Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 27 Harbor Island. The facility was inspected on January
11, 2002. We cannot transfer the pier permit until the following deficiency has been
corrected and we have been notified of the correction:
A new Backflow Prevention Device must be installed at the facility. The purpose of this
device is to protect the domestic water system from being contaminated by seawater.
A drawing of an approved device and a drawing showing a typical installation is
attached.
The electrical receptacle on the pier/dock must be Gff or Twist Lock for use in a water
environment.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

In accordance with your request, this office has reviewed the schematic
plan for the proposed improvements at subject property.
All land bayward of the mean high tide line is public property (tidelands)
owned by the County of Orange. This land was granted to the County of
Ora -age by the: State of California under Chapter 526 of the Statutes 1919,
as amended by Chapter 575, Statutes 1929. The County was given the tidelands
in trust for the establishment, improvement and conduct of a harbor and
such other uses which are necessary or convenient or incidental to the
promotion or accommodation of that harbor and commerce or navigation.
A.review of your plan discloses that the followinglimprovements exist on
public property:
1. Sidewalk, wood and concrete
2. Concrete block wall
3. Bulkheads - v
4. Landscaping
Because of the encroachments to County tidelands that exist on Harbor
Island, a study was initiated to determine the extent and nature of these
encroachments. This study should be available in late July or early August -
With respect to any private encroachments upon the tidelands which are
permissible under the terms of the grant, the County may authorize such
private usage but must receive adequate compensation (fair rental value)—dI11119
therefor. Pending the outcome of the aforementioned study, the County has
not yet decided on its cours6 of action in this regard; i.e., whether to
require removal of all encroachments.or to charge fair market rental for
those encroachments allowed to remain on County tideland property.

HARBORS, BEACHES AND PARKS DISTRICT
We suggest that all new improvements to the property at No. 27 Harbor Island
be iimited to the mean high tide line. It should be taken into consideration
by the architect that the bulkhead might have to be constructed at the mean
high tide line and thus the rest of the property, if fully developed, would
have no landscaping facing bayward.

tidelands is hereby granted to the owner or long term leaseholder of the adjacent uplands, for the
purpose of encouraging recreational boating in Newport Harbor. The permit is subject to all con-
ditions and limitations referred to in the application.
