Pier Permit Conditions
October 21, 2004
Property Address: 26 Harbor Island Dr, Newport Beach, CA 92660
With reference to the plans currently under consideration to reconfigure or modify the dock
system, the following conditions will now be in effect on the above referenced pier.
1. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of
Newport Beach Municipal Code. The pier permittee understands that the above referenced
pier is under the purview of these Policies and Codes.
2. Any future work on the above mentioned pier requires permits with the City of Newport
Beach and any other applicable agencies. Painting, replacement of rub rails and work
considered to be cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the current, proposed dock system
under consideration. Any future modifications or alterations to the dock system may require
new conditions which may override or change these conditions.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. The westernmost property line extends exactly parallel to the easternmost property line.
6. A vessel may not extend beyond the end of the float by more than the width of its beam.
7. The maximum beam of a vessel that is permitted to side tie to the westernmost side of the
float is 10'.
8. The maximum beam of a vessel that is permitted to side tie to the easternmost side of the
float is 10'.

A copy of any variance, exception, conditional use permit or other issued permit is
attached together with all conditions of approval and all approved plans including
approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the Zoning
Ordinance or other regulations in any manner that would affect the use of the property or
the design of a project located thereon, this approval in concept shall become null and
void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted thereunder, this development:
'as been determined to be ministerial or categorically exempt.
o Has received a final Exemption Declaration or final Negative Declaration (copy
attached).
o Has received a Final Environmental Impact Report (copy attached).
All discretionary approvals legally required of Newport Beach prior to issuance of a
building permit have been given and are final. The development is not subject to
rejection in principal by Newport Beach unless a substantial change is proposed.
This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached
conditions to the pier permit.

If standard dock construction methods and materials are utilized, this project should not adversely
impact water quality. A statement has been submitted that there will be no waste discharged from
the proposed project. Based on these assurances, clearance is provided.
However, should the Army Corps of Engineers determine that this project requires a Section 404
pen -nit, it will be necessary for the project proponent to obtain from this Board a Water Quality
Certification under Section 401 of the Clean Water Act.

existing private boat dock i -n Newpor� Bay at 26 Harbor Island, Newport Beach,
Orange County, California, as shown on the enclosed drawings and subject to
the enclosed conditions.
The owner or authorized responsible official must sign and date all copies
of this Letter of Permission (LOP) indicating that he/she agrees to the work
as described and to comply with all conditions. One of the signed copies of
this Letter of Permission must be returned to the Corps of Engineers (a pre -
addressed envelope is enclosed for your convenience). Notice of the
commencement of the activity must reach this office at least 10 days before
the activity actually starts. Please use the enclosed card.

waterward of the adjudicated mean high tide line as set forth in
Superior Court Case No. 23690 onto lands granted to the County of
Orange pursuant to Chapter 526, Statutes of 1919 and as
subsequently amended. Therefore, you need not apply to the State
Lands Commission for project authorization. You should, however,
apply to all other agencies having approval authority.
This action does not constitute, nor shall it be construed as,,
a waiver of any right, title, or interest by the State of
California in any lands under its jurisdiction.

Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development Permit is obtained or any discrepancy
is resolved in writing.

LOCATION: 26 Harbor island, Newport Beach, Orange Co.
PROPOSED DEVELOPMENT: Remove and replace existing dock with a smaller dock.
The resultant dock will be U-shaped, 56 feet in length, and 36 feet wide. The
Proposed dock will extend 50 feet seaward of the bulkhead line and will be
within the pierhead line.
RATIONALE: The proposed project will have no adverse impacts on coastal
access or resources, is consistent with the City's certified LCP, the chapter
3 Policies of the Coastal Act and past Commission actions in the area.
This waiver will not become effective until reported to the Commission at their
— Febuary 18-21 1992 _-, meeting and the site of the proposed
development fia-s—been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

drawing. This amends permit 71-125.
PURPOSE AND USE: For%private use.
FEDERAL, STATE AND LOCAL AUTHORIZATIONS.: Approval has been received from
the City of Newport Beach Noi.143-26. Approvals will also be required
from the California Regional Water Quality.Control Board and California
Coastal Zone Conservation C6mmission.
ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environ-
mental Impact Stat . ement on this activity unless significant detrimental
effects are brought to our attention.
CRITERIA: Your written.comments or objections should include the number
and date of this notice and must reach -this.office within thirty (30)
calendar days. The decision whether to issue a permit will be based on
an evaluation of the probable impact of the activity on the public interest.
'That decision will reflect the national concern for both protection and
utiliZation of important resources. The benefit which reasonably may be
expected to accrue from the activity must be balanced against its reason-
ably foreseeable detriments. All factors which may be relevant to the
activity will be considered; among those are conservation, economics,
aesthetics, general environmental concerns, historic values, fish and
wildlife values, flood damage prevention, land use classification, naviga-
tion, recreation, water supply, water quality, . and, in general, the needs
and welfare of the people. Details of changed conditions on the final
permit action will be provided upon request.

TO RELOCATE AN EXISTING GROIN
Recommendation
If desired approve the permit subject to 1) the approval of the
U. S. Army Corps of Engineers, and 2) that no fence or other
appurtenance be.installed on either groin bayward of Lot 26.
Discussion
This application is being brought to the City Council for approval
because the original permit issued by the City on April 20, 1971,
expired due to the work not being completed within the required two
year time limit. Since the project is over County Tidelands, the
application was sent to the Joint Harbor Committee for review and
recommendation. At their March 24, 1976 meeting, the Joint Harbor
Committee recommended the City Council approve the permit.
The Joint Harbor Committee originally recommended approval of the
project on April 2, 1971. A permit was granted by the Orange County
Harbor District on April 31,1971 and is still in effect.
At the time of the original application, both the City's Public
Works Department and the Harbor District reviewed the project and
determined that no significant effect would be experienced by the
adjacent properties. Staff feels this finding is still valid.
Mr. Benvenvetti, the owner of Lot 27, has been contacted and has no
objection to the project.

Dear Mr. Pf leger:
The Orange County Harbor Commission, at its regular meeting on April 13,
1971, reviewed your application for removal of an existing groin and the
construction of a new groin along the bayward prolongation of the common
property line for Lots 26 and 27, Harbor Island. The adjacent property
owner, in a telephone conversation with a City staff representative, Don
Sanford, concurred with the proposed improvement. A portion of the pro-
posed groin is located on County property inland of the U.S. bulkhead
line. Your application was approved, subject to the execution of a long
term lease for use of the public property located between the U.S. bulk-
head line and the private property line.
An exec.uted copy of your permit is attached. Please note that three spec-
ial conditions were added to your permit with the concurrence of your
representative, Mr. Lee Bateman. A copy of the permit is being forwarded
to the City of Newport Beach and the receipt for payment of the application
fee is being forwarded to your contractor, Croft and Neville.
As you know, a City pier permit and a Corps of Engineers permit are also
required prior to the start of construction.

CONDITIONS
The Applicant Warrants and Agrees That:
1. The attached exhibit furnished by the applicant shows accurately the location, extent, and character of the
work for which this permit is gr'anted.
2. The County tidelands utilized under this permit are for the recreational use of the fee owners or long-term
lease holders of the adjacent uplands, and if the facilities are rented, leased, or used in any manner for the
applicant's financial gain, the permit will be automatically forfeited.
3. This permit is not subject to transfer, assignment, alienation, pledging or hypothecation; any change in owner-
ship requires a new permit.
4. The County of Orange retains authority to cancel the permit without cause upon 30 days written notice to the
Permittee's current mailing address kept on file with the Orange County Harbor District, 1901 Bayside Drive,
Newport Beach, California 92662.
5. In the event the Permittee is requested to remove any facilities, the removal will be made and the site re-
stored to its prior unimproved condition at no expense to the County or the Harbor District. If the facilities
are not removed as requested, the Permittee acknowledges the financial responsibility and agrees to reimburse
the County or the Harbor District for any expense incurred in the removal of the facilities.
6. All facilities covered by this permit shall be maintained in good repair and failure to comply will be cause
for cancellation of the permit.
7. The permit shall be automatically forfeited in the event the facilities are unused by the applicant for a
period of one year.
8. In the event the County adopts a policy for the renting of tidelands to the adjacent property owners, the area
covered by this permit will be subject to the fee so established.
9. The County of Orange and the Orange County Harbor District shall be held harmless from any and all iiabilities
arising out of use of these tidelands.
10. This permit authorizes use of County tidelands only and does not eliminate the need for other permits for con-
struction and use of facilities, as may be required by other governmental agencies.
I I . The improvement is I imited to a single pier and float or sl ip bayward of each parcei
or lot and the use of the improvement is reserved for the occupants of the abutting
upland property.
SPECIAL CONDITIONS
1. it is understood that this permit authorizes improvements only on that portion o's
the public tidelands bounded by the U. S. Bulkhead line, U. S. Pierhead lines, and
the bayward extension of the property lines.
2. Approval of the proposed improvement is subject to applicant's receip-11-- of
land rights from the County of Orange for the use of that portion of public -Lide-
lands inland of the U. S. Bulkhead lines. —7
3. No construction is to commence until the land rights referred to in (2) above have
been granted by the County.
The undersigned further agrees to the
