This waiver will not become effective until reported to the Commission at their
December 11-14, 1990 , meeting and the site of the proposed
development has been'appropriately noticed, pursuant to 13054(b) of the-
Administrative.Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less.than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Dear Mr. Miller:
This is in response to your September 19, 1989 letter regarding the
above -referenced project.
You are proposing to dredge approximately 500 cubic yards of
material at the Steele/Todisco residence, No. 5 & 6 Harbor Island,
Newport Beach, Orange County. The dredged material will be pumped
to a dump barge and hauled to sea for disposal at the EPA disposal
site, LA -3. A filter screen will be installed around the discharge
area to minimize turbidity,
Based on the information you have provided, it appears that this
discharge will not significantly affect the quality of waters of
the region. Pursuant to the California Water Code Section 13269,
the Regional Board adopted Resolution No. 84-48 on Nay 11, 1984,
waiving waste discharge requirements for various types of
discharges. The above referenced project complies with the waiver
criteria. Therefore, the need to file a Report of Waste Discharge
is hereby waived.
This letter constitutes our clearance for this project. This
waiver is conditioned upon the following.
1. The discharge shall not exceed 500 cubic yards of dredge
spoils.
2. The discharge shall be non-toxic -and shall not cause a
nuisance or pollution as defined in the California Water
Code.
Should the above conditions not be met, this waiver may be revoked,
and you must notify this office immediately to determine a further
course of action. In addition, this waiver does not relieve you
of the responsibility to comply with the laws and guidelines of
other regulatory agencies involved with this project.

Recommendgtion:
If desired, approve the application subject to the following
conditions:
1. Approval of the U. S. Army Corps of Engineers
2. Approval of the California Coastal Commission
3. Approval of the Plans and Specifications by the City
Building Department
4. Approval of the County of Orange
5. That the proposed groin wall be located on the
applicant's side of the common property line/permit
line between #6 and #7 Harbor Island, and
6. That the applicant obtain written approval of the
proposed groin wall from adjacent property owners.
Discussion;_
This application is before the City Council as required by Section
5.B. of the Harbor Permit Policies which states:
5.B. "Prior approval of the City Council will be required
before the Marine Department may issue any permit that does
not conform to the Standard Drawings and the adopted Harbor
Permit Policies".
The applicant proposes to rebuild an existing wooden seawall
bayward of his property at i6 Harbor Island. In addition to
rebuilding the 45 feet of existing wooden bulkhead, the applicant
proposes the installation of a groin wall perpendicular to the
F-11 (b)
bulkhead wall, 25 feet bayward of the U. S. Bulkhead line. The
Harbor Permit Policies do. not address the installation of groin
walls bayward of residentally zoned properties. However, the
Marine Department has recommended approval of groin wall
installations in those areas where the wall is set within the
individual permittee's permit zone and in situations where the
permittee has obtained the approval of adjacent property owners.
The design and engineering of the groin walls is addressed in the
City Standard Drawings and requires review by the appropriate City
Departments of the design and engineering of the individual groin
walls.

In response to your request for verification on the subject proposed permit
application, Coastal Facilities Operations and Dredging operations staff performed
a joint inspection of the site on August 20, 1987 and provide the following
comments:
1. Replacement of the old wooden bulkhead with a concrete bulkhead is acceptable
and should be allowed under permit.
2. Installation of the groins 251 out from the bulkhead lines along the west
property line of lot 5 and the east property line of lot 6 may impact the
present sand transport conditions. Permiting of these structures may result in
a liability to the County and should not be allowed unless the following
conditions are met:
a. The applicant should obtain the written approval of proposed groins from
adjacent property owners.
b. The applicant should obtain a letter from the adjacent property owners
indemnifying the County and the Harbors, Beaches and Parks District against
any losses whidn may occur due to alterations of sand transport or changes
in currents due to the construction of the subject groins.
Staff has discussed the above proposed conditions with the City of Newport Beach
Tidelands Administrator and has determined that the proposed conditions are
consistent with standard policy and practices of the city. If you have any

Subject: Replacement Bulkhead - Tom Tedesco
Staff of the State Lands Commission has received your letter dated
June 25, 1987, and attached drawing, relative to the proposed replacement
bulkhead for Tom Tedesco, located at North 6 Harbor Island, Newport Beach.
The existing bulkhead, at this location, extends over sovereign tidelands
of the State of California which the Legislature granted in trust to the County
of Orange pursuant to Chapter 526, Statutes of 1919, and as amended. In
addition, the tidelands are subject to an Interim Tidelands Lease Agreement
between the County of Orange, as Lessor, and the Harbor Island Community
Association, as Lessee, The lease, as approved by the State Lands Commission,
provides that no additions or alterations, other than non -permanent and
recreational landscaping uses, may be made of the lease premises without the
prior written consent of the County. The County has stipulated that alterations
or additions be substantially in kind with the existing improvements.
Staff of the Commission, in its oversight capacity over the granted lands,
and the lease, may have no objedtion to the proposed project. It cannot make
this determination, however, without the prior review of detailed engineering
plans �for the project which demonstrate that the replacement bulkhead will be in
substantially the same location as the existing bulkhead. We will be happy to
review these plans when they are available.

The City of Newport Beach has received an application to
transfer pier permit # 139-6 for the property located
at #6 Harbor Island, Newport Beach, CA.
The structure was inspected on 3-23-79 at which time it
was determined that the following deficiency exists.
A continuous pressure anti -siphon device must be attached
to the municipal'water service, bayward of the bulkhead,
in compliance'to title 17 of the California Administrative
Code..
In accordance with Section 10-D of the City Harbor Permit
Policies,, "All structural deficiencies must be corrected...
A permit for this work must be obtained from the Community
Development Department.
Would you please advise this department when this require-
ment has been met. If you have any questions, please con-
