Your dock has become a refuge for a large seagull population and their droppings are abundant. The condition of your dock may jeopardize the health and safety of those who use the waters of Newport Harbor, emergency personnel who may have to access your dock and your neighbor's enjoyment of the surrounding area. Per the City of Newport Beach Municipal Code, 17.24.090, pier permits may be revoked by the Harbor Commission if the structure has fallen into a state of disrepair. In addition, Chapter 17.24.100 allows for piers to be abated if they are declared a nuisance. The intent of this letter is to alert you of the problem and to suggest methods to rid your dock of the seagulls. Because the City is concerned about water quality and the effects of the droppings on your dock if washed into the Harbor, we recommend that you take precautionary measures when cleaning your dock. Listed below are three companies that may be able to assist you in cleaning / vacuuming your dock. (The City is not recommending any particular company.) This may be a good deterrent to keep the seagulls off your dock after it has been cleaned. Please proceed with cleaning your dock within 15 days of receiving this letter. The purpose of this work is to provide a larger dock. The approval from the City of Newport Beach has been obtained. The applicant has obtained a Permit No. P-8-29-73-1819, from the California State Coastal Zone Conservation Commission - South Coast Region. The California Regional Water Quality Control Board - Santa Ana Region,, has indicated that the proposed activity is satisfactory based on the disposition of the dredged materials in the ocean beyond the 3-mile limit. However, a "Waste Discharge Certificate" must be issued by the Santa Ana Regional Water Quality Control Board prior to the U. S.
