Your dock has become a refuge for a large seagull population and their droppings are abundant. The condition of your dock may jeopardize the health and safety of those who use the waters of Newport Harbor, emergency personnel who may have to access your dock and your neighbor's enjoyment of the surrounding area. Per the City of Newport Beach Municipal Code, 17.24.090, pier permits may be revoked by the Harbor Commission if the structure has fallen into a state of disrepair. In addition, Chapter 17.24.100 allows for piers to be abated if they are declared a nuisance. The intent of this letter is to alert you of the problem and to suggest methods to rid your dock of the seagulls. Because the City is concerned about water quality and the effects of the droppings on your dock if washed into the Harbor, we recommend that you take precautionary measures when cleaning your dock. Listed below are three companies that may be able to assist you in cleaning / vacuuming your dock. (The City is not recommending any particular company.) This may be a good deterrent to keep the seagulls off your dock after it has been cleaned. Please proceed with cleaning your dock within 15 days of receiving this letter. S. Army Corps of Engineers and the South Coast Regional Zone Conservation Commission and, (2) the following; conditions recommended by the Joint Harbor Committee: (a) Approval of the County of Orange Harbors, Beaches, and -Parks Commission (approved 8-14-73). (b) That the applicant sign a non-commercial use agreement for county tidelands 'executed 'by the Director of the CountyHarbors, Beaches and 'Parks District: Discussion The subject application is to replace a pier, ramp and float, and a non -conforming detached finger float with a 90'' x 35' "U" shaped slip. The proposed slip installation will require the removal of approximately-450 cubic yards of dredged material. A separate permit from the City for dredging is not required 'since .the dredging is necessary to accomodate the proposed slip. However, a "Waste Discharge Certificate" must be issued by the Santa Ana Regional Water Quality Control Board prior to the U. S.
